Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The application, staff report, and related materials are attached for your review. Discussion Cody Weaver, Civil Engineering Consultants, 2400 86th St, Urbandale, Iowa, spoke on behalf of the property owner. He stated they are seeking to add a bank with a drive -up ATM to Building C. He explained this involves reworking the pavement and parking there. He said they are also cleaning up the signage and parking requirements. He explained that a bank is allowed, they just want to make sure the drive -up ATM is allowed and included in the conceptual development plan. Staff detailed the staff report summarizing the request as an update to the Conceptual Development Plan, a simplification of the parking standards, and a clarification of the signage requirements within the PUD. Staff displayed the map of properties that received notification and explained the history of the property going back to the 1989 adoption of the PUD and the 2005 signage amendment. Staff explained that adding a drive-thru ATM required a conceptual development plan and site plan review and approval. Staff noted that the proposal was reviewed by Development Review Team. Staff noted that the parking requirements were based on the 1985 zoning code and varied by use, meaning they changed whenever a use changed. Staff noted that the proposal is to simplify the parking requirements to one per every 250 square feet available to the public and noted that staff typically estimate parking by using 80% of each building's gross -floor space to accommodate back of house, bathrooms, private offices, etc. Staff stated that the 80% computes to 218 required parking spaces and that there are 287 on the property when removing the spaces in the proposed drive -through lane. Staff noted that there are 1,400 linear feet of fagade, which allows 2,800 aggregate square feet of wall signage to be shared by all businesses. Recommendation By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. INTRODUCTION The applicant is requesting to amend the Wacker Plaza Planned Unit Development (PUD) located at 800 and 806 Wacker Drive by adopting an updated conceptual development plan, consolidating a previously approved signage ordinance, and simplifying the parking requirements for the district. BACKGROUND The subject Planned Unit Development is located at the intersection of Dodge Street (Highway 20) and Wacker Drive. The property is approximately 6 acres and consists of one main structure with four satellite structures. It has frontage along both Dodge Street and Wacker Drive and is surrounded by commercial development. The Wacker Plaza planned district was established in 1989, and it formerly consisted of additional property to the north. The PUD has been nearly halved in size since its inception and was most recently amended to modify signage standards in 2005. The property owner and prospective tenant are seeking to amend the district to accommodate an attached drive -up ATM and clarify district standards regarding signage and parking. Memo to Zoning Advisory Commission — Wacker Plaza PUD Amendment Page 3 Q 6'Yli111b'%9101 k Conceptual Development Plan (Exhibit A) The applicant is requesting to amend the current conceptual development plan to incorporate a new attached drive -up ATM associated with a prospective tenant. The drive through location would replace existing parking spaces and would have minimal impact on the district otherwise. The new concept plan has been reviewed by Engineering as part of site plan review, and it has been determined to be compliant with all City standards. The drive through is considered a substantial change to the conceptual development plan and therefore an amendment is required before approval of a site plan may be granted. Parking The Wacker Plaza PUD Ordinance currently describes minimum off-street parking standards by use and per the 1985 zoning code calculations. Those standards, depending on the use, i.e. restaurant, retail, office, etc., require developers and/or staff to establish the number of employees in addition to floor space accessible to the public, and other difficult -to -establish and often changing variables. The proposed change would be based strictly on floor area accessible to the public, a number which is estimated by taking 80% of a building's footprint. As proposed, the minimum number of required spaces would be one space per 250 square feet of floor area accessible to the public. The PUD has a current amount and built-in limit of 68,000 square feet of structures. Taking a conservative 80%, that is 54,400 sq ft. which would require 218 spaces across the district. With the proposed changes to the drive -up atm and including some rear loading and parking areas, the site provides 287. The minimum parking requirement is just that, a minimum. A developer in the district may provide more than the minimum requirement and that would be the case if adopted. Site map on the following page. The amendment seeks to consolidate the signage section into the same ordinance and to clarify the limits of signage for the district. The current Wacker Plaza ordinance sign section was an amendment from 2005 and is a separate ordinance document from the 1989 ordinance. Historically, ordinances were not `replaced' (rescind old and adopt new) as they are now. That leaves a separate ordinance document for each amendment in a district, which can become unwieldy and difficult to track over time. Additionally, the district notes that signage is limited to two square feet of wall signage per each "linear foot of fagade" which is an unclear standard when reviewing sign permits (which facades are counted?). There is no change to the wall signage allocation. The change is to add clarity by explicitly stating the total linear feet and related square feet of signage permitted. The total linear feet come to 1,400 and total signage is then limited to 2,800 square feet. Current signage totals approximately 2,400 square feet which leaves 400 square feet to allocate for additional tenants. Development Review All new developments, including new signage, within the PUD require permits through Inspection and Construction Services. Additionally, developments that modify the site or any new construction require site plan review and approval through the City's Development Review Team (DRT). The DRT is comprised of multiple City departments including Engineering, Planning, Water Distribution, Fire, Police, Housing & Community Development, and Leisure Services. Site plans are reviewed by all relevant departments regarding street improvements, site access, parking, grading, screening, paving, park land, stormwater management, water connection, sanitary sewer connection, fire safety, and more. Pursuant to Iowa Code Section 414.5, and as an express condition of the reclassification, the undersigned property owner agrees to the following conditions, all of which the property owner further agrees are reasonable and imposed to satisfy the public needs that are caused directly by the zoning reclassification: A. Lot and Bulk Regulations Development of land in the PUD District shall be as follows: Page 3of7 1. All structures shall be a minimum of 40 feet from the front property line adjoining Dodge Street and Wacker Drive. 2. No building or structure shall exceed 40 feet in height on the site. 3. A maximum building area of 68,000 square feet will be permitted on the site. 4. The development shall consist of one main building and four separate structures, designated on the conceptual plan as A, B, C, and D. Building C has an attached drive -up ATM on the east side and a drive -through and pickup window on the west side. C. Parking Requirements 1. The minimum off-street parking requirement for the district shall be 1 space per 250 square feet of floor area accessible to the public. D. Site Plan Provisions The site development standards for this PC Planned Commercial District shall be as follows: 1. A landscape area containing permeable and uncovered surface with living materials shall be a minimum of 10% of the combined building coverage and vehicle use area, in conformance with the landscaping and screening requirements of the Unified Development Code. 2. All parking aisles and traffic control areas shall have raised curbing. E. Sign Regulations Signs in the PUD District shall be regulated as follows: A maximum of five (5) free-standing on -premise signs shall be permitted, with a maximum area of 125 square feet each and a maximum height of 40 feet. The total wall -mounted signage maximum area shall be two (2) square feet for each lineal foot of building fagade (1,400 linear feet for a total of 2,800 square feet of signage). The signable area shall be distributed among all tenants on the site, with a maximum of three (3) signs per business. Wall -mounted signs may be located on any wall below the eave or parapet line. 3. A maximum of two (2) off -premise signs shall be permitted on the premises, with a maximum area of 750 square feet each and a maximum height of 40 feet. 4. Directional signs shall be permitted at 6 square feet per sign panel, either wall -mounted, projecting, or free-standing, with a maximum height of 10 feet. 5. No name plate or directory signs are allowed. 6. Variance requests from sign requirements for size, number, and height shall be reviewed by the Zoning Board of Adjustment in accordance with the Unified Development Code. F. Previous Conceptual Plans That all previously approved conceptual development plans are hereby rescinded and that the attached conceptual plan, Exhibit A, shall hereinafter regulate the Wacker Plaza Planned Unit Development District. G. Ordinance History 1. Ord. 40-89: Approved an amended conceptual development plan for a PC Planned Commercial District at 3400 Highway 20 (owner/applicant Richard L. Davis), adopted September 5, 1989. 2. Ord. 50-05: Approved an amended Section 2.E., Sign regulations, of ordinance no. 40-89 that established the PUD Planned Unit Development district for Wacker Plaza. H. Transfer of Ownership Transfer of ownership or lease of property in this PUD District shall include in the transfer or lease agreement a provision that the purchaser or lessee acknowledges awareness of the conditions authorizing the establishment of the PUD District. Modifications Any modification of the Ordinance must be approved by the City Council in accordance with the Zoning Reclassification proceedings of PUD Ordinance 32-26 Page 5 of 7 Wacker Plaza PUD Section 16-9 of the Unified Development Code. J. Recording A copy of this PUD Ordinance shall be recorded, at the expense of the property owner, with the Dubuque County Recorder as a permanent record of the conditions accepted as a part of this reclassification approval. This ordinance shall be binding upon the undersigned and his/her heirs, successors, and assigns. Section 3. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 4. That Title 16, the Unified Development Code of the City of Dubuque Code of Ordinances is hereby amended by rescinding ordinance 40-89 and 50-05 which provide regulations for a PUD planned unit development district with a pc planned commercial designation for the Wacker Plaza PUD district at 800 and 806 Wacker drive and now being amended to update the conceptual development plan and to modify parking and signage regulations, to wit: Lot 1 and Lot 2 of Wacker Plaza First Addition, and to the centerline of the adjoining public right-of-way, as shown in the attached Exhibit A, all in the City of Dubuque, Iowa. Section 2. Attached hereto and made a part of this zoning reclassification approval is an amended Conceptual Development Plan for the Wacker Plaza Planned Unit Development. (Exhibit A) Section 3. Pursuant to Iowa Code Section 414.5, and as an express condition of the reclassification, the undersigned property owner agrees to the following conditions, all of which the property owner further agrees are reasonable and imposed to satisfy the public needs that are caused directly by the zoning reclassification: A. Use Regulations The following regulations shall apply to all land uses in the above - described PUD District. Accessory uses shall be limited to any use customarily incidental and subordinate to the principal use. B. Lot and Bulk Regulations Development of land in the PUD District shall be as follows: Page 3 of 7 All structures shall be a minimum of 40 feet from the front property line adjoining Dodge Street and Wacker Drive. 2. No building or structure shall exceed 40 feet in height on the site. 3. A maximum building area of 68,000 square feet will be permitted on the site. 4. The development shall consist of one main building and four separate structures, designated on the conceptual plan as A, B, C, and D. Building C has an attached drive -up ATM on the east side and a drive -through and pickup window on the west side. C. Parking Requirements 1. The minimum off-street parking requirement for the district shall be 1 space per 250 square feet of floor area accessible to the public. D. Site Plan Provisions The site development standards for this PC Planned Commercial District shall be as follows: 1. A landscape area containing permeable and uncovered surface with living materials shall be a minimum of 10% of the combined building coverage and vehicle use area, in conformance with the landscaping and screening requirements of the Unified Development Code. 2. All parking aisles and traffic control areas shall have raised curbing. E. Sign n Regulations Signs in the PUD District shall be regulated as follows: 1. A maximum of five (5) free-standing on -premise signs shall be permitted, with a maximum area of 125 square feet each and a maximum height of 40 feet. The total wall -mounted signage maximum area shall be two (2) square feet for each lineal foot of building fagade (1,400 linear feet for a total of 2,800 square feet of signage). The signable area shall be distributed among all tenants on the site, with a maximum of three (3) signs per business. Wall -mounted signs may be located on any wall below the eave or parapet line. 3. A maximum of two (2) off -premise signs shall be permitted on the premises, with a maximum area of 750 square feet each and a maximum height of 40 feet. 4. Directional signs shall be permitted at 6 square feet per sign panel, either wall -mounted, projecting, or free-standing, with a maximum height of 10 feet. 5. No name plate or directory signs are allowed. 6. Variance requests from sign requirements for size, number, and height shall be reviewed by the Zoning Board of Adjustment in accordance with the Unified Development Code. F. Previous Conceptual Plans That all previously approved conceptual development plans are hereby rescinded and that the attached conceptual plan, Exhibit A, shall hereinafter regulate the Wacker Plaza Planned Unit Development District. G. Ordinance History 1. Ord. 40-89: Approved an amended conceptual development plan for a PC Planned Commercial District at 3400 Highway 20 (owner/applicant Richard L. Davis), adopted September 5, 1989. 2. Ord. 50-05: Approved an amended Section 2.E., Sign regulations, of ordinance no. 40-89 that established the PUD Planned Unit Development district for Wacker Plaza. H. Transfer of Ownership Transfer of ownership or lease of property in this PUD District shall include in the transfer or lease agreement a provision that the purchaser or lessee acknowledges awareness of the conditions authorizing the establishment of the PUD District. Modifications _ Any modification of the Ordinance must be approved by the City Council in accordance with the Zoning Reclassification proceedings of PUD Ordinance 32-26 Page 5 of 7 Wacker Plaza PUD Section 16-9 of the Unified Development Code. J. Recording A copy of this PUD Ordinance shall be recorded, at the expense of the property owner, with the Dubuque County Recorder as a permanent record of the conditions accepted as a part of this reclassification approval. This ordinance shall be binding upon the undersigned and his/her heirs, successors, and assigns. Section 3. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 4.
