Pine Knoll Accept San SewerMEMORANDUM August 29, 2001 TO: FROM: SUBJECT: The Honorable Mayor and City Council Members Michael C. Van Milligen, City Manager Acceptance of Sanitary Sewer in Pine Knoll - Phase 1 (Lot 1-1-3 St. Mary's Place) Prior to approval of the Pine Knoll Subdivision - Phase, I, the developer, Kane Development Corporation, was required to install certain improvements, including sanitary sewer and watermain. Kane Development Corp. has recently completed the improvements. Public Works Director Mike Koch is recommending acceptance of the sanitary sewer that has been installed, however some modifications will need to be made to the watermain prior to acceptance. I concur with the recommendation and respectfully request Mayor and City Council approval. Michael C. Koch, Public Works Director Acceptance of Sanitary Sewer in Pine Knoll - Phase I (Lot 1-1-3 St. Mary's Place) INTRODUCTION The enclosed material provides for City Council acceptance of the public sanitary sewer improvements that the developer, Kane Development Corp., has recently completed in Lot 1-1-3 St. Mary's Place. BACKGROUND As a condition of approval of the Pine Knoll Subdivision - Phase I, the developer was required to install certain improvements including sanitary sewer and watermain. The developer of Pine Knoll - Phase I, Kane Development Corp., has recently completed the improvements and has formally requested the City's acceptan.ce of the sanitary sewer and watermain has been installed. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. On February 10, 2001, Kane Development Corp. requested the City's acceptance of the sanitary sewer and watermain in Pine Knoll - Phase I. Upon inspection by the City, it has been determined that the sanitary sewer improvements have been completed in accordance with plans approved by the City Council and in conformance with City specifications. An easement has been recorded for maintenance and repair of the sanitary sewer. The watermain has not been installed to City specifications and is not proposed to be accepted until a flushing hydrant is installed, and noncompliant stop boxes are replaced. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the sanitary sewer improvements. MAK/vjd Prepared by Ronald J. KochI Public Works Director Address: 50 W. 13th Street, Dubuque, tA 52001-4864 RESOLUTION NO. 384-01 ACCEPTING SANITARY SEWER IMPROVEMENTS IN PINE KNOLL - PHASE I Whereas, certain improvements including sanitary sewer were installed by the developer of Pine Knoll - Phase I (Lot 1-1-3 St. Mary's Place); and Whereas, the improvements have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by the City Council and in conformance with City specifications, and has recommended that the improvements be accepted by the City Council. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said improvements in Pine Knoll - Phase 1 (Lot 1-1-3 St. Mary's Place) be and the same is hereby accepted. Section 2. That maintenance of said improvements shall be the responsibility of the contractor and the owner for a period of two years from this date. Cont~ctor will stockpile any topsoil present in separate area and place on top of the excavation so as to restore said ground to its present condition. Grantor shall not perfom~ any construction or excavation lhat will diminish the lateral support of said improvement without obtaining the prior written consent of thc City Engineer.
