llc Works Ass'n Research Founda-
tion offering the possibility of
materially red u c i n g equipment
costs of Government fleets, pre-
sented and read. Mayor Couchman
moved that the communication be

Your staff has investigated the
petition request for the vacation
of National Street by the residents
of Keokuk Street. The investiga-
tion revealed that the vacation of
the street should be predicated on
the instalJation of sidewalka and
sanitary sewers by the petitioners
for street vacation. We will ar-
range to put this proposition to
the petitioners and are requesting
the City Solicitor to assemble the
gronp for this purpose.

Honorable Mayor and
Council Members
The City Planning and Zoning
Commission has reviewed a pro-
posal for voluntary annexation of
approximately 85 acres of land
lying along the Peru Road, north
of the City.
The Commission has found that
the property is eontiguous to the
present corporate limits and that
municipal services can be provided
to tbe area.
Annexation of this property is in
accord with the overall annevation
program, and the General Develop-
ment Plan for the City.
It is the recommendation of the
Commission that the Council accept
the proposed voluntary annexation.

WHEREAS, the owners of an
area approximately 88.7 Acres in
size immediately adjoining the

of Dubuque, Iowa now voluntarily
petition the City Council for an-
nexation of their property to the
City of Dubuque, Iowa.
WHEREAS, the inhabitants of
said territory will be enabled to se-
cure the benefits of city govern-
ment in the way of police and fire
protection if said territory is in-
corporated within the city limits
of the City of Dubuque, Iowa; and
WHEREAS, the inhabitants of
said territory will be enabled to
secure water, and other municipal
services if territory is incorporated
within the city limits of the City of
Dubuque, Iowa; and
WHEREAS, Section 362.30 Code
of Iowa, 1962, authorizes the exten-
sion of city limits in situations of
this character by the adoption of a
resolution therefore; and
WHEREAS the future growth,
development, and preservation of
the public health of the City of
Dubuque, Iowa, makes it imperative
that said territory be made a part
of the City of Dubuque, Iowa;
and
NOW, therefore, be it resolved
by the City Council of the City of
Dubuque, Iowa, that the territorial
limits of the City of Dubuque, Iowa
be and they are hereby extended to
include the area comprising the

I am attaching a letter dated
March 11, reeeived from the Acting
Regional Director, Water Quality
Office, Environmental Protection
Agency, Region V.
This letter is an offer of a Fed-
eral Grant in the amount of $1,-
822,800. This assist in financing
the construction of Phase IT of the
Sewage Plant and Force Main Pro-
gram.
You will reeall that the engi-
neer's estimate of project east was
$4,558,000, including $2,506,900
Federal assistance and $1,139,500
State assistance. The offer of Fed-
eral assistance is substantially less
than the estimate. No offer of State
assistance has been received.
Because of this situation, the
Federal Environmental Protection
Agency, and the Iowa State Depart-
ment of Health were contacted.
From these sources, it appears that
the best procedure is to aceept the
Federal offer.
Sinee the acceptance of the offer
must be on or before April 7, 1971,
and must be without qualification,
I request that you favorably con-
sider a resolution authorizing the
City Manager to accept the Federal
grant offer on hehalf of the City.

WHEREAS, the City Council of
Dubuque, Iowa has been and con-
tinues to be deeply concerned
with the increasing problems of
financing local government ser-
vices for the three out of four
Iowans who live in cities and
towns; and
WHEREAS, there are 670 cities
and towns levying 28 mills or
over and an additional 35 cities
and towns levying an emergency
mill; and
WHEREAS, the total debt for
cities and towns rose $96 million
in 1969, bringing the total debt
for eities and towns to he above
$378 million, or 97% of total
operating budgets of $390 million;
and
WHEREAS, there is a demon-
strated need for additional non- I
property tax revenues to adequate-
ly finance laval governments; and
WHEREAS, the urban popula-
tion has risen from 53.0 percent
of the total state population in
1960 to 73.2 percent in 1970; and
WHEREAS, any tax reform
must provide equitable tax treat-
ment to rural and urban citizens
alike.
NOW THEREFORE BE IT RE-
SOLVED by the City Council of
the City of Dubuque, Iowa, in re-
affirmation of the policy adopted
at the annual meeting of the
League of Iowa Municipalities in
September of 1970, urges the
Iowa General Assembly to in-
crease the state sales tax from 3
percent to 4 percent with the pro-
ceeds being returned to cities,
towns and eounties on a per capi-
ta basis.
BE IT FURTHER RESOLVED
that the City Council of the City
of Dubuque, Iowa, will strongly
oppose any increase in state sales
or income tax, unless the equiva-
lent of one-half of one cent of
sales tax is returned to the cities
and towns only on a per capita
basis for the henefit of their citi-
zens.
BE IT FURTHER RESOLVED
that copies of this resolution be
forwarded to our State Represen-
tatives and Senators and the
League of Iowa MuniCipalities re-
questing their vocal and active
support of these measures.

before the Council and read a pre-
pared statement indicating that
section 2 of Ordinance No. 48-70,
requiring a plumbing inspector to
hold a journeyman or Master
Plumber license and with five
years experience, was included in
the ordinance either unwittinglY
or by specific design to limit the
number of applicants for Plumb-
ing Inspector. Mr. Stonskas re-
quested the Council to postpone
the appointment until they re-
view the Ordinance and consider
some of his suggestions. Mr. Peter
L. Stonskas, father of Robert
Stonskas, addressed the Council
by stating that the Ordinance is

On February 24, 1971, Mrs. Don-
ald Cullen of 93 North Algona, this
city, filed claim against the City
of Dubuque in the total sum of
$33.38 for injuries allegedly re-
ceived on January 8, 1971 as the
result of slipping and falling on
the sidewalk at a point near 2463
Central Avenue, this city and said
damages claimed are for doctor
bill, loss of a day's wages and eab
fare after the fall.
I have made an investigation of
this matter and have eonferred
with clainmant and have reviewed
the medical bill and claimant has
made an offer of settlement of
this claim in the amount of $33.38
and it is the recommendation of
the City Attorney that said offer
of settlement be accepted and that
the City Auditor be instructed to
draw a warrant payable to Mrs.
Donald (Margaret Cullen) and Don-
ald Cullen, husband and wife in
the amount of $33.38 and transmit
the same to the City Attorney for
delivery upon receipt of duly exe-
cuted releases. Original claim is
attached hereto.

On January 29, 1971, Mrs. Betty
(Francis) Barrett of 515 Almond
Street, this city, filed claim against

the City of Dubuque, claiming dam-
ages for the total amount of
$102.00 and alleging that said dam-
ages were for doctor bill, loss of
wages and rental of crutches and
further claiming that said damages
and personal injury resulted from
a fall in the street near said ad-
dress on January 13, 1971 and that
said fall was caused by ice and
snow on an unsalted street.
I have made an investigation of
this matter and have learned that
there was a snow fall on that date
and that claimant fall in the street
attempting to reach her car, and
from the facts learned and the per-
tinent laws, it is the opinion of
the writer that there was no action- 1
able negligence on the part of the
City of Dubuque and therefore it
is recommended that said claim
be denied.

On March 30, 1971, the City of
Dubuque was put on notice of a
fall by Ann Filiatrault on a city
public sidewalk on February 10,
1971 on the property of Vivian B.
Snyder, 950 Spruce Street, this city
and claiming doctor bills, X-rays
and loss of wages.
This matter was referred to the
City Attorney who has made an
investigation of the matter and re-
viewed the doctor bills and claim-
ant has made an offer of settle-
ment in the amount of $20.25 and
in view of the foregoing it is the
recommendation of the City Attor-
ney that said offer of settlement
be accepted and that the City Aud-
itor be instructed to draw a war-
rant payable to Ann Filiatrault in
the amount of $2025 and transmit
the same to the City Attorney for
delivery upon receipt of duly exe-
cuted releases. Original notice is
returned herewith.

and alleging said damages were
in the total amount of $108.25.
This matter was investigated by
the City Attorney's Office who
also checked with the Street De-
partment and based on the facts
and existing law finds there is no
actionable negligence by the City
of Dubuque and therefore recom-
mends that said claim be denied.

Grant Contraet for the undertak-
ing of the Downtown Urban Re-
newal Project, Iowa R-15; and
WHEREAS, under date of April
7, 1969, the Council of the City
of Dubuque adopted Resolution No.
87-69 authorizing to be issued, from
time to time, Project Notes in con-
nection with the Downtown Urban
Renewal Project, Iowa R-15, in an
aggregate principal amount out-
standing at anyone time of not
to exceed $8,624,313; and
WHEREAS, under date of Janu-
ary 18, 1971, the Council of the
City of Dubuque authorized the
issuance and sale of its Project
Notes in the aggregate principal
amount of $3,082,000 to finance
certain undertakings in connection
with the Downtown Urban Renewal
Project, Iowa R-15; and
WHEREAS, in order to refinance
the outstanding Project Notes and
provide additional working capital,

was consulted by the Council and
advised against an exeeutive ses-
sion. There was an agreement
made by both the City and Fischer
Investment to buy and sell the
property and there reallY is noth-
ing new. It should also be borne in
mind that other people were inter-
ested in the sale of the property
at the time. Mr. Louis pfohl was in
attendance and stated that he was
under the impression that the mat-
ter would be discussed in an exeeu-
tive session. He would not discuss
the status of the property in an
open meeting because he had no
legal counsel with him. He did not
want to be put under pressure.
Councilman Moldenhauer moved
that the Mayor attempt to re-
schedule a meeting with Mr. Pfohl
to diseuss the matter he was con-
cerned about. Seconded by Mayor

Commission conducted Promotion-
al examinations on April 17, 1971,
for members of the Police De-
partment for Captain and Ser-
geant-Detective.

ten examinations with an average
of seventy per cent or better.
