No. 2 in Dubuque County Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request. Staff reviewed the proposed request noting that subject property will be subdivided to provide 3 additional home sites and is located near the entrance to Crystal Lake Cave. The Zoning Advisory Commission discussed the request, noting that the property was not included as part of the City's Annexation study and this property is unlikely to be annexed in the near future. Recommendation By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. Kritz, Associate Planner Final Plat of Ricann Farms Inc., No. 2 INTRODUCTION Ricann Farms, Inc. has submitted a minor final plat for property located along U.S. Highway 52 in Dubuque County. The final plat is being reviewed jointly by the City and CourrZy of Dubuque as it lies within two miles of the corporate limits of the City of Dubuque. DISCUSSION The submitted final plat of Ricann Farms, Inc. No. 2 subdivides an exisfing 44.95 acre parcel into four lots. Lots 1, 2 and 3 are between 1.7 and 2.5 acres in size, while Lot 4 will be 44.95 acres. The minor final plat is being submitted to allow three additional home sites to be constructed. Access to Lots 1,. 2, 3 and 4 is by way of an access easement shown on the submitted plat. The subject property was not included in any of the areas studied by the City of Dubuque for annexation to the City. The parcel is within the two mile limit that requires joint review by both the City and County of Dubuque. Planning staff does not anticipate the City annexing property in this area in the near future. RECOMMENDATION The submitted final plat of Ricann Farms Inc., No. 2 is in substantial compliance with City of Dubuque Subdivision Regulations, and staff recommends that the Zoning Advisory Commission recommend approval of the subdivision subject to waiving Article IV, Design Improvement Standards, except for Section 42-19, Blocks and Lots. NO.2 IN DUBUQUE COUNTY, IOWA Whereas, there has been filed with the City Clerk a Final Plat of Ricann Farms, Inc. No. 2 in Dubuque County, Iowa; and Whereas, said plat has been examined by the Zoning Advisory Commission and had its approval endorsed thereon; and Whereas, said survey plat has been examined by the City Council and they find that it conforms to the statutes and ordinances relating thereto. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the Final Plat of Ricann Farms, Inc. No. 2 is hereby approved and the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa, upon said subdivision plat. Section 2. That the City Council hereby waives Article IV, Design and Improvement Standards of the Subdivision Regulations, except Section 42-19, Lots and Blocks.
