Iowa provides that the City Council
shall set a time and place for puhlic
hearing on the hudget before the final
certification date and shall publish no-
tice before the hearing as provided in
Section 362.3 of the Code of Jowa.
NOW, THEREFORE, BE IT RE-
SOLVED BY THE City Council of the
City of Dubuque, Iowa:
Section 1. That the City Council shall
conduct a public hearing on the
proposed 1977-78 budget at City Coun-
cil Chambers, City Hall, 13th and Cen-
tral, Dubuque, Iowa, on Thrusday,
March 10, 1977, beginning at 7:30 P.M.
Section 2. That the City Clerk be and
he is hereby authorized and directed to
publish according to law Notice of
Public Hearing together with the
required budget information
documents.

written and physical tests required for
placement on the Pollee Department.
Said tests were given on May lith and

The City of Dubuque Planning and
Zoning Commission has received two
(2) petitions for reclassification of
property, as follows:
1. The Commission will hold a public
hearing at their meeting of March 16,
1977, on the petition of Mr. Earl McClain
to reclassify Lots 1, 11, 12 and 19 if
McClain Suhdivision from R-I Residen-
tial District to R-3 Residential District.
The property is located on the south side
of West Thirty-Second Street west of
Carter Road and it is the intent of the
petitioner to construct multiple-family
units on the property if the zoning re-
classification is granted. See map at-
tached attachment No.1.
2. The Commission has received and
reviewed the petition of the Powers
Land Development Company request-
ing various zoning changes on 5 parcels
of property, as identified on the at-
tached map. The Commission will sub-
mit their recommendations to you on
each of the 5 parcels in a separate com-
munication. A map identifying each of
the parcels will accompany the
recommendation.
The petitioners have met the applica-
tion and zoning fee requirements of the
City Zoning Ordinance No. 32-75.
The Commission has also scheduled a
public hearing on March 16, 1977,
proposing to enact a new Section 1-103,
Application of District Regulations, to
Ordinance No. 32-75, and will report
their recommendation to you following
that meeting. Copies of the proposed
amendment, marked Item No.2, are
attached for your information.

On April 2, 1973, Roy A. Kuch and

Marie L. Kuch commenced an action
against the City of Dubuque, Iowa and
Donald T. Sand and Malinda Sand
claiming damages in the amount of
$20,000.00 in Count J thereof and
$2,500.00 in Count 11 thereof.
The essence of plaintiffs' claim was
that on December 30, 1972, Roy A. Kucb
fell on an accumulation of ice and snow
on the premises of 2364 Washington
Street in the City of Dubuque, Iowa, and
that the matter was then referred to the
City Attorney's Office to interpose the
appropriate defenses thereto.
This matter was scheduled for dis-
missal and a stipulation was entered
into by the Assistant City Attorney and
the plaintiffs' attorney that the matter
be settled upon payment of the sum of
$200.00 hy the City of Dubuque, Iowa.
Thereafter the plaintiffs and plain-
tiffs' attorney had some difficulty com-
municating, and this matter was
recently resolved and accordingly the
offer to settle has still been maintained
open, and it is the recommendation of
the City Attorney's Office that said
above entitled litigation he settled upon
the payment of $200.00 by the City of
Dubuque. Accordingly, it is the recom-
mendation of the City Attorney that
said offer be accepted and that the City
Auditor be instructed to draw a warrant
payable to Roy A. Kuch and Marie L.
Kuch and Peter J. Klauer their attorney
in the amount of $200.00 and to transmit
the same upon delivery of the duly ex-
ecuted releases and payment of the
Court costs along with a dismissal with
prejudice.
A copy of the Original Notice with
Petition attached is herewith returned.

procedure (24 CFR Part 58), and may be
addressed to HUD at the Omaha Area
Office, 7100 West Center Road, Omaha,
Nehraska 68106. Objections to the
release of funds on bases other than

sidered by HUD. No objection received
after the 30th day of June, 1977, will be

WHBREAS, under the date of Fe-
bruary 22, 1977, the Annual Perfor-
mance Report was accepted by the U.S.
Department of Housing and Urban
Development for processing; and
WHEREAS, Section 570.300 (b) of the
Community Development Block Gran!
Program requires that reasonable effort
shall be made to inform citizens in-
volved in or affected by the local Com-
munity Development Program that the
Annual Performance Report has beèn
submitted and is available to interested
parties upon request; and
WHEREAS, Section 570.906 (c)
requires that there be public notice of
the availability of the Annual Perfor-
mance Report for inspection by the
public; now therefore:

COUNCIL of the City of Dubuque,
Jowa:
Section 1. Be it resolved that the City
Clerk be and he is hereby authorized
and directed to puhlish in the Dubuque
Teiegraph Herald, a newspaper of gen-
eral circulation within the City, public
notice in the form of Exhibit A attached
hereto and made a part hereof.

PUBLIC NOTICE
Pursuant to Title I of the Housing and
Community Development Act of 1974,
the City of Dubuque submitted an.An-
nual Performance Report to the U.S.
Department of Housing and Urban
Development for the Second Year Pro-
gram. The report was accepted for
processing by the Federal government
on February 22, 1977. A copy of the
Annual Performance Report is on file in
the office of the City Clerk, City Hall,
Dubuque, Iowa and in the office of the
Department of Community Develop-
ment, 480 Fischer Building, Dubuque,
Iowa. The report is available for inspec-
tion by all interested parties, Monday
through Friday between the hours of
8:00 AM to 5:00 PM, Saturdays, Sundays
and holidays excluded.

Resolution authorizing the Mayor to
sign a contract for the Adminis-
tration and Operation of a Public
Service Employment Program
under Title VI of PL 93-203
Regular Session, March 7, 1977

WHEREAS, the Federai Government
has enacted the Comprehensive Em-
ployment and Training Act Title VI and
has made funds available to hire unem-
ployed people; and
WHEREAS, the Governor of the
State of Jowa, through the Office for
Planning and Programming, has desig-
nated the City of Dubuque as a Pro-
gram Agent; and
WHEREAS, funds in the amount of
$327,250.00 have allocated to the City of
Dubuque for the purpose of extending
the Public Service Employment Pro-
gram in the community; and
WHEREAS, it is required of the City,
as Program Agent, to submit an em-
ployment plan and contract to the Iowa
State Office for Planning and
Programming:
NOW THEREFORE, BE IT RE-
SOLVED BY THE City Council of the
City of Dubuque, Jowa that the Mayor
is authorized to sign the Contract for
Public Service Employment with the
Iowa State Office for Planning and
Programming.

RESOLUTION ANNEXING CERTAIN
TERRITORY NO- 75-77
WHEREAS, the owners of an area
approximately 38.1 acres in size im-
mediately adjoining the city limits of the
City of Dubuque, Jowa now voluntarily
petition the City Council for annexation
of their property to the City ofDubuque,
Iowa
WHEREAS, the inhabitants of said
territory will be enabled to secure the
benefits of city government in the way
of police and fire protection if said ter-
ritory is incorporated within the city
limits of the City of Dubuque, Iowa; and
WHEREAS, the inhabitants of said
territory will be enabled to secure water,
and other municipal services if territory
is incorporated within the city limits of
the City of Duhuque, Jowa; and
WHEREAS, Section 368.7 Code of
Iowa, 1975, authorizes the extension of
city limits in situations of this character
by the adoption of a resolution ther-
efore; and
WHEREAS, the future growth,
development, and preservation of the
public health of the City of Dubuque,
Iowa, makes it imperative that said
territory be made a part of the City of
Dubuque, Iowa; and
NOW, THEREFORE, BE IT RE-
SOLVED BY THE CJTY COUNCIL of
the City of Dubuque, Iowa, that the
territorial limits of tbe City of Dubuque,
Iowa be and they are hereby extended
to include the area comprising the fol-
lowing described real estate: Lot I of Lot
I ofLot 1 of the Northwest Úne Quarter
of the Southwest One Quarter, and Lot2

The City Council has inquired about
the use of the services of Mr. Steven B.
Rynecki in labor negótiations.
Mr. Steven Rynecki was consulted by
me in the period January 13, 1977
through Fehruary 8, 1977. It was in this
period that we were conducting exten-
sive labor negotiations and preparing
for fact finding hearings and had the
urgent need for the knowledge of a
person experienced in labor
negotiations.
Mr. Rynecki was asked to review all
union demands and to research those
demands that appeared to be nonman-
datory negotiable issues as defined by
the Public Employment Relations Act.
Mr. Rynecki did research declaratory
rulings of the Public Employment Rela-
tions Board and provided us cases that
were pertinent to the issues involved.
His opinion was also requested on the
appropriate strategy to he used by the
city in conducting negotiations with the
various unions. His ideas were solicited
In the preparation of briefs to be used in
fact finding. Mr. Rynecki reviewed with
us briefs prepared for the fact finding
hearing on February 8,1977 and advised
us on the methods to be used in the
presentation of our position to the fact
finder In this hearing.
Mr. Rynecki did not participate in any
negotiations with city unions. He did
not prepare amy material used by the
city in fact finding or did he assist in
preparation of material for the hearing
with the Public EmploymentRelations
Board on March 1, 1977. Members of the
personnel department and myself met
with him on four separate occasions
January 24, February 5, February 7 and
Fehruary 8. Mr. Ryencki has not been
consulted by anyone in the personnel
department or myself since the fact
finding hearing on February 8, 1977.
Expenses for his services were about
$2,000. This amount of money was bud-
geted in the FY '77 budget for an-
ticipated expenses incurred in labor
negotiations.

spoke to Council relative to commun-
ication. Submitted a map showing 1,2
and 3 ball diamonds; Requesting to
rearrange parking; Propose one softball
complex complete with fence, conces-
sions, rest rooms and ground mainten-
ance. Have made an offer to Men's
Recreation Association of 60% - 40% of
Gate Receipts and 70%-30% of Conces-
sion Receipts. Stated softball diamonds
are needed 3 nights a week; Willing to
accept what Council has to offer; Have
made inquiries to the Bureau ofOutdoor
Recreation.

recipient of $300 in prize money from
the Iowa Development Commission as a
result of participating in the 1976 Iowa
Community Betterment Program.
At the May 24, 1976 City Council
meeting, the Dubuque Ambassadors
were designated sponsors for this pro-
gram, and their representative suggest-
ed at that time that any prize money
received be distributed to the organiza-
tions used as the basis for Dubuque's
entry. The final submission for compe-
tition included both the Washington
Park Jmprovement Program and the
Five Flags Theater Restoration Project.

The City of Dubuque Planning and
Zoning Commission has revieWed the
petition of the Powers Land Develop-
ment Company which requested reclas-
sification of 5 parcels of property. Four
of the parcels are located in "Powers
Place", an area bounded on the north by
Asbury Road and on the west by John F.
Kennedy Road. The fifth parcel is a
portion of Mineral Lot 263, located at
the southwest corner of the intersection
of Judson Drive and Asbury Road. The
location and the zoning reclassification
request on each parcel is depicted on the
attached map.
The Commission has tabled action on
Parcel I pending completion of the
Kennedy Road report, and has
scheduled a March 16, 1977, public
hearing on Parcel 4 and will report their
recommendations on those parcels to
you at a later date.
In considering the petitions, the
Commission has made the following
determinations:
that the existing zoning classification
on Parcel 2 and Parcel 3 are appropriate
and that no useful purpose would be
served by reclassification of those
properties;
that the request for OR-1a Office-Re-
sidential District Classification on Par-
cel 5 is substantially the same request
that the Commission heard in January,
1976. In denying the 1976 request the
Commission noted the impact that the
range and intensity of uses in the OR-!
District would have on the subject
property and which might later apply to
other vacant properties in the general
vicinity.
The Commission has found the pre-
sent zoning classification on Parcels 2,3,
and 5 to he appropriate and have voted
to deny those requests.

BE IT ORDAINED BY THE CITY
COUNCIL OFTHE CITY OF DUBUQUE,
IOWA
Section 1. That Robert J. Kehl be and
he is hereby granted the right to con-
struct an eight inch (8") sanitary sewer
in the extension of East 2nd Street-
Beginning at the existing 42" sanitary
sewer under the Burlington Northern
Railroad tracks eastward to the east
lease line of the property lease to Robert
River Rides, approximately 525' upon
the following terms and conditio:,,:
(0) That the grantee agrees to con-
struct said stmtiary sewer within one
year from the dote of adoption of this
ordInance and pay the entire cost ther-
eof including the cost of engineering,
inspection and restoration of the sur-
face of the street.
(b) That said sanitary sewer shall be
constructed in accordance with plans
approved by the Iowa State Department
of Environmental Quolity and the City
Manager and under the supervision and
direction of the City Manager and City
Engineer.
(c) That the grantee shall enler into a
contract for the construction of said
sanitary sewer with a well qualified
contractor which contract, among other
things, will can win a clause requiring
the contractor to obtain all necessary
permits required by the City of
Dubuque, or any other governmentat
agency, a clause obligating the contrac-
tor and his bondsman to keep said san-
itary sewer and appurtenances in good
repair for a period of not wss than two
years from the date of acceptance of the
work, and a clause requiring the con-
tractor to furnish surety bond with the
City of Dubuque named as one of the
obligees, guaranteeing the faithful per-
formance of said contract.
(d) That upon completion of said san-
iiary sewer and the acceptance of the
same by the City Council, said sanitary
sewer sholl become a public sewer
under the exclusive charge and control
of the City of Dubuque. That portion of
the sewer outside the lease property of
Roberts River Rides shall have its free
use as such shall not be interfered with
by grantees or their successors or as-
signs. That portion within the limits of
the leased property of Roberts River
Rides shall have its free use as such
following the adoption by the City of
Dubuque of a connection charge bosed
on the final cost of the same which
cost shall be collected by the City and
paid to the grantee.
Section 2. That the authority granied
herein shall terminate on March 1, 1978,
unless the terms and conditions of this
ordinance are accepted in writing by the
grantee prior to that date.
Section 3. This ordinance shall be in
full force and effect from and after its
final passage, adoption and publication
as provided by law.

Water Street.
The proposed vacated area begins at
the Dodge Street right-of-way beneath
the Julien Duhuque Bridge, and extends
480 feet southerly.
The street is bounded on all sides by
property owned by Mulgrew Oil Com-
pany, and is used solely as access to
their facility.
Mulgrew Oil has requested the vacat-
ing of the street and dedication of
property to them. It is my recommen-
dation that the street be vacated and
deeded to Mulgrew for the cost of ad-
vertising the official publications and
the cost of filing the plat.

various federal, state, and local public
agencies and to the local news media,
individuals, and groups known to be
interested and believed to be appro-

following bases: (a) That the certifica-
tion was not in fact executed by the
Chief Executive Officer or other officer
of applicant approved by HUD: or (b)
That applicant's environmental review
record for the project indicates omission
of a required decision, finding, or step
applicable to the project in the environ-
mental review process. Objections must
be prepared and submitted in accor-
dance with the required procedure (24
CFR Part 58), and may be addressed to
HUD at the Omaha Area Office, 7100
West Center Road, Omaha, Nebraska
68106. Objections to the release of funds
on bases other than those stated above
will not be considered by HUD. No
objection received after the 30th day of
June, 1977, will be considered by HUD.

As a prerequisite to receiving Federal
Aid Assistance for any road construc-
tion projects involving right-of-way
purchase, it is necessary that the City
make assurances to the Jowa Depart-
ment of Transportation that the
procedures outlined in the 1970 Uniform
Relocation Assistance and Land Acqui-
sition Policites Act will be followed.
Jn the past we have heen following
these same rules and regulations on all
federal aid projects. This is a yearly
assurance of our policy of providing
such assistance in accordance with the
1970 Act.
The attached Resolution authorizes
the Mayor to sign the document on
hehalf of the City Council and directs
the City Clerk to file the document with
the Iowa Department of
Transportation.

WHEREAS, the City of Dubuque,
Iowa may be making application to the
Iowa Department of Transportation for
Federal Funding of highway construc-
tion projects requiring right-of-way
purchase, and
WHEREAS, it is necessary to comply
with the provisions of the 1970 Uniform
Relocation Assistance and Land Acqui-
sition Policies Act for such federal aid
projects, and
WHEREAS, it is the policy of the City
of Dubuque to acquire right-of-way and
to provide relocation assistance henefits
for federal aid projects in accord with
the 1970 Act.
NOW, THEREFORE, BE IT RE-
SOLVED BY THE City Council of tbe
City of Dubuque, Jowa, that the Mayor
be and he is hereby authorized and
directed to execute the attached right-
of-way assurance statement, and that
the City Cierk be and he is hereby dir-

dorsed the Dubuque Ambassadors as

munity Betterment Program; and
WHEREAS, it is recognized that par-
ticipation within this program
stimulates civic awareness and gener-
ates community spirit; and
WHEREAS, it is deemed to be in the

continue its participation in the Iowa
Community Betterment Program: now
