Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The
application, staff report and related materials are attached for your review.
DISCUSSION
Dave Schneider, Schneider Land Surveying at 906 1st Street North in Farley, Iowa, spoke on
behalf of the property owners. He stated that Ron White is planning to purchase the proposed Lot
2 of Genesis Subdivision. He noted this land is in Dubuque County within the City's two-mile
extraterritorial jurisdiction (ETJ) and will go through the County review process as well. He
explained this is following the Swiss Valley Road interchange and realignment of North Cascade
Road. He stated the property has city water but is on a septic system.
Staff detailed the staff report, noting the submitted Final Plat of Genesis Subdivision is in the
Dubuque County within the city's ETJ, and as such the city has the authority to review the
subdivision. Staff explained that proposed plat is considered a major subdivision as the plat
creates three or more lots and also includes an easement for the creation of a future street. Staff
stated that the plat would reconfigure two existing lots into three lots, it would create an access
and utility easement, and all lots would have frontage on North Cascade Road.
RECOMMENDATION
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve
the Final Plat of Genesis Subdivision
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The Final Plat of Genesis Subdivision is located in Dubuque County along North Cascade
Road (PINs 1412400011 and 1507351001). The subdivision plat proposes to subdivide
two existing parcels into three parcels and create an access and utility easement for a
future street. Pursuant to the Unified Development Code (UDC), the proposed subdivision
is classified as a Major Subdivision' and therefore requires review by the Zoning Advisory
Commission and City Council.
DISCUSSION
The submitted Final Plat of Genesis Subdivision proposes to subdivide two (2) parcels
totaling approximately 46.4 acres into three (3) parcels. The property is located within
Dubuque County within two -miles of the City of Dubuque corporate limits and as such is
subject to city review.
The Final Plat of Genesis Subdivision proposes to create the following:
■ Lot 1 would total approximately 15.41 acres and would continue to be used as for
commercial use. Lot 1 will have frontage along and would take access from North
Cascade Road.
■ Lot 2 would total approximately 2.06 acres and would continue to be used for
commercial use. Lot 2 will have frontage along and take access from North
Cascade Road.
■ Lot 3 would total approximately 30.12 acres. This lot is currently vacant and is
anticipated to be utilized for future commercial development. Lot 3 will have
frontage along and take access from North Cascade Road.
■ A sixty-six (66) foot wide access and utility easement is proposed along the eastern
boundary of Lot 2. This easement extends over portions of Lot 1 and Lot 2 is
anticipated to be utilized as a future street.

UDC Chapter 16-11-6 states a Major Subdivision is any subdivision or consolidation of property which
creates three (3) or more lots and creates a new private or public street.

Final Plat of Genesis Subdivision
Pursuant to the Unified Development Code all lots must have frontage on a public or
private street. As proposed, Lot 1, Lot 2, and Lot 3 all have frontage along the North
Cascade Road right-of-way. As such, proposed lots and access and utility easement are
in substantial conformance with the Unified Development Code.
RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Final Plat of
Genesis Subdivision and recommends approval of the subdivision plat.

RESOLUTION NO. 36 - 26
A RESOLUTION APPROVING THE FINAL PLAT OF GENESIS SUBDIVISION,
DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Genesis
Subdivision, Dubuque County, Iowa that is within the City's 2-mile extraterritorial
jurisdiction; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission
and its approval has been endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that
it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the Final Plat of Genesis Subdivision, Dubuque County, Iowa is
hereby approved, and the Mayor and City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque, Iowa upon said Final Plat.
