Ald. Hines stated that the towel sup-
ply for the city hall had been changed
from Young Bros. to Foley Laundry
without the consent of the city council,
and asked that the City Attorney give
the council a written opinion as to
what committee the city hall building
property belongs.
On motion of Ald. Clancy matter
was referred to the committee of the
whole and City Attorney to give said
committee a written opinion on the
subject at the next meeting.
PETITIONS AND COMMUNICA-
TIONS.
Petition of Louisa Schwartz stating
that she is a widow without any means
of support and in poor health, and ask-
ing that the taxes for the year 1906 on
lots 7 and 9, in Marsh's Dubuque No.
2, and lot 6 in Kringle's sub- division
and lot 6a of Quigley's sub - division of
lot 711, be cancelled, was on motion
referred to the Board of Equalization.
Petition of Joseph Schaett'en et al
asking that the sewer in Broadway be
extended in the southern part of Broad-
way to their property, was on motion,
granted and the proper resolutions to
be prepared.
Petition of Dubuque Packing Co.
asking that the Bee Branch sewer be-
tween Sixteenth and Seventeenth
streets be arched so that alley can be
used as a driveway, was on motion,
referred to the committee of the whole,
and Mr. Beach to be notified to appear
at the meeting.
Petition of J. J. Grigg et al asking
that slough or frog pond situated on
lot 27 in Reche'se sub. be ordered
filled or drained at once, as same is a
nuisance and a menace to the public
health, was on motion, referred to
Board of Health.
Petition of Jas. McAloon asking that
the council adopt the resolution at-
tached to his petition granting him per-
mission to conduct a saloon on Julien
avenue in the building situated on lot
east 25 feet of lot 11 of city lot 688,
was on motion, granted.
Whereupon the following resolution
was read:
"Be it Resolved by the City Council
of the City of Dubuque, That consent
is hereby granted to James McAloon
to conduct a saloon in the premises
owned by Thomas Daykin and known
as the east 25 feet of lot 11 of city lot
688, on Julien avenue between Bluff
street and Rock street."

Acceptance of the ordinance of Bell
Bros. Company was read as follows:

On motion, the appraisement was
confirmed and report accepted and re-
ferred to the ordinance committee to
prepare ordinance.
REPORTS OF OFFICERS.
Mayor Schunk stated that at the
meeting of the City Council held Sep-
tember 5th, 1907, Mr. C. T. Hancock
and H. B. Gniffke addressed the Coun-
cil, stating the City of Dubuque had in
previous years paid an assessment of
$250.00 each year to the Upper Missis-
sippi River Improvement Association,
and requested that the city appropriate
$250.00 this year for that purpose. And
a warrant in the sum of $250.00 was
ordered drawn 111 favor of Mr. N. J.
Schrup, Secretary of the Upper Missis_
sippi River Improvement Association,
to pay the dues of the City of Dubuque
for the year 1907 in said association.
1layor Schunk reported that un-
known to Mr. Hancock, Mr. Gniffke,
the City Council or himself, this as-
sessment had been previously paid by a
former Council, and presented the fol-
lowing communication from Captain
John Killeen verifying the statement:

Dear Sir: - "I received a letter this
morning from Mr. L. B'. Boswell, Secre-
tary of the Upper Mississippi River
Improvement Association, stating that
the Dubuque assessment for the past '
year has been paid, and that the City
of Dubuque shows a clean record on
his books.

In view of this fact the Mayor re-
ported that he had not forwarded the
warrant ordered drawn at the Septem-
ber 5th meeting.
On motion of Ald. Clancy the Mayor's

Gentlemen :—In repairing West 16th
street the water brakes were made so
as to turn the water into the natural
water course, which has caused the
washing out of a portion of the ter-
race along the baseball grounds of
the St. Joseph's college.
I have been asked by the president,
Rev. D. M. Gorman, to repair same,
which damage will not amount to
more than five dollars ($5.00).
I would respectfully recommend to
your honorable body that I be instruct-
ed to make the necessary repairs.

City of Dubuque, and Henry Friederick,.

the City of Dubuque permit a slight
change to be made in the specifications.
with reference to the line of the curb
stone on Eleventh street so as to save -
the large trees now growing alongside
of said curbstone and waiving any il-
legality which such change might make
in the assessment for said improve-
ment.

AN ORDINANCE granting to William
Lawther Co., their successors and
assigns, the right to construct and
operate a high pressure water main
for fire protection in Locust street
from Fourth street to Second street
and east in Second street to alley,
south in alley to their manufactur-
ing plant and regulating same.
Section 1. That the William Law -
ther Co., their successors and assigns
are hereby authorized to construct,
maintain and operate a high pressure
water main six inches in diameter, to
be laid in Locust street from a con-
nection with the high pressure water
main at Bell Bros. Co. manufacturing
plant, south to Second street, thence
east in Second street to alley and
south in alley to their manufacturing
plant between First and Second streets
in the city of Dubuque; for the pur-
pose of providing sufficient and ade-
'tiate water pressure for fire protection
purposes 'only. Said line of water pipe
shall be constructed,• maintained and
operated at the expense of said Wil-
liam Lawther Co. under the direction
and supervision of the city engineer
and the superintendent of the water
works department of the city of Du-
bugue.
S'ec. 2. In the construction of said
water pipe line, the streets shall not
be unnecessarily obstructed; all ob-
struction's and excavations made in
any. street shall be properly barricad-
ed and 'lighted, and in any action for
damages caused' by such construction
nr excavation, the said William Law-
ther' Co. shall appear and defend the
same and shall pay any judgment ren-
dered against the city therein.
Sed: 3. The city of Dubuque may
at' any' time grant the right to any
other person or company to connect
with said high pressure water main
for fire prbtection only, upon paying
to the said' William Lawther Co. a
share of the cost of construction and
maintenance of said line, in propor-
tion to' the number of users and the
length of said main used by any such
person or company desiring to make
connection therewith, that is a pro-
portionate share of the cost' of con -
•structing and maintaining said ' line
from Fourth street to the point where

connection is made, and also paying
to the said William Lawther Co. and
Bell Bros. Co. a proportionate share
of the cost of constructing and main-
taining the said water line from Eighth
street to Fourth street in Locust street.
Sec. 4. The permission hereby
granted is upon condition that said
William Lawther Co. pay to Bell Bros.
Co. a proportionate share of the cost
of constructing and maintaining the
high pressure water main constructed
by said Bell Bros. Co. from Eighth
(8th) street to Fourth (4th) street in
said city.
Sec. 5. The city of Dubuque may
at any time connect such a number
of high presstre fire hydrants along
the line of said water main as it may
deem necessary, without paying any
part of the construction of said water
main.
Sec. 6. This ordinance shall be in
force from and after its publication in
the Telegraph - Herald and its accept-
ance in writing by the William Law-

deceased, for delinquent taxes against
said Jas. W. Farrell, deceased, the total'
amount of which including interest was
$899.99. It was claimed by the execu-
trix of said estate that said deceased
was not a resident of the City `'of'Du=
buque for two years for which taxes
were levied against him. Said execu-
trix therefore offered the City of Du-
buque $634.55 to settle said delinquent
taxes.
The undersigned believing it to the
best interest of the city to accept said
offer, have accordingly' done so, and we
therefore recommend that out action
and the action of the City Attorney;
making said settlement, be approved
and that the City Treasurer' be in=
structed to cancel the delinquent' taxes
for which suit was brought, for said''
sum of $634.55.

Comes now Joseph B. Workman and
submits to the common council of the

proposal to the Honorable Common
Council of the city of Dubuque, Iowa:
Gentlemen: —I propose to make a
careful and diligent search of the rec-
ords of this and other counties and
states for real and personal property
subject to assessment and taxation in
the City of Dubuque, that has escaped
assessment and taxation for any cause,
and to report the same, if any there be,
to the proper officers for assessment
and taxation, and for my services and
all expenses connected therewith, I
will charge the sum of money equal to

AN ORDINANCE.
AN ORDINANCE REGULATING THE
SALE OF MEAT, FISH AND FOWL
IN THE CITY OF DUBUQUE,
IOWA, AND PROVIDING FOR THE
APPOINTMENT OF A CITY MEAT
INSPECTOR AND PRESCRIBING
HIS DUTIES.
Be it Ordained by the City Council of
the City of Dubuque:
I. That the City Council of the City
of Dubuque, shall annually appoint
some suitable person to fill an office to
be known as a City Meat Inspector
from the date of his appointment until
the first day of May in each year, and
until his successor has been duly ap-
pointed and qualified.
II. It shall be the duty of such in-
spector to carefully inspect all fresh
and cured meats, fish and fowl kept or
offered for sale within the corporate'
limits of the City of Dubuque, and to
test the same by the best and most
efficient means to determine the fitness
of such meats, fish and fowl to be used
for human food and consumption. The
meats and fowl so inspected by said in-
spector shall he labeled by him and
such label shall contain in legible print
or writing the date of the inspection
and the result of said examination,
which said label shall be placed on a
conspicuous part of the meat and fowl
so inspected to apprise the purchaser
thereof when said meat and fowl were
so inspetced. And any and all fresh
meats so inspected by said inspector if
not sold within the period of seven days
after such inspection was made, shall
be again inspected and labeled, and no
meat, fish or fowl shall be sold or of-
fered for sale within the corporate
limits of the City of Dubuque, until
such meat, fish and fowl shall be in-
spected by the City Meat Inspector and
such meat and fowl labeled by him In-
accordance with the requirements of this
ordinance. And any and all meats,
fish and fowl shipped into the City of
Dubuque, to be sold for human food
and consumption, which have been in-
spected by the government inspector,
shall be also inspected by the City.
Meat Inspector for the purposes of this
ordinance, and for the, purpose of de-
termining whether any, change has
taken place in the condition of the said
meat, fish and fowl since said inspec-
tion was made by the government in-.
spector, and for the purpose of placing
on said meat and fowl a label con-
taining- the date of such inspection by
the City Meat Inspector, as required by
this ordinance.
III. It shall, be the duty of said in-
spector to immediately seize, condemn
and, after notice to the owner, destroy
any and all meats, fish and fowl that
he shall find to be tainted and un-
sound, and which are being kept and
offered for sale for human food and
consumption within the corporate lim-
its of the City of Dubuque, and his
notice to the person in possession of'
the same, stating the reasons 'why the
same are seized and condemned, shall'
be a sufficient warrant therefor. And
it shall also be the duty of such of-
_ficer to carefully inspect all premises
and places where meats and provisions
of any kind are kept for sale and to see
that the sane are kept in a clean,
wholesome and sanitary condition, and
any person, firm or corporation refus-
ing to obey any order or notice given
by him with reference to cleaning any
such premises or place, or destroying
any tainted or condemned meats or
other foods, shall be deemed guilty of
.a misdemeanor and shall be fined not
to exceed one hundred dollars, or such
_persons imprisoned in the city jail un-
til such fine is paid not to exceed thirty
days.
IV. The City Meat Inspector shall
_inspect all meats, fish and fowl kept
or offered for sale for human food and
consumption within the corporate lim-
its of the city of Dubuque, and no per-
son, firm or corporation shall sell or
offer for sale therefor to any person,
firm or corporation within the corpo-
rate limits of said city, any meat of any
.kind whatsoever until inspected by the
•City Meat Inspector and labeled in ac-
cordance with the provisions of this
.ordinance, so that the purchaser there-
of may know at what time such in-
spection was so made. And such officer
.shall be entitled to charge for such in-
spection the following fees:
V. Such officer shall receive seventy-
- five dollars per month or such com-
pensation as the City Council shall by
resolution or vote authorize, 'which
shall not be changed during the term
tor which he is appointed. The meat
•inspector shall also perform the duties
of City Milk Inspector and such other
duties and have such powers in addi-
tion to those specially granted by this
-ordinance and the ordinance providing
for the inspection of mills as shall rea-
sonably be necessary to carry out the
requirements of this office.
VI. That for the purpose of prevent-
ing the use in the City of Dubuque, as
herein provided, all meat and meat food
.products which are unsound, unwhole-
some, unhealthy and otherwise unfit for
:human food, the City Meat Inspector
herein above provided for, shall make
an examination and inspection of all
.cattle, sheep, swine and goats before
they shall be allowed to enter into any
slaughtering, packing, meat canning,
rendering or similar establishment in
the City of Dubuque, in which they are
to be slaughtered, when the meat and
-meat food products thereof are to be
used as human food in the City of Du-
buque; and all cattle, sheep, swine and
goats found on such inspection to show
symptoms of disease shall be set. apart
and slaughtered separately from all
• other cattle, sheep, swine or goats, and
when so slaughtered the' carcasses"bf
said cattle, sheep; swine or goats shall
be subject to it careful examination and

inspection according to the best known
methods for ascertaining their fitness
as human food. That for the purposes
set forth in this ordinance said meat
inspector shall make a post mortem ex-
amination and inspection of the car-
casses and parts thereof of all cattle,
sheep, swine and goats to be prepared
for human consumption at any slaugh-
tering, meat canning, salting,
packing, rendering or similar
establishment in the City of Du-
buque, which meats are intended for
use as human food in the City of Du-
buque, Iowa; and the carcasses and
parts thereof of all such animals found
to be sound, healthful, wholesome and
fit for human food shall be so marked
and labeled as heretofore set forth by
the inspector, and said inspector shall
label, mark, stamp or tag as inspected
and condemned all carcasses and parts
thereof of animals found to be unsound,
unhealthful, unwholesome or otherwise
unfit for human food; and all car-
casses and parts thereof thus inspected
and conderliped shall be destroyed for
food purposes by said establishment in
the presence of said City Inspector.
VII. Any person, firm or corporation
violating any of the provisions of this
ordinance shall, upon conviction there-
of, he punished by a fine of not less
than one hundred ($100.00) dollars, or
such person shall be imprisoned in the
city jail until such fine is paid, not ex-
ceeding thirty days.
VIII. This ordinance shall be in
force and take effect from and after its
passage and publication in the Tele-
graph- Herald, the official newspaper of
the City of Dubuque, Iowa.

through its sanitary officer. The appli-
cant must at the time of filing his ap-
plication with the city recorder deposit
with said city recorder the sum of five
dollars to defray the expenses of mak-
ing the necessary examination of the
herds and dairies, which cost of said
examination shall not exceed the surf
of twenty -five cents for each cow ex-
amined.
V. The hoard of health shall have
charge of and issue all licenses re-
quired under the ordinance, for which
no fee shall be charged (other than
the examination fee provided for in the
last section), said license shall author-
ize the holder thereof to sell milk with-
in the corporation limits of the city of
Dubuque, until the thirty -first day of
March ensuing, and no longer, which
license may be renewed on application
with or without further examination,
as the board may determine, provided,
however, that such license may be re-
voked whenever the applicant, or those
in the employ of such applicant, shall
violate any of the rules and regulations
of this ordinance, or any of the rules of
the board of health of the city of Du-
buque, Iowa, or for any cause on the
part of such applicant in the man-
agement, distribution and sale of such
milk which would or might prove
detrimental to the public health or
public welfare. Such licensee shall
cause the name and place of business
of such licensee and the number of
the license issued to such licensee to
be legibly and conspicuously placed
and printed on the outside of each
wagon, carriage, sleigh or other ve-
hicles used by such licensee in the dis-
tribution of such milk, and all li-
censees who sell milk from stores or
shops shall keep such license,con-
stantly posted in a conspicuous place
upon the walls of the room within
which said sale of milk is carried on.
VI. The board of health of the
city of Dubuque, Iowa, and all of-
ficials, inspectors and employes of
such hoard of health shall have the
right at all times to enter upon or
into the premises of any person
licensed, or who has made application
for a license under the provisions of
this ordinance, to examine and in-
spect the dairy and dairy herd of such
licensee or applicant, and they shall
also have the right to enter upon or
into the premises of any person, firm
or corporation from whom such li-
censes or applicant shall obtain Milk
to sell within the corporate limits of
the city of Dubuque, Iowa, to inspect
the dairy and dairy herd of such per-
son, firm or corporation, and any re_
fusal on' the part of such licensee, ap-
plicant or person, firm or corporation
furnishing milk to such licensee or ap-

plicant to allow such entry and inspec-
tion as may be required by this ordi-
nance, shall be followed by the revo-

VII. It is hereby made the duty of
the city veterinarian or all other of-
ficers of the city of Dubuque, Iowa,
designated by the board of health to-
carry into effect the provisions of this
ordinance, to cause the dairies and
dairy herds of licensees and the dairies=
and dairy herds of all persons, firms or
corporations selling milk to such.
licensees, to be inspected at least once
every three months and oftener if
they deem it requisite and necessary
for the public welfare, and if the con-
ditions which are required - as pre-
requisites to obtaining a license under -
the provisions of this ordinance, or
the rules and regulations of said board
of health are not constantly maintain-
ed. then it shall be their duty to make
a report to such board of health and
such recommendation in regard there-
to as they may deem proper.
VIII. Any person, firm or corpora-
tion violating any of the provisions of
this ordinance shall, upon conviction,
thereof, be punished by a fine of not
less 'than one hundred dollars.
($100.00), or such persons shall be
imprisoned in the city jail until such
fine is paid, not exceeding thirty days_

and take effect after its passage and
publication in the Telegraph-Herald,
the official newspaper of the City of
Dubuque, Iowa.

AN ORDINANCE.
An Ordinance to provide for the in-
spection of Milk, Dairies and Dairy
Herds, and to License and Regulate
the Sale of Milk in the City of Du-
buque, Iowa.
Be It Ordained by the City Council of
the City of Dubuque:
I. That no person, firm or cor-
poration shall sell any milk within the
corporate limits of the city of Du-
buque, without first having obtained a
license so to do in the manner herein
provided.
II. Any person, firm or corporation
desiring to sell milk within the cor-
porate limits of the city of Dubuque
shall make application for a license
therefore to the hoard of health of the
city of Dubuque by filing with the
city recorder —the clerk of such board
—an application in writing, which ap-
plication shall state fully and ex-
plicitly:
First. The full name and place of
residence or business of said applicant.
Second. The exact location and
name of his dairy and the number of
cows therein contained, owned and
used by him, and if such person, firm
or corporation be not the owner of
the cows producing the milk to be so
sold, then the name and location of
the person, firm or corporation from
whom the milk is obtained for sale,
and the number of cows owned, used
and controlled by such person, firm or
corporation.
Third. The manner in which he
intends to sell and distribute the milk
when licensed, and the character of
the receptacles or vessels to be used
in storing and distributing such milk.
Fourth. Said application shall also
contain the assent of the applicant to
permit the city of Dubuque, through
the board of health of said city and
its officers, to inspect the dairy and
herd of such applicant, and the dairies
and herds from which said applicant
shall obtain milk, and unless such as-
sent is given the applicant shall be re-
fused a license and be prohibited from
selling or distributing any milk with-
in the corporate limits of the city of
Dubuque. Said application shall he
signed and sworn to by the applicant
and when received by the city recor-
der shall be placed on file and the
name of such applicant shall be en-
tered in a book of registration kept
by the city recorder for such pur-
poses, which book shall contain the
name of the applicant, the date when
such application was filed, the date
when a license was granted to such
applicant, or the date when such li-
cense was refused. The fili s of such
application for a license shall author-
ize such applicant to continue the
prosecution of the business until the.
hoard of health shall grant, or refuse
to grant, a license to the applicant
therefor.
III. Upon the filing of such appli-
cation with the city recorder of said
city, as provided for in the preceding
section, the board of health, or the
regularly licensed veterinarian, ap-
pointed by the city of Dubuque for
such purpose, or such officer as the
hoard of health of the city of Dubuque
shall designate, shall inspect the dairy
and dairy herd of such applicant, or
the dairy and dairy herd of such per-
son, firm or corporation from whom
such applicant obtains his milk with-
out unnecessary delay after the filing
of such application; and it is hereby
made the duty of the said board of
health to cause such officer to make-
an examination of each and every ani-
mal producing milk —for sale or con-
sumption-- within said city and be-
longing to or controlled by said ap-
plicant or person, firm or corporation
from whom said applicant obtains his
milk, for the purpose of detecting the,
presence of tuberculosis or any other
contagious or infectious disease; and
said officer in making such inspection
is hereby authorized to use any test
from which he can obtain the most
accurate and reliable results. Upon
such examination the officer making
the same shall place upon each cow
examined a tag showing the result of
said examination, which tag shall be
of such a character as to afford a per-
manent record of such examination
and shall show upon the face thereof
the date when such examination was
made and the presence or absence of
infectious or contagious disease. Such
officer shall also inspect the buildings
wherein the cows are kept and the
milk stored —the cans, vessels or re-
ceptacles wherein the milk is placed
for storage or distribution, and each
and every portion of the premises
surrounding the dairy which may
through unsanitary conditions be the
cause of infection or contagion, and
make a full and complete report of
his acts in each and every case to the
said hoard of health at each regular
meeting thereof, which shall be placed
on file in the city recorder's office in
said city, and shall furnish a bond in
the sum of $1,000.00.
IV. The board of health shall de-
termine from facts submitted to it by
the inspector, through his report, and
from other sources of reliable infor-
mation whether the application for
permission to sell milk within the cor-
porate limits of the city of Dubuque,
Iowa, shall be granted' or refused. If
'granted, a license shall be issued to the
applicant therefore —if refused, notice of
said refusal shall be served upon the

at its next session, notify the Council
thereof in writing with a printed copy
of such notice accompanying the same.

pointed by your honorable body to'at-
tend the meeting held in Council Bluffs,.
September 17 to 19th inclusive, of the
League of Iowa Municipalities with at
view of determining the advisability of
having the City of. Dubuque take out
membership in said league, would re-
spectfully report that he attended all
the meetings of - said' - convention and
was favorably impressed with the great
need for such an organization, espec-
ially in this state, • where our repre-
sentatives to the state assembly are
largely drawn. from farming communi=
ties and consequently are not familiar
:with the, requirements : Of 'or the gees,

tions that arise in the government of
a city, These questions are discussed
at the meetings of the league, as are
also other matters relating to civic im-
provement, and when deemed advisable,
intelligent and organized effort is made
to secure the adoption of laws beneficial
to the municipalities of Iowa. The
league has been instrumental in hav-
ing many such laws passed, and Du-
buque has shared in the benefits there-.
of without joining in the paying of the
expense necessarily incurred by the
league, which is manifestly unjust.
You will each receive a complete re-
port of the work of the convention in
the next issue of the "Midland Munici-
palities," which will be far more com-
prehensive than any report the under-
signed could make.
From personal observation of the
.good being accomplished by the league,
your delegate would unhesitatingly
recommend that the city of Dubuque
take out a membership therein.
The expense connected with the at-
tendance of your delegate to the con-
vention was fifty dollars.

Rules and Regulations With Flat and
Meter Rates of the City Waterworks
of Dubuque, Iowa.
The following rules shall be consid-
ered a part of the contract with every
person who takes water supplied by the
City of Dubuque, from the City Water
Works, and every person taking the
water shall be considered as having ex-
pressed his consent to be bound there-
by.
The City Water works agrees to fur-
nish water for certain specified uses for
a certain specified sum. If, therefore,
consumers furnish other people, or sup-
ply water for animals, or for sprinkling
or washing buggies, or to brick or
stone masons or plasterers, or permit
it to be taken without permission of the
City Water Works, or neglect to keep
their plumbing in repair to meet the
views of the Trustees, it is a violation
of the contract, and consumers so of-
fending will be required to pay double
the price of the water so used or wast-
ed in the estimation of the Trustees,
and the City Water Works reserves the
right to shut off the supply for such
abuses of water privileges.
Rule 1. All assessed water rents are
due and payable semi - annually in ad-
vance, on the first day of June and
December. If not paid within thirty
days at the office of the Board of
Trustees, ten per cent. penalty will be
added; and if not paid within five days
thereafter, the water shall be shut off,
and when turned off for non- payment
the water_ shall not be turned on until
all' back rent and a charge of one dol-
lar for turning off and on is paid.
Rule 2. ,No pipe shall be laid at less
depth than five feet below the surface
of the street, alley or yard, to be
measured , invariably from . the top of
the pipe; and every private pipe con-

netted with the works shall have a
stop -cock approved by the Trustees.
Rule 3. All tapping and inserting of
ferrules in the street mains or distrib-
uting pipes of the water works shall be
done by persons in the employ of 1he
Trustees, and under the direction of
the Superintendent.
Rule 4 No person shall, except in
time of fire, draw off or cause the water
to be removed from any public cistern,
public or private fire hydrant, private
fire protection opening (unless me-
tered), or open any valve on the afore-
said fire hydrants, or fire protection
opening, except in case of fire, or the
services be metered, or remove any
meter or the cap or cover of any fire
hydrant or stop -gate box.
No person shall connect or discon-
nect any fixture, or in any manner do
any work on water service pipes with-
out a plumber's license from Water
Works Trustees, or in any way or man-
ner injure the buildings, fire hydrants,
meters, water source or supply or any
apparatus or property belonging to the
Dubuque Water Works.
No person shall break any seal con-
nected to any meter, valve, private fire
hydrant, or other fixtures that may be
sealed by the Water Department, ex-
cept the seals on private fire hydrants,
and private fire protection valves,
which may be broken in case of fire
only, and when so broken it must be
reported to the Water Works office
within twenty -four hours thereafter,
and the person or persons offending or
neglecting to report same in the re-
quired time when the seal is broken,
shall have water shut off. Not turned
on until payment shall be made to the
Water Works of $100 for each offense.
Rule 5. No person or persons shall
be allowed to back up any horse,
horses or vehicle of any kind, or to
hitch to or leave standing the same
within five (5) feet of any fire hydrant,
or to place any goods, materials or
other obstructions within five (5) feet
of any fire hydrant, or to in any man-
ner whatsoever impede the free access
to, or the immediate connection with,
any fire hydrant by the Fire Depart-
ment.
Rule 6. The Superintendent of the
Water Works and each and every one
authorized by him are hereby named
and appointed inspectors, and they
may enter at reasonable hours into any
house or building ( supplied with water
of said works, to examine bibbs, pipes,
meters, cisterns, reservoirs, tanks or
other apparatus, for the purpose of as-
certaining the quantity df water con-
sumed or supplied, or for placing or
carrying away any meter, instru-
ment, pipe, fitting, or other work be-
longing t the city.
Rule 7: Hydrants, plugs, stop- boxes,
offender to have the water turned off
without previous notice.
Rule 22. In all cases where the water
is turned off for any violation of the
rules the owner or occupant of such
premises shall pay one dollar for turn-
ing the water off and on.
Rule 23. The use of hand hose is
permitted from six to eight o'clock in
the morning and from six to eight
o'clock in the evening, for any of the
purposes named in the permit, to -wit:
Sprinkling yards and gardens, washing
sidewalks, walks, steps, windows, and
fronts (rneter service excepted), except
in case of fire or when there is an
alarm of fire. During such time the
use of hand hose is strictly prohibited
for any of the uses hereinbefore
enumerated; and any person so of-
fending shall be fined in a sum not
exceeding ten dollars; water shall be
turned off, and not on again until the
fine is paid.
Rule 24. Any person desiring to dis-
continue the use of water must give
notice to the Superintendent on or be-
fore the first day of June and Decem-
ber, or they will be charged with water
rent to the next rent day; and in all
cases where persons desire a return of
water rent, the receipt must be re-
turned to the office. No refund of pre-
paid water rents for less than one
month shall be allowed.
Rule 25. Water closets and urinals
must be supplied with self - closing
valves. The use of other kinds is pro-
hibited, except on metered services.
Rule 26. Steam boilers taking a sup-
ply of water directly from the service
pipe, depending on the hydrostatic
pressure for supplying such boilers un-
der working pressure, will be required
to have tanks erected that will contain
an ample quantity of water for supply-
ing such boiler or boilers for at least
ten hours, in case the water is shut off
for necessary repairs or extensions, as
the Department will not be responsible
for any accidents or damages to which
such devices are frequently subject.
Rule 27. In all occupied premises,
every private fountain, bath, water
closet, wash basin, sink, or other fix-
tures, whether used or not, will be
deemed and held as used, and will be
charged for so long as such fountain,
hydrant, bath, water closet, sink or
other fixtures shall remain connected
with the water pipes; and hose bibbs
and hydrants with hose connections
will not be allowed without charge for
hose use, whether used or not. Meter
services excepted.
Rule 28. No permit shall be allowed
to any owner or occupant for the use
of water on the premises where the
water rent therefrom shall be less than
six dollars for twelve months; and no
charge less than five dollars shall be

made for sprinkling purposes only dur-
ing the season.
Rule 29. No more than twenty -five
per cent. discount will be allowed from
regular rates where permits are issued
for yard or street sprinkling with gar-
den hose, after two months or more of
the season have expired, and no re-
bate will he allowed for any sprinkling.

Rule 30. No abatement of water rent
will be allowed by reason of removal,
disuse, or diminished use, or vacant
premises, unless notice thereof is left
at the office at the time when such
change takes place.
Rule 31. Hydraulic engines, or ma-
chines of any design in which water
is Made use of as the motive power, or
any service requiring a running jet, or
automatic lawn sprinklers, will have
to be provided with an approved
meter and charged at meter rates;
meter to be furnished by consumer.
Rule 32. All sprinkling carts are
strictly prohibited from drawing water
from standpipes, fire hydrants or any
of the service pipes connected with the -
Water Works, during a fire.
Rule 33. All water used for street or
lawn sprinkling is subordinate to
domestic use and fire purposes, and is
subject to the control of the Water
Works Trustees, and its use may be re-
stricted by them at any time, should a
scarcity of water or emergency of any
kind require.
Rule 34. The Trustees reserve the
right to change the rules and regula-
tions, and the rates for the use of wa-
ter, from time to time; to make special.
rates on contracts in all proper cases;
to shut off the water for non- payment
of water rents, or for neglect or refusal:
to comply with the rules and regula-
tions of the Board; and for alterations,
extensions or repairs, and to stop and
restrict the supply of water whenever
it may be found necessary; and the
Trustees shall not be liable, under any
circumstances, for a deficiency or fail-
ure in the supply of water, whether oc-
casioned by shutting off water to make
repairs or connections, or for any
cause whatever.

and all other attachments must be kept
in complete repair, and the stop -boxes
kept exposed by the owner or occupant,
and protected from frost at their own
expense. The owner must provide a
stop and waste cock, and have the
pipes so arranged that the water can
be drawn from them whenever there is
danger of freezing.
For any violation of this rule the
Trustees shall have the right to make
any repairs or alterations they deem
necessary at the expense of the owner.
Rule 8. The following abuses are
absolutely prohibited, to -wit:
First. Permitting leaks, or allowing
Water to flow or escape unnecessarily
while washing pavements, sprinkling
lawns, gardens, or streets, drawing
water to fill street sprinkling carts or
other purposes.
Second. In no case will hose be al-
lowed for the purpose of sprinkling
sidewalks, gardens, streets and lawns,
or washing carriages or other vehicles,
havifig outflows or nozzles greater than
one - fourth of an inch in diameter
(meter service excepted).
Any violation of the foregoing rules
will subject the offender to have the
water turned off immediately, and the
unexpired term for which the water
may have been paid shall be forfeited.
Rule 9. No person without a written
permit from the proper officer is al-
lowed to turn a public stop cock, curb
cock or valve.
Rule 10. When cisterns are so lo-
cated as to supply separate premises,
and may be filled from hydrant, water
rent must be paid for all families or
other consumers having access to said
cistern. , .
Rule 11.> Cisterns located on prem-
ises where there, is no hydrant must
not be filled from the hydrant in any
case without special permit.
Rule 12. Hydrants niustiirrot be lo-
cated in • such a manner as to afford
parties occupying neighboring prem-
ises, or the public ready access to them;
and all parties having access to any
hydrants shall first have the costs as-
sessed, and pay for supplying their
premises with water. -
Rule 13. Any consumer who • shall
habitually permit others, not members
of his family, to use water from his or
their pipes, shall have the water turned
off, and not turned on until all charges
are paid.
Rule 14. Permits for sprinkling
yards, streets and sidewalks will be
issued from May 1st to November 1st,
which shall constitute the 'season for
sprinkling. . And no permit will be is-
sued for street sprinkling with hand
hose unless it is also taken for yard
use, excepting prerlrises that have no
yards.
Rule 15. Where meters are in use no
attachments will be allowed outside the
meter, but all water supplied through
such service must be paid for at meter
rates. Every house where a meter is.
set must have a separate service and a
separate meter, and every double house
where a meter is set must have a sep-
arate service and a separate meter for
each side.
Rule 16. In all cases where the water
or meter rent is not paid in accordance
with the rules, the service will be
turned off at the curb or in the street;
and it shall not be turned on again
until the bill due and all penalties are
paid; and when turned off at the fer-
rule five dollars will be charged, and
if the .street is paved, ten dollars will
be charged.
Rule 17. Application for permission
to erect private fire hydrants must be
made to the Superintendent at the
Water Works office.
Rule 18. Plasterers, bricklayers,
stonemasons, cement walk builders and
others are especially notified not to
take or use water from the Dubuque -
Water Works without a builder's per.
mit for every separate job; and all
owners or occupants are strictly pro-
hibited from furnishing water or al-
lowing the same to be taken from their
service (unless metered) by any per
son without a permit signed by the-
Superintendent of the Water .Works.
For any violation of this rule a penalty
of $10.00 will be incurred, and the use -
of the water will not be allowed on the
Premises until same is paid, and cost
of water used.
Ilule 19. Whenever two or more
parties are supplied with water from the
same service pipe, on the failure of any
one of said parties to pay the water
rent when due, or to comply with the
published rules and regulations of the
Trustees cf Water Works,. the supply
of water to such service pipe shall be
:withheld. without liabilities in damages
to any of the other parties beyond the-
forfeiture of the amount paid.
Rule 20. The regular water rent for
street, sidewalk - or garden sprinkling
will be based upon such use only for
dust' laying or sprinkling purposes;
fairly applied, and any excessive or
unreasonable use thereof for these or
other purposes is prohibited, except
when metered.
Rule' 21. Street sprinklers, garden'
hydrants, yard faucets, or other at-
tachments must not be allowed to run
or waste, or be converted into jets,
Unless metered; neither may they be
used for sprinkling or washing adjoin-
ing or opposite premises. Consumers
are also strictly prohibited from allow-
ing their hose or any other fixtures to•
run all night (unless metered). Any.
violation of this rule will subject the
tear, shall be chargeable to the con-
sumer and will be added to his next
water bill unless sooner paid.
Rule 8. If a meter at any time fails
to register the quantity of water used,
the quantity shall be determined and
the charge made, based on the average
amount registered during such pre -
ceding period of the time prior to the
date of failure, as the superintendent of
the water works may direct. No de-
duction will be made from water bills
on account of leakage.
Rule 9. In all cases where one ser-
vice connection supplies two or more
separate consumers, or a block occu-
pied by divers parties, only one meter
will be furnished for all said consumers,
and the water rent as registered by said
meter shall be chargeable to and pay-
able by the owner of said premises or
building. If additional meters are re-
quired for any building, the city will
furnish such additional meters of the
kind used by the department at the ex-
pense of the owner.
Rule 10. Water rents under the
meter system shall be payable at the
water works office as per record of
meter, every thirty or ninety days, as
determined by the superintendent. If
not paid within thirty days after the
bill is rendered, ten per cent. penalty
will be added; and if not paid within
fiVe days thereafter the water shall be
shut off, and when turned off for non-
payment the water shall not be turned
on until all back rent and a charge of
one dollar for turning off and on is paid.
Rule 11. Whenever meters are set
below basement or cellar floors they
must be encased in a brick or tile box
large enough to contain the meter, con-
nections, and check waste cock.
When set in basement or cellar, the
meter must rest on a tile, brick or
stone support.
Whenever meters are placed outside
of buildings they must be set in brick
pits, not less than three feet square,
Inside measurement, and deep enough
to be safe from frost. The pit must
be supplied with a close fitting cover,
also with iron rods for steps to enable
one to descend into the pit. The meter
must be placed in one corner of this
pit and be enclosed in a small tile or
brick box, with cover large enough to
permit setting or removing meter. Said
box must be built with its top even
with the surface of the ground in the
pit.
Rule 12. When meters are Co located
that they cannot be readily read cr in-
pected; or when any obstrudtion inter-
feres with an easy access to the .__ter,
the trustees shall have the right to
re -set the meter, or to remove the ob-
struction without notice, and r.t the ex-
pense of the property own ^r.

tions relating to consumers of city
water shall be deemed in -full force and
effect after publication as part of the
minutes of the Dubuque city council,
They are subject to revision as occasion
may require, and all former rules and
regulations in conflict herewith are
hereby repealed and annulled.
Relating to the Government of Licensed
Plumbers of the Water Depart-
ment of the City of Dubu-
que, Iowa.
Rule 1. No person shall introduce a
ferrule or other fixture into the mains
of the water department, except em-
ployees of said department. No person
shall make any attachment to, .or con-
nection with, the pipes of the water de-
partment, or make any additions to,
or alterations of any pipe, tap, cock
or other fixtures or change a plain fau-
cet to a hose connection, or other fix-
ture connected with the pipes supply-
ing water to consumers from the said
department, unless licensed as a plumb-
er by the trustees, under a penalty of
not less than $25.00 for each and every
offense.
Rule 2. Any plumber wishing to do
business in connection with the water
department shall, before receiving a
license to do so, file in the office of the
trustees his petition in writing, giving
the name of his firm and the place of
business, and ask to become a licensed
plumber and permitted to perform work
in connection with said department.
The said petition must give satisfac-
tory evidence that the applicant is (or
employs permanently) a practical and
experienced plumber; is a master of his
trade, and that he will be governed in
all respects by the rules and regula-
tions which are or may be adopted by
the department, and that he will pay all
fines imposed upon him for the violation
of any rules and regulations of the
water department.
Rule 3. Said plumber shall execute
to the water department a bond in the
sum of $1,000, with not less than two
sureties, residents of the county, or a
surety company to be approved by the
trustees, conditioned to indemnify and
save harmless the said water depart-
ment of and from all damages and loss-
es which may result from the work of
said plumber being done carelessly or
imperfectly, or in such a way that in-
jury or loss results therefrom, or by
reason of the failure on the part of any
employee to comply with all or any of
the rules and regulations of the water
department relating to plumbing, and
all the rules and regulations relating
to excavations in public streets and

N. B. In fixing fiat rates the above
schedule shall be a guide and not an
.arbitrary rule. The amount of water
consumed and the condition of the
plumbing, in the estimation of the trus-
tees, shall be the paramount consider-
ation.
Meter Water Rates.
The minimum rate to consumers
- owning meters shall never be more than
a flat rate for a similar service, and
never more than 75c per month.
Where the city owns the meter the
minimum rate shall be $1.00 per month.
First 10,000 gallons per month at 25c
per thousand gallons.
Second 10,000 gallons per month at
20c per thousand gallons.
Third 10,000 gallons per month at 15c
per thousand gallons.
Next 70,000 gallons per month at 130
per thousand gallons.
Next 50,000 gallons per month at 12c
per thousand gallons.
Next 100,000 gallons per month at
11c pet thousand gallons.
All over 250,000 gallons per month by
*,pecial contract.
Rules for Water Meters.
Rule 1. Whenever meters are the
private property of the consumers they
are subject to the same rules and regu-
lations which govern the use of meters
owned by the city.
Rule 2. Any consumer who desire
to pay meter rates must install the
ureter purchased of the city, at actual
cost, at his own expense. When water
rules are broken the second time within
one fiscal year, or when improper use
or wastefulness are suspected, the trus-
tees shall have the right to install a
meter at the expense of the consumer.
Rule 3. Any person who doubts the
accuracy of the meter he uses can have
the same tested in his presence. Com-
mon practice allows five per cent.
variation either way. Should the test
fall within this five per cent. limit, then
the meter will be adjudged as practi-
cally accurate, and the cost of the test,
Two Dollars, will be assessed tO the
applicant.
Rule 4. After the first day of Janu-
ary, 1908, all new connections made
with the city waterworks must be
metered at the expense of the property
owner, the meter to be purchased of
the city at the actual cost price.
Rule 5. All meters must be placed
by a licensed plumber at the expense
of property owners, and as near as
possible to where the service pipe
enters the building. The plumber doing
the work must flush the pipe thorough-
ly before connecting the meter. The
city will repair all meters that are out
of order, if lead chips or solder drips
are found to be the cause, a fine of $1.00
will be collected from the plumber that
performed the work for each and every
job so found, before issuing another
permit to said plumber. No water
meter shall be removed or disturbed
without first having obtained permis-
sion from the superintendent of the
water works.
Rule 6. A check and waste shall be
placed between the shut -off cock and
meter, and within one foot of the meter.
All meters shall be so located and
placed and kept free from all obstruc-
tions so as to afford easy access there-
to, so that they can easily be read and
inspected. In all cases where meters
have been ordered and placed no water
from the city water works shall be
taken, received or supplied to the build-
ing and fixtures for which the same
was constructed and intended, except
that which shall pass through and be
registered by such meter.
Rule 7. Meters damaged by frost or
otherwise will be repaired by the de-
partment. - A license plumber must re-
move and replace the meter. The ex-
pense of- such repair, except when'dam-
age is caused by ordinary wear and-

connections with the water pipes, and
all rules now existing or hereafter
adopted for said department.
0.-Ru le 4. No plumber shall allow his
name to be used by any other person
or party, either for the purpose of ob-
taining permits or doing any work un-
der his license. Neither shall plumbers
loan to water takers or others any key
for turning on or off water.
Rule 5. Plumbers will be held re-
sponsible, under the bond, for the vio-
lation of any of the rules or regula-
tions of the water department by jour-
neymen plumbers or others in their em-
ploy.
Rule 6. No plumber shall make any
• extension to, or alteration of, any tap,
pipe or other fixture attached to the
pipes of the water department, without
first having obtained a written permit
from the superintendent thereof. It is
understood that the above restrictions
in relation to obtaining permits are
not to prevent them from rendering as-
sistance in case of accidents to service
pipes occurring during the night or at
hou }s when the office is closed, the
trustees only requiring in such cases
that the permit shall be taken out im-
mediately after the opening of the of-
fice thereafter.
Rule 7. No person, except employees
of the department, is allowed to open or
close curb stops, except licensed plumb-
ers, who may do so for the purpose of
stopping leaks, repairs, alterations,
testing pipes, etc. And in 110 case shall
the plumber leave the water on when
they find it off at the curb.
Rule 8. Within forty -eight hours
after completing any attachment or
connection. the plumber shall :.iahe a,
return of the length and size of the ser-
vice pipe, the number and kind of fix-
tures, and where attached, according to
the rules and regulations, and file the
same in the office of the water 'com-
pany, as the water will not be turned
on to any premises until complete re-
turns have been made by the plumber;
or in case of the suspension of any
part of the completed work for any
cause, shall be the duty of the plumber
to make a return of the work as far as
completed.
Rule 9. No plumber shall be permit-
ted to enter the pipe or conduct water
into any two distinct premises or tene-
ments, unless separt to and distinct
stop -cocks shall be Placed on the out-
side of such premises, on the pavement
or in the alley opposite the same; and
the services two inches in diameter
and over must be provided with a valve
in the street and a valve box; nor shall
pipes be allowed to cross lots or ad-
joining premises. Every service pipe
must be furnished with a- stop and
waste cock immediately after the ser-
vice pipe enters the cellar, below the
action of the frost, so situated that the
water can be completely shut off and
drained from the pipe when necessary
to prevent freezing.
Rule 10. Every service pipe must be
laid at a depth of not less than five
feet below the surface, and sufficiently
waving to allow not less than six (6)
inches extra length for every thirty
feet or less of pipe, to prevent rupture
by settlement of the earth; and all lead
pipe used to convey water into the
premises, one inch or less shall be of
the kind known as "strong" for the low
presure system, and "extra strong"
for the high pressure system. All ser-
vice pipes more than one inch must be
of the "extra strong" quality.
Rule 11. All plumbers are required
to state on their permits whether the
faucets are plain or hose bibbs, and
yard hydrants whether plain spout or
hose connection; and permits must be
obtained to change plain faucets or
hydrants to hose connection.
Rule 12. Should a plumber fail or
neglect to take out a permit for any
fixture that he should connect, the de-
partment will hold him responsible for
the arrearages of water rent from the
date such, fixture was attached.
Rule 13. It shall be unlawful for any
plumber to take any outlet before the
meter, but all fixtures must be arranged
so that all water will pass through the
meter on every service provided with a
meter. Neither will any plumber be al-
lowed to attach or remove any meter
or break any seal without a special per-
mit signed by the superintendent.
For any violation of these rules, the -
party so offending will be suspended,
and before any further permits can be
granted they shall; appear before the
trustees, at their next regular meeting,.
and show cause why their license
should not be revoked.
Rule 14. All stop boxes shall have
square caps, and when stop box comes
through the sidewalk shall be made
level with surface and allow space for
placing wrench to remove cap, and
shall not be more than three inches
from curb. All boxes must be of a
telescope pattern approved by the su-
perintendent.
All the foregoing rules and regula-
tions relating to plumbers shall be
deemed in full force and effects after -
publication, as part of the proceedings
of the Dubuque city council. They are
subject to change and revision as oc—
casion may require, and all former
rules and regulations in conflict here -
with are hereby annulled and repealed.

Report of the Water Works Trus --
tees for the quarter ending October
1, 1907, was presented, read and on
motion referred to the Committee of
the Whole.
Bids for constructing sanitary sewer
in the alley between Rhomberg and
Garfield avenues from Middle avenue
to Reed avenue and in Reed avenue
to Lincoln avenue and in Lincoln ave-
nue to Middle avenue, were opened
and read.
Ald. Closs stated that since petition-
ing for said sewer the property own-
ers had decided that they did not, want
to be put to the extra expense of con-
structing this sewer until such time
as the water mains were extended and
moved that the rules be suspended to
allow the remonstrators permission
to address the council.
Simon Miller, Chas. O'Connor and
Mr. Schultz then addressed the council
i emonstrating against the constructing
of said sewer until such time as the
water mains were extended in Garfield
Avenue so that they could use the
sewer, and asked that the council peti-
tion the Water Works Trustees to ex-
tend their water mains in Garfield
Avenue.
Whereupon Ald. Clancy moved that
action be deferred on said sewer until
such time as water mains are extend-
ed and that the council petition the
Water Works Trustees asking for said
extension and the bids for construct-
ing sewer be returned to the bidders.
Carried.
Bids for constructing sewer in the
alley between Rhomberg and Lincoln
avenue from Middle avenue to Reed
avenue were presented and ordered
opened. Ald. Clancy stated Mr. John
Tibey wished to have his bid returned
to him, and moved the recorder re-
turn to John Tibey bid for construct-
ing sewer in alley between Rhomberg
and Lincoln avenue. Carried.

Resolutions and Motions.
Alderman Thomas offered the follow-
ing:
Whereas, the contract heretofore en-
tered into by the City of Dubuque for
the construction of a sanitary sewer
in Chestnut street from the alley first
west of Highland Place to the east line
of lot 3 of the sub. of lots 823 and 824
A. McDaniel's sub., has been completed
and the City Engineer has computed
that the cost and expense of said sewer
amounts to $201.50, and
Whereas, the -- owners of all the prop-
erty abutting on said improvement
have paid in full their assessments for
said improvement, and
Whereas, the system of keeping ac-
count of improvements assessable upon
abutting property necessitates the is-
suance of bonds in all cases to cover
the cost thereof, therefore be it

Improvement Bond.
The City of Dubuque in the State of
Iowa, has by its City Council caused
this bond for Two Hundred and One
and 50 -100 dollars to be issued in order
to, preserve the form of, procedure
adopted by the City of Dubuque in case

of street and sewer improvements and
in accordance with the laws and ordi-
nances bearing upon that subject.
This bond is not negotiable and is
of no value, being merely a "mock
bond," and issued for the purpose
aforesaid and in the case of the sani-
tary sewer constructed in Chestnut
street from the alley first west of High-
land Place to the east line of lot 3 of
the sub. of lots 823 and 824 A. Mc-
Daniel's sub., the cost of which sewer
has already been paid by the abutting
property owners, and this bond is to be
canceled as soon as executed.
In testimony whereof the City of Du-
buque by its Council, has caused this
bond to be signed by its Mayor and
countersigned by its City Recorder with
the seal of the city affixed this 17th day
of October, 1907.

mate of entire cost thereof and the
amount and cost of such improvement,
and the amount and cost thereof, to,
be. paid by the city, if any, and the cost
thereof and amount assessable upon

front foot, and to file such plat and
estimate in the office of the City Re-
corder; that after the filing of salt
plat and estimate in his office, the City
Recorder shall notify said abutting and

street, westerly to the west line Of lot
8, 'Cushing's addition, showing the 'lo-
cations and general nature of such im-
provement, the extent thereof, the size
and kind of material to be 'used, and
to prepare an estimate of the cost
thereof and the amount assessable upon
each lot or parcel of land adjacent to or
abutting thereon per front feet or
square feet in area, and to file such
plat, specifications and estimate in the
office of the City Recorder.
That after such plat is so filed, the
City Recorder shall cause to be pub-
lished notice of the intention of the
Council to make such improvement,
which notice shall be published 'in three
consecutive issues of the official paper
of the City of Dubuque, stating 'that
such plat is on file, and generally the
nature of the sewer, its location, size
and kinds of material to be used, and
the 'estimate of its cost, and. .'fixing the
time before which objections can be
filed, which time shall not be less than
five days after the last publication of
said notice, and after the completion
of such notice, he shall, at its next ses-

Be it Resolved by the City Council of
the City of Dubuque, That a sanitary
sewer of Eight inch tile pipe be con-
structed in Broadway from the south-
ern end of the present sewer south to
the south line of lot 5 in John King's
1st addition, according to the plans and
specifications of said sewer prepared
by the City Engineer and now on file
in the office of the City Recorder, and
be it further
Resolved, That said sewer shall be
completed on or before the 1st day of
December, 1907, and shall be paid for
at the time and in the manner pre-
scribed by Chapter XXXIV of the Re-
vised Ordinances of 1901 of the City of
Dubuque, for the payment of the cost
of constructing sewers. The proposals
for doing such work will be acted upon
by the Council on the 7th day of No-
vember, 1907, and the City Recorder
is hereby ordered to give ten days no-
tice by publication, asking for pro-
posals as provided by ordinance.

sion, all sidewalks which are in a dan-
gerous condition and prepare proper

City Attorney Kintzinger reported
that the accountants employed to in-
vestigate the water works books have
finished the book - keeping part of their
work and are now working on the Mar-
tin & Strelau and piping bills, and they
state it will require about 200 hours
in addition to the time already granted
them to complete the work, and that
he in conjunction with the Water
Works Trustees would recommend that
the experts be allowed 200 hours ad-
ditional in which to complete their la-
bors.
On motion, the recommendation of
the City Attorney and Water Works
.Trustees was adopted.

session was called to consider the re-
port of the committee of the whole on
the appointment of a milk and meat
inspector.
Ald. Clancy, chairman of the com-
mittee of the whole, reported as fol-
lows:

whom was referred the matter of the
appointment of a meat and milk in-
spector, would respectfully recommend
that Dr. F. J. Kennedy be appointed to
such office at the pleasure of the Coun-
cil, said appointment to take effect
October 18th, 1907.

AN ORDINANCE.
AN ORDINANCE granting to William
Lawther Co., their successors and
assigns, the right to construct and
operate a high pressure water main
for fire protection in Locust street
from Fourth street to Second street
and east in Second street to alley,
south in alley to their manufactur-
ing plant and regulating same.
Section 1. That the William Law-
ther Co., their successors and assigns
are hereby authorized to construct,
maintain and operate a high pressure
water main six inches in diameter, to
be laid in Locust street from a con-
nection with the high pressure water
Main at Bell Bros. Co. manufacturing
plant, south to Second street, thence
east in Second street to alley and
south in alley to their manufacturing
plant between First and Second streets
in the city of Dubuque; for the pur-
pose of providing sufficient and ade-
quate water pressure for fire protection
purposes only. Said line of water pipe
shall he constructed, maintained and
operated at the expense of said Wil-
liam Lawther Co. under the direction
and supervision of the city engineer
and the superintendent of the water
works department of the city of Du-
buque.
Sec. 2. In the construction of said
water pipe line, the streets shall not
be unnecessarily obstructed; all ob-
structions and excavations made in
any street shall be properly barricad-
, ed and lighted, and in any action for
damages caused by such construction
.or excavation, the said William Law-
ther Co. shall appear and defend the
Sallie and shall pay any judgment ren-
dered against the city therein.
Sec. 3. The city of Dubuque may
at any time grant the right to any
other person or company to connect
with said high pressure water main
for fire protection only, upon paying
to the said William Lawther Co. a
share of the cost of construction and
maintenance of said line, in propor-
tion to the number of users and the
length of said main used by any such
person or company desiring to make
connection therewith, that is a pro-
portionate share of the cost of con-
structing and maintaining said line
from Fourth street to the point where
connection is made, and also paying
to the said William Lawther Co. and
Bell Bros. Co. a proportionate share
of the cost of constructing and main-
taining the said water line from Eighth
street to Fourth street in Locust street.
Sec. 4. The permission hereby
granted is upon condition that said
William Lawther Co. pay to Bell Bros.
Co. a proportionate share of the cost
of constructing and maintaining the
high pressure water main constructed
by said Bell Bros. Co. from Eighth
(8th) street to Fourth (4th) street in
said city.
Sec. 5. The city of Dubuque may
at any time connect such a number
of high pressure fire hydrants along
the line of said water main as it may
deem necessary, without paying any
part of the construction of said water
main.
Sec. 6. This ordinance shall be in
force from and after its publication in
the Telegraph - Herald and its accept-
ance in writing by the William Law-
ther company.

AN ORDINANCE,
An Ordinance to provide for the in-
spection of Milk, Dairies and Dairy
Herds, and to License and Regulate
the Sale of Milk in the City of Du-
buque, Iowa.
Be It Ordained by the City Council of
the City of Dubuque:
I. That no person, firm or cor-
poration shall sell any milk within the
corporate limits of the city of Du-
bugtle, without first having obtained a
license so to do in the manner herein
provided.
II. Any person, firm or corporation

desiring to sell milk within the cor-
porate limits of the city of Dubuque
shall make application for a license
therefore to the board of health of the
city of Dubuque by filing with the
city recorder —the clerk of such board
—an application in writing, which ap-
plication shall state fully and ex-
plicitly:
First. The full name and place of
residence or business of said applicant.
- Second. The exact location and
name of his dairy and the number of
rcows therein contained, owned and
used by him, and if such person, firm
or corporation be not the owner of
the cows producing the milk to be so
Sold, then the name and location of
the person, firm or corporation from
Whom the milk is obtained for sale,
and the number of cows owned, used
and controlled by such person, firm or
corporation.
Third. The manner in which he
intends to sell and distribute the milk
when licensed, and the character of
the receptacles or vessels to be used
in storing and distributing such milk.
Fourth. Said application shall also
contain the assent of the applicant to
permit the city of Dubuque, through
the board of health of said city and
its officers, to inspect the dairy and
herd of such applicant, and the dairies
and herds from which said applicant
shall obtain milk, and unless such as-
.sent is given the applicant shall be re-
fused a license and be prohibited from
:selling or distributing any milk with-
in the corporate limits of the city of
Dubuque. Said application shall be
signed and sworn to by the applicant
and when received by the city recor-
der shall be placed on file and the
name of such applicant shall be en-
tered in a book of registration kept
by the city recorder for such pur-
poses, which book shall contain the
:name of the applicant, the date when
such application was filed, the date
When a license was granted to such
applicant, or the date when such li-
cense was refused. The filing of such
.application for a license shall author-
ize such applicant to continue the
prosecution of the business until the
hoard of health shall grant, or refuse
to grant, a license to the applicant
'therefor.
III. Upon the filing of such appli-
cation with the city recorder of said
'city, as provided for in the preceding
section, the board of health, or the
regularly licensed veterinarian, ap-
pointed by the city of Dubuque for
such purpose, or such officer as the
board of health of the city of Dubuque
shall designate, shall inspect the dairy
and dairy herd of such applicant, or
the dairy and dairy herd of such per-
son, -firm or corporation from whom
such applicant obtains his milk with
out unnecessary delay after the filin
of such application; and it is hereb
made the duty of the said hoard o
health to cause such officer to rnak
an examination of each and every ani
teal producing milk—for sale or con
sumption -- within said city and be
longing to or controlled by said ap
plicant or person, firm or corporation
from whom said applicant obtains hi
milk, for the purpose of detecting th
presence of tuberculosis or any other
contagious or infectious disease; and
said officer in making such inspection
is hereby authorized to use any test
from which he can obtain the most
accurate and reliable results. Upon
such examination the officer making
the same shall place upon each cow
examined a tag showing the result of
said examination, which tag shall .be
of such a character as to afford a per-
manent record of such examination
and shall show upon the face thereof
the date when such examination was
made and the presence or absence of
infectious or contagious disease. Such
officer shall also inspect the buildings
wherein the cows are kept and the
milk stored —the cans, vessels or re-
ceptacles wherein the milk is placed
for storage or distribution, and each
and every portion of the premises
surrounding the dairy which may
through unsanitary conditions be the
cause of infection or contagion, and
make a full and complete report of
his acts in each and every case to the
said board of health at each regular
meeting thereof, which shall be placed
on file in the city recorder's office in
said city, and shall furnish a bond in
the sum of $1,000.00.
IV. The board of health shall de-
termine from facts submitted to it by
the inspector, through his report, and
from other sources of reliable infor-
mation whether the application for
permission to sell milk within the cor-
porate limits of the city of Dubuque,
Iowa, shall be granted or refused. If
granted, a license shall be issued to the
applicant therefore —if refused, notice of
said refusal shall be served upon the
applicant by the board of health
through its sanitary officer. The appli-
cant must at the time of filing his ap-
plication with the city recorder deposit
with said city recorder the sum of five
dollars to defray the expenses of mak-
ing the necessary examination of the
herds and dairies, which cost of said
examination shall not exceed the sum
of twenty -five cents for each cow ex-
amined.
V. The board of health shall have
charge of and issue all licenses re-
quired under the ordinance, for which
no fee shall be charged (other than
the examination fee provided for in the
Official Notices
Jost section), said license shall author-
ize the holder thereof to sell milk with-
in the corporation limits of the city of
Dubuque, until the thirty -first day of
March ensuing, and no longer, which
license may be renewed on application
with or without further examination,
as the board may determine, provided,
however, that such license may be re-
voked whenever the applicant, or those
in the employ of such applicant, shall
violate any of the rules and regulations
of this ordinance, or any of the rules of
the board of health of the city of Du-
buque, Iowa, or for any cause on the
.part of such applicant in the man-
agement, distribution and sale of such
milk which would or might prove
detrimental to the public health or
public welfare. Such licensee shall
cause the name and place of business
of such licensee and the number of
the license issued to such licensee to
be legibly and conspicuously placed
and printed on the outside of each
wagon, carriage, sleigh or other ve-
hicles used by such licensee in the dis-
tribution of such milk, and all li-
censees who sell milk from stores or
shops shall keep such license con-
stantly posted in a conspicuous place
upon the walls of the room within
which said sale of milk is carried on.
VI. The board of health of the
city of Dubuque, Iowa, and all of-
ficials, inspectors and employes of
such hoard of health shall have the
right at all times to enter upon or
into the premises of any person
licensed, or who has made application
for a license under the provisions of
this ordinance, to examine and in-
spect the dairy and dairy herd of such
licensee or applicant, and they shall
also have the right to enter upon or
into the premises of any person, firm
or corporation from whom such li-
censee or applicant shall obtain milk
to sell within the corporate limits of
the city of Dubuque, Iowa, to inspect
the dairy and dairy herd of such per-
son, firm or corporation, and any re_
fusal on the part of such licensee, ap-
plicant or person, firm or corporation
furnishing milk to such licensee or ap-
plicant to allow such entry and inspec-
tion as may be required by this ordi-
nance, shall be followed by the revo-
cation of the license of such licensee
and a refusal to grant a license to
- such applicant.
VII. It is hereby made the duty of
the city veterinarian or all other of-
ficers of the city of Dubuque, Iowa,
designated by the board of health to
carry into effect the provisions of this
ordinance, to cause the dairies and
dairy herds of licensees and the dairies
and dairy herds of all persons, firms or
corporations selling milk to - such
licensees, to be inspected at least once

every three months and oftener if
they deem it requisite and necessary
for the public welfare, and if the con-
ditions which are required as pre-
requisites to obtaining a license under
the provisions of this ordinance, or
the rules and regulations of said board
of health are not constantly maintain-
ed, then it shall be their duty to make
a report to such board of health and
such recommendation in regard there-
to as they may deem proper.
VII1. Any person, firm or corpora-
tion violating any of the provisions of
this ordinance shall, upon conviction
thereof, be punished by a fine of not
less than one hundred dollars
($100.00), or such persons shall be
imprisoned in the city jail until such
fine is paid, not exceeding thirty days.
IX. This ordinance shall be in force
and take effect after its passage and
publication in the Telegraph - Herald,
the official newspaper of the City of
Dubuque, Iowa.

AN ORDINANCE.
AN ORDINANCE REGULATING THE
SALE OF MEAT, FISH AND FOWL
IN THE CITY OF DUBUQUE,
IOWA, AND PROVIDING FOR THE
APPOINTMENT OF A CITY MEAT
INSPECTOR AND PRESCRIBING
HIS DUTIES.
Be it Ordained by the City Council of
the City of Dubuque:
I. That the City Council of the City
of Dubuque, shall annually appoint
some suitable person to fill an office to
be known as a City Meat Inspector
from the date of his appointment until
the first day of May in each year, and
until his successor has been duly ap-
pointed and qualified.
II. It shall be the duty of such in-
spector to carefully inspect all fresh
and cured meats, fish and fowl kept or
offered for sale within the corporate
limits of the City of Dubuque, and to
test the same by the best and most
efficient means to determine the fitness
of such meats, fish and fowl to be used
for human food and consumption. The
meats and fowl so inspected by said in-
spector shall be labeled by him and
such label shall contain in legible print
or writing ,the date of the inspection
and the result of said examination,
which said label shall be placed on a
conspicuous part of the meat and fowl
and condemned shall be destroyed for
food purposes by said establishment in
the presenee said Inspector.
VII.
.Any ; person, firm or corporation
violating any of the provisions of this
ordinance shall, upon conviction there-
of, be punished by a 'fine of not less
than one hundred (1100.00) dollars, or
,such person shall be imprisoned in the
-elty jail until ,such fine is paid,:not ex-
ceeding thirty days.
VIII. This ordinance shall ,be in

so inspected to apprise the purchaser
thereof when said meat and fowl were
so inspetted. And any and all fresh
meats so inspected by said inspector if
not sold within the period of seven days
after such inspection was made, shall
be again inspected and labeled, and no
meat, fish or fowl shall be sold or of-
fered for sale within the corporate
limits of the City of Dubuque, until
such meat, fish and fowl shall be In-
spected by the City Meat Inspector and
such meat and fowl labeled by him -in
accordance with the requirements of this
ordinance. And any and all meats,
fish and fowl shipped into the City of
Dubuque, to be sold for human food
and consumption, which have been in-
spected by the government inspector,
shall be also inspected by the City
Meat Inspector for the purposes of this
ordinance, and for the purpose of de-
termining whether any change has
taken place in the condition of the said
meat, fish and fowl since said inspec-
tion was made by the government in-
spector, and for the purpose of placing
on said meat and fowl a label con-
taining the date of .such inspection by
the City Meat Inspector, as required by
this. ,ordinance.
-III. It shall be the duty of said in-
spector to immediately seize, condemn
and, after notice to the owner, destroy
any and all meats, fish and fowl that
he shall find to be tainted and un-
sound, and which are being kept and
offered for sale for human food and
consumption within' the corporate lim-
its of the City of Dubuque, and his
notice to the person in possession of
the same, stating the reasons why the
same are seized and condemned, shall
be a sufficient warrant therefor. And
it shall also be the duty of such of-
ficer to carefully inspect all premises
and places where meats and provisions
of any kind are kept for sale and to see
that the same are kept in a clean,
wholesome and sanitary condition, and
'any person, firm or corporation refus-
ing to obey any order or notice given
by him with reference to cleaning any
such premises or place, or destroying
any tainted cr condemned meats or
other foods, shall he deemed guilty of
a misdemeanor and shall be fined not
to exceed one hundred dollars, or such
persons imprisoned in the city jail un-
til such fine is paid not to exceed thirty
days.
IV. The City Meat Inspector shall
inspect all meats, fish and fowl kept
or offered for sale for human food and
consumption within the corporate lim-
its of the city of Dubuque, and no per-
son, firm or corporation shall sell or
offer for sale therefor to any person,
' firm or corporation within the corpo-
rate limits of said city, any meat of any
kind whatsoever until inspected by the
City Meat Inspector and labeled in ac,
cordance with the provisions of this
ordinance, so that the purchaser there-
of may know at what time such in-
spection was so made. And such officer
shall be entitled to charge for such ins
speetion the following fees:
V. Such officer shall receive seventy -
five dollars per month or such com-
pensation as the City Council shall by
resolution or vote authorize, which
shall not be changed during the term
for which he is appointed. The meat
inspector shall also perform the dutieS-
of City Milk Inspector and such other
duties and have such powers in addi-
tion to those specially granted by this-
ordinance and the ordinance providing
for the inspection of milk as shall rea-
sonably be necessary to carry out the
requirements of this office.
VI. That for the purpose of prevent-
ing the use in the City of Dubuque, as
herein provided, all meat and meat food
products which are unsound, unwhole-
some, unhealthy and otherwise unfit for
human food, the City Meat Inspector
herein above provided for, shall make
an examination and inspection of all
cattle, sheep, swine and goats before -
they shall be allowed to enter into any
slaughtering, packing, meat canning,
rendering or similar establishment in
the City of Dubuque, in which they are
to be slaughtered, when the meat and
meat food products thereof are to be
used as human food in the City of Du-
buque; and all cattle, sheep, swine and
goats found on such inspection to show
symptoms of disease shall be set apart
and slaughtered separately from all
other cattle, sheep, swine or goats, and
when so slaughtered the carcasses of
said cattle, sheep, swine or goats shall
be subject to a careful examination and
inspection according to the best known
methods for ascertaining their fitness
as human food. That for the purposes
set forth in this ordinance said meat
inspector shall make a post mortem ex-
amination and inspection of the car-
casses and parts thereof of all cattle,
sheep, swine and goats to be prepared
for human consumption at any slaugh-
tering, meat canning, salting,
packing, rendering or similar
establishment in the City of Du-
buque, which meats are intended for
use as human food in the City of Du-
buque, Iowa; and the carcasses and
parts thereof of all such animals found.
to be sound, healthful, wholesome and
fit for human food shall he so marked
and labeled as heretofore set forth by'
the inspector, and said inspector shall
' label, mark, stamp or tag as inspected
and condemned all carcasses and parts
thereof of animals found to be unsound,
unhealthful, unwholesome or otherwise•
unfit for human food; and all car-
casses and parts thereof thus inspected:

Notice to Sewer Contractors.
Sealed proposals Will be received at
the Council Chamber, City Hall, by the
City Recorder until 8:30 p. In., Thurs-
day, November 7th, 1907, for -the con-
struction of an eight -inch tile pipe
sanitary sewer in Broadway street
from the southern end of the present
sewer, south to the south line of lot
5 in John King's 1st addition, in ac-
cordance with plans and specifications
prepared by the City Engineer and
now on file in the office .of the City Re-
corder.
It is estimated by the City Engineer
that it will require
168 lineal feet of 8 -inch tile pipe,
1 manhole,
The work to be paid for when said
work is completed and as prescribed by
Chapter XXXIV of the Revised Ordi-
nances of 1901 of the City of Dubuque,
work to be completed on or before
December 1st, 1907.
Bidders must state price per lineal
foot for tile pipe, and each manhole.
All bids must be accompanied by a
certified check for $50.00 on some Du-
buque bank as a guarantee that a
contract will be entered into if award-
ed.
The city reserves the right to reject
any and all bids.

'To Whom It May Concern:
You and each of you are hereby 'no-
tified that it is the intention of the
City Council of the City of Dubuque
to construct an 8 -inch the pipe'sani-
tary sewer. in Kaufmann avenue from
present manhole at the intersection of
North Main street, westerly to the
west line of Lot 8, Cushing's Addition.
That a plat and specifications of
Official Notices
said proposed sewer is now on file in
the office of the City Recorder.
It is estimated by the City Engineer
that it will require 750 lineal feet of
8 -inch tile pipe with 3 manholes, and
will cost the abutting property owners
$600.00 in total.
Any persons having objection to the
construction of said sanitary sewer
are hereby notified to appear before
the City Council at its regular session,
November 7th, 1907, or to file in
writing with the City Recorder their
objections, on or before November 7th,
