INTRODUCTION
This memo provides information regarding the platting and acceptance of right of way
(fee ownership) along Portions of West 8t" Street, West 7t" Street, Locust Street, and
Bluff Street as Part of the Dubuque Museum of Art and Cottingham and Butler Daycare
Projects.
BACKGROUND
DUMA and CBDC have coordinated the redevelopment of said city block property. The
improvements include the recently constructed Cottingham and Butler day care facility
located in the northeast quadrant of the block and the proposed Dubuque Museum of
Art building and campus improvements in the remainder of the block area.
DISCUSSION
In this area of the original City of Dubuque the adjacent lot owners own to the centerline
of the street and the City holds only a right of way easement. The City and Dubuque
Museum of Art (DUMA) and Cottingham and Butler Day Care (CBDC) have agreed in
writing that DUMA and CBDC will dedicate, in fee, their respective portion of West 8th
Street, West 7t" Street, Locust Street, and Bluff Street, along their property frontages to
the City and then the City will vacate certain portions of said street right of ways back to
DUMA and CBDC to accommodate their proposed site improvements. The City and
DUMA and CBDC have agreed to exchange the proposed vacate areas for fee title to
the street areas that it currently holds in easements.
Buesing and Associates, Inc. has prepared a plat of survey for right of way dedication
(also known as an acquisition plat) to provide the right of way areas. The areas being
platted will be dedicated to the public for street right of way and public utility purposes.
This is the first step in the process for the fee title land conveyance and vacation. A
public hearing for the street vacation will follow.

RECOMMENDATION
I recommend that the City Council approve the Plat of Survey for Right of Way
Dedication (Acquisition Plat) of City Lots 623A, 623B, 648A, 64813, and Lot 1A of
Woodward Place, in the City Of Dubuque, Iowa, by the adoption of the attached
resolution.
ACTION TO BE TAKEN
I respectfully request approval of the Plat of Survey for Right of Way Dedication
(Acquisition Plat) of City Lots 623A, 623B, 648A, 64813, and Lot 1A of Woodward Place,

Whereas, there has been presented to the City Council of the City of
Dubuque, Iowa, a Plat of Survey for Right of Way Dedication (Acquisition Plat)
dated February 18, 2026 prepared by Buesing and Associates, Inc. describing City
Lots 623A, 623B, 648A, 648B, and Lot 1A of Woodward Place, in the City Of
Dubuque, Iowa; and
Whereas, said plat conforms to the laws and statutes pertaining thereto;
and
Whereas, upon said plat appears City Lot 623A and 623B, which CBDC,
LLC, by said plat has dedicated to the City of Dubuque forever for street right of
way and public utility purposes; and
Whereas, upon said plat appears City Lot 648A, 648B, and Lot 1A of
Woodward Place, Dubuque Museum of Art, by said plat has dedicated to the City
of Dubuque forever for street right of way and public utility purposes; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the plat dated February 18, 2026, prepared by Buesing and
Associates, Inc., relative to the real estate hereinabove described be and the same
is hereby approved, and the Mayor and City Clerk be and they are hereby
authorized and directed to execute said plat and on behalf of the City of Dubuque,
Iowa.
Section 2. That the dedication of City Lots 623A, 623B, 648A, 648B, and
Lot 1A of Woodward Place, in the City Of Dubuque, Iowa, for street right of way
and public utility purposes, as it appears on said Plat of Survey for Right of Way
