Mixed -use Building Project at the Corner of West 5th and Main Streets DATE: March 9, 2026 INTRODUCTION This memo provides information regarding the platting and reservation of right of way (fee ownership) along portions of West 5th Street, West 6th Street, Main Street, and the City Alley just West of Main St., as part of the Gronen Development, Inc. Mixed -use Building Project at the corner of West 5th and Main Streets. BACKGROUND The City executed a Development Agreement with Gronen Development, Inc. last year on March 17, 2025 for the development of a mixed -use building at the corner of 5th and Main Streets. The project will provide 8,000 square feet of first -floor commercial space and at least eighty (80) rental residential units at an investment of approximately $24,000,000. DISCUSSION Since the execution of the Development Agreement, the Gronen team has worked with City staff and identified an additional small area of land (which we are referring to as the "Notch") that is required to "square off" the northeast corner of the property. In order for the City to convey that property, a First Amendment to the Development Agreement is required. The Amendment has been prepared in order to allow for the following: • Adding new land to the project (the "Notch"). • Establishing easement areas and revocable and irrevocable license areas. • Imposing new infrastructure, utility, and permitting obligations. • Establishing required bonding, inspections, and platting procedures. • Creating mechanisms for early site access. Page 162 of 811 All other terms and conditions of the original Development Agreement remain unchanged. In this area of the original City of Dubuque, the adjacent lot owners own to the centerline of the street and the City holds only a right of way easement. The City of Dubuque will dedicate and reserve the subject right of way areas unto itself prior to the vacation and disposal of the "Notch" property to Gronen. Origin Design has prepared a plat of survey for right of way dedication (also known as an acquisition plat) to provide the City's reservation of right of way areas. The areas being platted will be dedicated and reserved by the City for street right of way and public utility purposes. This is being done in anticipation of the First Amendment to Development Agreement which is scheduled to be reviewed and approved at public hearing by the City Council on the March 23, 2026. This is the first step in the process for the fee title land conveyance and vacation for the "Notch" property to Gronen. A public hearing for the street vacation and subsequent disposal of the "Notch" property will follow. The attached Exhibit A shows the right of way dedication/reservation areas and the "Notch" property. RECOMMENDATION I recommend that the City Council approve the Plat of Survey for Right of Way Dedication (Acquisition Plat) of City Lot 62A and City Lot 6213, in the City Of Dubuque, Iowa, by the adoption of the attached resolution.
