Van Milligen, City Manager SUBJECT: 2024 Catherine Street Storm Sewer Project Cancelling the Public Improvement Contract Project No. 5586500019 DATE: February 10, 2026 Dubuque AI WIN av 2007-2012.2013 2017*2019 Assistant City Engineer Robert Schiesl is recommending City Council approve the cancellation of the 2024 Catherine Street Storm Sewer Project and rescind the Public Improvement Contract with Temperley Excavating Co. through adoption of the attached resolution. Before construction began, the City identified unforeseen underground utility conflicts and further deterioration of the existing storm sewer pipe, which were conditions not included in the original project scope. After evaluating redesign alternatives, City staff determined that these changes would significantly increase both the scope and cost of the project. Given the potential substantial cost increase, proceeding under the current contract would not serve the public's best interest. The most appropriate course of action was to cancel the existing project and prepare a revised design for rebidding at a later date. The City and Temperley Excavating Co. have mutually agreed that, due to circumstances beyond either party's control, the project and contract should be cancelled. I concur with the recommendation and respectfully request Mayor and City Council approval. /- - LT v Mic ael C.
