INTRODUCTION
This is in response to a request from Northeast Iowa Community College (NICC) for the
vacation and sale of a portion of the Main Street and West 71" Street Right of Way to be
known as Lot 25B of Block 11, Dubuque Downtown Plaza, in the City of Dubuque, Iowa,
as part of the Northeast Iowa Community College's construction of its proposed building
entrance site improvements at 700 Main Street in Dubuque, Iowa.
BACKGROUND
NICC is planning to remodel its existing Dubuque Center campus building at 700 Main
Street. The newly remodeled building will house classrooms, conference rooms, labs,
and associated facilities. Part of the remodeling plans includes the construction of a
new two-story entrance at the southwest corner of the existing building. The proposed
two-story entrance improvements will be located partially on what is currently City of
Dubuque street right of way easement.
In this area of the original City of Dubuque the adjacent lot owners own to the centerline
of the street and the City holds only a right of way easement. Per City Resolution No.
80-26, the City of Dubuque approved an agreement with NICC for the vacation and sale
of a portion of the Main Street and West 7t" Street right of way. The agreement includes
the dedication of fee title (City currently holds an easement) to the adjoining street and
alley rights of way, from NICC to the City, followed by the subsequent vacation and
disposal of portions of those rights of way from the City to NICC, in order to
accommodate the proposed NICC development plans. City staff, including Planning
Services, Engineering, and Parks and Recreation met with NICC representatives,
reviewed the proposal, and have determined that the right of way area to be vacated is
not needed. The proposed vacation of the designated portion of 7th Street is
anticipated to have minimal operational or public -access impact. Following completion
of the associated construction activities, sufficient right-of-way will remain to
accommodate installation of a standard City -compliant sidewalk. All pedestrian facilities
will be rebuilt to conform to applicable City design standards and accessibility
requirements. The City of Dubuque Development Review Team has finished its review
of the construction plans and has issued an approval letter. The agreement states that
the right of way property will be sold to NICC for $1,674.00. NICC will also be
responsible for all surveying, platting, and publication and filing costs.
As part of the agreement, the property owner is responsible for the surveying and
platting of the proposed division of the property and right of way vacation as well as all
costs for publication and filing fees. The attached plat shows the portion of the street
right of way area proposed to be vacated and conveyed to NICC to facilitate the
construction of its proposed building entrance site improvements. The portion of the
street right of way area to be vacated is to be known as Lot 25B of Block 11, Dubuque
Downtown Plaza, in the City of Dubuque, Iowa.
DISCUSSION
The attached plat shows the street right of way area proposed to be vacated. The right
of way area to be vacated is described Lot 25B of Block 11, Dubuque Downtown Plaza,
in the City of Dubuque, Iowa.
Per City Resolution No. 293-26 and City Resolution No. 295-26, the City Council
approved the platting of Lot 25B of Block 11, Dubuque Downtown Plaza, in the City of
Dubuque, Iowa, and the setting of a public hearing to vacate and dispose of the
property at its August 17, 2026 meeting. A copy of the vacation plat and public hearing
resolution are attached to this memo.
After the above resolutions were adopted, it was identified that the legal description of
the plat contained an error. Therefore, this City Council meeting includes an action item
after the public hearing to correct the naming/legal description of the parent tract for Lot
25B of Block 11, Dubuque Downtown Plaza, in the City of Dubuque, Iowa in previous
City Council resolutions.
RECOMMENDATION
I am recommending the vacating and disposal of the alley right of way described as Lot
25B of Block 11, Dubuque Downtown Plaza, in the City of Dubuque, Iowa, through
adoption of the enclosed resolution.
ACTION TO BE TAKEN
I respectfully request that the vacating and disposal of the street right of way described
as Lot 25B of Block 11, Dubuque Downtown Plaza, in the City of Dubuque, Iowa, be
approved through the adoption of the enclosed resolutions.

Whereas, pursuant to resolution and published notice of time and place of
hearing, published in the Telegraph Herald, a newspaper of general circulation
published in the City of Dubuque, Iowa on the 7th day of August 2026, the City
Council of the City of Dubuque, Iowa met on the 17th day of August 2026, at 6:30
p.m. in the Historic Federal Building Council Chambers (second floor), 350 West
6t" Street, Dubuque, Dubuque County, Iowa to consider the request to vacate; and
Whereas, the City Council of the City of Dubuque, Iowa overruled any and
all objections, oral or written to the request to vacate; and
Whereas, the City Council of the City of Dubuque, Iowa, has determined

RESOLUTION NO. 295-26
RESOLUTION OF INTENTFOR THE VACATION AND DISPOSAL OF A
PORTION OF CITY LOT 25A, IN THE CITY OF DUBUQUE, IOWA, BEING A
PART THE WEST 7TH STREET AND MAIN STREET RIGHT OF WAY, TO BE
KNOWN AS LOT 25B, OF BLOCK 11, DUBUQUE DOWNTOWN PLAZA, IN THE
CITY OF DUBUQUE, IOWA
Whereas, Northeast Iowa Community College, a school
corporation, (NICC) has requested the vacation and sale of a
portion of the West 7th Street right of way lying east of Main
Street, in the City of Dubuque, Iowa, and adjacent to its
existing property, in order to accommodate the construction of
its proposed building entrance site improvements at 700 Main
Street in Dubuque, Iowa (NICC Improvements); and
Whereas, per City Resolution No. 80-26, the City of Dubuque
approved an agreement with NICC for the vacation and sale of a
portion of the Main Street and West 7th Street right of way in
order to accommodate the proposed NICC Improvements; and
Whereas, NICC has requested the vacation of said right of
way and the conveyance of said property to NICC per said
agreement; and
Whereas, WHKS has prepared and submitted to the City Council
a plat showing the proposed vacated portion of portion of City
Lot 25A, in the City of Dubuque, Iowa, said vacated portion to
be hereafter known as Lot 25B of Block 11, Dubuque Downtown
Plaza, in the City of Dubuque, Iowa.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the City of Dubuque intends to vacate and
dispose of the right of way area to be known as Lot 25B of
Block 11, Dubuque Downtown Plaza, in the City of Dubuque,
Iowa.
Section 2. That a public hearing, and/or by virtual means,
on the intent to vacate and dispose of the right of way area
to be known as Lot 25B of Block 11, Dubuque Downtown Plaza, in
the City of Dubuque, Iowa is hereby set for the 17th day of
August, 2026, at the Historic Federal Building, 350 W. 6th
Street, Dubuque, Iowa, beginning at 6:30 p.m., and the City
Clerk be and is hereby authorized and directed to cause a
notice of public hearing on the intent to vacate said real
estate to be published in the manner as prescribed by law.
