Minutes Zoning Adv 7 5 01PRESENT: ABSENT: ZONING ADVISORY COMISSION MEETING MINUTES July 5, 2001 6:30 p.m. Auditorium, Carnegie Stout Library 360 W. 11t~ Street, Dubuque, Iowa Chairperson Eugene Bird, Jr., Commissioners Ron Smith, Stephen Hardie, Martha Christ, Jeff Stiles and Dick Schiltz. Commissioner Bob Nagle. CERTIFICATE OF COMPLIANCE: Staff presented an Affidavit of Compliance verifying that the meeting wes being held in compliance with the Iowa Open Meetings Law. CALL TO ORDER: The meeting was called to order at 6:30 p.m. MINUTES: The minutes of June 6, 2001 were approved unanimously as submitted. ELECTION OF OFFICERS: Motion by Schlitz, seconded by Hardie, to nominate Eugene Bird, Jr. as Commission Chair, Richard Schiltz as Vice Chair and Martha Christ as Secretary. The nominations were approved unanimously. ACTION ITEMS/PRELIMINARY PLATIGUDENKAUF: Application of Lloyd Gudenkauf to approve the preliminary plat of Jaeger Heights Subdivision No. 2 located west of Jaeger Ddve. Lloyd Gudenkauf, t0816 Cascade Drive, asked the Commission to approve his preliminary plat as submitted. Commissioner Schillz asked if Mr. Gudankauf's brother had originally developed this property. Mr. Gudenkauf said yes. Commissioner Schiltz asked if access to the Malone's property would be maintained. Mr. Gudenkauf said that the access issues with the Malone's have bean resolved and that an access to the property will be maintained. The Commissioners discussed the request to develop Lot 6 with no frontage, utilizing an access easement. The Commissioners discussed problems that may be generated by creating lots with no frontage. The Commissioners also discussed increasing the width of the 12-foot access easement between Lots 7 & 8 across Lot 6 to the detention basin on Lot 4. The Commissioners felt that a 20-foot access easement would be The Commissioners discussed the elimination of the former Rita Drive access to the balance of the property to the south. Mr. Gudenkauf stated that the property to the south would most likely be developed as a self-contained trailer park with no access to his subdivision. He also said there is a grade change between the properties that made access difficult. The Commissioners felt that based on the reasons Mr. Gudankaut outlined, there is no need to maintain the former Rita Drive access. Motion by Hardie, seconded by Stiles, to approve the subdivision plat waiving the Section 4 Lot Frontage requirements for Lots 3, 4, 5, 6 and 7 of Block 6, and designating Lot 6 of Block 6 as a non- buildable lot, and recognizing that the Rita Drive accass has been eliminated. Motion was approved by the following vote: Aye - Smith, Hardie, Christ, Stiles, Schiltz and Bird; Nay - None. Meeting Minutes - Zoning Advisory Commission July 5, 2001 Page 2 ITEMS FROM COMMISSION: Commissioners questioned the absence of Bob Nagle from the meeting. The Commissioners stated that if Mr. Nagle has moved, that a formal letter of resignation should be submitted to enable a new commissioner to be appointed. Motion by Hardie, seconded by Schiltz, to carry out by-law stipulations regarding absence a commission member. Motion was approved by the following vote: Aye - Smith, Hardie, Christ, Stiles Schlitz and Bird; Nay - None.
