The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request.
This memorandum transmits the Plat of Survey of Adair Place, a resolution, and related
materials for City Council review and approval.
DISCUSSION
Parker Scott, 2455 Woodlawn Street, spoke for his application. He explained that this is a
simple subdivision of the lot at 1425 Adair Street for the purpose of constructing an additional
home on Lot 1. He noted that the area of Lot 2 will be less than 5,000 square feet.
Staff detailed the staff report noting the submitted Plat of Survey of Adair Place creates two lots
out of one. Staff stated that the lot with the existing house will be slightly under the code required
lot area (4,424 square feet where 5,000 square feet is required) and have less than the minimum
required street frontage (44.37' where 50' is required); however, the existing house will meet
setback requirements.
The Commission asked why Lot 1 was larger than Lot 2. Mr. Scott explained that it's due both to
the topography of the lot and the need to meet 20' front setbacks on both Adair Street and Loras
Boulevard, as Lot 1 is a corner lot.
RECOMMENDATION
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve
the Plat of Survey of Adair Place subject to waiving the lot area and lot frontage requirement for
Lot 2.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The Plat of Survey of Adair Place is located in the city of Dubuque at 1425 Adair Street,
at the northwest corner of Adair Street and Loras Boulevard (PIN 1023464009). The
property is being subdivided with the intention of constructing a new single-family home
to the south of the existing single-family home.
Pursuant to the Unified Development Code (UDC), the proposed subdivision is classified
as a Simple Subdivision' and requires a waiver of bulk regulations and therefore requires
review by the Zoning Advisory Commission.
DISCUSSION
The submitted Plat of Survey of Adair Place proposes to subdivide an approximately
10,034-square feet (0.23-acre) property located in the city of Dubuque (PIN 1023464009).
The Plat of Survey of Adair Place proposes to subdivide one (1) existing lot into two (2)
lots. The following is a description of the proposed lots:
■ Lot 1 would total approximately 5,562 square feet (0.13 acres) in area and have
55.66' of street frontage along Adair Street and 99.97' along Loras Boulevard. A
new single-family home is planned to be constructed on this lot with access from
the Adair Street frontage.
■ Lot 2 would total approximately 4,424 square feet (0.10 acres) in area and have
44.37' of frontage along Adair Street. The existing home at 1425 Adair Street would
remain.
Pursuant to the Unified Development Code (UDC) Chapters 11-14 and 5-2, the subject
lots must have a minimum of 50' of street frontage and 5,000 square feet of area. Lot 2
will have 44.37' of street frontage and 4,424 square feet of area. Therefore, the applicant
is requesting a waiver of these bulk regulations for Lot 2. Lot 2 is compliant with all other
bulk regulations, such as setbacks to the existing home. Lot 1 is compliant with all other
bulk regulations.
UDC Chapter 16-11-6 defines a Simple Subdivision as "Any subdivision or consolidation of property in
which no new streets, public or private, are proposed, which does not require the construction of any public
improvements, and which creates fewer than three (3) lots."

Plat of Survey of Adair Place
The UDC categorizes the proposed plat as a Simple Subdivision. Pursuant to UDC
Chapter 11-14 and 5-2, the Zoning Advisory Commission and City Council are the
reviewing authorities for Simple Subdivisions which require a waiver of bulk regulations.
The Zoning Advisory Commission shall review the plat to determine whether it is in
substantial conformance with the Unified Development Code.
RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Plat of Survey
of Adair Place and recommends approval of the subdivision plat subject to waiving the
minimum requirements for lot width and lot area for Lot 2.

RESOLUTION NO. 37 - 26
A RESOLUTION APPROVING THE PLAT OF SURVEY OF ADAIR
PLACE, IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Plat of Survey of Adair Place
in the City of Dubuque, Iowa; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and its approval has been endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find
that it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-14(B) of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived regarding required lot width and lot
area for Lot 2 of the Plat of Survey of Adair Place.
Section 2. That the Plat of Survey of Adair Place, in the City of Dubuque, Iowa is
hereby approved, and the Mayor and City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque, Iowa upon said Plat of Survey.
