and this Meeting is called as A Regular

dioator of Wahlert High School.
Proclamations proclaiming week of

The 11th Street Neighbhorhood As-
">ciation was privileged to announce
the First House Tour featuring nine
historic houses in the Neighborhood.

On January 21, 1977, the City of
Dubuque Planning and Zoning Com-
mission transmitted their conclusions to
you following a public hearing on the
petition of Gerald P. and Thomas Swift
which sought R-3 Residential District
classification on property located on the
north side of Kane Street between
Wahlert High School and Hickory Hill
Drive in the City of Dubuque, Iowa. On
January 24,1977, the Swift's asked that
action on their petition be delayed
pending further study of the property
and development plan.
In a letter dated April 22, 1977, hereto
attached, the Swift's ask that their peti-
tion be placed on your agenda, and we
respectfully request that the City Plan-
ning and Zoning Commission commun-
ication to you of January 21, 1977, and
attachments thereto, stating the Com-
mission's findings on the Swift's peti-

NOW THEREFORE BE IT ORDAINED
by the City Council of the City of
Dubuque, Iowa:
Section 1. That Ordinance No. 32-75,
known as the Zoning Ordinance and
Zoning Map of the City of Dubuque,
Iowa", be and the same is hereby
a"",nded by enacting an new Section
1-103 of Article I as follows:
ARTICLE I Establishment of Districts:
Provisions for official Zoning Map in-
terpretations and amendment thereof
Section 1-1113 Application of District
Regulations - Regulations applicable
within each district shall be applied
uniformly to each class or kind of
structure or land.
Section 1-103.1.ConformancetoUse
Regulations- No building, structure, or
land shall hereafter be used oroccupied,
and no building or structure or part
thereof shall hereafter be erected, con-
structed, reconstructed, moved, or
structurally altered except in conformi-
ty with all of the regulations herein
specified for the district in which it is
located. All uses not expressly permitted
as a permitted use, an accessory use, or
a Conditional Use are prohibited.
Section 1-103.2 Conformance to
Bulk and Yard Regulation Required No
building or other structure shall her-
eafter be erected or altered:
1) To exceed the height or bulk;
2) To accommodate or house a
greater number of families;
3) To have narrower or smaller rear
yards, front yards, side yards, or other
open spaces
than herein permitted; or in any other
manner contrary to the provisions of
this ordinance.
Section 1-103.3. Yards, Open Space,
and On-Street Parking
No part of a yard, other open space,
off-street parking, or loading space
required in connection with any build-
ing for the purpose of complying with
this ordinance shall voluntarily be in-
cluded as part of a yard, open space,
off-street parking, or loading space
similarly required for any other building
or any other lots.
Section 1-103.4 Reducllon of
Required Lot. and Yards Prohibited No
yard or lot existing on the effective date
of this ordinance shall be voluntarily
reduced in dimension or area below the
minimum requirements set forth herein.
Yards or lots created after the effective
date hereof shall meet at least the min-
imum requirements established by this
ordinance.
Section 1-1 03.5. Classification of An-
nexed Territory All territory which may
hereafter be annexed, either voluntarily
or involuntarily, to the City shall be
classified in an AG Agricultural District,
ond shall remain in that classification

The City of Dubuque Planning and
Zoning Commission has held a public
hearing on the petition of the Theisen
Development Company to expand an
existing C-3 Arterial Business Commer-
cial District to include their property on
"Harwood Place" which was recently
annexed to the City by voluntary peti-
tion. The property is located on the
south side of the 2800 block of Dodge
Street approximately 500 feet east of its
intersection with Brunskill Road.
The Planning and Zoning Commis-
sion has approved the request for C-3
District classification on the property
and recommends your favorable
consideration.

approximately 25,482 acres in size lying
immediately South of the city limits of
the City of Dubuque, Iowa now volun-
tarily petition the City Council for an-
nexation of their property to the City of
Dubuque, Iowa: and
WHEREAS, the inbabitants of said
territory will be enabled to secure the
benefits of city government in the way
of police and fire protection if said
territory is incorporated within the city
limits of the City ofDubuque, Iowa: and

west Arterial. We have attached a re-
solution for this purpose, and have at-
tempted to refiect your expressed con-
census in the identification of align-
ments for further study.
The matter of an alignment selection
in the vicinity of Admiral Street (Met-
tel-Byrne Subdivision) was also raised
at your work session of April 25. In
reviewing our communication to you
of February 16, 1977, and the resolution
authorizing protective acquisition of a
selected roadway corridor in the Siegert
farm, it appears that the implications of
tbat action may not have been clear.
Therefore, we have re-submitted our
letter and our earlier correspondence
with tbe Federal Highway Administra-
tion and Iowa DOT for your review. We
will be prepared to address the Council
on this matter is you so desire.

addressed the Council questioning how
close would concrete come to their
properties? Is road below level of
houses? Suggesting to move road 50 feet
west; Does not want to create a problem
but are looking for protection: Re-
questing that their interests be
protected.
Councilman Brady moved to add
subsection (c) to section I to provide
that intersections other than Dodge
Street, Pennsylvania Ave., Asbury
Road, John F. Kennedy Road and High-
ways 3 and 52 are undesirable and not to

Alignments for a Proposed Northwest
Arterial Roadway, to be Subjected to
Further Study and Evaluallon Accord-
Ing to a Corridor Location Study Auth-
orized by Resolution No. 423-75.
WHEREAS, the City Council of the
City of Dubuque, Iowa, is sponsor of a
corridor location study of a proposed
Northwest Arterial Roadway, according
to Resolution No. 423-75; and,
WHEREAS, said corridor location
study provides that tbere shall be a
pre-evaluation state, in which the con-
sultant shall provide a recommendation
to the Dubuque City Council and to the
Policy and Technical Committees of the
Dubuque Metropolitan Area Transpor-
tation Study as to the alternate align-
ments to be further evaluated in the
evaluation stage. Following the report
of the Dubuque City Council, the Com-
mittees will select the alternates to be
evaluated and will notify the consultant
to proceed with the evaluation; and,
WHEREAS, a report on said pre-
evaluation stage has been made to the
City Council on April 25, 1977, and a
series of feasible alternate alignments
has been presented and shown upon the
facsimile map hereto attached and
marked Exhibit "A",
NOW THEREFORE BE IT RE-
SOLVED BY THE City Council of the
City of Dubuque, Iowa:
Sactlon 1. That alternate alignments
recommended for further study in tbe
evaluation stage shall include the fol-

The City of Dubuque Planning and
Zoning Commission, has reviewed two
final plats. The first piat, described as
Lot 2 of 2 of 2 of Mineral Lot 263, is a
simple subdivision of a larger lot which

feet of that subdivision to become part
of Asbury Springs Subdivision No.4.
The subdivision of that portion of Min-
eral Lot 263 is shown on the attached
map. The properties lie south of Asbury
Road and east of John F. Kennedy Road
in the City of Dubuque, Iowa.
You will also find attached a map
showing the final plat of Blocks I
through 6 of Asbury Springs Subdivi-
sion and the incorporation of the afor-
ementioned portion of Mineral Lot 263.
The Planning and Zoning Commission
has found both plats to be in confor-
mance with the Subdivision Regula-

Trail and Cherbourg Court, together
with the new easements for public
utilities as the same appear upon said

The City of Dubuque Planning and
Zoning Commission has reviewed the
request of Mrs. Lavon Duscher to re-
classify Lot 34 of O'Neill's Riverview
Addition from R-2 Residential District
to R-4 Residential District classification
to permit her to build a duplex on the
property. The 5000 square foot lot is
located in the 500 block ofO'Neill Street
in the City of Dubuque, Iowa, as shown
on the attached map. .
The Planning and Zoning Commis-
sion has voted to deny the petition
based on'the following: the size of the
property (50' x 100'); the single-family
residential cbaracter of the neighbor-
hood and that reclassification of tbis
property would constitute "spot" zon-
ing and set a precedent for similar
requests In the future. The Commission
recommends that the request be denied.

We hereby submit a staff report on
"Reconstruction of the Madison Street
(Seminary Hill) Steps."
In 1975, the City Council expressed its
desire to obtain a preliminary design
and cost estimate for this project in
hopes of attracting public and private
interest. The matter was referred to
staff on October 20, 1975, and initial
work began in collaboration with a
committee of councilmen, city staff, and
private citizens. The committee sug-
gested that a well-presented design and
preliminary cost estimate could be ef-
fective in attracting public interest and,
perhaps, private contributions. Staff
work was carried out in response to that
suggestion.
As a design and report were achieved,
we felt that the purpose of attracting
public interest would be served by the
added stature the project might receive
in national design competition. The de-
sign was entered in the recent National
Awards Program of the American
Society of Landscape Architects. 1 am
pleased to report that the design is one
of two projects receiving a Special
Recognition Award in this year's ASLA
competition. The comments of the
award jury are included in the attached
report.
As an initial request for consultant
assistance was denied, we had feit un-
easy in undertaking a project so
demanding of design skills. I believe
that David Dahlquist (as project direc-

tor), Larry Dunkin, and Sandy Welsh
have performed very we)! in a challeng-
ing assignment. We hope that you will
find their work to be a successful re-
sponse to the Council's directive of
October, 1975. We look forward to pre-
senting the project to you. We recom-

and referred to your official record for
the benefit of any public or private
interest that may emerge in support of a
Madison Street Steps reconstruction
project.

This is relative to a letter dated April
21, 1977 addressed to Ihe City Council
by Francis J. O'Connor with an attached
statement of objection from residents of
the sunset Ridge Subdivision.
A meeting was held by citizens of this
neighborhood with representatives of
our Public Works Department on April
20,1977. At this meeting the route of the
proposed sewer, the total cost and the
assessable cost were explained. Refer-
ence to this meeting is made in the letter
from Mr. O'Connor to the Council.
In consideration of the objections
from the neighborhood we would
recommend dropping the proposed
project. We would suggest that the
money assigned to this project in the FY
'78 budget be assigned to other sanitary
sewer projects, which will be submitted
to the City Council in the near future.

We have been in contact witb the
Lighting Center at 484 Central con-
cerning the proposed Lightcraft Artolier
fixtures, but have been unable to obtain
all of the necessary specifications which
we feel are needed to make a proper
evaluation of the fixture. Therefore, I
would recommend that action on the
award of the contract be deferred to the
meeting of June 6, 1977, at which time
further information on the Lightcraft
fixtures will be available.

On March 10, 1977, ciaim was filed
against the City of Dubuque Iowa by
Robert W. McCormick of 2040 Bunker
Hill alleging that he incurred expenses
in the amount of $35.00 to $40.00 for
digging a trench due to leak in the water
main at said address. He bad been ad-
vised by the City Water Department
that the leak was on his property and his
responsibility, when in fact the leak was
in the City water main. Accordingly, Mr.
McCormick incurred actual expenses in
the amount of $77.08.
It is the recommendation of the City
Attorney's Office that said claim in the
amount of $77.08 be paid and copy of
said statement is hereto attached. So
that there is no misunderstanding, the
Council should understand that this
writer has been, and is presently, doing
some work for the estate of claimant's
mother.

construction or maintenance of Steps
and to pay reasonable attorney fees
therefor;
c) To indemnify and hold City of
Dubuque free and harmless from any
and all claims, loss, liability and ex-
pense for injuries to third persons or
damages to property of third persons, or
for damage to any property of City of
Dubuque which may occur as a result of
or in connection with the location, in-
stallation, construction, maintenance
and repair of the facility, work or im-
provement permitted herein.
SecUon 4. That the permission herein
granted is expressly conditioned upon
permittees further agreement that
should the right and privilege herein
granted be rescinded or revoked by the
City Council, permittees, or their suc-
cessors in interest, as owners of the
abutting property, shall within ten (10)
days after receipt of written notice from
the City Manager, so to do, at their own
expense, remove said Steps and in the
event of their failure so to do, the City of
Dubuque shall be authorized to remove
said Steps at permittees expense and
dispose of the same, and the permittees
shall have no claim against the City or
its agents for damages resulting from
the removal of soid Steps.
SecUon 5. Permittees covenant and
agree that the revocable permit herein
granted does not constitute an approval
of the design, erection, location, con-
struction, repair or maintenance of said
facility and said permittee hereby
covenants and agrees not to assert such
claim or defense against the City of
Dubuque in the event of claim asserted
for personal injuries and or property
damage against the permittee arising
out of or in any way connected with the
location, installation, construction, de-
sign, repair and maintenance of the
facility herein permitted.
Section 6. This Ordinance shall
become effective and the rights her-
eunder accrue to Paul J. Uhlrich when
this Ordinance has been adopted by the
City Council and the terms and condi-
tions thereof accepted by permittees by
acceptance endorsed on this Ordinance.

parking for handicapped persons.
Sec. 25-345. FACTS FOUND
The City Council of the City of Dubuque
finds there is a need for permanent
parking places for handicapped persons
in order that various facilities and bu-
sinesses within the City of Dubuque will
be accessibie to, and be functional, for
handicapped persons.
Sec. 25-346. DESIGNATED
PARKING
I. Special parking places are hereby set
aside as special parking places for han-
dicapped persons and shall be designat-
ed as special parking piaces oniy for
parking motor vehicles displaying a
special identification device issued by
the Iowa Department of Transportation.
2. In those cases where there is public
anguiar parking, such anguiar perking
piaces designated for handicapped
parking shall have a parking place
width of no less than tweive (12) feet to
provide for access 10 and from the
parking space by those handicapped
persons who are confined to wheel-
chairs or need the use of walkers or
crutches for 1heir mobility.
Sec. 25-347. SIGNS
The Chief of Police shall cause appro-
priate signs to be installed at the ap-
proved parking places indicating such
parking places are desIgnated only for
the use of handicapped persons.
Sec. 25-348. PROHIBITED USE AND
PENALTY FOR IMPROPER USE
I. The use of parking places which are
described herein as special parking
places for handicapped persons by a
motor vehicle not displaying a special
identification device issued by the Iowa
Department of Transportation shall be a
misdemeanor for which a fine of not less
than Twenty-five Dollars ($25.00) and
not to exceed One Hundred Dollars
($100.00) shall be imposed.
2. The speciai identification device is-
sued by the Iowa Department of Tran-
sportation shall be displayed in such a
manner that the device is clearly legible
from the outside the vehicle, when the
vehicie is parked in a specially designat-
ed perking place for the handicapped.
Display of the special identification
device by someone other than to whom
it has been issued shall be a mis-
demeanor for which a fine of not less
than Twenty-five Dollars ($25.00) and
not to exceed more than One Hundred
Dollars ($100.00) shall be imposed.

accept an objection to its approval of
the release of funds and acceptance of
the certification only if it is on one of the
following basis: (a) That the certifica-
tion was not in fact executed by the
Chief Executive Officer or other officer
of applicant approved by HUD: or (b)
that applicant's environmental review
record for the project indicates omission
of a required decision, finding, or step
applicable to the project in tbe environ-
mental review process. Objections must
be prepared and submitted in accor-
dance with the required procedure (24
CFR Part 58), and may be addressed to

68106. Objections to the release offunds
on basis other than those stated above
will not be considored by HUD. No

SUBJECT: Avon Park - Application for
Federal Assistance
On April 18, 1977, we advised that the
application for supplementary federal
assistance for acquisition and develop-
ment of Avon Park was not approved by
the Iowa Conservation Commission. At
that time, you had also approved a Re-
solution authorizing acquisition of two
parcels for the park, to be fully funded
through tbe Community Development
Block Grant.
In our discussions with the Conser-
vation Commission's staff, we learned
that our inclusion of certain site
preparation items, such as structure
demolition, grading, street curb re-
placement, and others, produced a rela-
tively low ranking in the "Site Quality"
criteria used in their project rnting
system. The total development cost for
Avon Park is now estimated to be
$62813.00. This figure includes
$17,204.00 forsite preparation work. We
are hopeful that with tbe exclusion of
these supportive items and an amended
application the project might stili stand
a good cbance of receiving partial sup-
plementation from the Land and Water
Conservation Fund.
We wish to resubmit an amended
application for 50% cost sharing of an
estimated $45,609.00 of recreation relat-
ed development Items. Contribution of
the Community Development Block
Grant funds would be $40,009.00, in-
cluding approximately $17,000.00 in-
dependently funded site preparation
costs and $22,805.00 to match the
requested LAWCON funding. We have
attached a Resolution authorizing tbe
submittal of the amended application.

suant to such act by the Secretary of
the Interior and contained in 43 CFR

6. That it will maintain adequate fin-
ancial records on the proposed
project to substantiate claims for cost

acting upon such other business as may
properly come before a Regular Meeting
of the Council.
Communication of Operation New
View Requesting consideration for
funding allocations, (Forwarded from
meeting of May 16, 1977), presented and
read. Councilman Tully moved to su-
spend the rules to let anyone present
address the Council if they so desire.
Seconded by Councilman Wertzberger.
Carried by the following vote:

D. H. Langfield of Operation New
View spoke to Council relative to com-
munication stating agency serves Jack-
son, Dubuque and Delaware Counties;
Various programs are designed for low
income people to learn to beld them-
selves; Requesting $7,000. in hard match
from City of Dubuque, $7,000 from
Dubuque County; $7,000 assessed from
Delaware County and $3,000 from
Jackson County.
Mary Alice Foster stated present
operating cost not over 15% of funding
available out of budget of $1,161,167:
Present Budget could grown to $1.5
million. Councilman Pregler moved tbat
the communication of Operation New
View be received and filed and directed
$7,000. to Operation New View be rein-
stated in Budget, also $10,000. on Al-
coholism Control. Seconded by Coun-
cilman Tully. Carried by the following
vote:

Councilman Pregler moved that a
representative of the City Council be
instructed to negotiate for abolition and
governing Board be self-sustaining.

pointment of Wilbur Behlmer to the
Board of Heating, Ventilating, Air-Con-
ditioning and Refrigeration.
It is required that this appointment to
tbe Board be a registered engineer. It is
for a three year term from March 16,
1977. Mr. Behlmer is a registered engin-
eer and works in the Engineering
Department of Jobn Deere Tractor
Works. He lives at 2635 New Haven.

Civil Service Commission conducted
Bus Operator Examinations on January
12, 1977. The first ten applicants that
passed the test were certified to your
Honorable Body on January 17, 1977.

An Ordinance amending Code of Or-
dinances by adding a new Chapter to be
numbered 12\\ creating a Civic Center
Commission for the City of Dubuque,
Iowa, establishing the number of
members thereof and prescribing the
powers and responsibilities thereof,
presented and read. Jackie Merritt of
Five Flags Executive Committee ad-
dressed the Council requesting a five
member Commission; Recreation Com-
mission should have representation,
also one member should be from the
Chamber of Commerce and three
members at large.
The proposed Ordinance was
reviewed and after considerable discus-
sion the Ordinance was referred back to
the City Attorney to make proper cor-
rections and presentation for final draft
at the Council meeting of June 6th.
Councilman Wertzberger moved that
Donald Sanders and Lester Pihart be
reappointed to the Planning and Zoning
Commission for five year terms to
5-24-82. Seconded by Mayor Stackis.
Carried by the following vote:
Yeas - Mayor Stackis, Councilmen
Brady, Pregler, Tully, Wertzberger.
Nays-None.
