SUBJECT: Vacating Petition - 8th Street between Central Avenue and Iowa Street
Public Works Director Mike Koch is recommending approval of the vacation of 8t~ Street
between Central Avenue and Iowa Street to further the construction plans related to the
Dubuque Law Enforcement Center expansion. At the July 6, 1999 City Council
meeting, the Council voted to keep 8~ Street closed to traffic to accommodate this
facility expansion, however, the street was not officially vacated at that time.
As part of reviewing the concepts for this project, the City has identified some utility
improvements/modifications which need to be made. There are two water mains over
75 years old which the City believes should be replaced with one larger main installed in
a fashion that repairs could be made to it even though it wilt be partially under the
connecting breezeway between the old and the new Law Enforcement Center buildings.
The cost to complete this is approximately $108,000. In the alley to the west of the new
addition to the facility is a sanitary sewer line which needs replacement. The cost to
complete this replacement is $35,000. It is recommended that the storm sewer system
under the proposed building be reinforced at a cost of approximately $27,000. I am
proposing that as part of our partnership with Dubuque County on construction of this
building, that the City accepts responsibility for the cost of these items. They are
affordable within the confines of our water and sewer utility construction budgets.
I respectfully request that the Mayor and City Council schedule a public hearing for
July 2, 2001, to consider vacation of this street.

INTRODUCTION
This is in res.l~onse to a request from the Dubuque County Board of Supervisors for the
vacating of 8u' Street between Central Avenue and Iowa Street.
DISCUSSION
The attached plat shows the area proposed on 8th Street to be vacated. The abutting
properties are owned by the Dubuque County Board of Supervisors. The property is
needed for the planned construction of an extension to the Dubuque County Jail and the
Dubuque Law Enforcement Center, which will extend to the north across the present 8~
Street right-of-way.
The area to be vacated is divided in one lot numbered Lot lA of Block 1 of Dubuque
Downtown Plaza. Lot lA of Block 1 of Dubuque Downtown Plaza is an existing 37-foot
wide street on which public utilities exist. Perpetual easement rights will be reserved on
the entire Lot lA for maintenance of the existing sanitary sewer and watermain utilities,
and other utilities.
The City has no need for the proposed vacated area, except for reserving utility
easements. Some reconstruction and/or repair will be needed to be done by the City to
the existing watermain, and possibly sanitary or storm sewers in this vicinity.
RECOMMENDATION
The issue of extending 8th Street from Iowa Street to Central Avenue was discussed in a
memo to the City Council from Durrant dated June 29, 1999, a copy of which is
attached. The City Manager's recommendation to close the alley for the expansion of
the Law Enforcement Center dated July 1, 1999 is also attached.
I would recommend that the areas indicated by Lot lA of Block 1 of Dubuque Downtown
Plaza on the attached plat be vacated, and that a public hearing be set for the
disposition of the City's interest in the vacated area on July 2, 2001. I would further
recommend that the purchase pdce be established at $1.00, plus platting, publication
and filing fees.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public hearing
should be scheduled on the disposal of the property through adoption of the enclosed
resolutions

SUBJECT; DLEC Expansion - Maintaining Ctosure of Eighth Street
Police Chief John Mauss is recommending that the City of Dubuque concur with
request from Dubuque County to have Eighth Street remain closed to traffic.
The need for additional jail space in Dubuque County has bean weft documented.
Keeping Eighth Street ctosed would provide for the abifity to expand the existing jarl in
the most cost efficient manner possible by minimizing construction costs and the
annual operating expense of the new jail spaca.
Keeping Eighth Street closed would allow for a two-story structure connecting the
existing Dubuque Law Enforcement Center with the new addition. The first floor of
that connection would block, Eighth Street and would be a security port for police cars
to enter and drop off prisoners in a secure environment. It would also have space to

Storm Sewer
Currently there is a sanitary sewer in the alley within seven feet of the west edge of the
proposed Dubuque Law Enforcement Center facility. Also, there is a 60" storm sewer
on 8th Street that will be under the proposed facility.
Due to the close building proximity, it is my recommendation that ductile iron pipe be
used for the complete replacement of sanitary sewer. Also, the 60" storm sewer should
be reinforced to prevent any future sewer repair/replacement.
BUDGET IMPACT
The cost for the sanitary sewer replacement is approximately $35,000, with the funding
derived from the General Sanitary Sewer Repair Capital improvement Project. The
storm sewer reinforcement will utilize $27,000 of the General Storm Sewer Repair
Capital Improvement Project.

8th Street (DLEC) Watermain Replacement Project
Water Department Staff and I, when reviewing the new proposed Law Enforcement
Center project, have discovered the need to replace two watermains that have been in
service for the past 75 years.
Both watermains, an 8-inch and 10 inch are located within the scope of this project.
This pipe is cast iron and joined together with lead joints. The age of the material and
the method used to join this pipe could relate to failures in the near future.
It is our recommendation at this time to replace these two water mains with one 20 inch.
This will improve service and fire flows to this area. The use of ductile iron pipe and
fittings will eliminate potential failures. The portion of watermain to be constructed
under the parking garage structure area of their facility will be encased. This will
provide additional protection to the watermain and the building.
The funds to support this estimated $108,000 project will come from our annual
Watermain Replacement Program CIP #340-539.

As a folIow up to the discussion during the joint Dubuque City Council - County
Board of Supervisors meeting last Wednesday, June 23, it was suggested that I
prepare a letter describing the design concept in general and more spec{fically why
the concept depends on maintaining 8th Street as a closed street. During the joint
meeting I identified four reasons supporting keeping 8th Street closed as it has
been for the last 25 years. They were:
1, Maintains consistency in operation and in how the combined facility would
function;
2, Provides for greater staff efficiency and fewer new staff to operate a combined
facility;
3, Wouldn't present height limitation problems for vehicular traffic on 8th Street
using the facility; and
4. Problems associated with the existing underground utilities would be negated.
There is one other reason that bears mentioning: that of developing greater
security around the facility. One could argue that if Bth Street is opened to
through traffic, the threat of attack to the structures would be grea:er, However,
considering that both the existing facility, as well as the proposed addition, would
still have exposure to public streets and/or alley, this argument tends to be
somewhat subjective.
First, I believe it's important to remember that the 1973 design of the existing
Dubuque City-County Law Enforcement Center was predicated on the closing of
8th Street and was endorsed by the Dubuque City Council. One of the most
important aspects of that design, and any correctional facility design was, and
would continue to be under this design concept, the way prisoners are brought into
the facility and processed. This intake procedure should be aa efficient and safe
as possible for staff and prisoners alike and should occur as close to the exterior of
the building as possible. As originally designed, the intake procedure consisted of
moving a prisoner from the secure vehicle sally port into an eleva:or and up to
second floor for processing. Additionally, within the last couple years the county
spent ~34,000.00 developing an arraignment court from this area over to the
County Courthouse. Also, due to the increased demand on this vehicular sally port

by the local sheriff's department as well as other outside agencies over the last 25
years, the new design concept suggests maintaining the intake procedure within
the existing facility and incorporating a new drive-thru three vehicle sally port
across the width of 8th Street. The layout, as presented, would still allow for
sheriff's department vehicles to park along the south side of 8th with some limited
parking on the north side of 8th Street east of the sally port. This would allow
vehicles entering or leaving the double door portion of the sally port to do so
unimpeded. If access to the single stall of the sally port is required, parked
vehicles would need to be relocated. Stated another way, the design as presented
facilitates staff, inmate, and other outside law enforcement agency movement into
and out of the facility consistent with the present operation. As an added benefit,
no dollars are being spent having to redo the existing intake area. Also, as shown
on the design concept, traffic moving either north or south on Iowa Street would
be able to turn east onto 8th Street to access the north/south alley between 8th
and 9th Streets. Vehicles leaving the vehicular sally port could either move west
on 8th Street to Iowa Street and head north or south on Iowa or they could head
north through the aliey.
Second, the First to Second Floor dimension in the existing facility is 12' 8". By
maintaining approximately the same floor-to-floor heights and connecting the
existing facility to the addition with a second floor bridge above the on-grade -
vehicular sally port, supervising correctional staff can "rove" back and forth
between the existing LEC and the addition. This negates having to duplicate this
staff were they not connected. Again, stated another way, sharing this staff
position with the existing facility saves approximately 8250,000 annually {1 staff
position = !5 staff persons at approximately 950,000 annually including benefits).
Additionally, food, laundry and other services can move back and forth with ease
and under appropriate supervision. An added benefit is that the Indoor/Outdoor
Exercise area and other program spaces required by code and jail standards can be
located above the vehicular sally port and between the new and existing housing
units, thereby minimizing the movement of inmates while accommodating excellent
sight and sound separation between male and female inmates.
Third, if 8th Street were opened to facilitate through traffic, both the vehicular
saIly port as well as the connecting bridge at second floor(s} would need to be
eliminated from the project because the depth of the structure supporting the
bridge would be approximately 3' 0" thereby limiting the clear height below such a
structure to something in the area of 9'0" +1., clearly not enough for many
vehicles, including the on-grade vehicular sally port into the design provides the
opportunity to rely on exterior walls and columns for bearing thereby reducing the
dimension the structure has to span which results in a shallower structure.

Fourth, providing a below grade connection between the existing facility and the
addition to facilitate the movement of staff, inmates, services, otc, doesn't work
for several reasons:
1. Underground utilities consisting of a 5' diameter reinforced concrete storm
sewer, telephone conduit, and 8"diameter H.P. water main run below 8th
Street precluding any connection without substantial rework to these utilities.
2. There would be a tremendous inefficiency in staff if the "rover" in the existing
building were to provide supervision in the addition as well, That person would
have to move down two flights of stairs or use the elevator to access the
connector under the street, move under 8th Street, and then go up two flights
of stairs to access second floor housing, Iowa Jail Standards dated May 1997
require that the "rover" or other appropriate staff conduct personal observation
of individual inmates at least hourly and others considered to be higher risk at
least every half hour (Chapter 201-50.13(2)a.(3), During the time this person
is moving between buildings he/she would be unable to respond quickly to any
emergency that may occur.
3. The problems involving the movement of services, ie., food and laundry, are
just as significant, Trustees (inmates) are generally assigned the responsibility
for moving food and laundry, Under the proposed design, this type of
movement is always capable of being supervised by staff without
accompanying the trustee. If food and laundry were to move via an
underground connection it would require staff assistance or would be
accomplished entirely by staff. This would/could result in increased staff and
payroll,
4, One primary goal in a correctional facility m to maintain a safe environment for
both staff and inmates by minimizing inmate movement. A below grade
connection would do just the opposite,
In summary, Durrant was asked to develop a concept that kept any remodeling in
the existing building to a minimum, allowed the combined facility to function
efficiently and safely, and accommodated expansion. We believe that the concept
as presented does just that.
· It minimizes the number of additional correctional staff to operate the combined
facility. The present staff to inmate ratio - based on the rated number of beds
during the most staff intensive shift - is 1:11.5; as proposed the staff to
inmate ratio would be 1:23.5. If additional beds were added internally in the
future, it could be accomplished without any increase in correctional staff
thereby improving the staff to inmate ratio even further.
Changes to the existing facility are primarily associated with name changes as
opposed to any reconstruction.

Vacating Petition - 8th Street between Central Avenue and Iowa Street
Public Works Director Mike Koch is recommending approval of the vacation of 8th Street
between Central Avenue and Iowa Street to further the construction plans related to the
Dubuque Law Enforcement Center expansion. At the July 6, 1999 City CounCil
meeting, the Council voted to keep 8th Street closed to traffic to accommodate this
facility expansion, however, the street was not officially vacated at that time.
As part of reviewing the concepts for this project, the City has identified some utility
improvements/modifications which need to be made. There are two water mains over
75 years old which the City believes should be replaced with one larger main installed in
a fashion that repairs could be made to it even though it will be partially under the
connecting breezeway between the old and the new Law Enforcement Center buildings.
The cost to complete this is approximately $108,000. In the alley to the west of the new
addition to the facility is a sanitary sewer line which needs replacement. The cost to
complete this replacement is $35,000. It is recommended that the storm sewer system
under the proposed building be reinforced at a cost of approximately $27,000. I am
proposing that as part of our partnership with Dubuque County on construction of this
building, that the City accepts responsibility for the cost of these items. They are
affordable within the confines of our water and sewer utility construction budgets.
I respectfully request that the Mayor and City Council schedule a public hearing for
July 2, 2001, to consider vacation of this street.

Vacating Petition - 8th Street between Central Avenue & Iowa Street
INTRODUCTION
This is in response to a request from the Dubuque County Board of Supervisors for the
vacating of 8th Street between Central Avenue and Iowa Street.
DISCUSSION
The attached plat shows the area proposed on 8th StFeet to be vacated. The abutting
properties are owned by the Dubuque County Board of Supervisors. The property is
needed for the planned construction of an extension to the Dubuque County Jail and the
Dubuque Law Enforcement Center, which will extend to the north across the present 8th
Street right-of-way.
The area to be vacated is divided in one lot numbered Lot lA of Block 1 of Dubuque
Downtown Plaza. Lot lA of Block 1 of Dubuque Downtown Plaza is an existing 37-foot
wide street on which public utilities exist. Perpetual easement rights will be reserved on
the entire Lot lA for maintenance of the existing sanitary sewer and watermain utilities,
and other utilities.
The City has no need for the proposed vacated area, except for reserving utility
easements. Some reconstruction and/or repair will be needed to be done by the City to
the existing watermain, and possibly sanitary or storm sewers in this vicinity.
RECOMMENDATION
The issue of extending 8th Street from Iowa Street to Central Avenue was discussed in a
memo to the City Council from Durrant dated June 29, 1999, a copy of which is
attached. The City Manager's recommendation to close the alley for the expansion of
the Law Enforcement Center dated July 1, 1999 is also attached.
I would recommend that the areas indicated by Lot lA of Block 1 of Dubuque Downtown
Plaza on the attached plat be vacated, and that a public hearing be set for the
disposition of the City's interest in the vacated area on July 2, 2001. I would further
recommend that the purchase price be established at $1.00, plus platting, publication
and filing fees.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public hearing
should be scheduled on the disposal of the property through adoption of the enclosed
resolutions
