Eagle Point Ferry Co et al asking the city to donate to said Ferry Co the sum of 5000 to liquidate
their debt or if the city of Dubuque agrees to assume the debts of and continue in the future to
operate the ferry the company tenders to the city of Dubuque all its ferry property and franchises
Ald doerfler moved action upon the petition be deferred until the arrival of some of the Ferry Co
stockholders carried
Charles Reilly et al praying that the grade of West Seventeenth Street at the intersection of Clark
Street be fixed to coincide with the grade of clark St at said intersection Referred to teh committee
on streets
C W Horr asking that Lake street between John son ave and Humboldt street be graded or if
said street is not graded that the taxes on his property abutting be cancelled referred to the
committee on streets and city engineer
Duggan Sullivan and Kinsella praying that licenses amounting to 12.00 paid by them for the
permission of canvassing be credited on their taxes for year 1886 referred to the committee

Pfiffner and Kriebs asking that a judgement obtained by them against the city amounting to

from tax sale n 60 ft of lot 826 in mcDaniels sub div as petitioner now holds and wishes to turn
over to the city teh tax sale certificate He further asks that he be allowed interest on said amount
referred to the city attorney
Wm Hintrager praying that the city pay him as amount of tax sale certificate penalty interest and
subsequent taxes necessary to redeem sub city lot 598 lot 8 sub city lot 598 part lot 9 and sub city
lot 694 lot 3 assessed to Michael Reynolds estate the sum of 32.74 instead of 21.01 the amount
allowed by the council for said redemption on May 3rd 1886 Referred to the city attorney
Action being called on the petition of the Eagle point ferry co Ald Doerfler moved the rules be
suspended and any of the petitioners present granted permission to address the council Motion
carried
Messrs Geo Fengler Henry C Deckert Jos Rhomberg et al addressed the council regarding the
petition
Ald Parker moved the petition be referred to the committee of the whole carried
Mr Fengler presented an invitation to the council to visit at the ferry companys expense the property
owned by them
On motion of Ald Doerfler the invitation was accepted
Ald Crawford moved that when teh council adjourns it does so to meet again on Wednesday February
16th 1887 at 7:30 oclock pm carried
Wm J Burns and Co claiming damages to the amount of 100.00 caused by the gutters abutting
their property corner Jones and Locust streets overflowing filling their cellar and destroying a
large quantity of produce stored within the same On motion referred to the street committee
chicago Burlington and Northern Ry Co praying that the city cause the Pontoon Bridge Co to
so construct the approach to its bridge on the outer levee that cars of said railway company
may pass under the high level bridge as is specified by ordinance
Ald Parker moved the rules be suspended and mr B J ONeill president of the pontoon Bridge Co
be heard carried
Messrs ONeill Rhomberg and Longueville addressed the council in regard to the western approach
of the bridge

Ald Doerfler moved the petition be referred to the committee of the whole and that the committee
meet next Thursday at 2 pm and visit the bridge carried
the Ternes boot and Shoe Manufacturing Co asking that the taxes of their corporation be remitted
for a period of five years
Ald Doerfler moved that the prayer of the petitioners be granted
Ald Hayden offered as an amendment that the petition be referred to the committee of the whole
carried
Mrs Daniel Breen asking that a committee investigate and compensate her for damages casued
by her cellar being overflowed by a defective sewer in the vicinity of her property on the north side
of Jones Street between West Main and Locust Streets referred to the street committee
W W Perleth asking that on account of damages caused to his property by the extension of
West Eighth street the council cancel the special tax levied against the property to pay for the
improvement of West Eighth Street or to construct a retaining wall along his lot to protect it from
further loss Referred to the committee on streets and city engineer
M M Walker et al asking that Second Street be extended from the inner levee along the north side
of the ice harbor to the outer levee to form a suitable and most economical approach to the high
bridge
Ald Crawford moved the city engineer make a survey and plat of said extension and an estimate
cost of the improvement and that the petition be referred to the street committee and city engineer
carried

Street commissioner McMaster reported having expended improving and repairing streets
during the month of January 1887 the sum of 432.25 Ordered paid and report filed
auditor Reilly reported 858.05 due city officers for salaries and 1075 due members of the fire
department for services Ordered filed and warrants drawn to pay salaries
marshall Moore reported having paid to the treasurer 50 cents fees and 12.50 collected for
impounding also 1208.85 due members of the polcie force for salaries that 37 arrests had been

Commercial streets from washington street east to outer levee estimating the cost of filling to
grade and entire width of said street to be 1650.30 referred to the street committee
The same presented a profile and plat of the proposed extension of 4th street from west line
of white street to outer levee estimating the cost of said extension to be 12162.30 Referred to
the street committee
The same submitted a communication stating that the special tax levied against lot 3 of sublot
of mineral lot 79 erroneous as part of said assessment should be levied against lot 2 of sublot
4 of mineral lot 79 and asked that said assessment be cancelled and the following corrected one
adopted after again properly notifying the parties to wit

That to pay for guttering and macadamizing West Eight street from Wilson Avenue to Roberts
Avenue by M lavin contractor in front of and adjoining the same a special tax be and is hereby

Ald Crawford moved the resolution be referrd to the committee on streets and the recorder
instructed to notify the owners of abutting property to appear at the next regular session and
show cause if any they have why said assessment should not be levied carried
the city engineer presented a communication stating he awarded to mr James Crawford the
contract to construct a plank sidewalk on West Locust street and taht he laid the sidewalk
properly the total expense being 61.22 of which 58.14 is assessed to abutting property Ordered
approved and filed
The city engineer presented a communication stating that the Minnesota and Northwestern Ry
tracks crossing 9th street were nine and ten inches above the established grade which now
is at high water mark of 1880 he asked that the grade of said street be fixed improvement now
in progress may be completed on motion referred to the street committee

The city engineer presented an estimate cost of opening and making passable valley street
from southern avenue to Wilde Street amounting to 350.00 on motion referred to the street
committee
the city engineer presented a communication stating that the special assessment levied against
lots 44 and 45 Farleys subdivision for improvement of Julien Avenue were not correct as 1.66
was erroneously assessed against lot 45 and should be added to lot 44 and he asked that the
assessment be cancelled and a corrected one levied on motion received and action deferred
The city engineer presented a plat of the proposed improvement of west eighth street from Hill
to Air Hill Street together with a cost of teh same which he estimated to be 2343 referred to teh
street committee

Ald Parker moved that the preparing of a blank form to be used in taking assessments be
referred to the committee on ordinance and city attorney carried
Ald Doerfler offered the following resolution

whereas it is deemed expedient to open Lake Street to public travel such opening being a great
public benefit and demanded by a large number of citizens and tax payers
Therefore be it resolved by the city council of the city of Dubuque that the award of damages by the
jury for the opening of said lake street now on file in the city recorders office be accepted and adopted
by this council
Resolved further that the city attorney be instructed to examine title and procure deeds from the
owners of the land and that upon the acceptance of said deeds by the council warrants be drawn
in favor of such owners for the payment of the land
the question of the street railway company agreeing to pay 200 toward the damages awarded on
account of opening said Lake street ald Hollnagel moved the rules be suspended and Mr
Rhomberg permitted to address the council motion carried
Mr Rhomberg stated if Mr Linehan superintendent of the street railway company had promised
200 to defray the expenses on part of the city that he would guarantee to the city the sum of 400
Ald Downer moved action upon the resolution be postponed until the next meeting of the council
carried
Ald Crawford moved that a special committee consisting of alds Hollnagel Doerfler and Trexler
interview Mr A Heeb and others of property abutting on the proposed extension and negotiate
with them as to how they will accept from the city the amount of damages allowed carried
Ald Doerfler offered the following resolution which upon his motion was adopted
Be it resolved by the city council of the city of Dubuque that the recorder be instructed to furnish
the council with a list of the manufacturing establishments which have been exempt from taxation
for the last ten years and the dates when the different assessments of the parties will expire
Ald Crawford presented and read a resolution laid over at the last session of January 3rd 1887
providing for the levying of a special assessment to pay for the improvement of West Eighth
street from Wilson Avenue to roberts avenue by M lavin contractor no objections being raised
by the owners of abutting property on motion the resolution was adopted

Ald Crawford also presented and read a resolution laid over at the session of January 3rd 1887
providing for the levying of a special assessment to pay for the improvement of Grove Street
from S line Lot 771 McDaniels subdivision to 11th street by michael McCarten contractor no
objections being raised by the owners of abutting property on motion the resolution was adopted
Ald Crawford offered the following resolution
Resolved that the city taxes of mrs margaret Rawlings for the year 1886 be cancelled on motion
adopted
Ald Crawford moved that the city attorney be instructed to draft an ordinance authorizing the
appointment by the city council of one or more assistant city assessors carried
on motion adjourned

The chairman stated this was an adjourned regular session to hear the reports of several committees
among whom were the committee of the whole and the special committee on the extension of
Lake street
Ald Downer moved that the petition presented to the recorder at this session be read carried
Alois Nipp et al praying that L Hartman be granted permission to raise his frame house four
feet situated in block 442 city On motion of ald Trexler the petition was referred to the fire
committee with power
Iowa Coffin co owners of lots 182 183 184 185 186 217 218 219 220 and 221 in East dubuque
add asking that the alley separating said lots be vacated On motion of ald Downer referred
to the street committee

following report
to the honorable mayor and city council the committee that was appointed to confer with the
property owners about the extension of Lake street would respectfully report as follows

Further time was granted to the committee to prepare a resolution setting forth the terms and
conditions upon which Lake street would be opened and damages caused thereby paid
Ald Doerfler moved the city attorney be added to the committee to prepare said resolution
adopted
On motion the committee of the whole was granted further time to report
Ald Doerfler moved when the council adjourn is does so to meet again on Saturday February 19th
1887 at 7:30 oclock pm carried
city attorney mcCarthy submitted the following to the city council at your last meeting you referred
to me the within petition of Wm Hintrager asking that you reconsider your former action and
cancel the redemption from tax sale of sub city lot 598 lot 9 and sub city lot 694 lot 3 the only
question as it seems to me being as to the proper valuation of the property and this a matter
resting largely on the discretion of the city assessor I am of the opinion that petitioner comes too
late to be entitled to any legal relief I must therefore report adversely to the prayer of the petitioner
on motion report adopted
City Attorney mcCarthy submitted the following communication to the city council at the completion
of the improvemetn of Grove street some time since was instructed to procure from mr chas
Hancock 300 and a deed a triangular piece of ground which he agreed to give to the city in
consideration of and upon the completion of the grove street improvement I have demanded the
300 and the deed verbally and in writing

In reply to my demands he told me that no coping is yet upon the walls and that he did not propose
to pay the money or give the deed until coping was put on no coping is required by the contract or
plans and specifications the work I am informed by the city engineer is completed I would
suggest this matter be referred to some committee for action
On motion referred to the committee on streets and city engineer
The city attorney presented and read an ordinance modifying an ordinance entitled an ordinance
authorizing the knapp stout and co company to fill and occupy certain streets in the city of Dubuque
and to define the condition of said privilege to provide for the construction of a sewer on eighth
street and granting certain rights of way for a railroad track referred to the ordinance committee
The matter of paying damages to Mr B J ONeill caused to his property by the opening of third
street extension coming before the council Ald Doerfler moved the rules be suspended and
Mr ONeill permitted to address the council motion carried
Mr ONeill addressed the council
city attorney mcCarthy and the following communication
to the city council
In order to stop any further costs in the case of Pfiffner and Kriebs vs the city I deem it advisable
to increase the tender to sixty dollars and accrued costs the amount necessary to cover the
tender will be 67.60 I respectfully recommend that a warrant be drawn for this amount and that the
same be deposited with the clerk of the district court of Dubuque County approved P W Crawford

Ald Doerfler moved a warrant be drawn in favor of the for 53.70 money advanced to the city
attorney in the case of Pfiffner and Kriebs vs the city carried
Ald Hollnagel presented the following resolution and moved its adoption Resolved that for the
purpose of compensating the owners of property proposed to be taken for the opening and
extension of Lake Street from Jackson Street to Couler Avenue warrants be drawn on the
city treasurer in favor of the parties hereinafter named for the following several amounts to wit

The chairman stated the meeting was called to hear the report of the committee on ordinance
Ald Crawford of the ordinance committee presented and read an ordinance to amend an ordinance entitled An
ordinance to provide for the assessment and collection of taxes in the city of Dubuque and to provide for the appointment
of one or more assistant assessors
Ald Crawford moved his reading be the first reading of the ordinance carried
Ald Crawford moved the rules be suspended and the ordinance

Ald Parker chairman of the committee on harbors to whom was referred the petition of the Dubuque Pontoon Bridge
Co praying the payment of one half of the 25,000 donated to said Bridge Co by the city to aid the construction of a
wagon bridge recommended that 7,500 the part of the first half of said donation remaining unpaid be paid and presented
the following report of the engineer in charge showing the amount expended up to date
cubic yards masonry
lineal feet piling
cubic yards rip rap
feet grillage
eastern approach
pier 7 piling concrete and excavation
total 43980
cubic yards of stone on hand
feet lumber
expenses including superintendent and machinery
iron completed for spans between piers 4 and 5

The city attorney presented the following communication to the city council
An action was brought in the district court of Dubuque county by Grace A Provoost widow of the late B B Provoost
to enjoin the collection of a tax on monies and credits for hte year 1885 amounting to the sum of 110. Mrs Provoost
claims that on the first half of January 1885 she was an actual bonafide resident of the state of Illinois and therefore
not taxable for monies and credits in the city of Dubuque she also claims that the assessment was against the estate
of her husband B B Provoost who was dead some three or four years and whos property was distributed some two
years before the assessment complained of was made Mrs Provoost who is now a resident of Dubuque has agreed
to settle the case with the city upon the following terms she agrees to pay one half of the amount of the tax viz 55.00
and all costs of court I have carefully examined the question and deem it advisable for the city to accept her offer I
therefore recommend that upon payment to the city treasurer of 55.00 and the presentation of the treasurers receipt
therefor and upon presentation to the council of teh county clerks receipt for all costs of court that the city council do
by resolution cancel the other 55.00 for personal property tax on monies and credits for the year 1885 against the
estate of B B Provoost
In addition Mrs Provoost has deposited in the hands of the clerk fo courts 58.80 the amount of tax on real estate for
the year 1885 mrs Provoost has tendered this money at the proper time to the city treasurer but he refused to accept
the same because of mrs provoosts refusal to pay the tax monies and credits as she has always been willing and ready
to pay this money I recommend that the amount tendered 58.80 be accepted in full for real property tax of 1885 as
I do not think the city is entitled to any interest or penalty under such circumstances respectfully submitted J J mcCarthy

Ald Crawford moved the recommendation of the city attorney be adopted carried
Ald J M Byrne offered the following resolutions
Resolved by the city council of Dubuque that whereas we have learned with teh deepest sorrow of the death of Miss
Louie M Hayden the sister of our esteemed associate Mr C D Hayden be it resolved that in his great affliction we
extend to him and those who compose his family our sincere condolence
Resolved that as a lasting memorial of our sympathy and respect for our honored colleague these resolutions be ordered
spread upon the records and a copy of the same presented to the family
On motion adopted unanimously

The chair stated the object of the meeting was to elect one or more assistant city assessors
Ald Crawford offered the following resolution
Resolved that in accordance with the provisions of section 4 of an ordinance relating to the assessment and collection
of taxes adopted February 19th 1887 the city council now proceed to the appointment of two assistant city assessors
said appointment being deemed necessary in order to facilitate the listing and assessment of the real and personal
property in the city for the present year for the purpose of taxation on motion adopted
Ald Ryder moved the council proceed to elect the assistant assessors by ballto carried

Ald Crawford offered the following resolution
Resolved that in order to facilitate the listing for the purpose of assessment for the year 1887 of the real and personal
property in the city of Dubuque subject to taxation said city shall be divided into three districts or subdivisions as
follows
The first district shall include the first ward and all of the second ward west of Main street
the second district shall include the third ward and all of the second ward east of main street and all of the fifth ward
east of clay street and Couler avenue
The third district shall include the fourth ward and all of the fifth ward west of clay street and couler avenue
Resolved further that assessor J J Pfiffner be assigned to the first district Assistant Assessor T O Sullivan to the
second district and Assistant Assessor E J Royce to the Third district and the duty of listing all property in the several
districts be devolved upon them in accordance with their respective assisgnments on motion adopted
