ARTICLE II. ENVIRO~AL STEW-
ARDSHIP ADVISORY COM]~ISSION
Sec. 18.5-21. Created; Composition:
There is hereby created an Environmental
Stew~dship Advisory Commission, which shall
consist of seven (7) members, who shall all be
residents of the City, and shall include a mem-
ber representing those who will inherit the
environment (a person between the ages of 16
and 20 at time of appointment), and six (6)'
members who shall include representation from
d/verse segmen~ of the City's population. It is
desirable to select some members who may have
helpful backgrounds with envlronmen-
talfolological science, health care, busi-
ness'industry, and environmental/civic groups.

Sec. 15.5-22. Application And Appolut-
ment Process:
The appointment process to the Commisslcn
by the City Council shall include at least the
following:
(1)
An application form requesting basic
information on the education, training,
exper/ence, expectations and other quali-
fications of the applicant;
(2)
Notice to and an opportunity for the
general public to comment in writing on
the qualifications of each applicant; and
(3)
A formal interview by the City Council to
determine the appl/cant's qualifications
and ability to effectively serve on the
Ceramission. (Ord. 64-93, § 1, 12-6-1993)

Term; Term Limits; Filling
Of Vacancies; Compensa-
tion:
The term of office for a member of the Com-
mission, other than the youth representative,
shall be three (3) years, or until a successor is
duly appointed. However, two (2) of the initial
terms shall be for a term of one year; two (2) of
the initial terms shall be for two (2) years; and
two (2) of the initial terms shall be for three (3)
years. The youth representative shall be for a
term of one year, expiring on June I of the
following year; the initial term shall expire
June 1, 1994.
A Commission member may be removed et
anytime with or without cause by a vote of two-
thirds (2/3) of all members of the City Council.
A vacancy on the Covnr, lssion caused by res-
ignation or otherwise shall be filled by appoint-
ment by the City Council for the remainder of
the unexpired term.
Members of the Comm/ssion shall serve with-
out compensation except for actual expenses,
which shall be subject to approval by the City
Council.
The term of office of a member appointed
after January 1, 1996, shall expire October 1.

Sec. 18,5-24. Duties:
The duties of the Commission shall be as
follows:
(1)
To develop, articulate and propose goals,
objectives and policies for the steward-
ship of the City's environment and it's
ecological systems for present and future
generations. An initial report to City
Council should be completed within a
year and thenceforth periodically. It
shall also include sections on the current
condition of the City's natural environ-
ments and on the progress being made in

Sec. 2-202. Term/ha/ion of authority by
Council.
City Council may at any time by adoption of a
resolution terminate the authority of ~ny

(b) The original appointment of the members
of the Commission shall be as follows: one for
one year, one for two (2) years, and one for
three [3) years, from July 1 of the year of such
appointment or until a successor is ~med to
serve out the unexpired portion of a term of

Sec. 2-232. Composition.
(a)The Investment Oversight Cor~mission
members shall be appointed by the City

knowledge about investments and finance but
with no affil/ation with a firm or corporation
which does now or may in the future provide
investment or financial advice or services to the
city.
Sec. 2.233. Powers a~d duties.
The Investment Oversight Co~ssion shall:
(1)
Review the actions and decisions of the
City's Investment Com~nlttee and all
money managers for compliance with the
City's investment policy and report any
noncompliance to the City Council;
(2) Recommend, as needed, changes in the
City's investment policy to the City
Council; and
(3) Review the investment performance of
the City's Investment Committee and
money managers and to repor~ to the
City Council concerning same at least
quarterly.

Duties C~eneraiiy:
(a) The Board of Library Trustees described
in Section 30-1 of this Chapter shall have and

exercise the following powers:
(1)
To meet and org-~e by the election of
one of their number as president of the
Board, and by the election of a secretary
and such other officers as the Board may
deem necessary;
(2)
To have charge, control and supervision
of the public library, its appm'tenances
and fixtures, and rsoms contsi~ng the
same, directing and controlling all the
affairs of such library;
(3)
To employ a librarian, such assistants
and employees as may be necessary far
the proper management of said library,
and fix their compensation; but, prior to
such employment, the compensation of
such lihrar/an, assistants and employees
shall be fixed for the term of employment
by a majority of the members of said
Board voting in favor thereof;
(4)
To remove such librarian, assistants or
employees by a voze of two-thirds (~/3) of
such Board for misdemeanor, /ncompe-
zency or inattention to the duties of such
employment;
(5) To select and make purchases of books,
pamphlets, magazmes, periodicals, pa-
pers, maps, journals, furniture, fixtures,
stationery a~d supplies for such library;
(6) To authorize the use of such libraries by
nonresidents of the City and to fix eh.xg-
es therefor;
(7) To make and adopt, amend, modify or
repeal bylaws, rules and regulations, not
inconsistent with law, for the care. use,
government and management of such
library and the business of said Board,
fixing and enforcing penalties for the
vialation thereof;

To have exclusive control of the expendi-
tures of all taxes levied for library pur-

Sec. 34-25. Solicitation And Acceptance
Of Donations:
The Comrn;~slon may solicit and otherwise
accept donations and gifts of money, personal
and real property and personal services. All
such donations and gifts as received shall be-
come the property of the City for the general
use of support of park and recreation programs
of the City unless such items have been desig-
hated by the donors for specific purposes. (1976
Code, § 27-20)
Sec. 34-26. l~embership, Appointment:
(a) The Cor.~ission shall be compr/sed of a
membership of seven (7) persons who shall be
appointed by the Ci~ Council for teems of three
(3) years. Four (4) members of the Commission
sha.ll constitute a quorum for the transaction of
business. All action of the Cor-m~ssion shall be
by resolution and the affirmative vote of at
least four (4) members shall be necessary for
the adoption of any resolution.
(b) The expiration date for all term~ of office
shah be June 30 of the appropriate year.
(c) Membership on the Commission shall be
limited to persons who are residents of the City.
(d) Vacancies caused by death, resignation or
otherwise on the Commission shall be promptly
filled by the City C6uncil for the unexpired
term of office. (1976 Code, § 27-21; Ord. 63-94,
§ 3, 11-7-1994)
Sec. 34-27. Attendance:
(a) Members of the Commission shall attend
at least two-thirds (~/:) of all regularly sched-
uled and held meetings within any twelve (12)
month period. If any member does not attend
such prescribed number of meetings, it shall be
grounds for the Commission to recommend to
the City Council that the position be declared
vacant and a replacement appointed.
(b) The 'attendance of all Co~-r. ission mem-
bers shall be entered upon the minutes of all
meetings by the secretary. (1976 Code, § 27-22)
Sec. 34-28. Compensation:
Al/ members of the Com~-~ssien shall serve
without compensation except for reimbursement
of necessary expenses. (1976 Code, § 27-23)
Sec. 34-29. Organization:
(a) The officers of the Cor,,~isslon shall be a
chairperson, a vice chairperson and a secre~-y.

Zoning Advisory Commission
Created; Composition; Ap-
pointment:
There is hereby created a City Zoning Adviso-
ry Commission, which shall consist of seven (7)
residents of the City, appointed by the City

Sec. 36-10.1. Appointment To Airport
Zoning Commission:
Two (2) members of the Comm/ssion shall be
appointed by the City Council to serve on the
Airport Zoning Commission. A member shall
serve out the term on the Airport Zoning Com-
mission even if the member's term on the Zon-
~ng Commission has expired. (Ord. 86-95,
12-18-1995)
Sec. 36-11. Application And Appointment
The appointment process to the Commission
by the City Council shall include at least the
following:
(1)
An application form requesting b~sic
information on the education, training,
experience, expect;orions and other quali-
fications of the appEcant;

the qualifications of each applicant; and
(3)
A formal interview by the City Council to

Sec. 36-12. Terms; Filling Of .Vacancies/
Compensation:
The term of office for members of the Zoning
Adv/sory Comm~esion shall be three (3) years or
until a successor is duly appointed. Two (2) of
the initial terms shall be for a term of one year;
two (2) of the initial terms for two (2) years;
and three (3) of the initial terms for three (3)
years.
A Commission member may be ,removed at
any time with or without cause by a vote of two-
thirds (~'/3) of all members of the City Council.

A vacancy occurring on the Commission
caused ': resignation or otherwise, shall be
filled by appointment by the City Council for
the remainder of the unexpired term.

Sec. 36-13. Powers: .
The Zoning Adv/sory Commission shall con-
cern itself with ehar~-range physical planning
and shall have and possess the following pow-
ers, duties and responsibiliSes:
(i)
To prepare and recommend a Z3ning
Ordinance by exercising the powers con-
ferred by Iowa Code chapter 414, "Manic-
/pal Zoning". Such Zoning Ordinance
shall/nc]nde C~e boundaries of the va.ri-
,'"~ -.nlng disf~dcts; the height, number
of stories and size of buildings and other
s~ructures in each d/strict; the percent-
age of ground that may be occupied;
setback requirements; the size of yards,
courts and other open space; the density
of population; the location and use of
buildings, structures, and ]and for ~rade,
industry, commercial, residential or
other puzposas; and such regalations and
restrlc~ons necessary to enforce such
zoning provisions. To th/s end the inning
Advisory Commlssion shall prepare a
pre]/m/nary Zoning Ordinance and hold
public hearings thereon and after such
hearings have been held, shah submit a
final Zoning Ordinance and its recom-
mendations to the City Counci];
(2)
To recommend to the City Council, from
time to time, as conditions require,
amendments, supplements, changes or
modifications to the Zoning Ordinance

(3) To make such surveys, studies, maps,
plans or plats of the whole or any portion
of the City and of any land outside there-
of, which in the opinion of the Zoning
Advisory Commission are cons/stent with
the Comprehensive Plan and are neces-
sary to carry out the purposes of the
Corem/salon;
(4)
To make recommendations to the City
Council upon plans, plats or rephits of
subdivisions or resubdiv/sions wi~tin the
City which show streets, alleys or other
portions of the same intended ~ be dedi-
cated for public use;
(5)
To make recommendations to the Long-
Range Planning Advisory Commission on
the preparation and maintenance of the
Comprehensive Plan;
To fulfill those duties and responsibili-
ties assigned to a City Planning Comm/e-
sion in Iowa Code chapter 409, "Plats";
and
(7)
To undertake from time to flame other
spedfic short-range pl~unlng projects
wh/ch may be referred ~ i~ by the City
Council.
The City Council shall have the authority to
establish or revise the priorities of the Commis-

Sec. 36-14. Organization; Meetings:
(a) The Zoning Adv/sery Commission shall
choose annually, at its first regular meeting of
the fiscal year, one of its members te act ss

of the chairperson during the chairperson's
absence or disability. The Commission shall
adopt such rules and regulations goyerning its
operation and procedure as may be deemed
necessary.
