Pursuant to Iowa Code §453A.47A, a retail tobacco permit is required for the retail sale
of cigarettes, tobacco, alternative nicotine, and vapor products in Iowa. Iowa Code
§453E.3 requires a device retailer permit for the retail sale of glass and metal devices in
Iowa.

The Iowa Department of Revenue (IDOR) administers the state retail permit process
through its online portal. Businesses within city limits submit their applications through
this portal, which then routes them to the City Clerk's Office for local review and approval.
After the City Council approves the applications, they are routed to IDOR for final approval
and issuance of the state permit. All permits expire annually on June 30.
Upon confirmation that the City Clerk's Office has received the completed applications, I
recommend approving the Retail Tobacco Permits and Device Retailer Permits, as
applicable, effective July 6, 2026, and expiring on June 30, 2027, for the following
retailers.

RESOLUTION NO. 264-26
APPROVING APPLICATIONS FOR RETAIL TOBACCO PERMITS AND DEVICE RETAILER
PERMITS, AS APPLICABLE AND AS REQUIRED BY IOWA CODE 453A.47A AND 453E.3
WHEREAS, pursuant to Iowa Code §453A.47A, a retail tobacco permit is required for the retail
sale of cigarettes, tobacco, alternative nicotine, and vapor products in Iowa; and
WHEREAS, pursuant to Iowa Code §453E.3, a device retailer permit is required for the retail
sale of glass and metal devices in Iowa; and
WHEREAS, applications for Retail Tobacco Permit and Device Retailer Permit, as applicable,
have been submitted and filed with the City Clerk's Office; and
WHEREAS, the applicants have filed the proper application and fees as required by the Iowa
Department of Revenue; and
WHEREAS, applications are presented to City Council for approval before they are forwarded
to the Iowa Department of Revenue for final issuance.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. The City Clerk's Office is hereby authorized and directed to approve the following
named applicants and locations for a Retail Tobacco Permit and Device Retailer Permit, as
applicable, effective July 7, 2026, and expiring on June 30, 2027.

Section 2. The City Clerk's Office shall forward such approvals to the Iowa Department of
Revenue for final issuance of said permits.
