Mr. Bodenhofer's vehicle was parked in the street in the vicinity of the house where the warrant was to be served. The damage was caused by contact between police officer weapons and the body off the car. Kim Sims, Senior Claim Representative for the Iowa Communities Assurance Pool, investigated the claim and concluded that the actions of the police officers at the scene constituted a response to an emergency under Iowa Code § 670.4(11), for which a city has immunity from tort liability. The language of the statute plainly states that the only relevant inquiry in determining whether the city has immunity under the emergency response provision is whether the plaintiff's claim is "based upon or arising out of an act or omission in connection with an emergency response" by officers or employees carrying out their official duties. Iowa Code § 670.4(11); Kershner, 618 N.W.2d 346. Harrod v. City of Council Bluffs, 2008 Iowa App. LEXIS 328, *8-10. An emergency is commonly understood to be an urgent, unexpected, and usually dangerous situation that poses an immediate risk to health, life, property, or environment and requires immediate action. Senior Claims Representative Sims contacted City of Dubuque Police Corporal Brad Shannon who provided the following description of the incident: [Shannon] advised that there was a shooting in the city that night involving an individual who sustained a gunshot wound to the leg. Law enforcement tracked the individual to a residence. Due to the risk assessment and the individual's extensive history, the situation was considered high risk. Officers believed the suspect was inside and armed and dangerous. The entry team was deployed in full tactical gear. A vehicle [the Bodenhofer vehicle] was parked on the street, and officers positioned themselves in a manner that provided both visibility and cover. Units were also positioned behind the residence. The entry team cleared the residence; however, the suspect was not located inside. Shannon stated he reviewed the operation and confirmed that officers were positioned to the rear of the vehicle with weapons drawn over the top. He further advised that a search warrant had been signed, and investigators had probable cause to believe the suspect was inside the residence. The suspect was considered a threat to public safety, and the risk level was high due to his known history of being armed. He indicated that, given the layout and circumstances, there was nothing that could have been done differently in terms of positioning, which is why officers staged behind the residence. The search warrant needed to be executed at that time. He also noted that this was a prolonged operation. Officers made announcements over loudspeakers, removed occupants from the residence, deployed a drone, and utilized a K-9 unit. Based on that information, Sims recommended denial of the claim under the emergency immunity exception. The City Attorney's Office has reviewed the file and concurs with Sims' recommendation that the claim should be denied. I respectfully ask the City Council to reconsider my claim because I was not the person who was the subject of the search. I was not involved in the circumstances that led law enforcement to the residence, and at the time of the incident, I was asleep. Despite having no involvement in the reason for the police activity, my personal vehicle was damaged during the incident. The damage is documented in the photographs included with this appeal, and the estimated cost of repairing the damage is $3,310.00. 1 understand that law enforcement officers were performing their duties. However, I believe it is important for the City Council to consider the circumstances from my perspective. I was an innocent third parry. I did not cause the situation that resulted in the search, I was not the person law enforcement was looking for, and I had no control over the actions that resulted in my vehicle being damaged. I am therefore asking the City Council to reconsider the denial of my claim and reimburse me for the $3,310.00 necessary to repair my vehicle. I have included photographs documenting the damage and supporting evidence. I can also provide the repair estimate or invoice and any other documentation the City Council needs. I respectfully ask that the Council consider the fact that I was not involved in the incident and that I should not have to personally absorb a $3,310 expense for damage to my property resulting from an incident in which I had no involvement. Under Iowa Code § 670.4(i), a city is not liable for "[a] claim based upon or arising out of an act or omission of a municipality in connection with an emergency response ....." The legal standard for liability is generally negligence. In the case of emergency response, the legal standard for liability is recklessness. A representative of the Iowa Communities Assurance Pool who investigated the claim concluded that under the circumstances, City of Dubuque police officers were confronted with an emergency, the recklessness standard applied, and the officers were not reckless. We agree with that conclusion. As a result, the City is immunity from liability for the damages, i.e. the City has no liability for the claim. Payment of damages in the situation where the City has no liability would not be for a public purpose but rather would be a payment for a private purpose -essentially a gift - which is prohibited by the Iowa Constitution. The only basis for payment of the claim would be a finding of the City Council that the police officers were not confronted with an emergency, or, even if they were confronted with an emergency, they acted recklessly.
