Iowa for the Airport Commission
to acquire an avigational easement
as well as easement for removal
of obstruction and subsequently
thereto. Mr. Ambrosy appealed his
case to the District Court of Du-
buque County, Iowa.
Thereafter, the City Attorney's
office prepared and interposed the
necessary defenses to said action
and in the course of negotiations
between Mr. Ambrosy and the
City Attorney's office. Mr. Ambro.
sy made an offer of settlement in
the amount of $38,500.00 together
with court costs.
The City Attorney's office has
examined this offer and has con.
siedred all of the facets of it and
recommends that said offer be
accepted.
Accordingly, it is the recom-
mendation of the City Attorney's
office that the offer of Vincent
Ambrosy to settle his claim which
is the subject matter of suit pend.

WHEREAS the City of Dubuque,
in the County of Dubuque, State
of Iowa (the "City"), proposes to
acquire a leasehold interest in cer-
tain structures, equipment, 00-
provements and other facilities
useful for the purpose of reduc-
ing, preventing and eliminating
pollution of the air in and near
the City and an easement in con-
nection therewith (the "Project"),
to sublease the Project to Inter-
state Power Company, a Delaware
corporation (the "Company"), to
be used to reduce, prevent and
eliminate air pollution in and near
the City, and to issue Pollution
Control Revenue Bonds (Interstate
Power Company Project), Series
1973, in the principal amount of
$4,400,000 (the "Series 1973
Bonds"), to finance the cost of the
Project, all in accordance with the
provisions of Chapter 419 of the
Code of Iowa, 1973, as amended
(the "Act"); and
WHEREAS pursuant to pub-
lished notice of intention this City
Council has conducted a public
hearing, as required by Section
419.9 Of the Act, and this City
Council deems it necessary and
advisable to proceed with the proj-
ect and the issusnce of the Series
1973 Bonds; and
WHEREAS the City has arranged
for the sale of the Bonds to Blyth
Eastman Dillon & Co. Incorporat-
ed and Carleton D. Beh Co., joint-
ly;
NOW, THEREFORE, BE IT RE-
SOLVED BY THE CITY COUNCIL
OF THE CITY OF DUBUQUE,
IOWA, AS FOLLOWS:
Section 1. That, in order to 'fi-
nance the cost of the Project, the

Official Statement dated Novem-
ber 29, 1973, and the final Offi-
cial Statement dated December 14,
1973, be and the same are hereby
authorized, and the Mayor is au-
thorizedand directed to execute
said Official Statement; provided
that this authorization does not
apply to the information with re-
spect to the Company contained in
the Appendix to said Official
Statement, but nothing herein
shall be construed as prohibiting

The section "Exemptions for Ex-
isting Services" is recommended
to sllow those existing services to
continue, if tbey so desire, under
the timetable proposed by HF 653.
These standards would be adopted
by the Health Officer under Sec-
tion 8, subsection (e).
The fee schedule in revised Or-
dinance 52-89 is based on the De-
cember first survey of ambulance
services in Iowa cities over 30,000,
and the anticipated operatIng costs
of our service in 1974.

NOW THEREFORE BE IT OR-
DAINED BY THE CITY COUNCIL
OF THE CITY OF DUBUQUE,
IOWA:
Section 1. That Ordinance No.
7-65 be amended by repealing Sec-
tion 2 (d) thereof and enacting a
new Section 2 (d) in lieu thereof
as follows:
"Section 2.
(d) Three Dollars ($3.00) for
each male dog; Three Dollars
($3.00) for each spayed female
dog; Six Dollars ($6.00) for
each female dog not spayed."

entered into by the City of Du-
buque, Iowa, for the improvements
hereinafter described has been
completed and the City Manager
has certified the completion there-

Subdivision No.3," in the City
of Dubuque, Iowa, containing
2.052 acres more or less.
Be and the same is hereby ap-
proved upon the following tenns
and conditions:
I. That the said real estate be
sold to Uuited Parcel Service of
Omaha, Nebraska for the construc-
tion thereon of a new building
containing approximatelY 10,000.00
square feet.
2. That the sale price for said
real estate shall be $.25 per square
foot in the total amount of Twen-
ty-one Thousand, Seven-Hundred
Eighty ($21,780-00) Dollars for a
certain 200' by 450' lot and the
receipt of Twenty-One Hundred
Seventy Eight ($2,178_00) Dollars
as down payment is herewith ac-
knowledged by the City.
3. That construction of said
building shall be commenced with-
in one (I) year of adoption and the
passage of this Resolution and
shall be completed within two (2)
years of delivery of deed and upon
failure so to do or failure to make
improvements as to the land with-
in one (1) year by the United Par-
cel Service of Omaha, Nebraska,
purchaser, then said real estate
shall automatically revert to the
City of Dubuque, Iowa and pur-
chase price, less damages, shall be
refunded to the purchaser.
4. That the construction of all
buildings, yards, parking lots,
fences and ancillary improvements
shall be constructed in conform-
ance with existing City codes, and
manufacturing process carried out
in accord with City ordinances.
5. That the City of Dubuque,
Iowa retains a perpetual easement
for existing waterlines, existing
sanitary sewer and storm sewer
lines and for utilities, together
with right of ingress and egress
to repair, inspect and maintain the
same.
6. That all utilities and services
to proposed buildings be counect-
ed at buyer's expense.

over a span of years; and
WHEREAS, Walter F. Gilligan
served his City unselfishly and
discharged the duties of his of-
fice with ability and human
warmth; and
WHEREAS, Walter F. Gilligan
as Mayor of East Dubuque, Illinois
cemented closer and closer and
more effective relations with this
City; and
WHEREAS, Walter F. Gilligan
died on December 25th, 1973 and
his death should be memorialized
by this Council;

Honorable Walter F. Gilligan, Ma-
yor of East Dubuque, Illinois, and

friends of Walter F. Gilligan the
deep loss of his departure and
does hereby officially extend sym-
pathy and love to the family,
friends and associates of Walter F.
Gilligan, and officially wish to me-
morialize a legal public servant
who left his deep mark as he
passed through this life.
