The attached resolution provides for the adoption of Supplement Number S-20 of July
2026 to the City of Dubuque Code of Ordinances, which codifies ordinances up to and
including Ordinance No. 11-26 as adopted by the City Council through March 16, 2026.
Section 380.8(1) of the Iowa Code outlines cities code of ordinance requirements:
380.80) Code of ordinances published
1. a. A city shall compile a code of ordinances containing all the city ordinance in effect,
except grade ordinances, bond ordinances, zoning map ordinances, ordinances vacating
streets and alleys, and ordinances containing legal descriptions of urban revitalization
areas and urban renewal areas.
b. A city may maintain a code of ordinances either by compiling at least annually a
supplement to the code of ordinances consisting of all new ordinances and amendments
to ordinances which became effective during the previous year and adopting the
supplement by resolution or by adding at least annually new ordinances and amendments
to ordinances to the code of ordinances itself.
c. A city which does not maintain the city code of ordinances as provided in paragraph "b"
shall compile a code of ordinances at least once every five years.
Since August 17, 2009, the city has compiled supplements to the City of Dubuque Code
of Ordinances consisting of all new ordinances and amendments to ordinances.
Supplements are prepared on a quarterly basis by American Legal Publishing of
Cincinnati, Ohio.
I respectfully request City Council approval of the resolution adopting Supplement No.
2026 S-20 as part of the Code of Ordinances of the City of Dubuque.

ADOPTING SUPPLEMENT NO. 2026 S-20 TO THE CODE OF ORDINANCES OF THE
CITY OF DUBUQUE, IOWA
Whereas, on August 17, 2009, the City Council, pursuant to Ordinance No. 43-09,
readopted the Code of Ordinances of the City of Dubuque, Iowa in its entirety; and
Whereas, since August 17, 2009, the City of Dubuque, Iowa, has compiled
supplements to the Code of Ordinances consisting of all new ordinances and
amendments to ordinances; and
Whereas, Section 380.8 of the Code of Iowa provides that supplements, adopted by
resolution, become part of the Code of Ordinances; and
Whereas, Code Supplements are prepared by the American Legal Publishing of
Cincinnati, Ohio and filed in the Office of the City Clerk of the City of Dubuque, Iowa.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Supplement No. 2026 S-20 to the City of Dubuque Code of Ordinances,
which codifies ordinances up to and including Ordinance No. 11-26 as adopted by the
City Council through March 16, 2026, is hereby adopted, and becomes part of the Code
of Ordinances of the City of Dubuque, Iowa.

PREFACE
This code of the City of Dubuque, as
supplemented, contains ordinances up to and
including ordinance 11-26, passed March 16, 2026.
Ordinances of the City adopted after said ordinance
supersede the provisions of this code to the extent
that they are in conflict or inconsistent therewith.
Consult the City office in order to ascertain whether
any particular provision of the code has been
amended, superseded or repealed.

C. No licensure or registration of the electric personal assistive mobility device is
required.
D. No proof of financial responsibility is required.
E. A person shall operate an electric personal assistive mobility device in a safe
and nonhazardous manner so as not to endanger himself or herself or any
other person or property.
F. There shall be no prohibition against any person riding an electric personal
assistive mobility device upon a sidewalk or bicycle path within the city, so long
as the rider does not create a hazard; provided, that no person shall operate an
electric personal assistance mobility device upon a sidewalk within the city on
those sidewalks expressly designated by the city manager as prohibited and
appropriate signs to such effect are posted.
G. Any person riding an electric personal assistive mobility device upon a sidewalk
shall yield the right of way to pedestrians, and shall travel at a speed no greater
than is safe for the conditions then existing on the sidewalk.
H. A person propelling an electric personal assistive mobility device upon and
along a sidewalk or while crossing a roadway in a crosswalk shall have all the
rights and duties applicable to a pedestrian under the same circumstances,
except that the electric personal assistive mobility device operator must yield
to pedestrians on the sidewalk or crosswalk.
The operator of an electric personal assistive mobility device emerging from, or
entering an alley, driveway, or building shall, upon approaching a sidewalk, or
the sidewalk area extending across any alleyway, yield the right of way to all
pedestrians approaching on said sidewalk, and upon entering the roadway in
a crosswalk shall yield the right of way to all vehicles approaching on said
roadway.
Electric personal assistive mobility devices shall not be used on roadways,
except when using a crosswalk or on side streets where there is not a sidewalk
adjacent to the street.
K. A person shall not operate an electric personal assistive mobility device at the
times specified in section 9-12-321.384 of this title, unless the person or the
electric personal assistive mobility device is equipped with a headlight visible
from the front of the electric personal assistive mobility device and at least one
red reflector visible from the rear of the electric personal assistive mobility
device.
L. The provisions of this section shall not apply to use of a wheelchair or other
similar conveyance when used for transportation by any temporarily or
permanently disabled person.

vehicle speed contest or speed exhibition on any street or highway of this state,
except that a passenger shall not be considered as aiding or abetting. "Motor
vehicle speed contest" or "exhibition of speed" is defined as one or more persons
competing in speed in excess of the applicable speed limit in vehicles on the public

9-7-321.284: OPEN CONTAINERS IN MOTOR VEHICLES; DRIVERS:
A driver of a motor vehicle upon a public street or highway shall not possess in the
passenger area of the motor vehicle an open or unsealed bottle, can, jar, or other
receptacle containing an alcoholic beverage or a beverage containing any amount
of tetrahydrocannabinol. "Passenger area" means the area designed to seat the
driver and passengers while the motor vehicle is in operation and any area that is
readily accessible to the driver or a passenger while in their seating positions,
including the glove compartment. An open or unsealed receptacle containing an
alcoholic beverage or an otherwise lawful beverage containing tetrahydrocannabinol
may be transported in the trunk of the motor vehicle. An unsealed receptacle
containing alcoholic beverage or an otherwise lawful beverage containing
tetrahydrocannabinol may be transported behind the last upright seat of the motor
vehicle if the motor vehicle does not have a trunk. A person convicted of a violation
of this section is guilty of a simple misdemeanor punishable as a scheduled violation
under Iowa Code section 805.8A. (Ord. 23-09, 4-20-2009; amd. Ord. 8-26,

vided, that a fee is paid for each renewal in the same amount as the original
demolition permit fee.
4. Every permit for the use of streets or public property shall expire on the last
day for which the permit was issued, as described on said permit, and shall be
renewed upon the payment of an additional fee to the Building Department, as
established by the City Manager. Failure to renew the permit for the use of
streets or public property shall be considered as due cause for the City
Manager to order all barricades or fences removed and the public property
returned to public availability and use.
D. Suspension Or Revocation: The City Manager may, in writing, suspend or
revoke a permit issued under the provisions of this chapter whenever the permit
is issued in error, on the basis of incorrect information supplied, failure to
comply with permit conditions, or in violation of any ordinance. (Ord. 21-10,

E. Conditions Of Permit: The permit shall outline the conditions under which the
permit was issued and may include, but is not limited to:
1. Storage requirements; permit issuance through day one hundred seventy
nine (179): Storage of construction materials must comply with all City
ordinances.
2. Storage requirements; day one hundred eighty (180) and beyond: The
permit will contain requirements for the storage of construction materials and
maintenance of the site. The conditions will continue upon a renewal/extension
of a building permit until such time as the project is complete. The City Manager
may require additional storage and maintenance requirements upon the
issuance of a renewal and/or extension of a building permit. (Ord. 61-12,

14-2-4: MORATORIUM FOR CONSTRUCTION OR OTHER WORK ON
CERTAIN STREETS, AREAS OR FACILITIES:
A. East-West Corridor Study Area: The City Manager may not issue any permit
for any new construction or substantial enlargement, alteration, repair or
remodeling of any structure, building, or sign in the east -west corridor study
area as shown on the map on file in the Office of the City Clerk, but not to
include demolition or emergency repairs without the approval of the City
Council, from the effective date hereof to August 1, 2025, except where a
vested right to the issuance of such permit accrued prior to the effective date
hereof.
B. Off -premises sign Study Area: The city manager may not issue any permit for
any new off -premises sign in the corporate limits of the city of Dubuque from the
effective date hereof to July 1, 2026, except where a vested right to the
