The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The
application, Final Plat of Hirsch Place 2nd Addition, and related materials are attached for your
review.
DISCUSSION
Dan Marti, Origin Design, 137 Main Street, spoke on behalf of the property owner, Kevin Hirsch.
He stated the property is located in Dubuque County and is being divided for Mr. Hirsch and his
sister.
Staff detailed the staff report noting the submitted plat subdivides one existing lot into two. Staff
explained that the proposed Lot 1 would be a flag lot that has approximately 32.46' of street
frontage where 50' is required, which requires a waiver from the Commission. Staff stated Lot 2
would contain existing structures and Lot 1 could be for future development. Staff noted the
access easement over the property is already documented and recorded and that the plat
contains a note addressing this.
The Commission discussed the request and asked if there was an issue with a home being built
behind another home and using a shared driveway. Staff replied that the city does not regulate
the zoning and development standards for this lot since it is located in the county, but that any
development would need to adhere county codes and requirements.
RECOMMENDATION
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve
the Final Plat of Hirsch Place 2nd Addition.
A simple majority vote is needed for the City Council to approve the request.

The Final Plat of Hirsch Place 2nd Addition is located in Dubuque County southwest of the
North Cascasde Road and the Southwest Arterial Intersection. Currently the property is
a single irregularly -shaped lot (PIN 1505476011). The proposal would divide the property
into two lots.
Pursuant to the Unified Development Code (UDC), the proposed subdivision is classified
as a Simple Subdivision' and requires a waiver of bulk regulations and therefore review
by the Zoning Advisory Commission.
DISCUSSION
The submitted Final Plat of Hirsch Place 2nd Addition proposes to subdivide one (1)
4.4-acre lot into two (2) lots. The property is located in Dubuque County but is within two
miles of the City of Dubuque corporate limits and is therefore subject to city review.
The following is a description of the proposed lots:
■ Lot 1 would total 3.45 acres in area (with .03 of that in within the right-of-way) and
would become a developable flag lot2. The adjacent properties have a shared
asphalt driveway over the flag portion of this lot via a 30' access easement. The
subject lot has 32.46' of frontage along North Cascade Road.
■ Lot 2 would total .99 acres in area (with .13 of that in the right-of-way). It has access
via a 30' access easement on Lot 1, and adequate frontage and lot area.
A plat includes a note of a private access easement document that has been recorded
with the Dubuque County Assessor. The document records a 30' access easement
across the new Lot 1 and benefits the new Lot 2 and an existing lot located between the
two new lots (Lot 1 of Hirsch Place).
Pursuant to the Unified Development Code (UDC) Chapter 11-14, all lots must have
frontage on a public street or private street. For single-family residential uses, 50' of
UDC Chapter 16-11-6 defines a Simple Subdivision as "Any subdivision or consolidation of property in
which no new streets, public or private, are proposed, which does not require the construction of any public
improvements, and which creates fewer than three (3) lots."

on a public or private street for Lot 1.
The UDC categorizes the proposed plat as a Simple Subdivision. Pursuant to UDC
Chapter 11-14, the Zoning Advisory Commission and City Council are the reviewing
authorities for Simple Subdivisions which require a waiver of bulk regulations. The Zoning
Advisory Commission shall review the plat to determine whether it is in substantial
conformance with the Unified Development Code.

RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Final Plat of
Hirsch Place 2nd Addition and recommends approval of the subdivision plat subject to
waiving the frontage requirement for Lot 1.

RESOLUTION NO. 38 - 26
A RESOLUTION APPROVING THE FINAL PLAT OF HIRSCH PLACE 2ND
ADDITION, DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Hirsch Place 2nd
Addition, Dubuque County, Iowa that is within the City's 2-mile extraterritorial jurisdiction;
and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission
and its approval has been endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that
it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-14(B) of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived regarding required lot frontage for Lot
1 of Hirch Place 2nd Addition.
Section 2. That the Final Plat of Hirsch Place 2nd Addition, Dubuque County, Iowa
is hereby approved, and the Mayor and City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque, Iowa upon said Final Plat.
