The conditions that are present offer a definite fire hazard, a breeding place for rats, an attrac- tive nuisance for children and a detriment to this area. July 6, 1971 To the Honorable Mayor and City Council We are writing to request your affirmation on the purchase of cer. tain traffic signal and street light- ing equipment which will be in. stalled under 8 forthcoming con- struction contract principally in the downtown central business dis- trict. We touched on this subject briefly at our informal meeting on June 30, 1971. However, we wish to 284 Adjourned Regular Session, July 6, 1971 take this opportunity to discuss the matter in detail. I As you are aware, all of the traffic signals in the Urban Renew. al and peripheral areas are being improved and upgraded to more ef- ficiently carry the projected traffic volumes. The street lighting in the area is also being improved for safer pedestrian and vehicular flow and to establish a sense of continuity to the project. To this end, when the first ma- jor signal program, Iowa Street, was contemplated in 1969, infor- mal bid proposals were received on the equipment involved in that contract. Three bids were received, Eagle Signal was the lowest bid- der. Their bid at that time was closely comparable to the prices submitted on a purchase basis. Because most of the existing equipment operating in the City is Eagle Signal and our parts inven- tory reflects this, we feel real ec. onomies of operatiou cau be real- ized by continuing with this parts interchange capability. In the downtown area aU of the signalized intersections will be interconnect- ed, interna1ly sequenced, and pro- grammed by a master controHer to change with the demands of traf- fic. For this reason it is critical all equipment purchased be com- patible with the total system. As we mentioned on June 30, 1971 we were able to save approxi- mately $2,000.00 in price increases taking efect July 1 by ordering the equipment on that date. The total dollar amount ordered is $17,636.00. The order was hand- led on several Purchase Orders aU except one in amounts under $2,- 600.00. The exception was an order for the necessary 30' lighting stan- dards required on Central Avenue in the amount of $5,440.00. In the remainder of the project area we were able to salvage the existing poles and re.use them on the im- proved streets. As we near the completion of the project, nineteen 30' standards are. needed to com- plete the lighting system in the U.R. Project. These. could have been included as an item to be furnished under the forthcoming construction contract, however, it has been our experience that a contractor adds 1()'15% to the aup- ."'.~ pliers price on a material item in the contract. The lighting stand- ards are the same type as those in the balance of the project area and provide uniformity for the total system. In conclusion, we would ask your concurrence on the previously de- scribed purchase as heing in the best interest of the total plan for the downtown area. RespectfuHy submitted, Gilbert D. June 29, 1971 Honorable Mayor and City Council On January 11, 1971, Selma Mas- sey, filed claim against the City of Dubuque, Iowa claiming personal injuries as the result of a fan on January 6, 1971 on an icy side- walk at or near 2241 Central Ave- nue in the City of Dubuque, Iowa. This matter was referred to the City Attorney who made an inves- tigation and determined that the claimant had suffered a broken arm and that her hospital and doc- tor bills totaled approximately the sum of $400.00; and loss of wages - $729.20 and that the said claim- ant has made an offer of settle. ment in the amouut of $1,061.20 to which amount the insurance car- rier for the abutting property has agreed to pay $500.00 and the City shan pay $561.20. It is therefore recommended that the settlement offer be ap- proved and that the City Auditor be instructed to draw a warrant payable to Selma Massey and IDair Massey, hushand and wife, in the amount of $561,20 and transmit same lor delivery upon receipt of duly executed releases. Absent - Councilmen Meyers, Moldenhauer. 288 Adjourned Regular Session, July 6, 1971 RESOLUTION NO. 204-71 I RESOLUTION APPROVING THE PLAT OF Block 1 and Block 2 in "Knob Hill Grove" IN THE CITY OF DUBUQUE, IOWA WHEREAS, there has been filed with the City Clerk a plat of the Subdivision to be known as Block 1 and Block 2 in "Knob HiH Grove" in the City of Dubuque, Iowa, by John Duggan Trustee under the "Regina Duggan Trust"; and WHEREAS, upon said plat ap- pear streets to be known as Dug- gan Drive, together with certain public utility easements which the Owners by said plat have dedicated to the public forever; and WHEREAS, said plat has been examined by the City Planning and Zoning Commission and had its approval endorsed thereon; and WHEREAS, said plat has been examined by the City Council and they find that the same conforms to statutes and ordinances relating thereto, except that street grades have not been established, the streets brought to grade, or pav- iug, sewer or water installed; NOW THEREFORE, BE IT RE- SOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section I. That the dedications of Duggan Drive together with the easemeuts for public utilities as the same appear upon said plat, be and the same are hereby ac- cepted; Section 2. Mayor & City Council On January 18, 1969, Helen Shaf- fer and Harold Shaffer commenced an action in the District Court of Dubuque County, Iowa against the City of Dubuque claiming damages in the amount of $60,000.00 for in- juries to Helen Shaffer and claim- ing damages in the amount of $10,000.00 for plaintiff, Harold July 16, 1971 To the Honorable Mayor and City Council Your staff has requested that an engineering contract be executed with the firms of Henningson, Dur- ham & Richardson, Inc- and Cullen- Sehiltz & Associates Engineering Company for engineering services for Solid Waste Disposal Facilities. -~-~-~~ - - 296 Special Session, July 19, 1971 Shaffer, spouse of Helen Shaffer, and said action having beeu pre- ceded by notice to the City of Dubuque of claim for injuries al- legedly received on December 17, 1967 while plaintiff, Helen Shaf- fer, was walking on the public walk abutting the premises of 109 E. 32nd Street in the City of Du- buque, Iowa and as a result of which defect, she fell and frac- tured her hip and injuring her knee and incurring substantial medical expense and suffering, and resulting in a permanent disabil- ity of twenty-five percent of the whole person. The foregoing mat- ter was heard in the District Court of Dubuque County, Iowa before a jury and the jury trial which com- menced on July 6, 1971 and on I July 8, 1971 an offer of settlement was made in the amount of $5,000.00. It is to be borne in mind that the City brought in the property owner as a cross-defendant and who resisted the claim of the plain- tiff together with the City. Of said amount of settlement, it would be expected that the City would pay one-half thereof or in the amount of $2,500.00 and it is the recommendation' of the City Attorney that said offer of settle- ment be accepted and that the City undertake and agree to pay the court costs to the extent of one-half thereof and in addition thereto, that the City Attorney be authorized and empowered to con- fess judgment for and on behalf of the City in the amount of $2,500.00, same to bear interest at the rate of 5% commencing from the date of entry of said judgment in order that the same may be budgeted for the year 1972 as the statute provides. Mayor & City Council On the 29th day of April, 1970, a suit in the District Court of Du- buque County, Iowa wherein Trans- america was named plaintiff and City of Dubuque named defendant was filed, wherein the plaintiff claimed of the City of Dubuque the amount of $50,000.00 as the re- sult of alleged acts of negligence by the City of Dubuque in the re- sponse to and in the manner of fighting the fire at Rainbo Oil on the 8th day of February, 1969 and in which petition specific acts of negligence are charged. The matter was referred to the City Attorney who in turn referred the same to the appropriate City Agency and this matter has been pursued to various stages of suits including Dismissal of other plain- tiffs insurance companies against the City of Dubuque and this writ- er has been advised by the repre- sentative of the agency to whom this matter had been referred to that this matter has been amic- ably disposed of and that same is at no expense to the City of Du- buque. University from Asbury to Mc- Cormick. McCormick Street extension south to Dodge Street. WRERAS, the City of Dubuque is eligible to receive funds under this program. Iowa. in the above described real estate to S & A Realty Co., a Missouri Corpor- ation: NOW THEREFORE BE IT RE- SOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IO- WA: Section 1. That the disposal of interest of City of Dubuque, Iowa, in real estate to S & A Realty Co., a Missouri Corporation, covering the fallowing described real estate, to-wit: In the County of Dubuque, State of Iowa, beginning at the North- west corner of Lot Four (4) in Reeder Langworthy's Subdivi- sion in the City of Dubuque, Iowa, according to the recorded plat thereof; thence Easterly a I distance of Two Hundred Sixty Two and Thirty-six Hundredths (262.36) feet to a point; thence Northerly a distance of Twenty (2(}) feet to a point; thence West- eriy a distance of Two Hundred Sixty (260) feet, more or less, to a point in the Easterly edge of Alpine Street; thence Southerly along the Easterly edge of Al- pine Street a distance of Twenty (20) feet to the point of begin- ning, which property is an unim- proved alley, and whicb is shown on attached Exhibit "A" for the toal purchase price of $1,500.00 plus publication costs and recording fees, and that no ab- stract of title be furnished, be and the same is hereby approved sub- ject to conditions of Purchase Agreement, which Pur c has e Agreement is hereto attached and made a part hereof, and the Mayor and City Clerk are hereby au- thorized to execute said agreement and deed. Section 2. That the City Clerk be and he is hereby authorized and directed to deliver deed of conveyance to S & A Realty Co., a Missouri Corporation, upon re- ceipt of the purchase price of $1,500.00 plus costs of publication and recording fees. Section 3. That the City Clerk be and he is hereby authorized and directed to record a certified copy of this Resolution in the of- fice of the Dubuque County Re- corder.
