Van Milligen, Public Works Director City Acquisition of Property for Manson Road Right-Of-Way Public Works Director, Mike Koch, is recommending that the City Council establish the fair market appraisal of a parcel of property needed for the reconstruction of the Manson Road Bridge. This property is needed as a temporary easement, the value of which was established by an independent appraiser as $50.00. In addition, the City Council is requested to authorize the Corporation Counsel to initiate eminent domain proceedings should negotiations fail to acquire the temporary easement for said property referenced above, as well as the acquisition for part of Lot 1- 1-4 of Mineral Lot 501, which value was previously approved by City Council. Koch, Public Works Director City Acquisition of Property for Manson Road Right-Of-Way INTRODUCTION The City of Dubuque Engineering Division is requesting City Council approval to acquire a temporary easement for the reconstruction of the Manson Road Bridge and to proceed with eminent domain if negotiations are unsuccessful. BACKGROUND The City Council established the fair market value of an area to be acquired for permanent right-of-way at the July 2 meeting for part of Lot 1-1-4 of Mineral Lot 501 owned by John and Viola Sutton. An additional area on an abutting lot known as Lot 1-1-1-1-1-1-1-1-1 of Mineral Lot 499 lying south of the centerline of the public road contiguous to Lot 2-1-1-1-1-1-1 of Mineral Lot 499 as per Equity No. 82416, owned by the Suttons requires only a temporary easement for reconstruction of Manson Road. A value was not set at the same time on this temporary easement since the City had not obtained an appraisal for that area. An appraisal for this temporary easement has now been obtained from Felderman Appraisals. The value has been established at $50.00. DISCUSSION As part of the reconstruction of the Manson Road Bridge, a part of Manson Road will need to be relocated. This requires additional right-of-way and temporary easements to be purchased for the new roadway and accompanying embankments. The parcel of property (see Exhibit A) necessary for temporary easement has been appraised at $50.00. The Engineering Division is now requesting authorization to proceed with formal negotiations for the purchase of the temporary easement required for roadway improvements. If , in the event negotiations fail on both of the parcels owned by Sutton, eminent domain proceedings may be necessary. ACTION REQUESTED The City Council is requested to adopt the attached resolution establishing the fair market value of the property for the temporary easement, and to adopt the Resolution authorizing the initiation of formal negotiations with the property owner and authorization to proceed with eminent domain proceedings on both parcels should negotiations be unsuccessful.
