Lyons Prairie- Woodland Preserve and Nature Interpretive Center with the Iowa State Conservation Commission to include a section of the Rip Row Valley property. Van Milligen, City Manager FROM: Gil D. spence, Leisure Services Manager SUBJECT: Amending the Lease with the Iowa State Conservation Commission to Include Part of the Rip Row Valley Property INTRODUCTION The purpose of this memorandum is to ask the City Council to set a public hearing on amending the lease of the E.B. Lyons Prairie-Woodland Preserve and Nature Interpretive Center with the Iowa State Conservation Commission to include a section of the Rip Row Valley property. DISCUSSION Part of the Rip Row Valley development plans call for leasing 12.29 acres next to the river to the Iowa Department of Natural Resources for development of a picnic area and prairie. This is the old wastewater treatment plant site and has never been developed since the plant moved a number of years ago. IDNR has no funds available for development but hopes to budget some in the next few years. In the meantime, they will maintain and supervise the area. ACTION STEP The action requested is that the City Council adopt the attached resolution setting a public hearing on September 17, 2001, to consider amending the lease. LYONS PRAIRIE-WOODLAND PRESERVE AND NATURE INTERPRETIVE CENTER WHEREAS, the City is the Lessor and the DNR is the Lessee under the terms of a Lease Agreement entered into on June 6, 1983; and WHEREAS, the DNR desires to lease additional property from the City for a park area; and WHEREAS, it is deemed to be in the best interest of both parties to the Lease Agreement that this First Amendment to Lease Agreement be approved, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That it is the intent of the City Council of the City of Dubuque, Iowa, to amend the lease, after a public, hearing, of the Iowa State Conservation Commission for the E.B. Lyons Prairie-Woodland Preserve and Nature Interpretive Center to include a section of Rip Row Valley property, located in the City of Dubuque, for the purpose of providing a park area. Section 2. That the first amendment, attached hereto and made a part hereof, of such property shall be for the term of the original lease agreement, and shall be subject to such terms and conditions as set forth in the lease agreement. Section 3. That the City Clerk is hereby directed to give notice in the manner required by law of a public hearing to be held on September 17, 2001, at 6:30 p.m., in the City Council Chambers, Carnegie-Stout Public Library, Dubuque, Iowa, at which time and place all interested parties will be given opportunity to be heard for or against the proposal to lease the facility herein described.
