Approve Minutes of July 3, 2001
Commissioner Kluesner moved to approve the minutes of July 3, 2001.
Seconded by Wertzberger, passed unanimously.
Establish Passing Point for the Position of Foreman and Certify List
Commissioner Wertzberger moved to receive and file the communication of
Personnel Manager Randy Peck, Operations and Maintenance Manager Don
Vogt, and Leisure Services Manager Gil Spence and to accept their
recommendation to establish the passing score for the position of Foreman as
96 (69.6%). Seconded by Kluesner, passed unanimously. Kluesner moved that
the list be certified as read for two years. Seconded by Wertzberger, passed
unanimously.
Establish Passing Point for the Position of Equipment Mechanic
Commissioner Wertzberger moved to receive and file the communication of
Personnel Manager Randy Peck, Water Department Manager Bob Green, and
Water Pollution Control Manager Paul Horsfall and to concur with the
recommendation establishing a passing point of 66 (66%) for the position of
Equipment Mechanic. Seconded by Kluesner, passed unanimously. Kluesner
moved to certify the list as read and that the list be good for two years.
Seconded by Wertzberger, passed unanimously.

Communication from Barry A. Lindahl, Corporation Counsel, Regarding
Dennis F. Rath
Commissioner Kluesner moved to receive and file the communications of Barry
Lindahl and Steve Juergens. Seconded by Wertzberger and passed
unanimously. Motion by Kluesner to remove the matter from the table for
discussion; seconded by Wertzberger, passed unanimously.
Chairperson Duehr stated that two things needed to be done. First, the Civil
Service seniority list needed to be posted, and second, Mr. Rath was to be given
a Certificate of Seniority. Personnel Manager Peck stated his office is working
on the seniority list and that Mr. Rath had been provided a Certificate of
Seniority when he was advised of the elimination of his position. Peck further
stated that the question which needs to be answered is what Mr. Rath's seniority
date is. It is the City's position that his civil service seniority date is March of
1993, the date he started as a full-time Serviceworker, and that all of his civil
service seniority is as a Serviceworker, and therefore that is the only position he
can bump into. Mr. Peck further explained that an employee's date of hire, civil
service seniority date, and union contract seniority date could all be different.
It is Mr. Rath's position that according to his EEOC settlement, his full-time
seniority date is 1992 and after that date he worked as a part-time Laborer in the
Parking Division. That position is now a full-time civil service position, and since
he worked in it, he should be allowed to bump into it.
After further discussion, the Commission determined that they were not prepared
to make a decision at this time. Kluesner moved that the matter be tabled until
such time as a meeting can be scheduled when both Mr. Lindahl and Mr.
Juergens could be available. Seconded by Wertzberger and passed
unanimOusly.
The next meeting is scheduled for Tuesday, July 31, 2001, at 2:00 p.m. in
Conference Room A at City Hall.
There being no further business, Kluesner moved to adjourn. Seconded by
Wertzberger. Unanimously approved and meeting adjourned at 4:00 p.m.
