Enclosed is a copy of the Stipulation of Settlement regarding a tax assessment appeal
filed by Theisen's Warehouse, LLC (Theisen's) with the District Court for Dubuque
County. lowa Code Sec. 441.44 requires that the Stipulation of Settlement be served
upon each of you.

There is one property that is the subject of this appeal. The appeal is for the January 1,
2025 assessed value.
Details of Property
The property is located at 6201 Chavenelle Road, Dubuque lowa, and is owned by
Theisen's Warehouse, LLC and operated by Theisen Supply, Inc. The land area of the
property is 16.68 acres. In 2006 the property was improved with warehouse buildings
and an office totaling 146,396 square feet. In 2012 an additional 80,000 square feet of
warehouse was added.
2025 Appeal
Theisen's filed a protest with the City of Dubuque Board of Review in April 2025 appealing
the January 1, 2025 assessment of $12,054,800.00. The prior 2024 assessment was
$9,762,000.00. The protest claimed the market value to be $10,000,000.00. After
presenting evidence of a 2021 appraisal, current rental rates and sales comparables
during the Board of Review hearing, the petitioner requested a value of $10,000,000.00.
The Board denied the petition. Theisen's filed a District Court appeal.
Proposed Settlement
After each party provided recent comparable sales, discussion ensued between them
regarding a settlement. The parties have reached a proposed settlement agreement.
The tentative settlement is for an assessed value for January 1, 2025, and January 1,
2026, of$11,839,400.00.
The settlement will result in an estimated tax loss each year to all taxing bodies of
$5,877.00.
Pursuant to the Stipulation of Settlement the appeal will be dismissed, and the assessed
value will be adjusted to $11,839,400.00 for 2025 and 2026.
The value for 2025 and 2026 of 6201 Chavenelle Road will be apportioned as follows:
Land $ 1,375,500.00
Building $10,463,900.00
Total Value $11,839,400.00
The proposed settlement will be presented to the lowa District Court for Dubuque County
after fourteen (14) days from the date indicated on the attached Notice of Voluntary
Settlement. If there are any objections to the settlement they should be made known to
the Court prior to that time. If you have any questions about the proposed settlement,

Settlement approving the settlement regarding the above-referenced tax appeals.
I would appreciate it if you would please sign the Stipulation and return it to me if it is
acceptable in form. We need to give all of the taxing bodies fourteen (14) days' notice
of the proposed settlement. Once we receive the signed Stipulation, we will then send
the Notice of Voluntary Settlement and Stipulation of Settlement to the taxing bodies
and wait the required time before submitting the Stipulation of Settlement to the Court
for approval.
