Assistant City Engineer Robert Schiesl is recommending City Council adopt the
attached resolution to accept the Public Improvement Construction Contract and to
authorize the payment of the contract amount of $89,477.53 to Midwest Concrete, Inc.
for the 2025 ADA Sidewalk Curb Ramp Project One.
The 2025 ADA Sidewalk Curb Ramp Project One provided for the replacement of
access curb ramps on Asbury Road from John F. Kennedy Road to Avalon Street in
conjunction with the Public Works Asphalt Overlay program at the following locations:
• Asbury Road and John F. Kennedy Road, three directional ADA sidewalk curb
ramps and one non -directional ADA sidewalk curb ramp.
• Asbury Road and Crissy Street, two directional ADA sidewalk curb ramps.
• Asbury Road and Evergreen Street, two directional ADA sidewalk curb ramps.
• Asbury Road and Woodlawn Street, two directional ADA sidewalk curb ramps.

The enclosed resolution provides for the acceptance of the Public Improvement
Construction Contract for the 2025 ADA Sidewalk Curb Ramp Project One.
BACKGROUND
The 2025 ADA Sidewalk Curb Ramp Project One provided for the replacement of access
curb ramps on Asbury Road from John F. Kennedy Road to Avalon Street in conjunction
with the Public Works Asphalt Overlay program at the following locations:
• Asbury Road and John F. Kennedy Road, three directional ADA sidewalk curb ramps
and one non -directional ADA sidewalk curb ramp.
• Asbury Road and Crissy Street, two directional ADA sidewalk curb ramps.
• Asbury Road and Evergreen Street, two directional ADA sidewalk curb ramps.
• Asbury Road and Woodlawn Street, two directional ADA sidewalk curb ramps.
• Asbury Road and Avalon Street, two directional ADA sidewalk curb ramps.
DISCUSSION
The 2025 ADA Sidewalk Curb Ramp Project One was completed by Midwest Concrete,
Inc. of Peosta, Iowa in the final contract amount of $89,477.53 which is a 9.7% increase
from the original contract amount of $81,602.58. The added costs incurred were a result
of additional work required for traffic control at the intersection of Asbury and JFK, to
modify traffic signal conduits and handholes at the Asbury and JFK intersection, and
groundwater bypass pumping that was required to construct a deep storm sewer intake
structure.
RECOMMENDATION
I recommend that the City Council accept the Public Improvements and authorize the
payment of $89,477.53 to Midwest Concrete, Inc. for the 2025 ADA Sidewalk Curb Ramp
Project One.

RESOLUTION NO. 76-26
ACCEPTING THE 2025 ADA SIDEWALK CURB RAMP PROJECT ONE AND
AUTHORIZING FINAL PAYMENT TO THE CONTRACTOR
WHEREAS, the 2025 ADA Sidewalk Curb Ramp Project One (the Project)
provided for the replacement of access curb ramps on Asbury Road from John F.
Kennedy Road to Avalon Street in conjunction with the 2025 Public Works Asphalt
Overlay program); and
WHEREAS, the Public Improvement Contract for the Project has been completed
by the contractor, Midwest Concrete, Inc. of Peosta, Iowa (Contractor), and the City
Engineer has examined the work and recommends that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $89,477.53; and
WHEREAS, the Contractor has previously been paid $86,793.21, leaving a
retainage balance of $2,684.32; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
SECTION 1. The recommendation of the City Engineer is approved, and the
Project is hereby accepted.
SECTION 2. The Chief Financial Officer is hereby directed to pay the balance of
the retainage of $2,684.32 as provided in Iowa Code Chapter 573, and to pay such
retainage in accordance with the provisions of Iowa Code Chapter 573 or Iowa Chapter
26.13.

The undersigned City Engineer of the City of Dubuque, Iowa, hereby certifies that
he has inspected the 2025 ADA Sidewalk Curb Ramp Project One and work has been
performed in compliance with the terms of the Public Improvement Contract, and that
the total cost of the completed work is $100,642.54.
