Assistant City Engineer Robert Schiesl is recommending City Council adopt the attached
resolution to accept the Public Improvement Construction Contract and to authorize the
payment of the contract amount of $224,599.25 to Midwest Concrete, Inc. for the 2025
ADA Sidewalk Curb Ramp Project Two.
The 2025 ADA Sidewalk Curb Ramp Project Two provided for the replacement of

The enclosed resolution provides for the acceptance of the Public Improvement
Construction Contract for the 2025 ADA Sidewalk Curb Ramp Project Two.
BACKGROUND
The 2025 ADA Sidewalk Curb Ramp Project Two provided for the replacement of
access ramps in conjunction with the Public Works Asphalt Overlay program at the
following locations:
• Woodlawn at Chippewa Street, two single directional ADA sidewalk curb ramps
and storm sewer intake replacement
• Mid -block Chippewa Street, replacement of two storm sewer intakes
• Woodlawn at Karen Street, two single& two double directional ADA sidewalk curb
ramps
• Woodlawn at Lindale Street, two single & one non -directional ADA sidewalk curb
ramps
• Kevindale at Karen Street, two single directional ADA curb ramps
• Kevindale at Lindale Street, curb replacement
• Kaufmann at North Grandview Avenue, four single & two double directional ADA
sidewalk curb ramps. Replacement of four storm sewer intakes
DISCUSSION
The 2025 ADA Sidewalk Curb Ramp Project Two was completed by Midwest Concrete,
Inc. of Peosta, Iowa in the final contract amount of $224,599.25 which is a 15.4% increase
from the original contract amount of $194,547.80. The added costs incurred were a result
of base bid item quantity increases ($21,142.05) for sidewalk replacement, curb and
gutter replacement, and storm sewer catch basin intake work. The Change Order issued
($8,909.40) included additional traffic control required at the intersection of Kaufmann

and N. Grandview, additional work to place flowable mortar to repair sidewalk
undermining that occurred due to a heavy rainfall event and placing straw mat over topsoil
to stabilize and control erosion.
RECOMMENDATION
I recommend that the City Council accept the Public Improvements and authorize the
payment of $224,599.25 to Midwest Concrete, Inc. for the 2025 ADA Sidewalk Curb
Ramp Project Two.

RESOLUTION NO. 77-26
ACCEPTING THE 2025 ADA SIDEWALK CURB RAMP PROJECT TWO AND
AUTHORIZING FINAL PAYMENT TO THE CONTRACTOR
WHEREAS, the 2025 ADA Sidewalk Curb Ramp Project Two (the Project)
provided for the replacement of access curb ramps on Asbury Road from John F.
Kennedy Road to Avalon Street in conjunction with the 2025 Public Works Asphalt
Overlay program); and
WHEREAS, the Public Improvement Contract for the Project has been completed
by the contractor, Midwest Concrete, Inc. of Peosta, Iowa (Contractor), and the City
Engineer has examined the work and recommends that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $224,599.25; and
WHEREAS, the Contractor has previously been paid $217,861.28 leaving a
retainage balance of $6,737.97; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
SECTION 1. The recommendation of the City Engineer is approved, and the
Project is hereby accepted.
SECTION 2. The Chief Financial Officer is hereby directed to pay the balance of
the retainage of $6,737.97 as provided in Iowa Code Chapter 573, and to pay such
retainage in accordance with the provisions of Iowa Code Chapter 573 or Iowa Chapter
26.13.

The undersigned City Engineer of the City of Dubuque, Iowa, hereby certifies that
he has inspected the 2025 ADA Sidewalk Curb Ramp Project Two and work has been
performed in compliance with the terms of the Public Improvement Contract, and that
the total cost of the completed work is $252,624.25.
