City Engineer Gus Psihoyos is recommending City Council approval of a resolution
setting a public hearing for March 16, 2026 for the disposal of City Owned Property lying
north of Cedar Crest Court in Dubuque, Iowa to Jeremy L. and Andrea E. Biedermann.
This property was deeded to the City along with the stormwater detention basin lot by
the developer of Cedar Ridge Farm Place No. 15.
The agreements include the following provisions:
- Purchase price of $1 for each of the properties
- Each of the three property owners are responsible for one-third of the total
surveying, public notice, and recordation costs
- Subject properties from City cannot be developed in the future unless combined
with the current private properties
- The City has reserved a 100' sanitary sewer and recreational trail easement near
the railroad and Catfish Creek over the properties to be sold to the private
property owners for possible future improvements

INTRODUCTION
This memorandum requests City Council approval of a resolution setting a public hearing
for the disposal of City Owned Property lying north of Cedar Crest Court in Dubuque Iowa.
BACKGROUND
The City of Dubuque is the current owner of the real property described as Lots 1, 2, 3
and 4 of Cedar Ridge Farm Place No. 21, in the City of Dubuque, Iowa. This property
was deeded to the City along with the stormwater detention basin lot by the developer of
Cedar Ridge Farm Place No. 15.
Recently, the City was contacted by the adjacent property owners on Cedar Crest Court
with inquiries about acquiring portions of the subject property for a proposed residence
and possible expansions of commercial businesses in the future.
DISCUSSION
The City has drafted and executed agreements with three adjacent property owners which
are JJR Investments LLC, BNZ Properties, LLC, and Jeremy and Andrea Biedermann.
Red Squirrell Development, LLC and BM Properties LLC were contacted by the City and
they have waived their right to purchase their respective portions. BNZ Properties, LLC
and Jeremy and Andrea Biedermann have agreed to split the Red Squirrell Development,
LLC and BM Properties LLC portion equally.
The agreements include the following provisions:
- Purchase price of $1 for each of the properties
- Each of the three property owners are responsible for one-third of the total
surveying, public notice, and recordation costs
- Subject properties from City cannot be developed in the future unless combined
with the current private properties
- The City has reserved a 100' sanitary sewer and recreational trail easement near
the railroad and Catfish Creek over the properties to be sold to the private property
owners for possible future improvements

Per Resolution No. 159-25 the City Council approved the Final Plat of Cedar Ridge Farm
Place No. 21 dividing the subject City property to facilitate the sale of the lots/areas per
the agreements with the three private property owners.
The currently proposed disposition is described below and as shown in the attached
property owner agreements:
- Lot 4 of Cedar Ridge Farm Place No. 21 to Jeremy L. and Andrea E. Biedermann
The conveyance of the subject property to Biedermann was previously delayed due to an
ongoing floodplain permitting issue between the property owner, the City, and the Iowa
DNR. The City Attorney's office has revised the Biedermann purchase agreement to
include contingencies related to this issue and the property owner and City Manager have
executed the revised agreement.
BUDGETIMPACT
None
RECOMMENDATION
I respectfully request that the properties be conveyed to Jeremy L. and Andrea E.
Biedermann, as indicated above, and that a public hearing be set for the disposition of
the City's interest in the subject areas on March16, 2026, through adoption of the
enclosed resolution.

RESOLUTION OF INTENT TO DISPOSE OF AN INTEREST IN CITY OF DUBUQUE REAL
ESTATE LOCATED NORTH OF CEDAR CREST COURT PURSUANT TO AN AGREEMENT
BETWEEN THE CITY OF DUBUQUE AND JEREMY L. AND ANDREA E. BIEDERMANN
Whereas, the City of Dubuque, Iowa (City) is the owner of the real property described as
Lots 1, 2, 3 and 4 of Cedar Ridge Farm Place No. 21, in the City of Dubuque, Iowa; and
Whereas, City and Jeremy L. and Andrea E. Biedermann have entered into an Agreement
for the sale of City property described as Lot 4 of Cedar Ridge Farm Place No. 21 lying north
of and adjacent to the Biedermann's property off of Duggan Drive to Jeremy L. and Andrea E.
Biedermann; and
Whereas, per Resolution No. 159-25 the City Council approved the Final Plat of Cedar Ridge
Farm Place No. 21 dividing City land to facilitate the sale of the properties per the Jeremy L.
and Andrea E. Biedermann agreement; and
Whereas, the Code of Iowa requires that the City Clerk publish notice of the proposal and of
the time and place of the meeting at which the City Council proposes to take action thereon
and at which meeting the City Council shall receive oral and/or written objections from any
resident or property owner of said City to such proposed action.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. That the City of Dubuque intends to dispose of its interest in Lot 4 of Cedar
Ridge Farm Place No. 21, in the City of Dubuque, Iowa by quit claim deed to Jeremy L. and
Andrea E. Biedermann pursuant to the executed Agreement attached hereto.
Section 2. The City Clerk is hereby authorized and directed to cause a notice to be published
as prescribed by Iowa Code Section 364.7 of a public hearing on the City's intent to dispose of
the foregoing -described Property, to be held on the 16h day of March, 2026, at 6:30 p.m. in the
City Council Chambers at the Historic Federal Building, 350 W. 6th Street, Dubuque, Iowa.
Section 3. That a public hearing, and/or by virtual means, on the intent to dispose of Lot 4
of Cedar Ridge Farm Place No. 21, in the City of Dubuque, Iowa, per Sections 1 above is
hereby set for the 16th day of March, 2026, at the Historic Federal Building, 350 W. 6th Street,
Dubuque, Iowa, beginning at 6:30 p.m., and the City Clerk be and is hereby authorized and
directed to cause a notice of public hearing on the intent to vacate said real estate to be
published in the manner as prescribed by law.

AGREEMENT
BY AND BETWEEN
JEREMY L. AND ANDREA E. BIEDERMANN
AND
THE CITY OF DUBUQUE, IOWA
This Agreement, dated for reference purposes the 9 day of
2026, is made and executed by and between the City of Dubuque,
to a. (Ci ), a municipal corporation, and Jeremy L. and Andrea E. Biedermann
( IEDERMANN).
WHEREAS, BIEDERMANN is the owner of property located on Duggan Drive and
legally described as LOT 2A BLOCK 3 OF KNOB HILL GROVE (the BIEDERMANN
Property); and
WHEREAS, City is the owner of the property legally described as LOT L CEDAR
RIDGE FARM PLACE NO. 15 (the City Property); and
WHEREAS, adjacent property owners JJRI, BNZ Properties, LLC, and
BIEDERMANN are requesting the sale of a portion of the City Property as generally
shown on the attached Exhibit A; and
WHEREAS, the sale will require the subdivision of the City Property; and
WHEREAS, the City Property is adjacent to real estate owned by BIEDERMANN
on Duggan Drive: and
WHEREAS, BIEDERMANN and City desire to enter into an agreement with
respect to the proposed sale of a portion of City Property, which is approximately 1.66
acres in size, as set forth herein.
NOW, THEREFORE, IT IS AGREED BETWEEN THE PARTIES HERETO AS
FOLLOWS:
SECTION 1. CITY RESPONSIBILITIES.
1.1 Subject to all of the conditions set forth herein, City will sell approximately 1.66
acres of the City Property, as generally shown in Exhibit A, to BIEDERMANN for $1.00.
1.2 City will procure three (3) quotes from local land surveying firms and will select the
lowest responsible quote for the surveying services (Selected Surveyor) required to
subdivide the City Property into the four lots, as generally shown on Exhibit A reserving
easements as necessary.
1.3 The City will instruct the Selected Surveyor to ensure that the extension of the lot
line running from the southwest to the northeast, between the property to be titled in JJRI

and the property to be titled in BNZ Properties, LLC, is straight and true with no angular
deviation.
1.4 The initial four-way lot split as shown in Exhibit A is considered a Minor Subdivision
and each lot will be labeled as non -buildable due to the fact that the lots do not have
street frontage. The Minor Subdivision Plat/waiver request will require review and
approval by:
a. the Zoning Advisory Commission (one meeting)
b. the City Council (one meeting).
1.5 The other private property owners shown on Exhibit A have asked to purchase the
other lots shown on Exhibit A. After the Minor Subdivision surveying is complete and the
plat is recorded with necessary easements, City staff will work with the other private
property owners and/or their representatives to prepare quit claim deeds for the other
lots. A public hearing to dispose of the City's interest in the lot is required.
1.6 Upon receipt of the Minor Subdivision plat for the lots proposed to be sold, the
requests for sale to the BIEDERMANN and the other private property owners will betaken
to the City Council to be set for a public hearing and formal approval of the sale of the
City lots.
1.7 After the public hearing and approval of the sale of the lots by the City Council and
receipt of the publication and filing fees, the City will execute quit claims deeds to
BIEDERMANN and the other private property owners and will record the deeds.
SECTION 2. BIEDERMANN RESPONSIBILITIES.
2.1 BIEDERMANN will be responsible for one-third of the total cost of the surveying
services required to subdivide the City lot into the four (4) lots as generally shown on
Exhibit A. Pursuant to Section 1.2, each of the three (3) private property owners shown
on Exhibit A must sign a contract with the selected surveying firm and pay their portion of
the surveying costs directly to the firm. The Minor Subdivision plat will include the
easement reservations referred to in Section 1.2.
2.2 BIEDERMANN will purchase approximately 1.66 acres of the City Property, as
generally shown in Exhibit A, from the City for One Dollar ($1.00).
2.3 BIEDERMANN will also be responsible for one-third of the total cost for City staff
to process this Agreement and all filing, publication, and recording fees associated with
the request.
2.4 BIEDERMANN will also be responsible for the costs of surveying to consolidate its
existing lot with the purchased lot if and when future development or redevelopment
activities on the purchased lot are planned. The lot consolidation surveying is required to
remove the non -buildable status put in place by the Minor Subdivision described above.

2.5 BIEDERMANN is responsible for addressing all Army Corps of Engineers and Iowa
Department of Natural Resources floodplain compliance issues to the satisfaction of the
City. All compliance issues must be resolved by April 30, 2026 unless another date is
agreed upon by the parties, in writing.
SECTION 3. NOTICES.
All notices and correspondence related to this Agreement must be sent to the following:

SECTION 4. DEFAULT.
4.1 If, through any cause, BIEDERMANN fails to fulfill in a timely and proper manner its
obligations under this Agreement, City shall thereupon have the right to terminate this
Agreement by giving written notice to BIEDERMANN of such termination and specifying
the effective date thereof which shall be not less than thirty (30) days before the effective
date of such termination. If BIEDERMANN fails to cure its default to the satisfaction of
City in City's sole discretion within such thirty -day period, this Agreement shall be deemed
terminated at the end of such thirty -day period without further action of either party and
City shall have the right to re-enter and take possession of City Property and to terminate
and revest in City pursuant to the provisions of this Section subject only to any rights in
any holder of mortgages on the Property.
4.2 In the event of default by BIEDERMANN, City reserves the right to seek specific
performance in Iowa District Court for Dubuque County.
SECTION 5. MISCELLANEOUS.
5.1 This Agreement may not be assigned without the prior written consent of the City
which written approval will not be unreasonably withheld.
5.2 This Agreement represents the entire Agreement between the parties. There are
no verbal additions to this Agreement, and endments, additions or changes to this
Agreement must be in writing and agreed tQoth parties.

5.3 All covenants, conditions, and provisions of this Agreement will inure to the benefit
of and be binding upon the parties hereto and their respective successors, heirs and
assigns.
5.4 This Agreement is governed by the laws of the state of Iowa and venue for any
action arising from or related to this Agreement will be in the Iowa District Court for
Dubuque County, Iowa.
5.5 If any term of this Agreement is found to be void or invalid, such invalidity will not
affect the remaining terms of this Agreement, which will continue in full force and effect.

A RESOLUTION APPROVING THE FINAL PLAT CEDAR RIDGE FARM
NO. 21, IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Final Plat Cedar Ridge Farm
No. 21 in the City of Dubuque, Iowa; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission
and its approval has been endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that
it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-14(B) of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived regarding required lot frontage for Lot
1, Lot 2, Lot 3, and Lot 4 of Cedar Ridge Farm No. 21.
Section 2. That the Final Plat Cedar Ridge Farm No. 21, in the City of Dubuque,
