RE: Correction of the 2527 Washington Street Special Warranty Deed and
Request for Approval of Revised Document
The purpose of this memorandum is to inform the City Council of a scrivener's error
identified in a previously executed Special Warranty Deed for 2527 Washington St. and
to request formal approval of a corrected version of the document.
During review of the recorded Special Warranty Deed associated with 2527 Washington
Street, a scrivener's error was discovered involving a missing initial "E" in the legal
description. This error is clerical in nature and does not alter the intent, terms, or
substance of the transaction previously approved by the City Council.
Approval of the corrected Special Warranty Deed is recommended.

RESOLUTION NO. 310-26
APPROVING A CORRECTED SPECIAL WARRANTY DEED AND AUTHORIZING
EXECUTION AND RECORDING OF THE DOCUMENT
WHEREAS, the City Council previously approved and executed a Special
Warranty Deed for the sale of 2527 Washington Street, Dubuque, Iowa legally described
as:
Lot 29 E. Langworthy's Addition of Part of Mineral Lot 320 in the City of Dubuque,
Iowa, according to the recorded plat thereof
; and
WHEREAS, a scrivener's error involving a missing initial "E" in the legal description
was discovered in the recorded deed; and
WHEREAS, a Corrected Special Warranty Deed has been prepared to accurately
reflect the correct legal description; and
WHEREAS, the City Council finds it necessary and appropriate to approve the
Corrected Special Warranty Deed and authorize its execution and recording.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA THAT:
Section 1. That the Corrected Special Warranty Deed is attached hereto hereby
approved.
Section 2. That the Mayor and City Clerk are authorized to execute the Corrected
Special Warranty Deed on behalf of the City of Dubuque.
Section 3. That the City Clerk is hereby authorized and directed to cause said
Corrected Special Warranty Deed to be delivered to the City Attorney's Office, together
with a certified copy of this Resolution.
Passed, approved, and adopted this 17th of August, 2026.

CORRECTION
SPECIAL WARRANTY DEED
KNOWN ALL MEN BY THESE PRESENTS: that the City of Dubuque, Iowa, a
municipal corporation of the State of Iowa (Grantor), in consideration of One Dollar
($1.00) and other good and valuable consideration, and pursuant to the authority of
Chapter 403, Code of Iowa, does hereby GRANT, SELL, AND CONVEY unto Jacob
Bedtka, a single person, the following legally described real estate situated in the County
of Dubuque, State of Iowa, to wit (the Property):
Lot 29 in E. Langworthy's Addition of Part of Mineral Lot 320 in the City of
Dubuque, Iowa, according to the recorded plat thereof
known locally as 2527 Washington Street, Dubuque, IA 52001
This Deed is exempt from transfer tax pursuant to Iowa Code 428A.2(6).
There is no known private burial site, well, solid waste disposal site,
underground storage tank, hazardous waste, or private sewage disposal
system on the property as described in Iowa Code Section 558.69, and
therefore the transaction is exempt from the requirement to submit a
groundwater hazard statement.
This Deed is given pursuant to the authority of Resolution No. 286 - 26 of the City
Council of the City of Dubuque adopted the 20th day of July, 2026, the terms and
conditions thereof, if any, having been fulfilled.
Grantor hereby covenants to warrant and defend the said premises against the
lawful claims of all persons whomsoever claiming by, through and under it.
