open meeting because he had no
legal counsel with him. He did not

jecting to businesses being ope-
rated in residential areas at 2782
Buena Vista Street and 105 West
17th Street Also, I am returning
a petition by which the signers
indicate that they have no objec-
tion to the operation being con-
ducted at 105 West 17th.
At Council meeting February
15th, the problem raised by the
Ring petition was discussed and
an oral presentation made that the
operation being carried on was
educational and as such was in
conformity to the zoning ordi-
nance, The matter was then re-
ferred to the city attorney and
manager for investigation and re-
port.
This report consists of the fol-

The city attorney in his letter
states his opinion that the opera-
tion of either premises under con.
sideration is not an educational
use exemption under the zoning
ordinance,
The building commissioner in
his letter states that there is a
violation of the zoning ordinance,
and notice should be given to stop
within a specified time.
I recommend that the building
commissioner be instructed to
send notice to the concerned per-
sons to cease the conduct of their
figurine business within a period
of thirty (30) days,

street, The place has been in ope-
ration for eighteen years, Mr. Con-
nery requested that the Council
view the grounds. Mrs. Ken Ring
inquired if Mrs, Grace has a retail
sales permit Mr. Arthur Ott stated
that a person could be educated
in a place of business same as in
a house. Various women spoke in
behalf of Mrs, Grace's shop as stu-
dents, Mrs. Richard Pluym spoke
in behalf of her figurine shop at
W. 17th Street by stating that I
when she bought the place there
was a business there at the time,
Petition of Mrs. James Steuer
et al (230 names) requesting that
Mrs. Pluym of 135 W. 17th street
be aIlowed to operate the figurine
shop she Owns and if the property
must be rezoned to accomplish this
to consider this a petition for
that purpose, presented and read.

filed claim against the City of Du-
buqne in the amount of $30,90,
said amount being plumber's ser-
vices, which aIlegedly were re-
quired as the result of a sewer
back up in her home on March
3, 1971.
This matter was referred to the
appropriate City Agency who made
an investigation thereof and re-
ported by letter to this office on
April 23, 1971 of no liability on
the part of the City and in view
of the foregoing it is the recom-
mendation of the City Attorney
that the claim of Vera F. Waite
be denied.

basement

N, Section 2(h) amended to in-
clude Lot 2 and Lot 3 of Sidouia
Hosford's Subdivision, in the City
of Dubuque, Iowa. This would au.
thorize professional offices as a
permitted use in the Multiple Res-
idence District.
It was pointed out that the pro.
posed zoning ordinance classifies
this area as Hospital.Medical, and
that the uses that would be per-
mitted in the professional classifi-
cation would also be permitted in
the Hospital-Medical classification
after adoption of the new zouing

of 1930 Westridge Court filed claim
against the City of Dubuque for
damages to his vehicle alleging that
same occurred on February 20,
1971 at or near Central Avenue at
32nd Street.
I have made an investigation of
this matter and it is my opinion
that Mr, Yourell should be reim-
bursed only in the amount of
$12,16,
Therefore, it is recommended
by the City Attorney that the City
Auditor be instructed to draw war-
rant payable to Gerald Yourell in
the amount of $12,16 and transmit
same to the City Attorney for de-
livery upon receipt of properly exe-
cuted releases.

On March 15, 1971, Robert Strub
of 2096 Broadlawn this city, filed
claim against the City of Dubuque
in the amount of $60.39 ood alleg-
ing that said damages occurred
to his automobile on March 12,
1971 as the result of his striking
an improperly lighted and unbar-
ricaded hole in the street at 1905
Asbury Street.
This matter was investigated by
the City Attorney's office who also
checked with the Street Depart-
ment and was advised by them
that the party responsible for the
hole in the street was an excavat-
ing contractor working in that area
at that time. Thereupon, the claim-
ant, Mr. Strub, referred his claim
to the excavating contractor, and
on May 6, 1971, Mr. Strub advised
this office by telephone that his
claim had been satisfied in full by
said contractor.
In view of the foregoing, it is
the recommendation of the City
Attorney that the claim of Robert
Strub against the City of Dubuque

to pay any sums which may be
received from the Government
pursuant to the Requisition Ag-

The Planning and Zoning Com-
mission has held a public hearing
on the Tower Mobile Home Park
Plan. The Commission has found
that the plan conforms to the de-
velopment standards that were
adopted by the Commission and
the Council. It was further the
opinion of the Commission that
a mobile home park would be an
appropriate use for this area ood
that it would meet a need in the
community,

Commission considered the matter
of access to property lying north
of this development. It was the feel-
ing of the Commission that in a
housing development such as a
mobile home park, where central
management is provided, that pri-
vate streets are more desirable than
public streets, and that require-
ments of additional public right.

(LG) with the United States of
America acting through the De-
partment of Housing and Urban
Development, providing for finan.

and carrying out of a certain Ur-
ban Renewal Project herein des-
iguated as Project No. Iowa R-15,
which is more fully identified in
the executed Contract for Loan
and Grant; and
WHEREAS, it is necessary ood

by the Housing Act of 1949, as

cil of the City of Dubuque adopted
Resolution No. 47.70 authorizing
sale of the following described
real property to The Eska Com-
pany:
Lot Three (3) of Lot One (1) of
Block Five (5) in River Front
Subdivision No, 3 in the City
of Dubuque, Iowa, subject to
existing easements of record.
The aforesaid Resolution pro-
vided in part that expansion of
Eska's facilities shall be completed
within two years of the date of
adoption and passage of the Res-
olution, This would require a com-
pletion date of not later than
March 2, 1972, The Eska Company
acquired titie to the aforesaid de.

dated March 2, 1970 and filed of
record In Dubuque County, Iowa,
on March 11, 1970. Subsequent
thereto The Eska Company under-
took an expansion program which
resulted in an expansion to the
existing plant which was complet-
ed In December of 1970 at an
approximate cost of $125,000.00.
The expansion was made on the
property where the main plant is
now located and adjoins the exist-
ing plant. It was decided by The
Eska Company that this method
of development would result in the
