Ald Downer moved that the resolution providing that no bills be paid unless signed by the party
ordering the same and audite by the proper committee be suspended today and the recorder

the bill of platz and co 10.50 lime for disenfecting sewers was on motion referred to the board
of health
Ald Crawford moved the rules be suspended and Mr Wm G Stewart be heard in regard to his
protest against the levying of a special assessment against his property for the improvement of
the east side of Water Street abutting the same carried
Mr Stewart explained the council ordering the improvement of the east side of Water Street in 1881
and of the levying of a special tax against the abutting property for the improvement of teh same
that he paid his special assessment under protest as only a part of the street was improved
and the other side unimprosed and used and occupied by

private parties who placed thereon wood yards and wooden sheds completely blockading a
part of Water street and placing the property of the east side in a dangerous position in case of
fire also that in case of any of his property being damaged by fire from frame structures erected
on the street he would hold the city for damages
Ald Crawford moved the matter of the obstruction of water and canal streets be referred to the
committee on streets carried
Petiton of C W Robinson praying that the action of the council at a former session ordering
the water mains laid down south locust street instead of main street and across railroad avenue
be reconsidered
Ald Doerfler moved the rules be suspended and the petitioner Mr Robinson be granted permission
to address the council carried
Mr Robinson stated the committee visited and examined the ground in which the water mains
were asked to be placed and explained if the water mains were laid down mainstreet to and over
over railroad avenue the same protection would be afforded to property owners on south locust
street as if the pipes were laid down said street abutting their property and allow him to tap the
mains on railroad avenue and lay a main through his lumber yards at an expense to him of from
1500 to 2000 and give him the same fire protection as is furnished to other lumber manufactureres
Ald Crawford moved the petition be referred to the committee of the whole
Ald Hollnagel amended Ald Crawfords motion by moving that the report of the fire committee
resented at a previous session on the petition of CWRobinson et al that the water mains be
extended from Jones Street down south main street and over railroad avenue be adopted lost
by the following vote

Communications of the city engineer accompanied by a plat of lot 771 McDaniels subdivision
a part of which mr Hancock agrees to donate to the city for the extension of Grove Street as that
the city attorney be instructed to procure a deed for said part of lot
Ald Crawford moved the city attorney be instructed to draw up a deed transferring said part of
lot 771 McDaniels subdivision to teh city and have

city to help pay the expense of grading and building retaining wall on Grove Street carried
Dubuque Water Co protesting against the extension of their water mains on the bluffs as petitioned
for by J K Graves et al and asking permission to be heard by the council before any ordinance
is adopted granting the prayer of JK Graves et al referred to committee of the whole
Anton Heisler praying that a sidewalk be ordered laid on west side of valeria street of width as
the council might think proper

Wm P lange et al asking that the Dubuque Water Co be compelled to lay water mains up on the
hills claiming that the ordinance under which the Dubuque Water Co are granted the right to lay
and maintain their pipes specifies that water shall be furnished where ordered when 7 percent interest

OF Hodge et al praying that a street 50 feet wide be opened from Grand View Avenue east street
between lots 1 to 14 inclusive of Ohares subdivision of part of mineral lot 161 all petitioners agreeing

LA Rhomberg et al protesting against the vacation of a part of Kniest Street on one side

The city engineer presented a statement of sidewalks ordered laid by him through contract on
Kniest and Seminary Streets also on eagle point avenue that teh same are laid according to the
plans and specifications and satisfactory to him ordered received and filed
Ald Doerfler moved the reporters be permitted to take petitions and return the same to the recorder
before leaving the council room carried
Jms Gutenkauf by W J Joerns his attorney asking that the city refund to him 72.75 damages caused
to him by council granting him permission to remove a frame building in the fire limits and afterward
recinding their action referred to the committee on claims
H H smith asking that his assessment on merchandise for the year 1884 and 1885 be placed at
1000 and that he be allowed to pay taxes on same without interest referred to the delinquent
tax committee
Communication from the city engineer explaining that the filling of the low grounds east of the railroad
tracks by Mr H L Stout was obstructing the drainage of Ninth street and in case of floods property
owners along said street west of Pine Street would be damaged also that seventh street sewer be
connected with Eight Street sewer and taht proper steps be taken to secure proper drainage
in the vicinity of fifteenth and elm Street referred to committee on streets
The city engineer also presented a communication stating that the following named parties had
laid plank sidewalks contrary to ordinance abutting their property viz Gabriel Weiss N 50 ft lot
444 city and R Waller E 90 ft lot 120 city and asked if he would cause said sidewalks to be
taken up and relaid accoding to the ordinance governing the laying of the same referred to the
ordinance committee
The city engineer presented a map showing the boundaries of the water district Ald Parker offered
the following resolution referring to said map be it resolved by the city council of teh city of Dubuque
that the area enclosed by the red line on the accompanying map be and is hereby declared
the water district for the city of Dubuque for the year 1886 On motion of ald Crawford the
resolution was adopted
Report of officers
Chas mcMaster Street commissioner reported having expended on improving streets the sum
of 2259.10 during the month of July report ordered filed and warrants ordered drawn to pay
same
Edward Moon city marshal reported 1085 due the police force for salaries during the past month
that 57 arrests had been made and that he paid into the city treasury the sum of 50 cents fees
collected and 25.40 collected for impounding animals report ordered filed and warrants ordered
drawn to pay salaries

for month of July 1886
Treasurer Traut reported having paid for interest refunded tax and postage during the past month

Marketmaster Rice reported having weighed on the central market scales during the past 117
drafts receiving therefore the sum of 17.55 which with 27.50 received for rent of huckster stands
he paid into the city treasury also that he furnished meals to prisoners amounting to 7.80 during
the past month report ordered received and a warrant drawn to pay for board of prisoners
Recorder Agnew reported having issued licenses amounting to 1989.85 during the past month

Chief Engineer Reinfried presented a list of members of the fire department appointed to fill
vacancies from time to time by the chief engineer and fire committee and not approved by city

Ald Crawford moved the ordinance committee be instructed to draft an ordinance providing
for the reorganization of the fire department under the present system Carried by the following
unamimous vote

The names of several ex firemen appearing on the auditors payroll Ald Hayden moved that teh

Ald Crawford moved an ordinance authorizing and to provide for aiding the construction of a
wagon and foot bridge over the mississippi river

between the city of Dubuque in the state of Iowa and the town of East Dubuque in the state of
Illinois be taken up and read a second time carried
the recorder read the ordinance a second time
Ald Crawford moved that the ordinance be amended by inserting after the words secretary of war
in the sixth line of the second section the following additional clause
the draw may be dispensed with provided the superstructure of said bridge across the span below
and in line with the span of the present railway bridge of the Dubuque and Dunleith bridge company
next west of the central draw pier of said railway bridge shall be constructed of height sufficient
to permit the free passage under teh same at all stages of water of steamboats and other water
crafts navigating the mississiippi river adopted by the following vote

Ald Ryder chairman of the finance committee reported on the petition of Ellen Conlon for cancellation
of special tax for the improvement of West Eight Street recommending the petition be received

Ald Downer offered as an amendment to the report of the committee that the petition of Ellen
Conlan be referred back to the finance committee to report on the same together with the petition
of Dennis Gilliam carried
Ald Hollnagel moved the two alderman of the 4th ward be added to the finance committee to
report on said petitions carried
Ald Hayden chairman of the ordinance committee presented and read for the first time an ordinance
granting to the Illinois Central Railroad Company the right to maintain and use the railroad tracks
and all connections made thereto now used by said company on Washington and Jackson
streets in this city

that the city was about to be enjoined from completing the improvement of Grove Street
The Chief engineer presented a corrected payroll of the fire department for the month of July
which on motion of Ald Doerfler was ordered received and filed and warrants drawn to pay
salaries 1070.00
Petitions
J D Johnson et al praying that Scott Street be vacated where it divides lots 1 to 16 inclusive of mineral
lot 306 as they wish to use said lots and streets abutting for park purposes referred to street
committee and fifth ward aldermen
Matthew Meagher asking that he be allowed 2.50 per day while working as a mason for the city
referred to the committee on streets
Fengler and Schwagler et al praying that High Street from the Eagle Point Ferry Landing to its
intersection with Lake Street be improved and put in passable condition referred to the street
committee
The following acceptance by the dubuque Pontoon Bridge company of the ordinance donating
25,000 to aid the construction of a wagon and foot bridge across teh river was read and ordered
received and filed to the honorable mayor and city council of the city of Dubuque Gentlemen
pursuant to teh terms of section 14 of an ordinance adopted by your honorable body August
2d 1886 entitled An ordinance authorizing and to provide for aiding the constructuion of a
wagon and foot bridge over the Mississippi river between the city of Dubuque in the State of
Iowa and the town of East dubuque in the state of Illinois I Bernard J ONeill president of the
Dubuque Pontoon Bridge Company and fully authorized and empowered by said company to
accept the terms and conditions of said ordinance and do hereby notify your honorable body
of such acceptance thereof

The Knapp Stout and Co Company et al asking that a six inch water main be extended east on 8
9 10 and 11th streets to the east side of the CM and St P R R Tracks referred to the committee
on fire
Communication of Dr Greene health physician calling attention of the council to the filthy state of
our sewers also of the contamination of the soil by our innumerable cesspools and privy vaults
showing the same to be the source of contagious diseases together with the recommendation
that our sewerage system be completed for the benefit of the health of our city referred to the
executive committee of the board of health
Ald Crawford moved the injunction restraining the city from completing the improvement of Grove
Street be read carried
The city attorney being called upon stated that no notice had yet been served but he had seen the
papers this morning asking that the city and the contractors be enjoined from improving Grove
Street also that Mr Andrews be awarded 15.00 damages claiming the city commenced the work
without adopting the proper measures Judge Utt continued the case until tomorrow morning and
it was impossible for him to speak further as he had no final as to what would be done
Ald Downer moved the rules be suspended and mr H B Fouke be heard in behalf of Geo H Andrew
carried
Mr Fouke stated an is being made to fill up a portion of 11th street which at present was not in
use to complete a part of grove street abutting the property of Geo Andrew No one has any
objection to the improvement of Grove Street if properly done the city proposes to cause Grove
Street to run within six feet of Geo Andrews property if Grove Street is improved as proposed
it will cause a change of grade on Eleventh Street and Judge Utt has been asked to levy an
injunction restraining the city from completing the work according to the plat of teh city engineer
Mr Andrew presents a plat of the proposed improvement also of the improvement proposed by
him which will not damage his property shown by the red line on plat said red line throws the
embankment twenty feet away from Andrews lot Mr andrews has no objection if a wallis built
as shown by red line on the plat but will object if done as shown by black line and thinks he has
a right to object if the work is done as is being at present without compensation to him as owner
Mr andrew being present stated he had no objection as to the improvement of Grove Street
as an accommodation to the public without interfering with his rights
Ald Doerfler offered the following resolution
Resolved by the city council of the city of Dubuque that whereas differences have arisen as to
the proper place for the

location of the retaining wall running west from the main wall running south on Grove Street and
whereas it does not appear from the records of the council that a location for said wall has yet
been agreed upon therefore be it resolved that if a wall is constructed running west from said
main wall on Eleventh street that the location of said wall be placed upon that part of the street
indicated by the red lines on the original plat of said improvement as submitted and on file by
the city engineer
Ald ryder moved that before action is taken upon Ald Doerflers resolution the rules be suspended
and Messers andrew and Hancock be heard carried
Mr Charles Hancock stated that it was not a personal matter between mr andrew and himself that
he has nothing to do with the building of the wall He made a proposition to the city if they would
adhere to the black line as shown on the profile he would raise a sum of money to donate toward
the improvement of Grove Street Mr Andrew had not conversed with him regarding the building of the
wall as shown by the black line Mr andrew is adverse to the plan of improvement as at first proposed
He stated this to the mayor who was acting in lieu the chairman of the committee on streets who
was absent from the city also that he would waive the right on the black line and adopt a line between
Andrews property and the sewer giving mr andrews 31 feet of property at his gate and the wall
could be built without any damage to Mr Andrew He would also adhere to his proposition made to
the city when the resolution was adopted ordering the improvement if the wall was built inside of
Mr Andrews lot and the sewer He has nothing to do with teh building of teh wall but can regulate
his proposition the city may construct the wall as it sees fit but it will release him from his proposition
four feet making a large difference in the width of a street as narrow as the one in question
Mr andrew stated that mr Hancock never consulted with him that he was as much in favor of the
improvement of Grove Street as Mr Hancock The wall if built according to red line on plat would leave
30 feet on Grove Street and parties able to turn a vehicle on bluff street would be able to do
the same on Grove Street as Mr Hancock proposes the wall to be built it would wall him up and
as he has already consented to the change of grade it would not be just to have him walled up
in order that Grove Street might be widened If the wall was built according to the red line on the
profile it would give a street abutting mr Hancock's lot 38 feet wide an dif 38 feet was not wide
enough to turn a vehicle in by driving 40 feet further they could turn into a street 60 feet wide
Ald ryder offered as an amendment to Ald Doerflers motion that the matter of the improvement
of Grove Street be referred back to the committee on streets carried by the following vote

The same committee offered the following report which on motion was adopted To the honorable
mayor and city council of Dubuque your committee on streets report having examined and accepted
the guttering and macadamizing on Nevada Street from Julien Avenue to West Fifth Street by
P Tiby Contractor
The same committee reported on the petition of O F Hodge et al praying for the opening of a
street 50 feet wide from Grand View Avenue to East Street on the line between lots 1 to 14
of Ohares subdivision of part of mineral lot 161 now owned by Wm Reche respectfully reports in
favor of opening said street is the parties interested will grant the right of way for the same We
recommend that the city engineer be instructed to make a survey and of said proposed street
in accordance with the ordinance on that subject report adopted

Ald Hollnagel of the special committee to whom was referred the petition of J Pickley et al offered
the following report which on motion was adopted To the city council your committee to whom with
the city attorney was referred the within petition of J Pickley Albert Hanson and others in relation
to obstruction of highway would report as follows it appears to your committee that the city has no
jurisdiction and the city council has no right to take any action in regard to the subject of said

his contract be extended for five years for lighting and caring for the same on the same terms as
is received at present In favor of receiving and filing the resolution report adopted
The same committee reported on the petition of Barbara Tinkham et al recommending that the matter
be referred to a committee composed of the fifth ward aldermen to wait on the officials of the
Union slaughter House and insist that something be done to abate the nuisance report adopted
The same committee reported on the resolution recommending the purchase of a patrol wagon
etc that action on the resolutionbe indefinately postponed report adopted
For same committee reported on the resolution recommending that 900.00 expended in improving

and Bluff streets be referred to the street committee with power carried
Ald Parker offered the following resolution Resolved by the city council of the city of Dubuque
that a sidewalk 8 feet wide of good two inch plank be within 15 days of this notice constructed
and laid crosswise in conformity with the ordinance inrelation to sidewalks on both side of
Nevada Street between Julien Ave and West Fifth Street adopted by the following vote

be it resolved by the city council of the city of Dubuque that the sum of fifty dollars be appropriated
for the work of excavating the necessary ditch to carry off the 17th street storm water from Maple
Street to couler creek said ditch to be constructed on 17th street under the direction of street
commissioner adopted
ald Downer presented a petition from AY McDonald asking to be permitted to place the old
wooden box now framing a sewer from his factory with tile pipe connecting with the fifth street
sewer and running to the river and moved the prayer of the petitioner be granted providing the
petitioner returns the filling to the satisfaction of the street commissioner and city engineer motion
adopted
The same offered the following resolution
Resolved that the citizens residing in the vicinity of Grant Park be allowed to remove the fence around
said park providing they fill up all post holes and leave the ground in proper condition adopted
Ald Downer moved the committee on public grounds and buildings be permitted to remove
the guards around the cellar entrances of the central market carried
Ald Hollnagel offered the following resolution
Resolved by the city council of the city of Dubuque that a sidewalk four feet wide of good two
inch plank be within thirty days of this notice constructed and laid in conformity with the ordinance
in relation to sidewalks on the east side of Washington Street between twenty-second street
and twenty third street and the city engineer be instructed to notify abutters on said street

Ald ryder of the special committee consisting of the aldermen of the First Ward to whom was
referred the petition of Mrs andrew Murphy claiming damages caused her property by the widening
of Grandview Avenue reported in favor of allowing her 25.00 and moved the petition be
referred back to the same committee together with the city engineer carried

Be it resolved by the city council of the city of Dubuque that the street commissioner be
instructed to fill up to grade southern Avenue from Dodge street south to J Piers lot in order that

citizens of said city to assess damages as provided by ordinance which any person owning property
along the line of said street may sustain by reason of the opening of said street adopetd by the

the chair presented teh following resolutions etc which were on motion unanimously adopted
Whereas the city council has learned with extreme sorrow of the demise of honor J D Bush long
an alderman and for two terms mayor of this city and in order to give expression to our sincere
sorry be it resolved that in the death of Hon J D Bush the city and community have lost an estimable
and very worthy citizen the poor and humble a kind and generous friend and his family an
affectionate father and husband that in his long career he was ever anxious for and vigilant in
promoting the growth and advancement of our key city in which he lived so long and which he loved
so well no sacrifice was to great when made for its interest no labor too severe that would tend
to its prosperity
Peace to the ashes of the venerable and esteemed citizen resolved that as a mark of respect for
the memory of the deceased these resolutions be spread upon the records of the council and
a certified copy thereof be presented to the bereaved family and as a further mark of respect his
portrait in the council chamber be draped in mourning for thirty days

praying for the remission of one half her taxes of 1885 reported adverse to the prayer of petitioner
