ZONING ADVISORY COMMISSION
REGULAR SESSION
6:00 p.m.
Wednesday, December 3, 2025
City Council Chambers, Historic Federal Building
Commissioners Present: Chairperson Matt Mulligan; Commission Members Martha
Christ, Troy Froistad, Carrie Lohrmann, Pat Norton, Rich Russell, and Teri Zuccaro
(virtually).
Commissioners Excused: None.
Commissioners Unexcused: None.
Staff Members Present: Shena Moon, Travis Schrobilgen, and Jason Duba
CALL TO ORDER: The meeting was called to order by Chairperson Mulligan at 6:00
p.m.
MINUTES: Motion by Norton, seconded by Christ, to approve the minutes of the
November 5, 2025 meeting. Motion carried by the following vote: Aye — Christ, Froistad,
Lohrmann, Norton, Russell, Zuccaro, and Mulligan; Nay — none.
ACTION ITEM/FINAL PLAT: Application of Timothy and Peggy Stockel to approve the
Final Plat of Clay Hill Road.
Ron Breitbach, 16543 Herod Lane, spoke on behalf of the application. He stated that he
is planning to purchase seven acres from the Stockel's at the north end of his property
because his driving range customers have been hitting golf balls past the property line,
so he would like to get the golf balls on his property.
Staff Member Moon detailed the staff report noting that the submitted Plat of Survey of
Stockel Acres is a Simple Subdivision which will subdivide off the southern seven acres
and convey them to Mr. Breitbach. She stated that Lot 2 will not have street frontage, so
that requirement needs to be waived. She explained that an access easement has been
included on the plat. Mr. Breitbach noted that the access is to the west from Herod Lane.
Commissioners had no questions or concerns.
Motion by Christ, seconded by Russell, to approve the Final Plat of Stockel Acres subject
to waiving the requirement for street frontage for Lot 2. Motion carried by the following
vote: Aye — Christ, Froistad, Lohrmann, Norton, Russell, Zuccaro, and Mulligan; Nay —
none.

PUBLIC HEARING/REZONING: Application of Jacob Kohlhaas to rezone property
located at 514 & 518 East 22nd Street.
Jacob Kohlhaas, 1125 Richards Road, spoke on behalf of the application. He stated that
he and his wife own these buildings. He noted that 518 East 22nd is a tri-plex and 514
East 22nd is duplex, and they are considering finishing the attic into a studio apartment.
He noted that both properties have a parking lot in the back.
There was no public input.
Staff Member Duba detailed the staff report. He described the characteristics of the
subject properties and the surrounding neighborhood. He explained the rationale for the
rezoning being to bring 518 East 22nd into conformance and providing the opportunity to
add a unit to 514 East 22nd. He said that the addition of one unit should have a negligible
impact on surrounding properties. He referred to several recommendations from the
Comprehensive Plan that support this change.
Commissioners had no questions or comments.
Motion by Christ, seconded by Norton, to recommend approval of the rezoning from R-
2A Alternate Two -Family Residential to R-3 Moderate Density Multi -Family Residential
as submitted. Motion carried by the following vote: Aye — Christ, Froistad, Lohrmann,
Norton, Russell, Zuccaro, and Mulligan; Nay — none.
Commissioner Norton recused himself from the hearing.
PUBLIC HEARING/REZONING: Application of Sean Shriver to rezone property located
at 2900 Block of Davenport Street.
Korrin and Sean Schriver, 2884 Davenport Street, spoke on behalf of their application.
They said they live adjacent to the two lots they own and are requesting to rezone. They
said they are seeking to lift the condition about number and type of goats allowed, noting
they have successfully owned goats and used them for mowing. They plan to convert the
baseball diamonds into grazing pasture. They stated they are no longer planning to build
a home on this property. They noted they are engaged in an agricultural research study
with the Natural Resources Conservation Service (NRCS). They said they would like to
have one pig. They said they went to all the neighbors who received public notification
about the request and talked with approximately twenty-six of them, and everyone was
either supportive or indifferent to the proposal.
There was no public input.
Staff Member Schrobilgen detailed the staff report. He stated the request is to rezone
these properties from R-1 and AG with conditions to AG with no conditions. He noted that
the current condition places some limits on the animals that can be raised there. He said

the Commission has the ability to place conditions. He said the property has received site
plan review. He said the change in zoning should cause little impact to neighbors. He
referred to recommendations in the Comprehensive Plan that support this request. He
noted that there are some site constraints, such as access and topography, that make
this site difficult to develop. He stated that no public input has been received.
Commissioner Lohrmann asked if the applicants are requesting both properties to be
zoned AG or to change the conditions. Staff Member Schrobilgen replied they are seeking
to rezone to AG with no conditions, but the Commission could discuss any conditions they
may deem appropriate. She asked if staff recommended any conditions, and staff replied
no.
Chairperson Mulligan suggested they vote to remove all conditions.
Motion by Mulligan, seconded by Froistad, to recommend approval of the rezoning from
AGc Agriculture with conditions and R-1 Single Family Residential to AG Agriculture
zoning district. Motion carried by the following vote: Aye — Christ, Froistad, Lohrmann,
Russell, Zuccaro, and Mulligan; Nay — none.
Commissioner Norton returned to the meeting.

ADJOURNMENT: Motion by Mulligan, seconded by Christ to adjourn the December 3,
