Koch, Public Works Director ~-j~ Vacating - Wall Street, Tower Street, East 6th Street and Adjacent Alleys All East of Bell Street INTRODUCTION The enclosed resolution and ordinance provide for the approval of the attached survey plat and vacating of Wall Street, Tower Street, East 6th Street and adjacent alleys all east of Bell Street, which provides for future platting required for the hotel, water park, convention center, and the adjacent parking areas as outlined in the Development Agreement with Platinum Hospitality Group, LLC. DISCUSSION To complete the agreements with Platinum Hospitality Group, LLC, a legal description for the parcels of land to be leased and developed needs to be prepared. The public streets and alley east of Bell Street need to be vacated in order to consolidate those areas with surrounding lots to properly configure the lease areas. The areas to be vacated are: · Wall Street east of Bell Street · East 6th Street east of Bell Street · Tower Street from East 6th Street to Wall Street · A 20-foot wide alley north of East 6th Street from Bell Street to Tower Street · A 15-foot wide alley south of East 6th Street from Bell Street to Lot 1 of Riverwalk 3rd Addition IIW Engineers & Surveyors, PC has prepared a Plat of Survey of the areas to be vacated and assigned lot numbers thereto. The City is the property owner of all abutting lands. Existing utilities in the street right- of-way are being rerouted as part of the new development plans. As platting and development occurs, new easements will be granted for utilities. The Dubuque County Recorder requires an "Owner's Consent" certificate to be attached to all plats recorded in Dubuque County. RECOMMENDATION I would recommend that the attached Plat of Survey be approved and that the Mayor be authorized and directed to sign the plat on behalf of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the plat dated June 28, 2001, prepared by IIW Engineers & Surveyors, P.C., relative to the real estate hereinabove described be and the same is hereby approved, and the Mayor and City Clerk be and they are hereby authorized and directed to execute said plat and on behalf of the City of Dubuque, Iowa. Section 2. That the City Clerk be and is hereby authorized and directed to file said plat and certified copy of this resolution in the office of the Recorder, in and for Dubuque County, Iowa.
