Ald. Clancy moved that the council
.proceedings for the month of August,
1907, .be approved as printed. Carried.
Ald. Clancy moved the rules be sus-
pended to allow the committee from
Dubuque Business Men's Club to ad-
.dress the Council. Carried.
Mr. C. T. Hancock and H. B. Gniffke
then addressed the Council, stating the
City of Dubuque had in previous years
paid an assessment of $250.00 each year
to the Upper Mississippi River Im-
provement Association, and requested
that the city appropriate $250.00 this
year for that purpose.
Whereupon Ald. Clancy moved that
a warrant in the sum of $250.00 be
drawn in favor of Mr. N. J. Schrup,
:Secretary of the Upper Mississippi
River Improvement Association, to pay
the clues of the city of Dubuque for
the year 1907 in said association. Car-
ried.

PETITIONS AND COMMUNICA-
TIONS.
Petition of J. V. Rider, George Bur-
den and B. W. Lacy agent for Grace R.
Willoughby estate, owners of E. 51
feet of E. 2 -5 of out lot 461, S 1 -5 of
out lot 457, S. 87 1 -2 feet of out lot
458 and S. 1 -5 of out lot 459 asking
that the Council accept amount of
original assessments without interest
in full settlement for the special as-
sessment for paving Iowa street was,
on motion, referred to finance com-
mittee and City Attorney.
Petition of H. B. Glover et al asking
that the Council take measures to pre-
vent the continuance of laundry in the
building on Main street recently de-
stroyed by fire, claiming the use of
said building for said purpose is a
menace to the surrounding property
and depreciates . the valuation of the
said property, was, on motion, referred
to the committee of the whole.
Petition of Dubuque Cabinet Makers
Association et al asking for the abate-
ment of laundry in the building recent-
ly burned, same being a nuisance and
a detriment to the trade' of the mer-
chants in the vicinity, was, on motion,
referred to the committee of the whole.
Petition of C. J. Young et al asking
that an electric lamp be placed at the
corner of West Third and Nevada
streets, was, on motion, granted and
the City Electrician to be instructed to
have light installed at once.
Petition of Pauline Rohr asking that
her taxes for the year 1906 on lot 283,
East Dubuque add., be reduced one-
half, she being a widow and unable to
pay same, was, on motion, granted and
the Treasurer to be instructed accord-
ingly.
Petition of Mary L. Blondin asking
that taxes for the year 1906 on her
homestead be exempted front taxes to
the amount of $800.00, she being the
widow of an honorably discharged sol-
die', was, on motion, granted and the
Treasurer to be instructed accordingly.
Communication from the City Coun-
cil of Council Bluffs, Iowa, inviting the
il[ayor and City Council to attend the
Tenth Annual Convention of the League
of Iowa Municipalities to be held in
Council Bluffs September 17th, 18th
and 19th, 1907, was, on motion, received
and the Recorder to notify the com-
mittee accordingly.
Communication from James Lee &
Son, contractors, for John T. Adams,
C. H. Gregoire agent of C. H. Gregoire
estate, and Marie L. McCartny asking
the Council not to accept any bids for
laying sidewalks on Nevada street
abutting on lots 1, 2, 3, 4, 6 and west
1 -2 of lot 33, Nairn's add., was read
and on motion bids were ordered not
opened and action deferred for two
weeks, bids to be opened on September
19th if sidewalks are not laid before
that time.
Petition of S. F. Kenneally et al
remonstrating against the construction
of a sanitary sewer in Chestnut street,
was, on motion, referred to the com-
mittee of the whole.
Petition of Pitts - Thompson Foundry
Company asking that they be exempted
from taxation for the year 1906 as per
resolution adopted April 29th, 1905, was,
on motion granted, and Treasurer to
be instructed accordingly.
Petition of the Dubuque Boat and
Boiler Works asking that their taxes
for the year 1906 be cancelled as per
ordinance passed by the City Council,
was, on motion, granted, and Treasurer
to be instructed accordingly.
Petition of Hottman Boiler Co. ask-
ing that their taxes be remitted for a
period of five years, or for such a per-
iod as the Council may deem proper,
was, on motion, referred to the com-
mittee of the whole, and Mr. Hottman
to be notified to be present at the meet-
ing of the committee.
Petition of James T. Carr asking that
he be granted permission to construct
a brick sidewalk on the south side of
Seminary street in front of sub 2 of
mineral lot 193, lot 1, instead of ce-
ment as was ordered by the Council,
was on motion, granted, and bricks to
be accepted by Street Commissioner
before sidewalk is constructed.
Communication from the League of
Iowa Municipalities asking that the
City of Dubuque send a delegate to the
convention of the League of Iowa
Municipalities to be held in Council
Bluffs, was, on motion, received and
filed.
Petition of Daniel Lyons asking that
the barb wire fence in the alley abut-
ting his property on Milwaukee ave-
nue be removed and alley made clear
for travel, was, on motion, referred to
the Alderman of the Fifth ward and
Chief of Police with power.
Petition of Mary E. Blake asking
that she be allowed until next spring
to lay sidewalk on Foye street, was,
ou motion, received and filed.
Communication from J. E. Shortel]
asking for the use of the alley between
his lots 23, 24 and 25 on Milwaukee
avenue, and lots 31, 32 and 33 on Dia-
mond avenue, was, on motion, received
and filed.
REPORTS OF OFFICERS.
Mayor Schunk stated that according
to the ordinance it became incumbent
on the Council to appoint a commit-
tee_ on assessments to act as a Board
of Equalization at its present session,
and he submitted the following list,
which, on motion of Ald. Clancy, was
approved:

To the Honorable City Council:
Gentlemen :—In the matter of the
proposed change of grade on Grand-
view avenue from Bennett street south
to station 15, I beg to report that act-
ing in accordance with Section 786 of
the Code of Iowa and Section 21 of
Chapter 31 of the Revised Ordinances
of 1901 of the City of Dubuque, I se-
lected C. H. Meyer to act as one of the
appraisers to appraise any damage that
might accrue to the property of Sidonia
Hosford, Thomas Hill, J. Steadman and
the John T. Hancock estate by reason
of such contemplated Change of grade
and have caused notice of such selec-
tion to be served on the above named
owners of property abutting on said
avenue. That each of said owners was
directed in said notice to select an ap-
praiser to appraise the damage if any
accruing to his or her property by rea-
son of said contemplated change of
grade and report the name of such ap-
praiser to me within ten days from
the time of receiving said notice. That
ten days have elapsed since the service
of said notice and that Sidonia Hosford
has selected S. B. Lattner and the John
T. Hancock Estate has selected W. A.
Leathers. That J. Steadman and
Thomas Hill have failed to select an
appraiser in accordance with the said
- fire department for the month of
August, 1907:

I find from the reports of the police
department that the total hours that
168 lamps failed to burn would equal
3 1 -2 lamps burning for one month, or

The following is the pay roll of the
394 Regular Session, September 5, 1907
relation to the special assessment
levied August 4th, 1904, for the sani-
tary sewer in White street, between
Eagle Point avenue and Sanford
street, against the N. E. 1 -4 of Lot
25, owned by R. Flick, and found that
they are unable to make connections
with said sewer, as the owner of the
property joining Flick's will not per-
mit them to go through his ground.

grade and profile of Pleasant street,
from Stafford avenue to Viola street.
The grade is shown by red line, and
I would recommend the same for your

1563.00 cubic yards of cut.

Sidewalk Inspector Mahoney reported
as follows:
To the Honorable Mayor and City
Council:
Gentlemen —Your undersigned side-
walk Inspector, to whom was referred
the petition of Margaret Drees, claim-
ing assessment for cleaning snow and
ice abutting sub. city lot 738, lot 1 lev-
ied January 21st, 1904, amount of as-
sessments $1.25 is erroneous, would re-
spectfully report I have investigated
same and itnad work was done under
the supervision of Wm. Woodward,
foreman Fourth ward street laborers,
and would therefore recommend that
said assessment be not canceled, same
not being erroneous.
Also, beg to report on the petition of
L. F. Cook, et al, which was referred
to me, asking that sidewalk be laid
on north side of 23rd street between
Elm and Pine street, would respect-
fully report that owner of said prop-
erty has been notified-by me to lay said
walk and has complied with said no-
tice and sidewalk is now laid as asked
for.

On motion the report of the sidewalk
inspector was received and adopted.
City Recorder Linehan presented and
read the printed notice, certified to by
the publisher, of the Council's inten-
tion to construct a sanitary sewer in
the alley between Rhomberg and Lin-
coln avenues, from present sewer at
Middle avenue to Reed avenue. No re-
monstrance being filed and no one in
the room objecting to the said improve-
ment, the notice was on motion receiv-
ed and filed.
City Recorder Linehan also presented
and read the printed notice, certified

amined the sanitary sewer in Kauf-
mann avenue from the manhole first
west of Couler avenue to North Main
street, thence southerly in North Main
street to Leibnitz street, thence west-
erly in Leibnitz street to Paul street,
D. W. Linehan, contractor, and would
recommend that said sewer be accept-
ed and that the City Engineer be in-
structed to prepare a special assess-
ment against the lots or parcels of land
subject to assessment for such im-
provement and file the same in the of-
fice of the City Recorder, who will
thereupon publish the notice required

be granted and that the ordinance com-
mittee and City Attorney be instructed
to prepare a suitable ordinance govern-.
ing such extension.

Alderman Hines moved that the
action taken by the City Council at its
session of August 1, 1907, having in
view the condemnation of a certain
strip of land through the properties of
R. W. Kemler and Lawrence Smith
estate, be rescinded because of the de-
sire of petitioners for said street to
slightly change the lines thereof.
Carried.
Whereupon Alderman Hines offered
the following:
Whereas it is deemed advisable by
the City Council of the City of Dubu-
que to lay out and open a street fifty
(50) feet wide through the property of
R. W. Kemler from West Fifth street
and extending in a northerly and
northwesterly direction through lot 6
of 7 of mineral lot 79 to the easterly
line of lot 8 of mineral lot 79, all said
property being in the City of Dubuque,
Iowa, therefore be it
Resolved by the City Council of the
City of Dubuque, That the City Engi-
neer be and he is hereby directed to
make a survey and plat of such pro-
posed improvement, showing the land
or lots through or over which the same
is proposed to be made, the names of
the owners thereof, the quantity of
land proposed to be taken and file such
plat in his office for public inspection;
that after such plat is so prepared and
filed, said Engineer shall give the own-
ers of the property through or over
which such improvement is proposed
to be made, notice as prescribed in
Section 2 of Chapter XXXI of the Re-
vised Ordinance of 1901 of the City of
Dubuque.
Ald. Hines moved the adoption of the
resolution. Carried.
Ald. Closs stated that the contractors
on the improvement of Althauser ave-
nue had finished a part of said contract
and were anxious to have same ac-
cepted so that that portion of the street
could be rolled and covered, and that
he had examined same and found it to
be a first -class job. Whereupon Ald.
Closs moved that the portion of Alt -
hauser avenue now finished by Street
& Steuck, be accepted. Carried.
Special assessment for the improve-
ment of Eighth street from the west lot
line of Bluff street to the railroad
tracks, Adams avenue from First to
Second avenue, and for constructing
sanitary sewer in Eagle Point and
Windsor avenue were presented to the
Council to be levied.
Mayor Schunk raised the question
of the legality of levying a special
assessment without having the affirma-
tive vote of three - fourths of the
whole number of the members of the
council and asked the City Attorney
for his opinion, whereupon City Attor-
ney Kintzinger stated that a majority
vote of the council was sufficient to
pass a resolution ordering a special
assessment levied.
Ald. Closs offered the following:

an order be made authorizing the pay-
ment to him of $42.00 upon the delivery
of certificates of tax sale for city and

Petition of Wm. Webber asking that
the city pay him $5.00 as damages
claimed to have been sustained by fall-
ing on a defective sidewalk on Dodge
street between Hill and South Dodge
street, was on motion, granted, and a
warrant ordered drawn in favor of the
Mayor in the sum of $5.00 in full settle-
ment of all damages.

REPORTS OF OFFICERS.
The following communication from
Mayor Schunk was presented and read:
Dubuque, Iowa, September 16,1907.
To the Honorable City Council, City of
Dubuque, Iowa:
Gentlemen: -The petition of the Key
City Gas Company for an extension of
charter by ordinance for ten years from
the termination of their present fran-
chise has had my careful attention.
The present franchise was given for
twenty -five years, and does not termi-
nate for fifteen years, hence there can
be no urgent necessity for action now.
We should hesitate and well consider
the proposition before undertaking to
legislate for a city council that will be
in existence when the gas company's
franchise expires.
The laws of Iowa contemplate that
no franchise shall extend beyond a
period of twenty -five years. The pro-
posed extension while it may not be
technically illegal, yet it absolutely
does annul and make void the intent
and purpose of that law by giving op-
portunity for evading it.
The Key City Gas Company's propo-
sition promises extensive improvements
in their plant, yet it neither offers nor
gives any idea of the nature, scope or
extent of these improvements. When
asked for a definite statement of what
these improvements would be and their
probable cost, I am told that it is im-
possible to say even approximately
what they will be or what they will
cost. This is too indefinite.
This fact does not influence my de-
cision, however. I am unalterably op-
posed to giving any valuable privileges
of the city without equivalent return
to the city. There should be an ex-
change of values. It being something of
value to them, it is something of value
to the city, and we should be paid for
it. The gas company offers the city
nothing in return for this extraordinary
grant. The improvements it offers to
make will give value to its property
and business wisdom directs them;
otherwise they would not .be made.
I take this method of advising your
honorable body that I deem it a public
duty to veto the ordinance and will do
so if it ever reaches me.

intention to construct a permanent
sidewalk five feet wide on the west
side of Southern avenue, between
Dodge and Valley streets, abutting on
Lots 3 and 4, Stout's Add., owned by
Michael Burke. No remonstrance being
filed and no one in the room object-
ing to the construction of said side-
walk, the notice, was, on motion, re-
ceived and filed.
City Recorder Linehan also present-
ed and read the printed notice, certi-
fied to by the publisher, of the coun-
cil's intention to levy a special assess-
ment for the construction of a sanitary

City Attorney, to whom was referred
the communication of John V. Rider,
Rider & Burden, and B. W. Lacy,
agent for the Grace R. Willoughby
estate, in relation to the special assess-
ment Levied against the East 51 feet
of the South 2 -5 of City Lot 461, the
South 1 -5 of City Lot 457, the South
871 -2 feet of City Lot 458, and the
South 1 -5 of City Lot 459 for the
brick paving of Iowa Street and offer-
ing to pay the entire original assess-
ment for said improvement witnout
interest, would respectfully recommend
that said offer be accepted and that
the City Treasurer be instructed to ac-

from Windsor avenue to Stafford ave-

dollars and one bond of the amount
of one hundred and thirty -one and 25-

Mayor Pro Tem Clancy stated that
residents of Allison Place and College
avenue were present in the council
chamber and wanted permission to ad-
dress the council in reference to sani-
tary sewer in College avenue.
Permission being given, Prof.
Lightcap and Mr. Collis addressed the
council stating that they were anxious
to have the sewer constructed and the
parties living on Allison Place who
signed the petition asking for the
sewer were willing to pay their pro-
portionate share of cost of constructing
the sewer.
On motion, the City Engineer was in-
structed to ascertain if the majority
of the property owners living on Col-
lege avenue had signed the petition
asking for the sewer.

fifth street from the east side of Wash-
ington street to the west side of Elm
street, the O'Farrell Contracting Co.,
contractors, and would recommend that
said work be accepted and that the
City Engineer be instructed to pre-
pare a special assessment against the
lots or parcels of land subject to as-
sessment for said improvement and
file the same in the office of the City
Recorder, who will thereupon publish
the notice of said assessment as re-
quired by ordinance.

the order to lay a cement sidewalk oY

rescinded because of his intention of
building on an adjoining lot in the
near future and his desire to construct
a cement walk after the building is
completed, would recommend that the
prayer of the petitioner be granted
provided he sign a waiver holding the
city harmless from any damage f0 '
personal injuries that may be sus-
tained on said walk and agrees to put
the same in safe condition without de

Also, your Committee of the Whole,
to whom was referred the petition of
V. E. Robison et al. protesting against
the changing of the tile pipe which
carries the water from Julien avenue
along the west side of lots 46, 47 and
48, Morheiser's Add., and asking that
said pipe be returned to its original
location because such location had
been agreed upon by all par-
ties interested at the time
Julien avenue was improved,
would respectfully report that the
changing of said pipe was done in error
and we would respectfully recommend
that the Street Commissioner be in-
structed to replace said pipe in its
original location without delay.
Also, your Committee of the Whole
would respectfully recommend that an
electric lamp be placed on Mt. Carmel
avenue about 300 feet from Grandview
avenue under the direction of the Com
mittee on Police and Light.
Also, your Committee of the Whole,
to whom was referred the communi-
cation from the League of Iowa Muni-
cipalities asking that the City take out
a membership or in any event to send
a delegate to the 10th annual conven-
tion to be held at Council Bluffs Sep-
tember 17 to 19, 1907, would respect-

spected by the City Council, Street
Commissioner, Street Committee and
City Engineer as provided by the ordi-
nance governing street improvements.
Also, your Committee of the Whole,
to whom was referred the petition of
the Hottman Boiler Company asking
that its taxes be canceled for a period
of years, would respectfully recom-
mend that said firm be exempt from
taxation on its machinery and other
personal property for a period of five
years beginning January 1, 1907, and
that the Ordinance Committee be in-
structed to prepare an ordinance gov-
erning said exemption.
Also, your Committee of the Whole,
to whom was referred the claim of An-.
drew Wieser for damage caused his
property by water flowing from the
street thereon, would respectfully rec-
ommend that said claim be not al-
lowed.

Also, your Committee of the Whole,
to whom was referred the communica-
tion of the Dubuque Telegraph - Herald
relative to the purchase of new direc-
tories, would respectfully recom-
inend that an order be placed for
twelve directories to be distributed at
the several engine houses and different
city offices under the direction of this
committee.
Also, your Committee of the Whole,
to whom was referred the remon-
strance of S. F. Kenneally et al. against
the construction of the proposed sewer
in Chestnut street, would respectfully
report that it is not feasible to con-
struct a sewer in said street under
present conditions and would therefore
recommend that action in this matter
be deferred until such time as an out-
let can be had for a sewer from said
street.
Also, your Committee of the Whole,
to whom was referred the claim of E.
F. Milligan for $245.00 and of Fred
Merz for $345.00 for damage caused
their buildings and property by water
from the West Locust storm water
sewer, would respectfully report that
we have examined the premises dam-
aged and would recommend that E. F.
Milligan be allowed the sum of $200.00
and F. Merz the sum of $300.00, the
same to be in full settlement for all
damage caused by reason of said water
flowing onto their premises, and pro-
vided - they both sign an agreement to
be prepared by the City Attorney to
provide for the drainage from their
property in the faiure and take care of
all future damage from this source.

Your special committee to whom was
referred the matter of building a
retaining wall on Althauser avenue
would respectfully report that I have
consulted with the property holders
and have concluded that it is abso_
lutely necessary to build a retaining
wall on said street, the property own-
ers agreeing to donate four lineal feet
of ground for that purpose and it will
be a source of continual expense if it
is not completed as set forth.
Ald. Closs moved the adoption of the
report of the special committee. Car-
ried.
MOTIONS AND RESOLUTIONS.

Be it resolved by the City Council
of the City of Dubuque, Iowa, that Wm.
Hintrager, the owner of Lot 22 in O.
Taylor Sub., be and he is hereby or-
dered to have said . lot filled up to
grade, lot being now below grade and
a menace to the adjoining property;
and to have said work completed with-
in 14 days from the adoption of the
resolution, and the service of said
notice. In case of failure to comply
with the order within the specified
time said work will be done by the
City and the costs for same taxed
against said property.

hereby ordered to construct an eigh-
teen -inch tile pipe drain under their
right of way on Seventeenth street and
to have said work completed within
thirty days from the date of service of
notice and the adoption of this reso-
lution, said work to be done in ac-
cordance with the plans and specifica-
tions for same on file in the office of
the City Engineer.

the resolution.

on the 21st day of August, 1907, adopt
the following resolution:
Be it Resolved by the City Council
of the City of Dubuque, Iowa: That
a permanent sidewalk of the width
of five feet be and the same is hereby
ordered to be laid on the west side
of Southern Ave., between Dodge and
Valley streets, and in front of and
abutting the following described pre-
mises, to wit:
Lots 3 and 4, Stout's Add.
Such sidewalk to be constructed of
materials and in the manner as fol-
lows, to wit: Eight inches of cin-
ders, three inches of concrete and one
inch of cement wearing surface.
Said sidewalk to be completed on
or before the 15th day of October,
1907, and the cost of the same be

lected in the manner prescribed by
law.
Be it Further Resolved. That said
property owner be and is authorized
to construct said sidewalk at his own
expense, provided he begins work
thereon within ten days after being
notified by the City Recorder of the
passage of this resolution by the City
Council, and completes the sauce with-
in thirty days thereafter.
Be it Further Resolved, That if said
work is not commenced within the
time named in said notice that the
City Recorder be and is hereby ordered
to give ten days notice by two publi-
cations asking for proposals for the
doing of said work under contract
with the City. The proposals for the
doing of said work shall be acted upon
by the City Council on the 19th day of
Sep tember, 1907.
You are further notified that you
will be permitted to lay this walk
yourself providing the work thereon
is begun within ten days and com-

be levied to pay for the construction
of an 8 -inch tile pipe sanitary sewer
in Kaufmann avenue from the alley
first west df Couler avenue to North
Main street, thence southerly in North
Main street to Leibnitz street, thence
westerly in Leibnitz street to Paul
street.
Amount of special assessement,
$1,494.79, against the abutting proper-
ty upon and along said street as pro-

Notice is hereby given to all con-
cerned that a special assessment will
be levied to pay for the construction
of an 8 -inch tile pipe sanitary sewer
in the alley between Rhomberg and
Lincoln avenue from Kniest street to
Johnson avenue, by O'Farrell Con-
tracting Co., contractors.
Amount of special assessment,
$380.00, against the abutting property
upon and along said street as pro-
vided by law, at a session of the City
Council to be held October 3rd, 1907.
And that there is a plat and sched-
ule on file in the office of the City
Recorder of said City of Dubuque,
showing the street, on which said sani-
tary sewer was constructed and the
separate lots and parcels of ground
and specified portions thereof subject to
assessment of such improvement, the
names of the owners as far as practi-
cable, and the amount to be assessed
against each lot or parcel of ground,
which plat and schedule is subject to
public inspection.
And that any and all persons ob-
jecting to said special assessment of
said plat must file his or their ob-
jection in writing with the City Re-
corder of said City of Dubuque on or
before said session of the City Coun-
cil to be held October 3rd, 1907, or
to appear at said session of the council
to show cause, if any you have, why

osition is now pending before the City
Council of the City of Dubuque, for
the establishment of a street across
land in which you claim an interest,
as follows: Lot 6 of lot 7 of the sub-
division of Mineral Lot No. 79, City
of Dubuque, Iowa, a plat of which pro-
posed improvement has been filed in
the office of the City Engineer of said
city, and you are notified that at a
session of the said City Council to
be holden at the City Hall of said
city on the 17th day of October, 1907,
it will be determined whether said pro-
posed improvement will be made, and
you are hereby notified to appear be-
fore said Council at said session, and
