On Friday, August 17, the City received comments from Dubuque County
Commissioner of Elections Denise Dolan. The redistricting map is being modified to
respond to those comments and that revised map will be brought to the City Council
meeting for the public hearing. I believe the revision will address the concerns brought
up by Walt Pregler and Dave Baker

Proposed Ward Redistricting Plan
On August 6 the City Council established a public hearing for August 20 on the
proposed ward redistricting plan based on the 2000 census results. At that time the
redistricting map had not yet been completed. On August 10 a plan was completed.
Since then the Planning Services staff has had discussions with Dubuque County
Auditor Denise Dolan and has made some modifications, which are included in the
attached version of the Redistricting Plan.
Planning Services Manager Laura Carstens is recommending adoption of the revised
2001 Redistricting Plan for City Wards and Precincts and approval of the City/County
Agreement for Extraterritorial Precincts.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: 2001 Redistricting Plan for City Wards and Precincts
INTRODUCTION
The purpose of this memo is to transmit the proposed 2001 Redistricting Plan for City
Wards and Precincts for City Council review and approval. The City Council has set a
public hearing date of August 20 for review and approval of a 2001 Redistricting Plan for
City Wards and Precincts.
In addition to new boundaries forwards and precincts, the 2001 Redistricting Plan includes
a City/County Agreement for Extraterritorial Precincts.
BACKGROUND
Cities with a population over 3,500 must review all ward and precinct boundaries to see if
redistricting is needed to comply with State law. The current ward and precinct boundaries
were adopted in the 1991 Redistricting Plan, based on the 1990 census. These
boundaries were amended as territory was annexed to the City over the last ten years.
After consulting with the Dubuque County Auditor's Office, we have determined that the
City of Dubuque will have to file a redistricting plan with the State. Plans are due to the
Secretary of State by September 1, 2001. If the City does not file a 2001 Redistricting
Plan by this date, the Secretary of State will redraw the ward and precinct boundaries
without City input, and then assess the cost to the City.
A redistricting plan must be approved by ordinance after a public hearing. Prior to
adoption, the County Auditor must be given 7 to 10 days to comment on the plan. The
County Auditor's Office has asked we provide them with the draft plan by August 10, which
wa have done.
The redistricting plan must be published in a newspaper of general circulation in the city
once each week for three consecutive weeks after the plan has been approved by the
Secretary of State. The last of the three publications must be made no later than 30 days
before the next general election, which is November 5, 2002.

Precinct and ward boundaries become effective January 15, 2002. They do not affect this
November's election.
DISCUSSION
Wards and Precincts
The 2001 Redistricting Plan has been created in accordance with State code and in
consultation with the Dubuque County Auditor's Office. A map of the proposed ward
and precinct boundaries is attached. These proposed boundaries meet all State
requirements.
The number of City wards - four - has remained the same, although their boundaries
have changed slightly. The State requires that ward and precinct boundaries be
adjusted to reflect population shifts, annexation and changes in legislative districts.
The State recently redrew the legislative district boundaries for the City and County of
Dubuque, With the new legislative districts, the ward and precinct boundaries had to
shift because they cannot cross a legislative district boundary.
The State has set population standards for each ward to be as close as possible to an
"ideal ward population". The boundaries of the proposed wards were adjusted so that
the population of each ward is as equal as practical to an "ideal ward population" of
approximately 14,421 (which is % of the City's 2000 census count of 57,686).
The State also requires that each precinct's population be between 50 and 3,500
people. All proposed precincts are within this range. With the small increase in City
population from 1990 to 2000, we have been able to reduce the number of precincts
from 22 to 21. This reduction lowers the cost of City elections.
A map comparing the current (1991) and proposed (2001) ward boundaries also is
attached. The proposed wards would mean that those Council members elected by
ward would represent approximately the same number of people, but some would be
new constituents.
Extraterritorial Precincts
The Dubuque County Auditor's Office has requested that the City of Dubuque expand
some of the proposed precincts to include rural areas as "extraterritorial precincts".
These areas are adjacent to the City, but lie outside the corporate limits.
The map of the proposed ward and precinct boundaries shows the location of these
extraterritorial precincts. Precincts 1 and 5 in Ward 1, Precinct 6 in Ward 2 and
Precinct 13 in Ward 3 have County areas within their boundaries.
The County Auditor's Office is asking that the City expand its precincts to include these
rural areas for several reasons. First, because separate polling places and additional
staff would be need to serve these areas, County elections costs would be higher.

Second, because these areas do not meet the State's population requirements, the
Secretary of State may reject a City redistricting plan that excludes these areas, and
then require that the City include them.
A cooperative agreement between the City and the County to include these
extraterritorial precincts within the City precincts for voting purposes does not bring any
additional expense to the City. Eligible residents of these County areas would not vote
in City elections. If a shared City/County election were held, then these residents
would be issued separate ballots for voting purposes. The County Auditor's Office
would regulate all voting within all precincts in the City and the County, including these
extraterritorial precincts.
The attached chart of 2001 ward and precinct populations shows the City and County
portions of the precinct populations. Possible polling places are shown on the chart as
well. The Dubuque County Auditor's Office is responsible for officially designating a
polling place for each precinct.
RECOMMENDATION
I recommend that the City Council approve the 2001 Redistricting Plan for City Wards and
Precincts.
I also recommend that the City Council approve the City/County Agreement for
Extraterritorial Precincts.

As part of the 2001 Redistricting Plan for City Wards and Precincts, the City of
Dubuque agrees to incorporate County territory into precincts within the City of
Dubuque. Specifically, the City agrees to accept County territory in Precincts 1 and 5
in Ward 1, Precinct 6 in Ward 2, Precinct 13 in Ward 3 as indicated by the attached
map. The inclusion of the County territory into the City of Dubuque precincts is for

AN ORDINANCE AMENDING THE CITY OF DUBUQUE, IOWA CODE OF
ORDINANCES BY REPEALING CHAPTER 17, ELECTIONS AND ADOPTING
IN LIEU THEREOF A NEW CHAPTER 17, ELECTIONS, ESTABLISHING
BOUNDARIES FOR FOUR (4) WARDS AND TWENTY-ONE (21) PRECINCTS
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. Chapter 17 of the City of Dubuque Code of Ordinances is hereby
repealed.
Section 2. A new Chapter 17 of the City of Dubuque Code of Ordinances,
attached hereto and incorporated herein, is hereby adopted.
Section 3. This ordinance shall take effect January 15, 2002.

ARTICLE 1: IN GENERAL
Section 17-1. Definitions and rules of construction.
For the purposes of this chapter, unless the context otherwise requires, the following
definitions and rules of construction shall be applied.
Points of the compass are approximate unless otherwise stated.
All names, boundaries, lines, features and fixtures, are to be construed as they existed
on the effective date of this chapter.
Annexed territory means territory annexed to the City after the effective date of this
chapter.
C/fy includes all territory within the corporate limits and all annexed territories.
Commissioner of elections means the county auditor of Dubuque County.
Corporate limits means the corporate limits of the city on the effective date of this
chapter.
Peosta Channel means the waterway between the major portions of the City of
Dubuque and the island known as Chaplain Schmitt Island.
Street or similar language means the centerline of the right-of-way, and a straight
extension of that centerline.
Section 17-2. Correction of errors.
(a)
Correction of errors. If this chapter fails to place any part of the city within a
precinct or ward established by this chapter, the commissioner of elections shall
assign the omitted area to an adjacent precinct or ward within the same
legislative district. If this chapter places any part of the city in more than one
precinct or ward established by this chapter, the commissioner of elections shall
assign that territory to an adjacent precinct or ward within the proper legislative
district. The commissioner of elections may also correct obvious cledcal errors in
this chapter.
(b)
Annexation of territory. When territory is annexed to the city, the city council may
attach all or any part of the annexed territory to any established precinct or
precincts, which are contiguous to the annexed territory; however, this
subsection shall not prohibit establishment of one or more new precincts in the
annexed territory.

Section 17-16. City divided into twenty-one precincts.
The city hereby is divided into twenty-one (21) precincts as described in this article.
Section 17-17. First precinct.
The First Precinct is described as that portion of the City of Dubuque and
Dubuque County bounded by a line commencing at the point that U.S. Highway 52
South intersects the boundary of the City of Dubuque, then proceeding southerly,
westerly and northwesterly along the boundary of the City of Dubuque until it intersects
North Cascade Road, then proceeding northeasterly along North Cascade Road until it
intersects Fremont Avenue, then proceeding northeasterly along Fremont Avenue until

The Twelfth precinct is described as that portion of the City of Dubuque bounded
by a line commencing at the point that Central Avenue intersects West 23rd Street, then
proceeding westerly along the boundary of Ward 4 until it intersects the boundary of
Ward 2, then proceeding northwesterly along the boundary of Ward 2 until it intersects

INTRODUCTION
The purpose of this memo is to request that the City Council set a public hearing date of
August 20, 2001 for review and approval of a Redistricting Plan for City Wards and
Precincts.
DISCUSSION
Cities with a population over 3,500 must review all ward and precinct boundaries to see if
redistricting is needed to comply with State law:
After consulting with the Dubuque County Auditor's Office, we have determined that the
City of Dubuque will have to file a redistricting plan with the State. Plans are due to the
Secretary of State by September 1, 2001.
Since we did not receive redistricting instructions from the Secretary of State until July 6,
a redistricting plan is still under development We expect to have a draft plan to hand out
at the August 6 Council meeting.
A redistricting plan must be approved by ordinance after a public hearing. The last Council
meeting before the State's submittal deadline (September 1) is August 20. Consequently,
we need the City Council to set the August 20 public hearing at their August 6 meeting.
Prior to adoption, the County Auditor must be given no less than 7 and no more than 10
days to comment on the plan. To meet this comment period, we must pmvicle the County
Auditor with the draft plan between August 10 and August 13.
RECOMMENDATION
We recommend that the City Council set August 20 as the public hearing date for review
and approval of a Redistricting Plan for City Wards and Precincts.

The purpose of this memo is to transmit the proposed 2001 Redistricting Plan for City
Wards and Precincts for City Council review and approval. The City Council has set a
public hearing date of August 20 for review and approval of a 2001 Redistricting Plan for
City Wards and Precincts.
In addition to new boundaries for wards and precincts, the 2001 Redistricting Plan includes
a City/County Agreement for Extraterritorial Precincts.
BACKGROUND
Cities with a population over 3,500 must review all ward and precinct boundaries to see if
redistricting is needed to comply with State law. The current ward and precinct boundaries
were adopted in the 1991 Redistricting Plan, based on the 1990 census; These
boundaries were amended as territory was annexed to the City over the last ten years.
After consulting with the Dubuque County Auditor's Office, we have determined that the
City of Dubuque will have to file a redistricting plan with the State. Plans ara due to the
Secretary of State by September 1, 2001. If the City does not file a 2001 Redistricting
Plan by this date, the Secretary of State will redraw the ward and precinct boundaries
without City input, and then assess the cost to the City.
A redistricting plan must be approved by ordinance after a public hearing. Pdor to
adoption, the County Auditor must be given 7 to 10 days to comment on the plan. The
County Auditor's Office has asked we provide them with the draft plan by August 10, which
we have done.
The redistricting plan must be published in a newspaper of general circulation in the city
once each week for three consecutive weeks after the plan has been approved by the
Secretary of State. The last of the three publications must be made no later than 30 days
before the next general election, which is November 5, 2002.

Precinct and ward boundaries become effective January 15, 2002. They do not affect this
November's election.
D~CUSSION
Wards and Precincts
The 2001 Redistricting Plan has been created in accordance with State code and in
consultation with the Dubuque County Auditor's Office. A map of the proposed ward
and precinct boundaries is attached. These proposed boundaries meet all State
requirements.
The number of City wards - four- has remained the same, although their boundaries
have changed slightly. The State requires that ward and precinct boundaries be
adjusted to reflect population shifts, annexation and changes in legislative districts.
The State recently redrew the legislative district boundaries for the City and County of
Dubuque. With the new legislative districts, the ward and precinct boundaries had to
shift because they cannot cross a legislative district boundary.
The State has set population standards for each ward to be as close as possible to an
"ideal ward population~. The boundaries of the proposed wards were adjusted so that
the population of each ward is as equal as practical to an "ideal ward population" of
approximately 14,421 (which is % of the City's 2000 census count of 57,686).
The State also requires that each precinct's population be between 50 and 3,500
people. All proposed precincts are within this range. With the small increase in City
population from 1990 to 2000, we have been able to reduce the number of precincts
from 22 to 21. This reduction lowers the cost of City elections.
A map comparing the current (1991) and proposed (2001) ward boundaries also is
attached. The proposed wards would mean that those Council members elected by
ward would represent approximately the same number of people, but some would be
new constituents.
Extraterritorial Precincts
The Dubuque County Auditor's OffiCe has requested that the City of Dubuque expand
some of the proposed precincts to include rural areas as "extraterritorial precincts".
These areas are adjacent to the City, but lie outside the corporate limits.
The map of the proposed ward and precinct boundaries shows the location of these
extraterritorial precincts. Precincts 1 and 5 in Ward 1, Precinct 6 in Ward 2 and
Precinct t3 in Ward 3 have County areas within their boundaries.
The County Auditor's Office is asking that the City expand its precincts to include these
rural areas for several reasons. First, because separate polling places and additional
staff would be need to serve these areas, County elections costs would be higher.

Second, because these areas do not meet the State's population requirements, the
Secretary of State may reject a City redistricting plan that excludes these areas, and
then require that the City include them.
A cooperative agreement between the City and the County to include these
extraterritorial precincts within the City precincts for voting purposes does not bring any
additional expense to the City. Eligible residents of these County areas would not vote
in City elections. If a shared City/County election were held, then these residents
would be issued separate ballots for voting purposes. The County Auditor's Office
would regulate all voting within all precincts in the City and the County, including these
extraterritorial precincts.
The attached chart of 2001 ward and precinct populations shows the City and County
portions of the precinct populations. Possible polling places are shown on the chart as
well. The Dubuque County Auditor's Office is responsible for officially designating a
polling place for each precinct.
RECOMMENDATION
I recommend that the City Council approve the 2001 Redistricting Plan for City Wards and
Precincts.
I also recommend that the City Council approve the City/County Agreement for
Extraterritorial Precincts.

ARTICLE 1. IN GENERAL
Section 17-1. Definitions and rules of construction.
For the purposes of this chapter, unless the context otherwise requires, the following
definitions and rules of construction shall be applied.
Points of the compass are approximate unless otherwise stated.
All names, boundaries, lines, features and fixtures, are to be construed as they existed
on the effective date of this chapter.
Annexed territory means territory annexed to the City after the effective date of this
chapter.
City includes all territory within the corporate limits and all annexed territories.
Commissioner of elections means the county auditor of Dubuque County.
Corporate limits means the corporate limits of the city on the effective date of this
chapter.
Peosta Channel means the waterway between the major portions of the City of
Dubuque and the island known as Chaplain Schmitt Island.
Street or similar language means the centerline of the right-of-way, and a straight
extension of that centerline.
Section 17-2. Correction of errors.
(a)
Correction of errors. If this chapter fails to place any part of the city within a
precinct or ward established by this chapter, the commissioner of elections shall
assign the omitted area to an adjacent precinct or ward within the same
legislative district. If this chapter places any part of the city in more than one
precinct or ward established by this chapter, the commissioner of elections shall
assign that territory to an adjacent precinct or ward within the proper legislative
district. The commissioner of elections may also correct obvious clerical errors in
this chapter.
(b)
Annexation ofterdtory. When territory is annexed to the city, the city council may
attach all or any part of the annexed territory to any established precinct or
precincts, which are contiguous to the annexed territory; however, this
subsection shall not prohibit establishment of one or more new precincts in the
annexed territory.

Section 17-16. City divided intotwenty-one precincts.
The city hereby is divided into twenty-one (21) precincts as described in this article.
Section 17-17. First precinct.
The First Precinct is described as that portion of the City of Dubuque and
Dubuque County bounded by a line commencing at the point that U.S. Highway 52
South intersects the boundary of the City of Dubuque, then proceeding southerly,

RE: Review of City of Dubuque Reprecincting Plan
Under Section 49.5 of the Iowa Code, the Commissioner of Elections is charged with
reviewing the precinct plan of any city in the County which is required or chooses to divide its
jurisdiction into voting precincts. It is in fulfillment of this requirement that I am communicating
with you, and I will outline the steps we took in our review.
My staff and I initially received a map of the proposed voting precincts, from your staff,
late afternoon Friday, August l0th. As the street names were not legible, we requested a second
map which we received midaftemoun on Monday, August 13th. Accompanying this was a draft
of a memo which contained information regarding the population breakout of each precinct and
ward. As it is a requirement of the Iowa Code that no precinct contain a population greater than
3,500 people, we verified that the proposed plan met this requirement.
In order to conduct a full review, we had, also, requested a draft of the proposed
ordinance you are required to adopt. We received the sections describing the ward boundaries
and the first five precincts on Tuesday morning, August 14t~. The subsequent sixteen precinct
descriptions were received on Tuesday afternoon. As the second map that had been provided
still did not contain legible street names, we undertook using the descriptions of the ward and
precinct lines contained in the ordinance to draw our own map to be reviewed.
Wednesday morning, August 15~, we compared the ward and precinct boundaries with
the boundaries of the legislative districts in the City of Dubuque, as it also required that all
precincts be wholly contained in a legislative district. This review highlighted four areas of
concern, as the precinct lines did not follow legislative districts. Upon being contacted about our
conceras, Mr. Guy Hemenway of the City Planning Department met with us and proceeded to
correct the errors. Unfortunately, three ofth~ igstances dealt not only with precinct lines but
with ward lines. This required Mr. Hemenway to recalculate the ward population figures, which
was very time consuming, as the variance in the ward populations must be as small as possible.
A subsequent draft of the ordinance, along with the precinct and ward population
breakdown, was received about noon on Thursday, August 16t~. Initial review showed one
precinct above the 3,500 population requirement, so Mr. Hemenway made final changes to bring
all precincts into compliance. We received the final draft of the ordinance for our review about
3:00 p.m. yesterday.
While the location of poll sites within each precinct is the prerogative of the
Commissioner of Elections, the city staff in their memo outl/ned possible poll sites in each
precinct. One of the criteria to be used in drawing precincts is "the convenience of the voter". I
would point out concerns we have in two precincts.
Precinct 12 contains an area the entire length of 32nd street west of Central Avenue.
While part of this is due to the large size of the census blocks in this area, there is the possibility
of some residents at the west end of the precinct being added to an adjoining precinct.
Precinct 13 contains both the Eagle Point area and Windsor Avenue. The residents of the
Eagle Point area currently vote at Holy Trinity Church on Rhomberg Avenue. Due to the
configuration of the new Precinct 13, and the availability of publicly accessible sites in the new
precinct, the residents of the Eagle Point area will most probably be required to drive past Holy
Trinity on their way to a polling site in the Windsor Avenue area of the precinct.
While it would have been my wish to have worked with Mr. Hemenway to rectify these
concerns, the requirement that I provide you with comments on your plan prior to your
impending public hearing did not afford such a luxury. I would refer you to House File 481,
passed by this year's legislature, which requires action be taken in your ordinance regarding
these concerns. A copy of this legislation accompanies this memo.
For the ease of people undertaking reprecincting projects following future censuses, I
would request your attention to the issue of the census block maps. The current block maps use
topographical features which are becoming hard to identify. The legislative service bureau in
describing the legislative districts within the city referred to the "north branch of the north fork of
Catfish creek" and the "northwest branch of the north fork of the Catfish creek". Both of these
descriptions are in the area currently being developed south of Asbury Road near the Northwest
Arterial. I am concerned that in ten years these topographical features will be out of date, and if
they remain on the census block maps would make the reprecincting task even more difficult.
Another such area of concern is rmunants of Catfish Creek in the area of the Butterfield
Apartments, which caused difficulty in the reprecincting project done in 1991. We discussed
other areas of concern with Mr. H~unenway earlier this week. Each jurisdiction is given a period,
prior to each census, to review the proposed blocks to be used in the upcoming census count. I
would urge that steps be taken to highlight the areas of concern so that the personnel who review
the maps, prior to the 2010 census, will be able to correct th~m.
Included in this plan are four areas of rural Dubuque County where connty residents will
be allowed to vote in a city precinct for non-municipal elections. This has been done at my
request. Code Section 49.6 allows for an agreement between the county and a city to allow for
such circumstances. I have prepared an agreement, as required, regarding this arrangement. The
Board of Supervisors will act on this agreement at their meeting Monday morning, August 20th.
The agreement is, I believe, being included in your agenda packets for your approval and
inclusion as part of the plan you submit to the Secretary of State. I appreciate the cooperation of
city staff in facilitating this agreement.
In closing, I would like to convey my concern about the requirements of Code Section
49.5, which provides for no less than seven days for the Commissioner of Elections to review
and comment on a city reprecincting plan. As my staff and I were not afforded the time allotted
under this requirement, I am conveying these comments, pertaining to the review, such as I was
able to conduct it in the time provided.

We would like to express our vigorous objection to the precinct layout plan being
considered this evening.
The undersigned have lived in Dubuque all of our lives and on Shires Ave. for many
years. Always, we voted at either Marshall School, Riverside Bowl or Holy Trinity. We
experienced changes in precinct numbers because of the census. In 1955 we were the
15~ precinct, then we became the 1~t. Precinct. After one of the reprecincting orders, we
became known as the 13th precinct. Always, we voted in our neighborhood.
Now, comes the new map and plan, and we are dissected from our neighborhood and
placed in an area several miles from home. The plan simply is absurd. We are
scheduled to vote at Windsor Park. Ridiculous.
We urge you to reject this plan and send it back to the drawing board for a more
sensible solution.
Over 600 registered voters would have to drive by Holy Trinity, Sacred Heart, Audubon,
and Christensen's to get to Windsor Park.
All of my adult life, I have worked with the political party of my choice to make voting
more convenient for people. The new plan is supposed to do that too. Please see to it
that better objectives are met.
