INTRODUCTION
This memo provides information regarding the platting and acceptance of right of way
(fee ownership) along Portions of West 7th Street, Main Street, and a 30' Alley as part of
the Northeast Iowa Community College's construction of its proposed building entrance
site improvements at 700 Main Street in Dubuque, Iowa.
BACKGROUND
NICC is planning to remodel its existing Dubuque Center campus building at 700 Main
Street. The newly remodeled building will house classrooms, conference rooms, labs,
and associated facilities. Part of the remodeling plans includes the construction of a
new two-story entrance at the southwest corner of the existing building. The proposed
two-story entrance improvements will be located partially on what is currently City of
Dubuque street right of way easement.
DISCUSSION
In this area of the original City of Dubuque the adjacent lot owners own to the centerline
of the street and the City holds only a right of way easement. Per City Resolution No.
80-26, the City of Dubuque approved an agreement with NICC for the vacation and sale
of a portion of the Main Street and West 7th Street right of way. The agreement includes
the dedication of fee title (City currently holds an easement) to the adjoining street and
alley rights of way, from NICC to the City, followed by the subsequent vacation and
disposal of portions of those rights of way from the City to NICC, in order to
accommodate the proposed NICC development plans. City staff, including Planning
Services, Engineering, and Parks and Recreation met with NICC representatives,
reviewed the proposal, and have determined that the right of way area to be vacated is
not needed. The proposed vacation of the designated portion of 7th Street is
anticipated to have minimal operational or public -access impact. Following completion
of the associated construction activities, sufficient right-of-way will remain to

accommodate installation of a standard City -compliant sidewalk. All pedestrian facilities
will be rebuilt to conform to applicable City design standards and accessibility
requirements. The City of Dubuque Development Review Team has finished its review
of the construction plans and has issued an approval letter. The agreement states that
the property will be sold to NICC for $1,674.00. NICC is also be responsible for all
surveying, platting, and publication and filing costs.
WHKS has prepared a plat of survey for right of way dedication (also known as an
acquisition plat) to provide the right of way areas. The areas being platted will be
dedicated to the public for street right of way and public utility purposes. This is the first
step in the process for the fee title land conveyance and vacation. A public hearing for
the street vacation and disposal of a portion of the right of way to NICC will follow.
RECOMMENDATION
I recommend that the City Council approve the Plat of Survey for Right of Way
Dedication (Acquisition Plat) of City Lot 25A, in the City Of Dubuque, Iowa, by the
adoption of the attached resolution.
ACTION TO BE TAKEN
I respectfully request approval of the Plat of Survey for Right of Way Dedication
(Acquisition Plat) of City Lot 25A, in the City Of Dubuque, Iowa, and acceptance of the
dedication of said lot for street right of way and public utility purposes, through the
adoption of the enclosed resolution.

APPROVING THE PLAT OF SURVEY FOR RIGHT OF WAY DEDICATION OF
CITY LOT 25A, IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been presented to the City Council of the City of
Dubuque, Iowa, a Plat of Survey for Right of Way Dedication (Acquisition Plat)
dated April 21, 2026 prepared by WHKS describing City Lot 25A, in the City Of
Dubuque, Iowa; and
Whereas, said plat conforms to the laws and statutes pertaining thereto;
and
Whereas, upon said plat appears City Lot 25A, which Northeast Iowa
Community College, by said plat, has dedicated to the City of Dubuque forever for
street right of way and public utility purposes.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the plat dated April 21, 2026 prepared by WHKS, relative to
the real estate hereinabove described be and the same is hereby approved, and
the Mayor and City Clerk be and they are hereby authorized and directed to
execute said plat and on behalf of the City of Dubuque, Iowa.
Section 2. That the dedication of City Lot 25A, in the City Of Dubuque, Iowa,
for street right of way and public utility purposes, as it appears on said Plat of
Survey for Right of Way Dedication (Acquisition Plat), be and the same are hereby
accepted.
Section 3. That the City Clerk be and is hereby authorized and directed to
file said plat and certified copy of this resolution in the office of the Recorder, in
and for Dubuque County, Iowa.
