The City Planning and Zoning
Commission has reviewed a propo-
sal to reclassify property described
as Lot 14 of Block 2 io Westside
Manor Subdivision, in the City of
of Dubuque, Iowa, from Single Fa-
mily Residence to Multiple Resi-
dence classification and to include
it in Article IV, Section 2(h) of
the Zoning Ordinance to permit
professional Office use. This pro-
perty is located at the northwest
corner of John F. Kennedy Road
and Crestwood Drive.
In 1969 and 1970, the Commis-
sion and Council heard a petition
to reclassify from Single Family
Residence to Local Business "B"
property described as the Souther-
ly one hundred and fifty feet
(150') of Lot 2 of the Subdivision
of Lot 25, Block 4 in Westside
Manor Subdivision, in the City of
Dubuque, Iowa. The property of
this earlier petition lies on the
west side of John F. Kennedy

The City Planning and Zoning
Commission has held a puhlic
hearing on a proposal to reclassi-
fy from Single Family Residence
to Multiple Residence classification
property described as Lot 2 of
Picardy Park in the City of Du-
buque, Iowa.
The applicant was represented
by Mr. Robert Bertsch, attorney
who spoke in suPPOrt of the pro-
posal. Mr. Hal ReYnolds, attorney
for the area residents opposing
the request, spoke in their behalf.
Several persons were present to
express OPposition to the propo.
sal, and a petition, bearing 63
names of area residents, and a
letter in opposition to the rezoning
request were submitted to the Com-
mission.
It was the opinion of the Com.
mission that reclassification of this

site to Multiple Residence classi-
fication would not be in accor-
dance with the General Plan for
this area. Residential development
density permissible in the Multi-
ple Residence zone is substantially
greater than both the development
density of existiug uses in the im-
mediate vicinity and the density
planned for the adjacent undeve.

Highway Commission, hereinafter
designated the "STATE" and the
City of Dubuque, Iowa, hereinafter
designated the "CITY".
WITNESSETH; that
WHEREAS, the STATE, in ac-
cordance with the provisions of
Chapters 306 and 30GA, and Sec-
tion 313.21 of the Code of Iowa,
1971, as amended, prOPOses to im-
prove the extension of Primary
Road No. US 20 within the City
of Dubuque, Iowa; by construct-
ing 6 inch thick stabilized shoul-
ders on US 20 (both traffic lanes)
from the west corporation line east
approximately 1,106 feet to the
west line of Devon Drive, and
WHEREAS, the STATE and the
CITY are willing to jointly par-
ticipate in said Project, in the
manner hereinafter Provided;
NOW, THEREFORE, in consi-
deration of these premises and the
mutual covenants hereinafter set
forth, it is hereby agreed as fol-
lows:
1. The STATE will develop and
construct the Project, and bear
aU costs incident thereto.
2. AU prior agreements within
the limits of this Project will re- I
main in effect.

As a result of a meetiug with
Mr. R. J. Schliekelman, Techni-
ca! Secretary of the Iowa State
Water pollution Control Commis-
sion, on December 8, 1971, the
Commission has served the City
of Dubuque with a "Consent Or-
der." This places the City and
specific major iodustrial contribu-
tors uoder penalty of law to comply
with certain constraints on sewage
being diacharged to the City of
Dubuque Waste Water Treatment
Facility.

the fact that the City had med
a cross-petition against said rail-
road company alleging in sub-
stance that if any flooding water
did result to the plaintiff's dam-
ages, said damages to the plaintiff
were caused by the action of the
said railway in permittiug its
Underpass to become clogged and
out-of-repair and thereby causing I
a backup of the water in the drain-
age ditch overflowing its banks
and the resulting consequential
damages.
It appears at this stage of the
proceedings that the City of Du-
buque has been dismissed out of
said action, and that said action
is terminated with no expense to
the City of Dubuque, Iowa.

To the Honorable Mayor and
Members of the City Council
Transmitted herewith for your
consideration are several amend-
ments to the Refuse and Garbage
Collection Ordinance (Ord. No. 66-
70). The purpose of the amend-
ments are fourfold. First, we re-
commend you modify slightly the
mandatory provision of refuse col-
lection from "residential pre-
mises" as defined 10 the Ordi-
nance. Second, we recommend you
provide for city collection service
utiliziog large refuse and garbage
bins in addition to the 20 and
30 gallon garbage cans and plas-
tic bags. Third, we recommend
you prohibit the placement of
refuse collection bins on public
right-of-way, except under limited
couditions when authorized by a
permit issued by the City Mana-
ger. And fourth, we recommend
you remove the requirement that
the refuse collection fee be paid
in advance.
Each of these recommended
changes is explained in the follow-
ing sections of this letter. A copy

MODIFICATION OF MAN D A-
TORY CITY COLLECTION OF
"RESIDENTIAL PRE MIS E S"
AND CLARIFICATION OF "RE-
SIDENTIAL PREMISES" DEFI.
NITION
The Ordinance as adopted on
December 14, 1970, made manda-
tory the city collection of refuse
and garbage from "residential pre-
mises" as defined in Section 1
(d) of the ordinance. It was the I
intention of the Ordinance for the
city to collect all single family
dwelling units, all multiple family
dwelling units up to and including
six separate family living quar-
ters, aU apartment complexes
where there were a clustering of
four and six unit buildings under
single ownership, all garden type
apartment complexes and al! row
type housing units, regardless of
the total number of units in the
developemnt.
Two thingS have happened in I
response to this provision which
indicates revision. First, the city
service has not been able to be
extended to the large apartment
complexes. This was due primarily
because the volume of refuse and
garbage was beyond the capability
of city equipment to handle ef-
ficiently. Sec<>nd, some confusion
and dispute have arisen in some
areas about what apartment units
and complexes are included in gar-
den type apartment complexes and
row type housing units as speci- I
fied in the ordinance.
Section 1 (d) of the proposed
amendment makes it clear that
the city is to collect from all apart-
ment complexes involving several
buildings on land centraUy owned
or owned in common, regardless
of the number of units or whe-
ther such complexes are referred
to as garden type apartments, row
type housing, planned apartment
developement, planned condomini-
um development or some other
name. However, Section 2 (b) of
the proposed amendment provides
that upon Written request the City I

provides for maintaining the iote-

tem while having the flexibility

PROVISION FOR CITY COLLEC-
TION SERVICE UTILIZING RE-
FUSE AND GARBAGE BINS
Section 2 (h) of this amendment
will make available to apartment
complexes city collection services
using large refuse and garbage
collection bins when the apartment
owner feels their needs are not
met through the use of garbage
cans and plastic bags. This is an
effort to improve the city's ser-
vice to apartment complexes. It
would not be available to business
and commercial accounts.
The current ordinance places a
limit of 31 gallons on refuse and
garbage containers. Several apart-
ment owners have stated that this
service does not meet their needs.
They feel it is (a) inconvenient
for them and their tenants; (b)
unsanitary and unsafe to bave gar-
bage cans and-or bags in their
buildings; and (c) difficult for
them to get someone to go around
on collection day and set out the
cans and-or hags. The recommend-
ed revision provides that upon writ-
ten request the City Manager may
authorize collection service using
an appropriately sized refuse and
garbage collection bio when he
determines that efficient, sanitary,
and convenient collection service
cannot be provided whithout such
bin and be responsible for main-
determine the size of the bio need-
ed. The city and apartment owner
will mutuaUy agree on the place-
ment of the bin and the owner
will maintain accessability to the
bin and he responsible for main-
taining the bin in matters of ope-
ration, appearance and sanitation.
The fee for this service would be
$1.75 per month for each separate
family living quarters served.
Definitions for (a) refuse and
garbage container; (b) refuse and
garbage bin; (c) container collec-
tion service; and (d) bin collection
service are also added to the de-
finitions section of the ordinance
by this amendment.

PROHIBIT PLACEMENT OF PRI-
VATE GARBAGE AND REFUSE
BINS ON PUBLIC RIGHT-OF-
WAY EXCEPT BY PERMIT
Section 5 of this amendment
would prohibit the placement of
garbage and refuse bios on the
public-right-of-way of any street or
alley without first receiving a
permit to do so from the City
Manager.
We are eJ<periencing some traf-
fic and safety problems with the
placement of collection bins on
tlhe public right-<>f-way in various
alleys around the city. This amend-
ment would prohibit this practice
without first obtaining a permit
to do so. Through the permit pro-
cess we hope to remove as many
collection bios from the public-
right-of-way as possible. Where this
is not possible we woold require
the bin be placed in a manner
to minimize it as a safety ha-
zard.
REMOVAL OF THE REQUIRE-
MENT THAT THE REFUSE COL-
LECTION FEE BE PAID IN AD-
VANCE.
The current ordinance requires
the payment of the refuse collec-
tion fee in advance. This was ori-
gioally necessary because there
was no revenue 10 the Refuse Col-
lection Fund on January I, 1971.
The inadvance payment provided
funds to pay wages and operate I
eqnipment. '
The io-advance payment is the
major source of complaint about
our utility billing system. Most ci-
tizens understand and appreciate
why we had to go to the fee
basis for refuse collection. Many,
however, do not understand or ap-
preciate why we are billing in
advance. We recommend that the
ordinance be amended to remove
the provision which requires the
provision whicb requires the in-
advance payment. Sufficient funds
are available to implemeot this
recommendation. The shift to bill-
ing on a current :basis woold be
initiated as soon as possible after
approval of the change.
SUMMARY
In summary, theo, the amend-
ments to the refuse collection or-
dinance are recommended to you
to: (a) clarify the definition of
"residential premises"; (b) slig
htly modify the mandatory provi-
sion for city collection from "re-
sidential premises"; (c) provide
for city collection service using
collection bins; (d) prohibit the
placement of private collection bins
on public right-of-way; and (e)
remove the provision that the col-
lection fee be paid in advance.
These amendments are recom-
mended for your consideration. If
