the afternoon session if possible
On motion of ald Hollnagel the bill of the Dubuque Herald 33.35 for printing of official notices
during the month of April 1886 was referred to the printing committee
The bill of the Silsby manufacturing company 768 for a new hose carriage was on motion
referred to the fire committee

and Sawyers addition referred to police and gas committee
C E Kloes asking that the city engineer be instructed to give grade to set curbing abutting parts

Catherine Morrisey praying that on account of damages to her property caused by overflowed
streets that her taxes for the year 1885 on lot 3 Dorgans subdivision be remitted referred to the
delinquent tax committee
Jacob Brueck et al remonstrating against the payment of a special tax levied against their
property for teh construction of a sidewalk abutting the same on Kniest Street claiming that they
were never received notice to lay a new sidewalk and that laid by order of the city engineer was an
inferior one poorly constructed
Ald Hollnagel moved the rules be suspended and mr Brick permitted to explain his grievances
to the council carried
Mr Bruck addressed the council briefly
Ald Crawford moved the petition be referred to the aldermen of the Fifth Ward and that they examine
the question together with that of any other abutters remonstrating against the payment for laying
sidewalks on Kniest Street carried
Dan harrington praying that the tax of 1885 on lot 2 of sub mineral lot 28 be cancelled referred to
delinquent tax committee
Jacob Brick et al asking that Kniest Street be so repaired as to cause the water to run freely off
both sides of said street and that a sidewalk be laid on the west side of said Kniest Street referred
to the street committee
Peter Geishecker et al residents on Jackson Washington and Elm Streets asking that a
policeman be stationed on said streets to protect life and property
Ald Doerfler moved the petition be laid over until the police payroll is read carried

Mary Rischatsch praying that one half the tax of 1885 on her homestead lot 34.4 city be cancelled
referred to delinquent tax committee
Margt Carr proposing to pay the city teh sum of 75.00 in full of the special assessment levied
against her property lot 2 marshs add for the improvement of Brad Street abutting said lot the full
amount of the special tax being 128.94 she further agreeing to pay all costs referred to city attorney
Chas B Jennings et al owners of property abutting on Nevada Street remonstrating against the
laying of a sidewalk eight feet wide on both sides of said street and asking that the resolution
ordering a sidewalk eight feet wide laid be amended so as to require only a four foot walk
Ald Doerfler moved the petition be received and filed And Crawford offered as an amendment
to Ald Doerfler's motion that Messes Tyler Jaeger Webb and Newport be granted until next spring
to comply with the order of the council lost by the following vote

remonstrating against the payment of the special assessment levied against their property for
the improvement of said street claiming the work to be improperly done on motion referred to
the committee on streets
C H Booth asking that in lieu of his filling the street and alley abutting on and contained in Booths
add to the city of Dubuque his taxes on lots in said addition be cancelled for the year 1885
Ald Crawford moved the petition be referred to the delinquent tax committee and that the property
be held from tax sale until final action is taken on said petition by council carried
Mrs Julie L Langworthy et al owners of property abutting on West Fifth Street protesting against
the improvement of said street and asking that the improvement as ordered be laid over
Ald Crawford moved the commencement of the improvement of West Fifth Street be postponed
until april 1st 1887 and that the bids be returned to the bidders carried
P C Foley et al praying for a policeman on southern avenue from Dodge Street to Grandview
Avenue on motion action on this petition was deferred
Mrs F A Smock praying that she be refunded taxes paid on an erroneous personal assessment
assessed against her during teh past two years also that an erroneous personal assessment
assessed to her for the present year be cancelled and her assessment on real estate be
reduced referred to delinquent tax committee
Ald Crawford moved that the rules be suspended and Hon T S Wilson permitted to address
the council in regard to the remonstrance of the property owners abutting on Sixteenth Street
against the levying of a special tax to pay for the improvement of said street carried
Hon T S Wilson explained the cause of complaint
E O Duncan et al praying that a fire plug be placed on the west side of Clay street near the
fifth ward engine house referred to fire committee
Sun Vapor Light and Stove Company asking that they be permitted to submit a proposal to the
city council for any new gasoline street lamsp the city may want in the future referred to the police
and gas committee

Dennis smyth praying that he be granted six months further time in which to pay the special
tax with internet levied against his property E 20 ft of the W 1/2 lot 1 Dub Harbor company add
to pay for the improvement of Jones Street abutting said lot
Ald Ryder moved the prayer of the petitioner be granted and that he pay interest on said special
tax at the rate of 6 percent carried
Jas L Hoar praying that the city tax on mineral lot 473 for the year 1885 be refunded to him said
tax amounting to 22.44 as the city utilizes the lot for material for street repairs referred to the
committee on streets
John Quinlivan et al praying for the opening of Rowan street from Southern Avenue to Grandview
Avenue referred to the committee on streets
H Firzlaff et al protesting against the setting of poles on the sidewalk on Elm Street by the
Minnesota and Northern Railroad company and asking that they be compelled to set said poles
in the gutters

notify the railroad company to set their telegraph poles in the gutters and not on the sidewalks

Henry Gehrig et al praying that the steam whistle of Farley Loetscher and Co be abated claiming
said whistle to be a public nuisance referred to the ordinance committee
Henry Rich praying the council accept his subdivision of lot 1 of Mineral lot 161 and of mineral lot
169 as platted by M Tschirgi Jr city engineer referred to the committee on streets
R W Stewart asking that he be empowered to execute an order issued to the street commissioner
to abate a socalled nuisance corner of fourteenth and bluff streets ordered received and filed
Frank Hoffman praying that the city tax of 1885 on the S 1/2 of lot 312 East Dubuque add assessed
to Mary Boyle be cancelled referred to the delinquent tax committee
North American Telegraph Company asking permission to erect poles wires etc along certain
streets and alleys in city
Ald Crawford moved that an ordinance granting the permission as prayed for in possession of
the ordinance committee be read carried
Upon the reading of the ordinance by Ald Hayden Ald Crawford moved the petition and ordinance
be referred to the committees on streets and ordinance to report at an adjourned meeting of the
city council motion carried
ald Hayden moved the rules be suspended and permission granted to Mr Clute manager of
the N A Telegraph company to address the council carried
Mr Clute addressed the council briefly

official printing were referred to the printing committee

Street commissioner McMaster reported having expended 2339.50 for improving and repairing
street etc. during the month of August 1886 report ordered filed and warrants drawn to pay same
City marshal Moore reported 1075 necessary to pay for the police force the past month that
79 arrests had been made and that he paid into the city treasury the sum of 4.50 received for
fees and 43.00 for impounding ordered receiveed and filed and warrants drawn to pay salaries
auditor reilly reported 836.35 due city officers and 1070 due members of the fire department
for salaries for the month of august 1886 Report ordered filed and warrants drawn to pay salaries

Market Master Rice reported having weighed upon central market scales 224 drafts receiving
therefor the sum of 33.60 which with 27.25 received for rent of huckster stands he paid to the city
treasurer 60.85 Also that he furnished meals for prisoners amounting to 7.20 during the month of
August 1886 Report ordered filed and warrant drawn to pay for board of prisoners
Recorder Agnew reported having issued licenses amounting to 735.50 during the month of
August 1886 ordered received and filed
Treasurer Traut reported having expended for interest on warrants freight on new hose carriage
and postal cards the sum of 372.80 ordered received and filed and warrants drawn to refund
the same
Lamplighter Caughlin reported having cared for and lighted 222 lamps during the past month
referred to the police and gas committee
Owen Reynolds wood inspector reported having measured 415 cords of wood during the
past month ordered received and filed

Communication of Bernard J ONeill president of the dubuque Pontoon Bridge Company accompanied
by the plans and specifications of the proposed high bridge to be constructed across the
Mississippi River at this point asking said plans and specifications to be approved by the

Ald Crawford offered the following resolution which upon his motion was adopted Resolved that
the plans and specifications of the wagon bridge over the mississippi river between Dubuque
and East Dubuque submitted to the city council this date by the Dubuque Pontoon Bridge Company
be and the same are hereby approved
Reports of Committee
Ald Ryder chairman of the finance committee reported on the petitions of Ellen Conlon and Dennis
Gilliam in relation to paying the special tax levied against their property for the improvement of
West Eight Street abutting the same by offering the following resolution be it resolved by the city
council of the city of Dubuque that E Conlan and Dennis Gilliam be allowed the term of two
years dating from Sept 6th 1886 to pay their special assessment on West Eight Street for the
grading curbing and macadamizing etc done in year 1885 without interest on motion the resolution
was adopted

Ald Hayden Chairman of the ordinance committee presented an ordinance laid over at a former
meeting entitled an ordinance granting to the Illinois Central Railroad company the right to maintain
and use the railroad tracks and all connections made thereto now used by said company on
Washington and Jackson Streets in this city
Ald John M Byrne moved the reading of the ordinance for the second time be laid over
Ald Crawford offered as an amendment to Ald Byrne's motion that the ordinance be read for the
second time lost by the following vote

mineral holes and other dangerous excavations situated upon private property within the corporate
limits of the city of Dubuque

Ald Crawford moved that the proposition of mr P McCollins agreeing to take 800 for his ground
as shown on the plat of the proposed extension of West Eight Street be accepted that the finance
committee be instructed to close the bargain and the city attorney to examine the title and draw
up a deed for the transferring of the property to the city and that a warrant be drawn upon the
treasury in favor of Mr McCollins when himself and wife execute said deed carried by the following
vote

On motion of ald Parker the bids for the construction of the sewer on West Eagle Point Ave were
opened and referred to the city engineer
Ald Downer offered the following resolution
Resolved that a warrant be drawn in favor of the chairman of the committee on public grounds and
buildings for the sum of 125 being the amount of the purchase price of certain real estate purchased
of the Dubuque building and Loan association and that said committee be authorized to complete
the transfer adopted
Ald Hollnagel chairman of the fire committee reported in favor of praying the bill of the J J Linehan
Engine Co 27 for time of minute men for the month of July report adopted
ald Hollnagel of the same committee reported on the petition of Knapp Stout and co company
et al for the extension of Water mains on 8th 9th 10th and 11th streets that prayer of petitioners
be granted report adopted
Ald Hollnagel of same committee reported on the petition of Farley Loetscher Manufacturing
Company et al praying that an engine company be equipped and stationed in some locality
in the manufacturing district in favor of referring it to the committee of the whole report adopted
Ald Hollnagel of a special committee consisting of the aldermen of the fifth ward to whom was
referred the petition of Henry Ehlers et al asking that the alley between Jackson and Washington
Streets from 22 nd to 23rd streets be opened reported in favor of granting the prayer of petitioners
and taht the city engineer be instructed to give the abutters the line to set their fences report
adopted
Ald Crawford of the street committee presented the following estimates of the city engineer on
the bids for the construction of sewer on West Eagle Point Ave James Lee 1491.50 Frank
Negeldy 1001.00 Chas Steuck 937.00 Wm H Rebman 877.00
Ald Doerfler moved the contract be awarded to Wm H Rebman his being the lowest bid carried

Ald Trexler moved the market committee be instructed to advertise for bids for furnishing wood
for use in city hall carried
Ald Downer offered the following resolution
Resolved that the city attorney and is hereby instructed to assist the citizens committee in preparation
of a sewerage ordinance and that said committee be requested to report such an ordinance at
as early a date as possible together with such other suggestions as may result from their deliberations
adopted

Ald Crawford moved that when the council adjourns it does so to meet again on next Tuesday
evening and that the question of the extension of the water mains be fixed as a special order for
that evening carried
Ald Crawford submitted the following report
To the city council your committee on streets to which with the city attorney was referred with
power the proposition of John Specht the plaintiff in a suit in the circuit court of Dubuque C ounty
against the city respectfully reports as follows
The suit of Mr Specht was brought to set aside a special assessment levied by the city council
in 1882 against lot 3 of out lot 720 to pay for curbing guttering and macadamizing street in front
of same the lot was sold by the city treasurer for the nonpayment of the assessment to D Rhomnberg
November 19th 1884 amount 298.65 Rhomberg paid the sugbsequent city taxes of 1884 on
amount 9.05 In his suit the owner Mr Specht claimed that the special assessment was null and
void for the reason that he had not been notified by the council that he could appear and show
cause why the special tax should not be levied and the court on demurrer sustained his cause of
action and at the last March term entered a decree against the city annulling the assessment
and setting aside the tax sale
Mr Specht now proposes to pay the city treasury the amount for which the lot was sold 298.65 and
the subequent tax paid by Rhomberg on condition that the city will accept the same as full
satisfaction of all claims against the lot or the improvement and will cause the assessment and tax
sale to be

Your committee under the power given it has accepted the proposition and recommends that the
city treasurer be authorized to receive from Mr Specht the amount for which the lot was sold to
Mr Rhombert 298.65 and the subsequent tax of 1884 paid by said amount when paid as in full
satisfaction of all claim against the property on account of the improvement also that the treasurer
and auditor be instructed to mark the assessment and the tax sale as cancelled on their respective
books We further recommend that a warrant be drawn on the city treasurer in favor of D Rhomberg
for the amount paid by him at the tax sale 298.65 and the subsequent tax of 1884 9.05 paid by him
with interest at the rate of six 6 percent on said amounts from the respective dates of the said
payment and that the audition notify said Rhomberg in writing that the warrant is ready for delivery
to him It is agreed between the city and Mr Specht that each party shall pay its own costs in the
suit

Ald Crawford from the street committee submitted the following report to the city council your committee
on streets to which was referred the claims of Robert Jesse owner of the north lot of block seven
7 Dubuque Harbors co add and of Hansen and linehan owners of south thirty feet of block six 6 same
add each asking to be credited with teh sum of 50 on the special assessment against their
respective lots for the improvement of Jones street reports as follows Petitioners state that between
the years 1869 and 1871 the council ordered Jones Street in front of their respective premises
to be macadamized and that in persuance of such order H L Stout then owner of the south thirty
feet of block six 6 and Mr Jess had the work done at an expense of 50 to each and paid for the
same By instruction of the council the city attorney has investigated the matter and examined
the records during the years mentioned he reports that there is no record of any order of the council
requiring the macadamizing of the street at that time nor any proceeding relating to the same the
grade of teh street was not established until 1885 and any improvement prior to that time must
have been if a temporary character When the street was permanently improved last year the street
was macadamized throughout for which the city has paid In the opinion of your committee it
would be creating a dangerous precedent and therefore inexpedient for the city council to give
credit for an improvement made over fifteen years ago by private property holders on a street
before any grade was established and of which no record can be found We therefore recommend
that the prayers of the petitioners be not allowed

having under consideration the petition of the various property owners on Kniest between High and
Lane Streets asking for the vacation of four 4 feet in width on the south side of that portion of said
street and also the remonstrance of L A Rhomberg and others against said vaction would report
that the proposed vacation is asked for on the ground that the main building of the national iron and
brass works was built by mistake it is claimed partly in the street and now occupies four feet of the
same in the opinion of your committee it would be a great hardship as well as entirely unnecessary
and uncalled for to require the removal from teh street of these works at present At the same time
we think it is bad policy for the city except in extreme cases to vacate or narrow any of the public
streets We therefore recommend that no alteration be made in the street but that the building of the
national iron and brass works be allowed to remain as it now stands until the interest of the public
shall in the discretion of the council demand its removal from the street

the city attorney presented an agreement signed by Chas T Hancock whereby said Charles T
Hancock agrees to pay to the city of Dubuque the sum of three hundred dollars 300 and also

I would report that if deemed advisable the council may by resolution declare said bees a
nuisance and after a reasonable notice to the owner to remove the same the council may
direct the city marshall to remove them on motion the report was adopted
The city attorney presented the deeds of the transferring of certain real estate from Patrick
McCollins and wife and John Coleman and Wife to the city of Dubuque said property being the
extension of West Eight Street as platted by the city engineer
Ald Crawford moved that the recorder be instructed to have the deeds recorded carried
The city attorney stated the case of Scott vs city of Dubuque was coming up for trial at an early
date and that the railroad company to whom the right of way over the land in said litigation was
granted wished to defend the same under the name of the city of Dubuque
Ald Crawford moved the city attorney be instructed to confer with the railroad company or its
representatives and have them agree to hold the city harmless against any cost that may arise
from said litigation and that the railroad company be granted permission to defend the case in
the name of the city provided they agree so to do carried
Ald Hayden moved an ordinance granting to the Illinois Central railroad company the right to maintain
and use the railroad tracks and all connections made thereto now used by said company on
Washington and Jackson streets in said city be taken up and acted upon carried

that the city take immediate action to provide for the drainage of that part of the city situated between
8th and 13th streets and between elm and pine st
Ald Crawford moved that the city engineer and street commissioner be empowered to have said
drain pipes laid from 8th to 9th and 10th to 11th streets and work done under the supervision of
the street committee carried
Engineers Tschirgi and Knowlton being called upon by the council explained the plans of the proposed
drainage as asked for
ald Crawford moved the street committee be autorized to confer with the railroad companies
in regard to the filling of the streets to grade between their tracks carried
Ald Ryder chairman of the committee of the whole submitted a report on the petition of Chas
W Robinson et al praying for the extension of the water mains along south main street and railroad
avenue which report on motion of ald Hollnagel was referred back to the committee together with
the chief engineer of the fire department to report on next Tuesday evening

and energetic action on the part of the city council as lie reasonably within its power
We believe the remedy recommended by him viz a complete and efficient system of sewerage
affords the only permanent relief in caus where complaints are annually coming before the council

every one the laboring man and the poorer classes more than the wealthy because it ensures
healthier homes to the former who must rent the cheapest property while the wealthy can choose
their homes that it is above all desirable that the amount of sewerage now deposited in the soil
should be carried outside the city to prevent sickness and possible future epidemics all commend
it to favorble consideration
We would recommend that teh council wage upon the advisory committee such action on their part
as will speedily introduce the best attainable system of sewerage to be completed as rapidly
as our finances will permit

being covered with mud and water at all times using new material if necessary

of copies of said book printed ruled and bound and to furnish the same to the official resgisters
of each election precinct of the city in the time and manner provided by statute
Ald Crawford offered the following resolution
Resolved that the julien avenue sewer be arched with stone masonry from the westerly terminus
of the present arching to the west side of Walnut Street that the north side of Julien Avenue
from the intersection of said avenue with Hill Street to Walnut Street be curbed and guttered in
accordance with the ordinance relating to such improvements that the city engineer be instructed to
prepare plans and specifications and make an estimate of teh cost and that the recorder advertise
for proposals for the doing of the work the curbing and guttering to be done at the expense of
the abutting property
On motion the preceding resolution ws referred to the committee on streets
ald Parker chairman of the equalization committee reported on the bill of Jos J Pfiffner city
assessor in favor of paying him 1100 in full of all demands 800 of said 1100 being already
paid leaving a balance due him of 300 report adopted
Ald Hollnagel of teh fire committee presented fules and regulations for the fire department of the
city of Dubuque
Ald Crawford moved that before the rules and regulations were read the council take a recess
of five minutes carried

a benevolent and educational institution being unable to agree with a majority of teh committee
desire to submit a minority report the legal opinion of the city atorney is conceding that the
objects are benevelent as alleged in the petition and as contemplated by statute the property
in question must be devoted solely to the appropriate objects of the society and cannot be
leased or otherwise used with a view to pecuniary profit That the building is used for a saloon
and rented for meetings dances theater purposes and otherwise used with a view to pecuniary
profit the petitioners themselves cannot deny We therefore report adversely to the prayer of

To the city council of the city of Dubuque Gentlemen your committee to when the petition of the
Dubuque Turn Verein has been referred would respectfully report
1 your committee find the society has been exempt from taxes for the last ten years in city and county
and since exmayor Knights administration when the same tax matter came before the council and
after due investigation of the law by ex mayor Knight and County Attorney Matthews the council
cancelled the taxes
2 The law exempts them as an educational and benevolent society which cares for and protects
the widows and orphans of its members the same and as well as any other society
3 As in regard to the city attorneys opinion that the property is devoted solely to the society your
committee is perfectly sure that institution is not a money making business and has to receive
some revenue from the building to support the society Your committee find also that all other societies
in the city are exempt taxes and it would not do justice if the prayer of the petitioner was not granted
and your committee could give you a list of other societies having from 5000 to 8000 in monies
and credits which are exempt from taxes in teh city and county and it would not be fair to make
flesh of one and fish of another we therefore recommend that the prayer of the petitioner be granted

Whereas lot No 209 East Dubuque addition in the city of Dubuque is subject to be and is covered with
stagnant water to the injury of the health comfort and property of the city and the surrounding vicinity
and whereas the property surrounding said lot is filled up and raised to grade and whereas it
appears to this council that to prevent stagnant water from covering and remaining on said lot it
will be necessary that said lot be filled up and raised to grade that is to a height even with the
surrounding property therefor be it resolved by the city council of the city of Dubuque that the owner
of owners of said lot No 209 be and are hereby ordered and required to fill up and raise said lot
to the grade of the surrounding property that is to a height even with the surrounding ground said
filling and raising to be completed in accordance herewith on or before the 1st day of December
1886 resolved further that is the owner or owners of said lot shall neglect or refuse to fill up
and raise said lot within the time herein designated said filling and raising shall be done at the
expense of the city and the cost thereof with all incidental expenses connected therewith
collected in the manner provided by ordinance
That a copy of this resolution duly issued and certified by the recorder under the seal of the city
shall be served upon the owner or owners of said lots as provided by ordinance

Ald Crawford moved the officials of the Chicago Burlington and Northern Railway Company be
granted permission to remove the buildings and that the city marshal cooperate with them in such
removal carried
Ald Crawford presented the following report which on his motion was adopted Your committee
on streets to which was referred the petition of J Quinlivan et al praying teh council to improve
Rowan street from Southern Avenue to Grandview Avenue sufficiently to render it passable for
unloaded teams would respectfully recommend that the street commissioner be instructed to
remove all trees and other obstructions from said street and to expend an amount not exceeding 50
in making it passable as asked for by petitioners

On motion of ald Thos Byrne the bids were opened by the recorder and referred ot the city
engineer
Ald Parker moved that a remonstrance in his hands relating to the opening of an alley between
lot 774 and lot 2 of subdivision of lot 775 of mcDaniels subdision be read carried
Remonstrance of Geo H Fry et al against the opening of a passage way between lot 774 and lot
2 of lot 775 McDaniels subdivision was read by the recorder and on motion of Ald parker referred
to the street committee
Ald Hollnagel offered the following resolution which upon his motion was referred to the street
committee
Whereas complaint has been brought about the Minnesota and Northwestern Railroad company
of not having a flagman stationed on the crossing of Eagle point Avenue and Kniest Street and
Whereas there is so much travel on said thoroughfare as children going to and from the Fifth Ward
School funerals passing said avenue to and from cemeteries etc
Therefore be it resolved by the city council that the city marshal be and is hereby instructed to notify
the said Minnesota and Northern R R Co to station a flagman on said Eagle Point Avfenue
R R Crossing when running their trains

Ald Downer of the special committee to which was referred the petition of Barbara Tinkeham
et al submitted the following report on the same to the city council your committee to whom was
referred certain petitions asking for the abatement of a nuisance caused by the union slaughter
house would report that in accordance with their instructions they had an interview with the principle
members of that establishment with the following results These gentlemen state it is the intention
of the company to replace the present building new occupied by their rendering establishment
tanks etc with a substancial brick building together with the most approved facilities for preventing
any obnoxious smells in the process of rendering In the opinion of your committee the principal
cause of the nuisance of which complaint is made arises from the rendering of material received
from the different butchers in advanced stages of decomposition this the managers promise to remedy
by refusing to receive such putrid of fal pending such time as the promised improvements are
made these improvements together with the promised caution on the part of the managers remove
all reasonable objections but we think that the health officer should visit the place frequently to
see that the above promises are faithfully complied with all of which is respectfully submitted

Ald ryder moved the report of the committee be adopted carried
Ald Downer chairman of the special committee appointed to investigate the doings of the
members of the fire department submitted the following Your committee appointed to investigate
certain alleged acts of insubordination in the fire department having finished their labors would
respectfully report as follows
We find that J Schonberger of the Sol Turck engine company is guilty of insubordination and
disrespect to his captain and of deserting his post of duty during the progress of fires we also
find Thomas Ryder stoker of the same company is guilty of like insubordination in denying the
authority of his captain in refusing to obey his orders thereby destroying the authority of his captain and
injuring the discipline of teh company Your committee also consider Chief Reinfried and Capt
James Daley deserving of censure the first named for not taking prompt action action when

cares affecting the discipline of the department were brought to his notice and capt daley for not
having promptly reported each dereliction of duty to his chief we find a general lack of discipline
throughout the departmetn owing as we think to the absence of proper rules of government of
the same the necessity for which cannot be too strongly urged We would recommend that such rules
be adopted as early as possible all of which is respectfully submitted

Ald Hollngel moved that the report be referred back to the committee awaiting a minority report
carried
The city attorney called the attention of the council to the fact that Messers Specht and Moore
had failed to keep their agreement with the city regarding the payment of a special assessment
levied against their property for the improvement of West Street abutting same
Ald Crawford moved that the auditor be instructed to call upon Messers Specht and moore and Henry
Michel their attorney and stated if they did not fulfill their proposition within five days the citys agreements
to accept teh same be withdrawn carried
Ald Crawford the attention of the council to the necessity of extending the retaining wall now in
course of construction on Grove Street so as the same will protect the filling on west eleventh street
Ald Thos Byrne moved the matter of extending said wall be referred to the committee of the whole
carried
Ald Trexler moved that in as much as a member of the special committee appointed to purchase
horses for the fire department had refused to serve the purchasing of said horses be referred to
the committee on fire carried
Ald parker chairman of the special committee to which was referred the matter of extending
the water mains on the hills submitted the following report
To the honorable mayor and city council your special committee to whom was referred the matter
of the petition of J K Graves and others asking the extension of the water mains to Burch street
and fenelon place would respectfully report that they find it is the duty of the water company to
extend its mains to any part of the city when requested so to do so by this council and to furnish
sufficient water for the use of the city and its cizitzens residing along the streets when such
mains extend that in this case it is advisable to extend the mains along from the junction of
Hill Street and Julien avenue up Hill Street to Burch up Burch to the center of Third with a

branch pipe to the east end of Fenelon Place and that there be placed thereon four plugs we also
find that the income from these plugs will more than pay 7 percent of the cost of the necessary
pipe we find that the cost of laying this pipe will not be more than the laying of pipe ordinarily
does your committee would therefore recommend the adoption of the following resolution
Resolved that the Dubuque Water Company be and hereby is required to extend its water mains
from the plug at the intersection of Julien Avenue and Hill Street along Hill Street to the intersection
of Burch Street thence along burch street to the center of Third Street and from Burch along Fenelon
Place to the east end thereof and that it be required to place along such extensions four plugs
at such places as the city council may direct
Ald Thos Byrne moved that before action is taken upon the report the rules be suspended and any
party present granted permission to address the council in favor or against the adoption of the
report carried
Mr Fouke addressed the council adverse to the adoption of the report at present Mr Burch spoke
in favor of its adoption
