City Engineer Gus Psihoyos is recommending City Council adopt a resolution approving
the Plat of Survey (Vacation) of Lot 25B of Block 11, Dubuque Downtown Plaza, in the
City of Dubuque, Iowa, as part of the Northeast Iowa Community College's construction
of its proposed building entrance site improvements at 700 Main Street in Dubuque,
Iowa.
The City of Dubuque Development Review Team has finished its review of the
construction plans and has issued an approval letter. The agreement states that the
right of way property will be sold to NICC for $1,674.00. NICC will also be responsible
for all surveying, platting, and publication and filing costs.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
This is in response to a request from Northeast Iowa Community College (NICC) for the
vacating of a portion of the Main Street and West 7t1 Street Right of Way to be known
as Lot 25B of Block 11, Dubuque Downtown Plaza, in the City of Dubuque, Iowa, as
part of the Northeast Iowa Community College's construction of its proposed building
entrance site improvements at 700 Main Street in Dubuque, Iowa.
BACKGROUND
NICC is planning to remodel its existing Dubuque Center campus building at 700 Main
Street. The newly remodeled building will house classrooms, conference rooms, labs,
and associated facilities. Part of the remodeling plans includes the construction of a
new two-story entrance at the southwest corner of the existing building. The proposed
two-story entrance improvements will be located partially on what is currently City of
Dubuque street right of way easement.
DISCUSSION
In this area of the original City of Dubuque the adjacent lot owners own to the centerline
of the street and the City holds only a right of way easement. Per City Resolution No.
80-26, the City of Dubuque approved an agreement with NICC for the vacation and sale
of a portion of the Main Street and West 7th Street right of way. The agreement includes
the dedication of fee title (City currently holds an easement) to the adjoining street and
alley rights of way, from NICC to the City, followed by the subsequent vacation and
disposal of portions of those rights of way from the City to NICC, in order to
accommodate the proposed NICC development plans. City staff, including Planning
Services, Engineering, and Parks and Recreation met with NICC representatives,
reviewed the proposal, and have determined that the right of way area to be vacated is
not needed. The proposed vacation of the designated portion of 7th Street is
anticipated to have minimal operational or public -access impact. Following completion

of the associated construction activities, sufficient right-of-way will remain to
accommodate installation of a standard City -compliant sidewalk. All pedestrian facilities
will be rebuilt to conform to applicable City design standards and accessibility
requirements. The City of Dubuque Development Review Team has finished its review
of the construction plans and has issued an approval letter. The agreement states that
the right of way property will be sold to NICC for $1,674.00. NICC will also be
responsible for all surveying, platting, and publication and filing costs.
As part of the agreement, the property owner is responsible for the surveying and
platting of the proposed division of the property and right of way vacation as well as all
costs for publication and filing fees. The attached plat shows the portion of the street
right of way area proposed to be vacated and conveyed to NICC to facilitate the
construction of its proposed building entrance site improvements. The portion of the
street right of way area to be vacated is to be known as Lot 25B of Block 11, Dubuque
Downtown Plaza, in the City of Dubuque, Iowa. The street right of way areas to be
vacated need to be platted. WHKS has prepared the attached vacation plat.
RECOMMENDATION
I am recommending that the plat of survey (vacation plat) be approved.
ACTION TO BE TAKEN
I respectfully request that the Plat of Survey (Vacation) of Lot 25B of Block 11, Dubuque
Downtown Plaza, in the City of Dubuque, Iowa, be approved through adoption of the
enclosed resolution.

I just spoke with Jill and Jeff and we believe we have a solution strategy:
- Jeremy will file a Surveyor's Affidavit citing a scrivener's error in the dedication plat lot name (City
Lot 25A, in the City of Dubuque, Iowa should have been City Lot 25C, in the City of Dubuque,
Iowa).
- Jeremy will revise the vacation plat where appropriate to replace all references to City Lot 25A
with City Lot 25C
- We can record the vacation plat after swapping out pertinent pages (Jeremy to bring new pages to
Adrienne)
- Nate K will have to revise the public hearing council docs to change all references to City Lot 25A
with City Lot 25C

Below is what I emailed to Jeremy Leemon from WHKS. Jeff Miller also left a voice mail for Nate on 8/4 about this
same thing.
Essentially, City Lot 25A has already been used, and isn't unique (see attached plat from 1970 in Plat Town Lots
Book 34, Page 284). Shortly thereafter, it was incorporated into Block 11 of Dubuque Downtown Plaza (PTL Book
34, Page 289), which is what it still is today. The above plat was when they originally decreased the width of 7tn
Street.
I mentioned City Lot 25B could work down below, not knowing that is the plat you just brought in today. City Lot
25C is available. I believe the Auditor has say in the approval of the naming of lots/plats — Iowa Code 354.4 —1. a.

The above mentioned plat was recorded on 7/22. 1 am concerned about the legal description for this new lot. There
was already a Lot 25A back in 1970 (see attached, Plat Town Lots Book 34, Page 284). You mention on this new
document Bk. 34-Page 289 where that old Lot 25A was combined into Blk 11 Dubuque Downtown Plaza. The next
pages after that page 289 also shows where 71" Street isn't 64' wide anymore either.
City Lot 25B could work.

Whereas, there has been presented to the City Council of the City of Dubuque,
Iowa, a plat dated July 22, 2026 prepared by WHKS, showing the proposed vacated
portion of City Lot 25A, in the City of Dubuque, Iowa, said vacated portion to be hereafter
known as Lot 25B of Block 11, Dubuque Downtown Plaza, in the City of Dubuque, Iowa;
and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY

Whereas, that on August 3, 2026, by City Council Resolution No. 293-26,
the city council approved the Plat of Survey (Vacation) of Lot 25B of Block 11,
Dubuque Downtown Plaza, in the City of Dubuque Iowa; and
Whereas, that on August 3, 2026, by City Council Resolution No. 295-26,
the city council approved the setting of a public hearing for the vacation and
disposal of Lot 25B of Block 11, Dubuque Downtown Plaza, in the City of Dubuque
Iowa; and
Whereas, that on August 17, 2026, by City Council Resolution No. 316-26,
the city council approved the vacation of Lot 25B of Block 11, Dubuque Downtown
Plaza, in the City of Dubuque Iowa; and
Whereas, that on August 17, 2026, by City Council Resolution No. 317-26,
the city council approved the disposal and sale of Lot 25B of Block 11, Dubuque
Downtown Plaza, in the City of Dubuque Iowa; and
Whereas, the Plat of Survey (Dedication) recorded as Document No. 2026-
00008051 in the Dubuque County Recorder's Office on July 22, 2026 includes City
Lot 25A, in the City of Dubuque, Iowa; and
Whereas, the lot name City Lot 25A, in the City of Dubuque, Iowa is not
allowed by the Dubuque County Auditor's office as it is a duplicate lot name/legal
description of an existing lot; and
Whereas, per Affidavit of Correction recorded as Document No. 2026-8725,
the lot name of City Lot 25A, in the City of Dubuque, Iowa on the Plat of Survey
(Dedication) was corrected to be City Lot 25C, in the City of Dubuque, Iowa; and
Whereas, all references to City Lot 25A, in the City of Dubuque, Iowa in City
Council Resolutions 293-26, 295-26, 316-26, 317-26 were erroneous and should
be replaced with the text "City Lot 25C, in the City of Dubuque, Iowa"; and
Whereas, a copy of the original Plat of Survey (Vacation) with proposed
corrections is attached for informational purposes; and
Whereas, a copy of the revised Plat of Survey (Vacation) with which will be
recorded with a copy of this resolution is attached for informational purposes.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That all references to "City Lot 25A, in the City of Dubuque,
Iowa" included in City Council Resolutions 293-26, 295-26, 316-26, 317-26 were
erroneous and should be replaced with the text "City Lot 25C, in the City of
Dubuque, Iowa".
Section 2. That the above -described City Council Resolutions are
hereby amended as described in Section 1 above.
Section 3. That the City Clerk be and is hereby authorized and directed
to record a certified copy of this resolution in the offices of the City Assessor,
Dubuque County Recorder and Dubuque County Auditor.
