Accordingly, it is my opinion there
was no actionable negligence on

The City of Duhuque Planning
and Zoning Commission has held
a puhlic hearing on a proposed
amendment to Ordinance No. 3-34,
enacting a new Section 2 of Article
!iV, thereof, estaJblishingand de-
fining the uses permitted in a Mul-
tiple Residence District.
The Commission ha's considered
that the effect of the amendment
is limited to ,a restriction on the
sale of material goods in premises
cla,ssified in the Multiple 'Residen~e
District, a'ccOrding to provisions
of proposed subparagraphs (j) and
(k). In its study of this amend-
ment, the Commission determined
that such a restriction has no pre- I
sent or fureseeahle application to
uses now permitted within the Mul-
tiple Residence District inrofar as
the Zoning Ordinance now contains
adequate safeguards a'gainst unre-
stricted sales activities in this zon-
ing district. The Commission has
also considered that the .principal
thrust of the amendment may be
directed against the esta'hlishment
of medica! office apothecaries in
Multiple Residence Districts.

ical office - apothecary issue is
still unresolved. In this regard,
The Planning and Zoning Commis-
sion wishes to again e- its
unanimous recommendation in fa"
vor of p"rmitllng limited drug dis-

In its examination of this issue
over a' period <If three years, it
bas been the judgement of the
Commission that medical offices I
and apothecaries could be esta'h-
lished in the vicinity of any of
the local hospitals without creating
a substantial hardship on the im-
mediate hospital neighhorh<1ods or
on the community-at-large, and
that a significant public benefit
could be provided in this develop-
ment. The Commission has held
public hearings on and has ap-
proved two sepO11ate ordiinance ac
mendments that would provide for
apothecary development under con-
trolled circumstances, and urges
you to reconsider the adoption of
either of these prior proposals.
In the matter of the Proposed
amendment to subparagraphs (j)
and (k) of Section 2 01. Article
IV, it is the finding of the Com-
mission that this amendment serv-
es no essential purpose, and it
is recommended that you reject
this proposal.
