that Atlantic avenue be improved was

Petition of John Phillips et al. ask-
ing that the grade of Grandview
avenue from Delhi street to Dodge
street be lowered and the street im-
proved was on motion referred to the
Street Committee, City Attorney and
City Engineer to report to the Com-
mittee of the Whole.
Petition of Harbor Master J. H. Car-
roll asking for an increase of salary
was on motion granted, and his salary
to be increased at the same ratio as to
the police department.
Petition of James Lee, Sr., asking for
permission to excavate in front of Lot
10, 11, and 12 Gilliam's Sub. on east
end of Angella street in order to widen
the street was on motion granted.
Petition of M. M. Walker Co., et al
asking that the regular monthly mar-
ket day be held on streets around
Phoenix Park instead of on Seventh
street was on motion referred to the
Committee of the Whole.
Remonstrance of Dr. O. F. Kempf et
al. remonstrating against the laying of
cement sidewalks on the north side of
Southern avenue from Valley street to
English Lane was on motion referred
to the Committee of the Whole.
Communication from Illinois and
Western Railway asking that the ordi-
nance granted on March 4th b0 passed
again and a 90 days' acceptance be in-
serted in place of the 30 days' accept-
ance, was on motion received and
action deferred.

of Pine street, which I would recom-
mend for your adoption.

Profile of Althauser avenue from the
east side of Stafford avenue to the
center of Eagle street, which I would
recommend for your adoption.
Also, please find attached grade of
Willow street from the east line of
Finley and Burton's add. to the east
end of Willow street, and I would rec-
ommend the same as shown by the red
line for your adoption.

posed change of grade of Bluff street

of 700 feet.
Third, from the easterly R. R. track
of the C., M. & St. P. R. R. on 17th
street to the Bee Branch sewer in
Washin_ ton street.

City Attorney Kintzinger reported as

Gentlemen: — Herewith attached
please find Treasurer's receipt of Fif-
teen ($15.00) Dollars for money collect-
ed for license fee from the Patent
Novelty company.
Also attached please find contract of
release and settlement of Bridget Mad-
den for $800.00 in full of all damages
in her case against the city. This case
has been dismissed and the costs paid,
amounting to $12.00, for which amount
also find receipt attached.

City Recorder Linehan also presented
and read the printed notice, certified
to by the publisher, of the council's
intention to construct a sanitary sewer
in West Locust street, Alta Vista
street, Rosedale avenue, Willow street
and Asbury street. Remonstrances of
C. A. Voelker et al and W. J. Clark
et al remonstrating against the pro-
posed sewer, were then read. The no-
tice was on motion received and filed
and the remonstrances referred to the
'committee of the whole..
By the unanimous consent of the
council, permission was granted the re-

monstrators against the two proposed
sewers to address the council. Mr. T.
J. Paisley, C. A. Voelker and W. J.
Clark then addressed the council.
City Recorder Linehan presented and
read the printed notice, certified to by
the publisher, of the council's inten-
tion to construct a sanitary sewer in
Grace street, Louisa street, Algona
avenue, West 14th street and Auburn
avenue. Remonstrance of C. A. Voel-
ker ct al remonstrating against said
proposed sewer was then read. The
notice was en motion received and
filed and the remonstrance referred to
the committee of the whole.

You are hereby notified that at a ses-
sion of the City Council held September
20th, 1906, the following resolution was
adopted: "Be it Resolved by the City
Council of the City of Dubuque, that
Iowa street from the southerly curb
line of Third street to the southerly
curb line of First street and First
street from the westerly curb line of
Iowa street to the easterly lot line of
Main street be improved by brick pav-
ing the same on a concrete foundation
in accordance with the plans and speci-
fications for such improvement pre-
pared by the City.Engineer and now on
file in the office of the City Recorder,
and be it further
Resolved, That said improvement
shall be completed on or before the
first day of December, 1906, and shall
be paid for in the manner prescribed
by Chapter XXXII of the Revised
Ordinances of the City of Dubuque for
the payment of the cost of street im-
provements.
The proposals for doing said work
shall be acted upon by the Council on
the 4th day of October, 1906, and the
City Recorder is hereby ordered to give
ten days' notice by publication asking
for proposals as provided by ordinance.
At a subsequent meeting of the City
Council, the time set for the completion
of the above improvement was extend-
ed to May 1, 1907, and you are further
notified that you are required to im-
prove the space between your tracks
and one foot outside the same along
the aforesaid streets in accordance
with the plans and specifications for
said work prepared by the City En-
gineer, and have the same completed
not later than May 1, 1907.
You are further notified that you are
required to designate in writing within
five days after the service of this no-
tice, whether or not you propose to do

the work of improvement yourself.
Should you fail to designate your wish-
es in writing within the time specified,
it will he presumed that you do not
propose to make the improvement your-
self, in which case the city will make
the improvement and assess the cost
and expense thereof against your prop-
erty.

City Assessor Scherr reported as fol-

whom was referred the Detition of M.
Kassler, asking that the valuation on
city lots 309 and 310 be reduced, would
respectfully recommend that said peti7
tion he granted and that the valuation
on said lots for assessment purposes
be placed as follows: Lot 309, Fifteen
Hundred Dollars, lot 310, One Thousand
dollars, and that the City Treasurer
be instructed to accept the taxes for
the year 1906 on the foregoing basis.

gutter and reconstruction of street in-

On motion the contract was awarded
to Street & Steuck, they being the low-
est bidder, and their bond be placed at
$400.00.
Ald. Closs moved that the action of
the Council taken, by receiving and fil-
ing the report of the City Engineer on
the 22nd street sewer, be reconsidered.
Carried.
Whereupon Aid. Closs then moved
that the City Recorder be instructed
to advertise for bids for constructing
a storm water sewer in 22nd street
from Jackson street to the Bee Branch
sewer in Washington street. Carried.
Ald. Closs moved that the City Re-
corder be instructed to advertise for
bids for laying clown a cement sidewalk
six feet wide in front of and abutting
sub. 3 of lot SS -26 ft., L. H. Lang -
w orthy's add., owned by Margaret
Graf Est , and situated on the west side
of Washington street between Lincoln
avenue and Eagle Point avenue; said
sidewalk to be constructed at the ex-
pense of the property owner. Carried.
REPORTS OF COMMITTEES.
Ald. Hines moved that the City Re-
corder be instructed to advertise for
bids for cleaning and sweeping brick
paved streets. Carried.
Ald. Thomas moved that a warrant
in the sum of $500.00 be drawn in favor
of the Mayor with which to settle the
claim of Nell Hennessy. Carried.
Ald. Hines stated that the matter of
the bridge at the foot of Seventh street
was still in the hands of the commit-
tee of the whole, and that the Standard
Lumber Co. and other parties were
anxious to have the bridge fixed so
their teams could cross same, and he
suggested that the matter be taken out
of the committee of the whole and re-
ferred to the committee on streets.
Owing to the absence of Ald. Clancy,
chairman: of the committee of the
whole, no action was taken on the mat-
ter.
Ald. Hines moved that George Miller
be given authority to furnish the cups
for all the drinking fountains in the
city for the coming year. Carried.
Ald. Hines moved that when the
,Council adjourned, they would adjourn
until Monday evening, April 8th, 1907.
Carried.
Unanimous consent of the Council
was given Mr. John Phillips to address
the Council in regard to the matter of
change of grade of Grandview avenue.
Whereupon Ald. Hopkins moved that
the City Engineer visit Grandview
avenue and go over same and report
- the result of his investigation to the
Council at the meeting Monday even-
ing. Carried.
Ald. McEvoy, chairman of the com-
mittee on sprinkling, reported as fol-
lows:
Your committee mn sprinkling, to
whom was referred the matter of con-
ferring with the Union Electric Co.
relative to an agreement with said com-
pany for the sprinkling of the streets
• occupied by their tracks, would re-
spectfully report that we have had a
meeting with the officers of said com-
pany and have arrived at the following
agreement: The Union Electric Com-
pany to sprinkle all down town streets
occupied by their tracks according to
a schedule to be prepared later, and as
far as Linwood on Windsor avenue and
McClain's store on Dodge street when
the present tracks have been replaced
with heavy rails. The charge per day
of 10 hours to be Twenty -three Dollars
and Fifty Cents ($23 50), of which
amount the Union Electric Company is
to bear 30 per cent. as its proportion
of the expense. The fixed charge
against the city for depreciation, in-
surance, etc., to be Six Dollars and
Fifty Cents ($6.50) per day for 24 days
per month of six months per year.
Seventeen Dollars ($17 00) per day of
10 hours to be added when sprinkling is
required. At the end of ten years the
city to acquire an interest of 70 per
cent. in the ownership of the car. The
running of the car to be under the
supervision of the Superintendent of
Sprinkling and not to be run on rainy
days.

We believe that the foregoing ar-
rangement will be advantageous to the
city and will overcome much of the
dissatisfaction hitherto existing on ac-
count of the lack of facilities to do the
street sprinkling properly, and would
therefore recommend that the Mayor
and City Attorney be instructed to
draw up a contract in accordance with
the foregoing, to he signed jointly by
the Mayor and the proper officer of the
Union Electric Company.

matter of grade for corner of Wash-
ington and Sanford streets, offered the

Be it Resolved by the City Council
of the City of Dubuque, That the
Street Commissioner be instructed to
put in a twelve -inch tile pipe sewer on
the south side of Sanford street from
the west side of Washington street to
the first intake east thereof, and to
lower the curb at both the southeast
and southwest corners of Sanford and
Washington streets, and also to raise
the crown of Washington street at this
:point.
Ald Thomas :moved the adoption of
the resolution.
Ald. Hopkins asked what the cost of
the work would be. City Engineer
stated the work would cost about
$140.00.
Ald. Closs stated that this sewer
would not altogether remedy the trou-
ble now existing, and suggested that
the sidewalk on the northwest corner
of Washington street be lowered at the
city's expense.

the matter be referred to the commit-
tee of the whole, City Attorney and
City Engineer. Carried.

Petition of Jos. Ryder asking that
the city accept $78.54 in full settle-
ment for special assessment levied in
1892 for improving Cleveland avenue
abutting lot 91 in Union add., was on
motion, referred to the committee of
the whole and City Attorney.
Petition of the Illinois and Western
Railway asking that the ordinance
granted them on March 4th, 1907, be
again passed and a ninety (90) day
clause be inserted so as to give their
company GO days in addition to the
time granted on March 4th. in which
to accent said ordinance. On motion
the petition was granted.

Be it Ordained by the City Council of
the City of Dubuque:
Section 1. That Section Nineteen
(19) of the Ordinance granted to the
Illinois and Western Railway on March
4th, 1907, by the City Council of the
City of Dubuque, be and the same is
hereby amended by repealing said sec-
tion and enacting in lieu thereof the
following to be known as Section 19
of said original ordinance, as follows:
"Section 19. The aforesaid Illinois
and Western Railway shall be deemed
to have abandoned all rights and privi-

less it shall within ninety (90) days

bridge.
City Engineer I]g reported the bridge
was in an unsafe condition and that it
was dangerous to leave the bridge re-
main as it was. Ald. Hopkins asked
the Engineer to make a written report
to the Council giving his opinion.

dition of the highway bridge on 7th
street across the slough near Day's
mill, I wish to report that said bridge

eral parties had come to him on Sat-
urday asking that the work on the
Stampfer building be stopped, as the
contractor was excavating the alley
and street and that he had not taken

out a permit for such excavation, and
at the demand of these people he had
stopped the work. He stated the con-
tractors were present to explain their
position and he moved that the rules
be suspended to allow the contractor
permission to address the Council.

Mr. Fred Burdt then addressed the
Council, stating that he had obtained
a building permit from City Engineer
Ilg for erecting the building according
to plans and specifications as submit-
ted to the City Engineer and that he
was not aware it was necessary to take
out an excavation permit. Con Sulli-
van, Sewer Inspector, also addressed
the Council in reference to the con-
tractors building a wall east of the
sewer in the alley in the rear of the
building, Security Building Co. main-
taining that the sewer was a private
sewer and that they had a right to
build this wall as contemplated.
Ald. Hines then moved that the con-
tractors be granted an excavation per-
mit and that the matter of the sewer
be referred to the sewer committee
and City Attorney with power to act
at once.
Bill of the City of Dubuque against
Key City Gas Co. for $8.00 was pre-
sented and on motion was referred to
Committee Clerk for collection.
Ald. Stumpf, chairman of the com-
mittee on sewers, reported as follows:
Your committee on sewers, to whom
was referred the petition of Roshek
Bros.. asking that they be granted per-
mission to connect their new building
on the corner of Eighth and Main
streets with the sanitary sewer in the
alley between Main and Iowa streets
because the sewer in the alley between
Main and Locust streets is too high
to be available, would respectfully
recommend that the prayer of the said
petitioners be granted, provided the
work be done at their own expense,
with the exception of one manhole
which it has been agreed shall be nut
in by the city, and provided further
that the contractors doing said work
shall furnish a bond to the eonti''ctnre
doing the work of brick - paving Eighth
street, conditioned on the replacing of

of 3 to 4 feet of said grade at North
street would be advisable in order to
provide for a better drainage. Said
change of grade would necessitate a
10 -inch tile pipe sewer at North street
from the east side of Grandview ave-
nue to the west side of Grandview ave-
nue,

Electric Company of Dubuque, its
successors and assigns, the right to
erect and maintain poles, wires and
other fixtures in the streets, alleys,
and public parks of the City of Du-
buque, for electric light power and
other purposes until March 6th, 1927,
and abrogating all franchises previ-
ously granted to said Union Electric
Company, or any of its predecessors
in title or interest, except the street
railway franchise granted to said Un-
ion Electric Company, on March 6,
1902, and excepting an ordinance adopt-
ed June 16th, 1904, to construct a sin-
gle track along Twenty- fourth street
'21 of said sub- division, in the City of

to whom was referred the petition of
James A. Hayes, administrator of the
estate of Mary A. Mulkern, deceased,
asking that the City Treasurer be in-
structed to accept the sum of Fifty -six
and 5 100 Dollars ($56.05) in settlement
of the special assessment levied
against city lot No. 221 for the im-
provement of Iowa street, would re-
spectfully recommend that the prayer
of the petitioner be granted and that
the City Treasurer be so notified.

Ald. Hines moved that the matter
of uniforms for the policemen be re-
ferred to the committee on police and

Mayor Schunk stated the contract
with the Union Electric Co. for the
sprinkling of the streets was drawn
up and ready to be signed, when Mr.
L. D. Mathes, manager of the Union
Electric Co. returned to the city on
Saturday.
Ald. Closs, chairman of the Board
of Health, reported as follows:

Gentlemen: —Your Board of Health
would respectfully report that at a
meeting held April 5th, 1907, the con-
tract for hauling garbage and dead
animals for the season of 1907 was
awarded to E. E. Frith at $16.94 per
day during the entire season.
Also report the contract for vault
cleaning was awarded to Mr. Martin
Bennett at 10c per cubic foot, below
the bluffs and 11c per cubic foot on
the bluffs, for the season from May
1, 1907 to May 1, 1908.
Also report the following officers
were appointed to serve for the en-
suing year:
Sanitary Policeman —Frank Flynn.
Health Physician —Dr. Chas. Palen.
We also recommend that warrants
be drawn in the sum of $39:00 in favor
of Joseph Scanlan and E. P. Peryon,
respectively, for acting as members of

Also report that Sanitary Officer
Flynn was instructed to notify Messrs.
.John Olinger and Joseph Hird to re-
-move the nuisances now on their

Alderman McEvoy moved that the
ordinance committee be instructed to
amend Section 4 of the ordinance re-
establishing the office of Street Com-
missioner by striking the words "Ten
Hundred Dollars" therefrom and in-
•serting in lieu thereof the words
"Twelve Hundred Dollars." Carried.
Ald. Hines moved that the wages of
the street laborers be increased 10c
per day, from $1.50 to $1.60 per day,
commencing April 15th, 1907. Carried.
Alderman Hines offered the follow-
ing:
Whereas, Bart E. Linehan has filed
his petition asking for the vacation
of the alley in Block twenty (20) in
Dubuque Harbor Company's addition,
and represents that he is the owner of
all the property abutting on said alley,
and
Whereas, said Bart E. Linehan lep•
resents further that it is his intention
to use said block for manufacturing
purposes, therefore be it
Resolved by the City Council of the
City of Dubuque, That the City Engi-
neer be and he is hereby directed to
make a survey and plat of that part
of said alley proposed to be vacated,
to be filed in said Engineer's office
•subject to public inspection, and to
give the notices required by ordinance
to all the owners of property abutting
said ground proposed to be vacated,
and to publish the notice required by
ordinance of the said proposed vaca-

Section 34 of the Ordinance in rela-
tion to Offenses and Penalties reads as
follows:
No person shall cast or leave ex-
posed in any street, alley, lot, common,
or water course within the city, the
carcass of any animal, or any putrid
or unsound meat, fish, or other sub-
stance, or make use, keep, or permit,
in his, her or their dwelling heusr,

shop, store, factory, outhouse, cellar,
yard, lot ,or any other place within the
city, any noisome or offensive liquid,
or substance injurious to the health
of the citizens, or an annoyance to the
neighborhood, or throw any filth, ma-
nure, offal, or other offensive matter,
in any street, alley, lot, or water course
in the city, and any person who shall
refuse or neglect to remove on being
notified by the city any such offensive
substance made, used or kept by such
person, shall be subject to a fine of
not less than one dollar nor more
than twenty dollars, and be imprisoned
until such fine and costs are paid, not
exceeding thirty days.
In accordance with the foregoing
section, you are hereby notified to re-
move all filth, ashes, rubbish, etc., from
the alley in rear of your premises with-
in ten (10) days from date of this no-
tice or you will be prosecuted to the
fullest extent of the law.

Notice is hereby given to all con-
cerned that a special assessment will
be levied to pay for the improvement
of Elm street from 24th to 26th streets,
O'Farrell Contracting Co., contractors.
Amount of special assessment,
$2,997.60, against the abutting property
upon and along said street as pro-
vided by law, at a session of the City
Council to be held May 2nd, 1907.
And that there is a plat and sched-
ule on file in the office of the City
Recorder of said City of Dubuque,
showing the street, on which said im-
provement was made and the separ-
ate lots and parcels of ground and
specified portions thereof subject to
assessment of such improvement, the
names of the owners as far as practi-

tified that it is the intention of the
City Council of the City of Dubuque
to construct an 8 -inch tile pipe sani-
tary sewer in Eagle Point avenue
from the intersection of Windsor ave-
nue to the middle of Stafford avenue.
That a plat and specifications of
said proposed sewer is now on file in
the office of the City Recorder.
It is estimated by the City Engineer
that it will require 430 lineal feet of
8 -inch tile pipe with 2 manholes and
will cost the abutting property own-
ers $380.00.
Any persons having objection to the
construction of said sanitary sewer
are hereby notified to appear before
the City Council at its regular session
April 18th, 1907, or to file in writing

Sealed proposals will be received at
the office of the City Recorder until
7:30 o'clock p. m. Thursday, April
18th, 1907, for the construction of a
storm water sewer in 22nd street from
the west side of Jackson street to the
Bee Branch sewer in Washington
street, in accordance with plans and
specifications now on file in the office
of the City Recorder.
The work to be completed on or be-
fore the 1st day of July, 1907, and
shall be paid for when said work is
completed and accepted by the City
Council.
The proposals for doing the work
will be acted upon by the City Coun-
cil on the 18th day of April, 1907.
Bidders must state price per lineal
foot for 30 -inch tile pipe sewer, 30-
inch concrete pipe sewer, square stone
sewer, intakes, each, manholes, each.
Each bid must be accompanied by
a certified check for $50.00 on some
Dubuque bank as a guarantee that a
contract will be entered into if award-
ed.
The City Council reserves the right
to reject any and all bids.

Be it Ordained by the City Council of
The City of Dubuque:
Section 1. That Section Nineteen
(19) , of the Ordinance granted to the
Illinois and Western Railway on March
4th, 1907, by the City Council of the
City of Dubuque, be and the same is
hereby ,amended by repealing said sec-
tion and enacting in lieu thereof the
following to be known as Section 19
of said original ordinance, as follows:
"Section 19. The aforesaid Illinois
and Western Railway shall be deemed
to have abandoned all rights and privi-
leges conferred by this ordinance un-
less it shall within ninety (90) days
after the passage and approval thereof
by the Mayor, file in the office of the
City Recorder a written acceptance
of the .privileges hereby conferred sub-
ject to the condition and terms herein
contained."
Sec. 2. This ordinance shall be in
force and effect from and after its
passage and publication in the Tele-
graph - Herald, an official newspaper of
the City of Dubuque, Iowa.
