Assistant City Engineer Robert Schiesl is recommending City Council accept the Public
Improvements and authorize the payment of the final contract amount of$601,779.84 to
Pirc-Tobin Construction, Inc. for the Heeb Street Reconstruction Project.
The Heeb Street Reconstruction Project was completed by Pirc-Tobin Construction, Inc.
in the final contract amount of$601,779.84 which is an 8.1% decrease from the original
contract amount of$655,020.84.
Based upon final construction costs, the total amount of Special Assessments for all
associated improvement (including street, private sanitary sewer laterals, and private
water service laterals) is in the amount of$65,028.65, which is 12.95% ($9,676.97)
below the Preliminary Schedule of Assessments estimate that were presented to the
property owners and was approved and adopted by City Council at the project public
hearing. This decrease is attributed to lower construction costs for street reconstruction
items.
The property owners assessed can pay their respective special assessments either
partially or in full at the City of Dubuque, Office of the City Engineer within the first 30
days after receiving the final Notice of Special Assessment to avoid interest charges.
After approximately 30 days, any unpaid assessment balance will be levied against said
benefited property with the Dubuque County Treasurer and any balance over $500 will
be payable in 15 annual installments at the County Treasurer's Office and will draw
annual interest at three percent (3%).
Low- to moderate-income property owners subject to assessments will be eligible for
financial assistance of the assessment for the owner-occupied resident property
depending on family size and income level.
Following the adoption of the Preliminary Schedule of Assessments, the property
owners were mailed a Notice of Assessment prior to the start of the project. The
preliminary assessments were noted as estimates only and that the final assessments
would not exceed the preliminary estimates provided with property owners.

The Final Schedule of Assessments provides a variance number for each individual
property, which is the difference between the preliminary assessments versus the final
assessments. You will note that some of the variance numbers are negative, which
means that for some of the benefited properties, the final cost for the private water
service and private sanitary sewer service improvements were greater than estimated in
the preliminary assessments.
The Mayor and City Council do have authority and the option to amend the Preliminary
Schedule of Assessments to revise the individual assessments to adjust for the
variance. However, historically the City has not levied a special assessment that was
greater than stated in the Preliminary Schedule of Assessments. Staff is recommending
that consistent with past practice the City Council not amend the Preliminary Schedule
of Assessments and the city pay the variances.

INTRODUCTION
The enclosed resolution provides for the acceptance of the Public Improvement
Construction Contract and the establishment of the Final Schedule of Assessments for
the Heeb Street Reconstruction Project.
BACKGROUND
The section of Heeb Street just south of Kaufmann Avenue is a dead-end street that had
very old utilities. The water main was an old 4-inch main that didn't meet current
standards. Most of the houses (5 out of 6) had lead water services and multiple properties
were daisy chained to provide service. This was problematic because if a services line
had leaked or broke, it would have impacted on multiple properties. There was one lead
service line failure in this area in the last 10 years that impacted multiple properties.
The sanitary sewer main also needed to be replaced. The last house on Heeb Street was
still on a septic system because the sanitary main didn't extend far enough to the south
to service the property.
The street itself had old brick pavers overlaid with asphalt. The end of the street did not
have a proper cul-de-sac to allow traffic to easily turn around.
DISCUSSION
The Heeb Street Reconstruction Project included the reconstruction of street with a new
7-inch asphalt pavement, new curb and gutter, new sidewalk on the west side, installation
of a modified cul-de-sac at the end of the street and the complete replacement of all water
main, sanitary main and associated services for both utilities. The historic brick pavers
under the existing asphalt street were salvaged and stockpiled for future use on a city
project.
The Heeb Street Reconstruction Project was completed by Pirc-Tobin Construction, Inc.
of Alburnett, lowa in the final contract amount of$601,779.84 which is an 8.1% decrease
from the original contract amount of$655,020.84.

RECOMMENDATION
I recommend that the City Council accept the Public Improvements and authorize the
payment of the final contract amount of $601,779.84 to Pirc-Tobin Construction, Inc. for
the Heeb Street Reconstruction Project.

RESOLUTION NO. 150-26
ACCEPTING THE HEEB STREET RECONSTRUCTION PROJECT AND
AUTHORIZING FINAL PAYMENT TO THE CONTRACTOR
WHEREAS, the Heeb Street Reconstruction Project (the Project) included the
reconstruction of the street with 7-inch asphalt pavement, new curb and gutter, new
sidewalk on the west side, installation of a modified cul-de-sac at the end of the street
and the complete replacement of all water main, sanitary main and associated services
for both utilities; and
WHEREAS, the Public Improvement Contract for the Project has been
completed by the contractor, Pirc-Tobin (Contractor), and the City Engineer has
examined the work and recommends that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $601,779.84; and
WHEREAS, the Contractor has previously been paid $583,726.44, leaving a
balance of $18,053.40; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
SECTION 1. The recommendation of the City Engineer is approved, and the
Project is hereby accepted.
SECTION 2. The Chief Financial Officer is hereby directed to pay the balance of
the retainage amount of $18,053.40 to the Contractor as provided in Iowa Code Chapter
573, and to pay such retainage in accordance with the provisions of Iowa Code Chapter
573 or Iowa Chapter 26.13.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
After full consideration, the Final Schedule of Assessments as shown on the attached
Exhibit A, is hereby approved for the Heeb Street Reconstruction Project.
There is hereby assessed and levied as a special tax against and upon each of the
benefited properties, the respective sums indicated. The amounts shown in said Final
Schedule of Assessments as deficiencies are found to be proper and levied conditionally
against the respective properties benefited by the improvements as shown in the Final
Schedule of Assessments, subject to the provisions of Iowa Code § 384.63. Said
assessments against said lots are hereby declared to be in proportion to the special benefits
conferred and not in excess of twenty-five percent of the value of same.
The City Clerk be and is hereby directed to certify the Final Schedule of Assessments
to the County Treasurer of Dubuque County, Iowa, and to publish notice of said certification
once each week for two consecutive weeks in the manner provided in Iowa Code § 362.3,
the first publication of which shall be not more than fifteen days from the date of filing of the
Final Schedule of Assessments. On or before the date of the second publication of the
notice, the City Clerk shall also mail a copy of said notice to property owners whose property
is subject to assessment, as provided in Iowa Code § 384.60.
The assessments may be paid in full or in part without interest at the office of the City
Engineer, City Hall, 50 W. 13th Street, Dubuque, Iowa, at any time within 30 days after the
date of the first notice of the Final Schedule of Assessments. Thereafter, unpaid

The public improvement and location is as follows:
— All properties abutting or served by utilities on Heeb Street. Consisting of the
properties which are described as follows:

The proposed district to be benefited and subject to assessment for the cost of
such improvements is described as follows:

— Reconstruction of the watermain
— Watermain private service laterals

You are hereby notified that the Final Schedule of Assessments attached exhibit "A"
against the benefited properties within the district described above, a copy of which Final
Schedule of Assessments is attached exhibit A, has been adopted and the assessments
confirmed by the City Council of the City of Dubuque, lowa, and that said Final Schedule
of Assessments has been certified to the Dubuque County Treasurer.

The assessments may be paid in full or in part without interest at the office of the City
Engineer, City Hall, 50 W. 13th Street, Dubuque, lowa, at any time within 30 days after
the date of the first notice of the Final Schedule of Assessments. Thereafter, unpaid
assessments of $500.00 or more are payable in 15 annual installments at the County
Treasurer's Office, Dubuque County Courthouse, 720 Central Avenue, Dubuque, lowa,
and will draw annual interest at three percent (3%) computed to December 1 next
following the due dates of the respective installments as provided in Section 384.65 of
the Code of lowa. Each installment will be delinquent from October 1 following its due
date on July 1 of each year. However, when the last day of September is a Saturday or
Sunday, that amount shall be delinquent from the second business day of October.
Delinquent installments will draw the same delinquent interest as ordinary taxes. Property
owners may elect to pay any annual installments semi-annually in advance.
