Van Milligen, City Manager SUBJECT: Acceptance of Grants of Easement for Sanitary Sewer Utility across Luedtke and McElmeel Properties Along Lake Eleanor Road DATE: February 23, 2026 City Engineer Gus Psihoyos is recommending City Council acceptance of the Grants of Easement for Sanitary Sewer Utility from Richard and Mary Luedtke and from Mary Jo McElmeel through the adoption of the enclosed resolution. In 1998, the City of Dubuque designed and constructed the Granger Creek Sanitary Sewer project to serve the Technology Park area in Dubuque. Recently it has come to the Engineering Departments attention that two property owners, Luedtke and McEneel, had not signed their grant of easement documents and were therefore never recorded and formalized. The City met with the owners and they agreed to formalize the easements by signing current grants of easement documents. Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer SUBJECT: Acceptance of Grants of Easement for Sanitary Sewer Utility across Luedtke and McElmeel Properties Along Lake Eleanor Road DATE: February 20, 2026 INTRODUCTION The purpose of this memorandum is to seek acceptance of grants of easement for sanitary sewer utility from Richard and Mary Luedtke and from Mary Jo McElmeel for the existing Granger Creek Sanitary Sewer under their respective properties on Lake Eleanor Road. DISCUSSION In 1998, the City of Dubuque designed and constructed the Granger Creek Sanitary Sewer project to serve the Technology Park area in Dubuque. As part of the project, sanitary sewer easements agreements were made with each of the affected property owners along the project corridor. Recently it has come to the Engineering Departments attention that two property owners, Luedtke and McEneel, had not signed their grant of easement documents and were therefore never recorded and formalized. The City met with the owners and they agreed to formalize the easements by signing current grants of easement documents. The attached grants of easement show the location of the sanitary sewer easement across the respective private properties. The property owners have executed the attached grants of easement. RECOMMENDATION I recommend accepting the Grants of Easement for Sanitary Sewer Utility through, under and parts of Lot 1 of "Meta Luedtke Place" in Section 12 and Section 13, Table Mound Township, Dubuque County, Iowa and parts of Lot 1 of the Subdivision of Lot 2 of Lot 3 of the Southeast Quarter of Section 12, Township 88 North, Range 2 East of the 5th P.M. in Dubuque County, Iowa, as shown on the attached exhibits included in the grants of easement. IN DUBUQUE COUNTY, IOWA Whereas, Richard C. Luedtke, Trustee of the Richard C. Luedtke Trust dated September 24, 2025, and Mary B. Luedtke, Trustee of the Mary B. Luedtke Trust dated September 24, 2025, have executed a Grant of Easement for Sanitary Sewer Utility through, under and across Part of Lot 1 of "Meta Luedtke Place" in Section 12 and Section 13, Table Mound Township, Dubuque County, Iowa; and Whereas, Mary Jo McElmeel, Trustee of the Mary Jo McElmeel Trust dated April 24, 2024, has executed a Grant of Easement for Sanitary Sewer Utility through, under and across Part of Lot 1 of the Subdivision of Lot 2 of Lot 3 of the Southeast Quarter of Section 12, Township 88 North, Range 2 East of the 5th P.M. in Dubuque County, Iowa. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of, accepts and consents to the Grants of Easement for Sanitary Sewer Utility through, under and across Part of Lot 1 of "Meta Luedtke Place" in Section 12 and Section 13, Table Mound Township, Dubuque County, Iowa from Richard C. Luedtke, Trustee of the Richard C. Luedtke Trust dated September 24, 2025, and Mary B. Luedtke, Trustee of the Mary B.
