Van Milligen, City Manager City Acquisition of Property for Manson Road Right-Of-Way As part of the reconstruction of the Manson Road Bridge, a part of Manson Road will need to be relocated. This requires additional right-of-way to be purchased for the new roadway and accompanying embankments. The parcel of agricultural property necessary for permanent right-of-way has been appraised at $4,232.00 ($6,500.00 per acre). Public Works Director Mike Koch is requesting authorization to proceed with formal negotiations for the purchase of the property required for roadway improvements. 1 concur with the recommendation and respectfully request Mayor and City Council approval. Koch, Public Works Director City Acquisition of Property for Manson Road Right-Of-Way INTRODUCTION The City of Dubuque Engineering Division is requesting City Council approval to acquire a parcel of land (Acquisition Plat) to be utilized as Manson Road right-of-way. DISCUSSION As part of the reconstruction of the Manson Road Bridge, a part of Manson Road will need to be relocated. This requires additional right-of-way to be purchased for the new roadway and accompanying embankments. The parcel of agricultural property (see Acquisition Plat) necessary for permanent right- of-way has been appraised at $4,232.00 ($6,500.00 per acre). The City has attempted to negotiate the purchase with the property owner and has been unsuccessful. The Engineering Division is now requesting authorization to proceed with formal negotiations for the purchase of the property required for roadway improvements. ACTION REQUESTED The City Council is requested to adopt the attached resolution establishing the fair market value of the property and authorizing formal negotiations with the property owner. AND VIOLA K. SUTTON IN THE CITY OF DUBUQUE, IOWA WHEREAS, the City of Dubuque (City) intends to acquire certain real property owned by John M. and Viola K. Sutton (Owner), legally described as follows (the property): A part of Lot 1 of 1 of 4 of Mineral Lot 501 and a part of all that portion of Lot 1 of 1 of 1 of 1 of 1 of 1 of 1 of 1 of 1 of Mineral Lot 499 lying south of the centerline of the public road contiguous to Lot 2 of 1 of 1 of 1 of 1 of 1 of 1 of Mineral Lot 499 as per Equity No. 82416, all in the City of Dubuque, Dubuque County, iowa, as shown on the attached Acquisition Plat and Exhibit for the purpose of constructing a bddge and associated roadway; AND WHEREAS, Iowa law requires that City must make a good faith effort to negotiate with the Owner to purchase the Property or property interest before proceeding with condemnation; AND WHEREAS, City may not make an offer to purchase the Property which is less than the fair market value City has established for the Property; AND WHEREAS, City has caused an appraisal of the Property to be made and the appraised value of the Property is $4,232.00 (0.15 per square foot) for permanent easement on agricultural land; AND WHEREAS, the City Council now desires to establish the fair market value of the Property. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA, AS FOLLOWS: 1. The fair market value of the Property is hereby established to be $4,232.00 for permanent easement on agricultural land. 2. The City Manager and the Corporation Counsel are hereby authorized to commence negotiations with the Owner of the Property and any other interested parties for the purchase of the Property for a purchase price which is not less than the fair market value established by this Resolution.
