Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The application, staff report and related materials are attached for your review. Discussion Andy Kepler, Leasing Director, Cafaro Company, spoke on behalf of the request. He stated three new tenants are coming to the Kennedy Mall: Fresenius Medical Care, Marshall's, and 7 Brew Coffee. Justin Somerville, Senior Civil Engineer, Cafaro Company, spoke about the proposed new access from the mall property onto Stoneman Road. He explained that this is necessary to accommodate the increased traffic that will be coming to the part of the mall due to the new tenants. He also noted that it will improve access for trucks making deliveries to Marshall's. He thought this new access may divert some traffic off Wacker Drive. He said that the updated conceptual plan is necessary for development of 7 Brew to proceed. The Commission asked where 7 Brew would be located, and Mr. Somerville noted the location on the map, which is the northeast corner of the mall property. The Commission sought clarification regarding the scope of their review and staff replied that the Commission has prevue over the conceptual development plan for the mall property; however, any detailed plans for the access would be reviewed by the Development Review Team. The Commission asked if the new driveway needs to line up with another access across Stoneman Road. Staff replied that it did not, and that the Engineering Department is actively reviewing the access location. There was no public input. Service People Integrity Responsibility Innovation Teamwork Page 490 of 1214 The Honorable Mayor and City Council Members Page 2 Staff detailed the staff report explaining the need to amend the conceptual development plan due to the substantial change of adding a new access point on Stoneman Road. Staff noted the additional modifications to the conceptual plan to accommodate the 7 Brews location and the parking lot modifications for Marshall's and Fresenius Medical Care. Staff noted that site changes are reviewed by the Development Review Team to ensure they are compliant with all city codes. Staff stated the PUD amendment is also seeking to add under -canopy signage as an allowed sign type, noting the under canopy signs would be limited to 6 square feet in area and requiring 8' of clearance below the signs. Staff stated that no public comment had been received. The Commission discussed the request noting that the signage and access make sense, and the access should line up with other driveway across Stoneman Road to try to reduce conflict points along Stoneman. Recommendation By a vote of 6-0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. INTRODUCTION The applicant is requesting to amend the existing Kennedy Mall Planned Unit Development (PUD) located at 555 John F Kennedy Road to modify the conceptual development plan and to allow for under canopy signage. BACKGROUND The subject Planned Unit Development is located on Dubuque's West End. The Kennedy Mall property is 52.6 acres and has approximately 50 tenants, large and small. It has frontage on five streets: John F Kennedy Road, Wacker Drive, Dodge Street/US 20, Century Drive, and Stoneman Road. It is surrounded by commercial development. The Kennedy Mall zoning district was established in 1966, and the mall was opened in 1968. The PUD has been amended several times over the decades, most recently in 2024. That amendment modified the following: • additional signage, • reduced parking requirements, and • increased ground floor leasable area The PUD Conceptual Development Plan on the following page. Red: Substantial Alteration; Other Recent Alterations DISCUSSION Conceptual Development Plan The applicant is requesting to amend the current conceptual development plan to incorporate recent alterations to the site and to add a new access drive along Stoneman Page 504 of 1214 Memo to Zoning Advisory Commission — Kennedy Mall PUD Amendment Page 4 Road. The new access drive has been reviewed by Engineering as part of site plan review, and it has been determined to be compliant with all City standards. The new access drive onto Stoneman Road is considered a substantial change to the conceptual development plan and therefore an amendment is required before approval of a site plan may be granted. The new access drive is expected to be beneficial to traffic flow in the area since it would allow for a more convenient entrance/exit for some patrons, depending on destination, of the mall than those entrances located further south along JFK or further west on Stoneman Road. Signage The current Mall ordinance sign section does not list under -canopy signs as a permitted sign and therefore, the signage portion of the proposed amendment would add under - canopy signage' to the list of permitted sign types within the Kennedy Mall PUD district. Under -canopy signs are limited to one per frontage for each tenant, six (6) square feet in area, and require eight (8) feet of clearance below the sign. Development Review All new developments, including new signage, within the PUD require permits through Inspection and Construction Services. Additionally, developments that modify the site or any new construction would require site plan review and approval through the City's Development Review Team (DRT). The DRT is comprised of multiple City departments including Engineering, Planning, Water Distribution, Fire, Police, Housing & Community Development, and Leisure Services. Site plans are reviewed by all relevant departments regarding street improvements, site access, parking, grading, screening, paving, park land, stormwater management, water connection, sanitary sewer connection, fire safety, and more. RECOMMENDATION City staff recommends that the Zoning Advisory Commission review the enclosed materials and make a recommendation to the City Council regarding the proposal to Amend the conceptual development plan and signage regulations for the Kennedy Mall Planned Unit Development. Lighting: Signs may be illuminated only by means of indirect lighting whereby all light sources and devices are shielded from view by opaque or translucent materials, or internally illuminated by means of a light source completely enclosed by the sign panel. 12. Motion: No signs may include any device or means, mechanical, electrical or natural, which shall cause motion of the sign panel or any part thereof. No flashing lights or changing colors shall be allowed. Message center signs are exempt from this provision. E. Previous Conceptual Plans That all previously approved conceptual development plans are hereby rescinded and that the attached conceptual plan, Exhibit A, shall hereinafter regulate the Kennedy Mall Planned Unit Development District.
