Gentlemen:
I am returning to you the peti-
tion of Mrs. Marie N agelmaker re-
questing that a connection be al-
lowed for sewer and water service
at 3670 Central. I am also returning
the petition of John J. Heiderscheit
requesting that sewer and water
connections be made at 3700 Jack-
son. Both of these properties are
outside the city limits.
J suggest that for the present
both of these petitions be denied
until there is an opportunity to
reconsider the city policy of ex-
tending sewer and water services
beyond the city limits. I believe
that it is imperative that the pol-
icy be reconsidered and your staff
will start immediately to gather
information for your consideration.
I am attaching letters from Mr.
Hail and Mr. White which pertain
to the Nagelmaker petition.

the roadway had not been sprink-
led with salt or plowed at the time
of the accident, even though it had
been snowing for some five hours.
I have made an investigation of
this matter and find that from the
report of the Street Commissioner
that on November 14, 1969 the salt
trucks covered Loras Boulevard
from Bluff to University at 1:30
A.M., at 3:25 P.M., at 8:00 P.M.
and rechecked at 1:00 A.M. on
November 15, 1969 and it further
appears that the operator of said
salt truck covered one side of the
street and returned on the other
side at approximately 3:25 P.M.
In view of the foregoing it ap-
pears there is no liability on the
part of the City of Dubuque, Iowa
for the claimed damages of Mr.
Friloux and therefore it is the
recommendation of the City At-
torney that said claim be denied.

Gentlemen:
I submit for your consideration
a proposed ordinance regulating
the City Ambulance.
You will note in Section 1, sub
paragraphs (c) and (d) that the
rate for services outside the corp-
orate limits is $37.50 plus $0.35 per
mile. This is different than the
rate stated in my analysis dated
November 14th. The change was
made because the rate suggested
in the ordinance is a more equit-
able sharing of ambulance costs
between the citizens of Dubuque
and those outside the corporate
limits.
Will you also note Section 6
which authorizes the city manager
to make adjustments in the charges
made to citizens who are required
to repeatedly use the ambulance
and are of limited financial means.
It is believed that this is a justi-
fiable and proper means of handl-
ing indigent cases.

Because of the indecisiveness of
the vote, the Commission members
held a public meeting on Decem-
ber 2, 1969 and invited interested
parties to re-state their views. At
this meeting the applicant was rep-
resented by Mr. C. J. May and those
objecting to the proposal were rep-
resented by Mr. Hal ReynoldS.
The property in question is lo-
cated on the west side of Kennedy
Road and north of the Shike-Rich-
ardson automobile agency. The el-
evation of the property has been
reduced approximately 15 feet so
that it is the same as Kennedy
Road. The area to the west and
north has been developed for single
family residences. The property
across the street has been develop-
ed by the Telephone Company as
a warehouse.: In reviewing this pro-
posal the Commission considered
the relationship of the site to the
single family area and the effect
of the proposed development on
the traffic flow on Kennedy Road.

It was the opinion of the Com-
mission that this proposed develop-
ment would not increase traffic on
Kennedy Road, however, .it would
substantially increase the number
of left turns on to and from Ken-
nedy Road. The Commission found
that Kennedy Road, at this point,
is wide enough to accomodate four
lanes of moving traffic and one
additional lane for turning move~
ments.
It was the general opinion of the
Commission that because of the ex-
cavation that has taken place on
the site, that development of it
should be oriented to Kennedy
Road and that the best use of the
site would be for commercial estab-
lishments.
It is the recommendation of the
Planning and Zoning Commission
that the property in question be
reclassified from Single Family
1969
and signed before any such service is

Section 1 hereof. All service authorized
by Dubuque County Officers shall be

financlal means. The City Manager shall
have the authority to require such proof
of the financial status of such person
seeking the benefits of this section for
such service.
Section 7. This Ordinance shall be in
full force and effect from and after its
final passage, adoption and publication

being made to combat the Rubella
(German Measles) epidemiC that
frequently occurs during the win~
ter and spring months. If the cycli~
cal character of rubella epidemics
persist we could expect to see an~
other increase in cases as early
as 1970 or as late as 1973. Most
cases are in school age children
and it is contemplated to have a
mass immunization program for
children from one to twelve years
of age. The estimated cost of the
vaccine would be $28,000. The
State is proposing to help in de~
fraying the cost, also the County
and the Junior Chamber of Com-
merce and the School Board.

bers of the Electrical Examining
Board to the Electrical Appeals
Board was questioned.
It was my understanding that
the question raised by Councilman
Schultz by way of objection was
that the appointment of a mem-
ber from the Examining Board
to the Appeal Board constituted
a review by members who per-
formed an act and thereafter said
member be called upon to judge
said act.
I have examined Section 5 of
Ordinance 32-64, known as "City
of Dubuque, Iowa Electrical Ordi-
nance" and find that there is no
requirement therein requiring a
member of the Electrical Examin-
ing Board to be appointed to the
Electrical Appeal Board.

WHEREAS, under date of Sep-
tember 22, 1969, the Council of the
City of DUbuque authorized the is~
suance and sale of its Project
Notes in the aggregate principal
amount of $4,183,000 to finance
certain undertakings in connection
with the Downtown Urban Renewal
Project, Iowa R-15; and
WHEREAS, in order to refin~
ance a portion of the outstanding
Project Notes, it is necessary for
the City of Dubuque to sell Pro-
ject Notes (First Series 1970) total-
ing $3,262,000; now therefore
BE IT RESOLVED BY THE
COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section I. That the City Clerk be
and he is hereby authorized and
directed to pUblish according to
law "Notice of Sale - Project Notes"
in the form of Exhibit "A" attach-
ed hereto and made a part hereof.
Section 2. That the City Clerk be
and he is hereby authorized and
directed to accept and tabulate
proposals for the sale of said notes
and to send telegrams of accept-
ance to the low bidder or bidders
all in accordance with instructions
covering such transactions as pro-
vided by the Department of Hous-
ing and Urban Development,
United States of America.
Section 3, That a meeting of the
Council of the City of Dubuque
shall be held after the bid open-
ing date of January 13, 1970 to
adopt such resolution or resolu-
tions necessary for the consumma-
tion of the sale of Project Notes
(First Series 1970) to the lowest
bidder or bidders.
