There are no anticipated budgetary impacts because of the RAISE Infrastructure
Planning Grant Amendment No. 1.

INTRODUCTION
The enclosed resolution authorizes the Mayor to execute an Amendment No. 1 to the
Grant Agreement between the City, the lowa Department of Transportation (lowa DOT),
and the Federal Highway Administration (FHWA) for the RAISE Infrastructure Planning
Grant to complete the Engineering Design and NEPA / Environmental Study Phase to
advance development for the project entitled "Building Bridges to Elevate Employment"
(B2E2).
BACKGROUND
The City was awarded a U.S. Department of Transportation (USDOT) RAISE
Infrastructure Planning Grant which will provide for the planning and design of a
multimodal transportation corridor project for proposed improvements to the Elm Street
corridor, the 16th Street corridor, the Kerper Blvd. corridor, Chaplain Schmitt Island
corridor, and the proposed 14th Street Railroad (vehicular and pedestrian) Overpass
bridge project.
In June 2024, the City was awarded a USDOT $25 million RAISE Capital Grant to
implement construction phases to complete the proposed 14th Street Railroad Overpass
bridge and the multimodal transportation corridor improvements.
DISCUSSION
Through collaborative discussions with the lowa DOT and FHWA staff, it was determined
that an amendment to the RAISE Planning Grant Agreement was necessary to revise the
Planning Grant project development schedule to align with the RAISE Capital Grant.
In April 2025, per Resolution No. 110 - 25, the City Council approved the original RAISE
Planning Grant Agreement Amendment No. 1, which was executed and submitted to the
USDOT. Following the submittal, the Office of Secretary of Transportation (OST) notified
FHWA Divisions that all grant agreement development and amendments were on hold
until grant funding programs could be reviewed for compliance with new administrative
polices.

Following guidance from OST, the City worked with FHWA lowa Division staff to revise
the Amendment Agreement. In August 2025, the updated Amendment No. 1 document
was resubmitted to FHWA Headquarters.
In Aril 2026, the City and lowa DOT were notified that OST has approved the revised
RAISE Grant Agreement Amendment No. 1 for execution.
The original Planning Grant project completion date of July 31, 2025, was based upon an
assumed National Environmental Policy Act (NEPA) Classification of a Categorical
Exclusion. After review, it has been determined that an Environmental Assessment is the
most likely outcome due to the potential impacts to the historical district within the project
limits. Due to this, the Planning Grant project completion deadline is being extended to
December 31, 2028, to complete NEPA requirements.

RECOMMENDATION
I recommend that the City Council approve and authorize the Mayor to execute
Amendment No. 1 to the Grant Agreement between the City, the lowa DOT, and the

and NEPA / Environmental Study Phase to advance development for the B2E2 project.

There are no anticipated budgetary impacts because of the RAISE Infrastructure Planning
Grant Amendment No. 1.

RESOLUTION APPROVING GRANT AGREEMENT AMENDMENT NO. 1 WITH THE
U.S. DEPARTMENT OF TRANSPORTATION FOR THE AWARDED RAISE
INFRASTRUCTURE PLANNING GRANT
WHEREAS, the City was awarded $2.28 million in U.S. Department of Transportation
RAISE Planning Grant funds to assist with the planning and design of multimodal
transportation corridors for the project entitled "Building Bridges to Employment and
Equity (B2E2)"; and
WHEREAS, the RAISE Infrastructure Planning Grant was awarded and fully executed
on November 11, 2023, between the City, the Iowa Department of Transportation, and the
Federal Highway Administration; and
WHEREAS, in June 2024, the City was awarded a RAISE Capital Grant to implement
construction phases to complete the proposed 14th Street Railroad Overpass bridge and
the multimodal transportation corridor improvements; and
WHEREAS, it was determined that an amendment to the RAISE Planning Grant
Agreement was necessary to revise the Planning Grant project development schedule to
align with the RAISE Capital Grant; and
WHEREAS, through Amendment No. 1 , the Planning Grant project completion
deadline is being extended to December 31 , 2028, to complete NEPA requirements.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA, THAT:
Section 1 . That said RAISE Planning Grant Agreement Amendment No. 1 with the U.S.
Department of Transportation is hereby approved.
Section 2. That the Mayor be authorized and directed to execute the RAISE Planning
Grant Agreement Amendment No. 1 with the U.S. Department of Transportation.

FIRST AMENDED AND RESTATED GRANT AGREEMENT UNDER THE
FISCAL YEAR 2022 RAISE GRANT PROGRAM
This agreement is between the United States Department of Transportation (the "USDOT")
and the Iowa Department of Transportation (the "Recipient").
This agreement reflects the selection of the Recipient to receive a RAISE Grant for the
Building Bridges to Elevate Employmentproject.
If schedule A to this agreement identifies a Designated Subrecipient, that Designated
Subrecipient is also a party to this agreement, and the parties want the Designated Subrecipient
to carry out the project with the Recipient's assistance and oversight.
The USDOT and Recipient executed a grant agreement on November 7, 2023 ("the Original
Grant Agreement"). The parties want to replace the Original Grant Agreement with this First
Amended and Restated Grant Agreement.
The parties therefore agree to amend and restate the grant agreement to read in its entirety as
follows:
ARTICLE 1
GENERAL TERMS AND CONDITIONS.
1.1 General Terms and Conditions.
(a) In this agreement, "General Terms and Conditions" means the content of the document
titled"General Terms and Conditions Under the Fiscal Year 2022 Rebuilding American
Infrastructure with Sustainability and Equity (RAISE) Grant Program: FHWA Projects,"
dated November 4, 2025, which is available at
https://www.transportation.gov/BUILDgrants/grant-agreements. The General Terms and
Conditions reference the information contained in the schedules to this agreement. The
General Terms and Conditions are part of this agreement.
(b) The Recipient states that it has knowledge of the General Terms and Conditions.
(c) The Recipient acknowledges that the General Terms and Conditions impose obligations
on the Recipient and that the Recipient's non-compliance with the General Terms and
Conditions may result in remedial action, terminating of the RAISE Grant, disallowing
costs incurred for the Project,requiring the Recipient to refund to the USDOT the RAISE
Grant, and reporting the non-compliance in the Federal-government-wide integrity and
performance system.

construction on December 1, 2022.

Scope: No change.
Schedule: The planned project completion date of July 3 l, 2025 from the original grant
agreement was based upon an assumed NEPA Classification of Categorical Exclusion. After
review, it has been determined that an Environmental Assessment is the most likely outcome due
to the potential adverse impacts to the historical district within the project limits. Due to this, the
planned project completion deadline is being extended by 41 months (December 31, 2028). This
roughly equates to the difference in five-year average of length of time between a Categorical
Exclusion and Environmental Analysis. Additionally, through collaborative discussions with the
Iowa DOT and Iowa FHWA staff, it was determined that the RAISE Planning Grant(RAIS-22-
0027-IA)project development schedule should be revised to align with the RAISE Capital Grant

The City of Dubuque is a longstanding member of the Dubuque Area Labar-Management
Council (DALMC) which was established in 1988. The City, along with local business
and labor leaders joined together to invest their time and resources in establishing
DALMC, which was created to promote and maintain a constructive labor-management
environment through workforce development, educational training, retention and new
business attraction. DALMC provides a forum to improve and expand labor-management
collaboration in the private and public sector within the tri-state area.

This RAISE Planning Grant is for the preliminary design, final design, and preparing
construction plans for a future bid capital project. The City is developing the Building
Bridges to Elevate Employment (B2E2)project to include four(4) separate construction
packages which will each bid separately through the Iowa DOT. The four(4)
construction bid packages will provide the greatest opportunity for a larger number of
local contractors to bid on the projects.
In Iowa, workers have the right to bargain collectively through a labor union. Iowa's state
code declares, "No person shall be deprived of the right to work at a chosen occupation
because of inembership, affiliation, withdrawal/expulsion, or refusal to join any labor
union." All construction projects will be bid through the Iowa DOT and the lowest
responsive, responsible bidder will be awarded the contract, and local contractors will
have an opportunity to bid on the project
US DOT investment will support efforts to create local employment opportunities,
provide good-paying jobs, and grow Dubuque's and the regional economy.
