Acceptance of Sanitary Sewer in Pine Knoll - Phase 1 (Lot 1-1-3 St. Mary's
Place)
Prior to approval of the Pine Knoll Subdivision - Phase, I, the developer, Kane
Development Corporation, was required to install certain improvements, including
sanitary sewer and watermain. Kane Development Corp. has recently completed the
improvements. Public Works Director Mike Koch is recommending acceptance of the
sanitary sewer that has been installed, however some modifications will need to be
made to the watermain prior to acceptance.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Acceptance of Sanitary Sewer in Pine Knoll - Phase I
(Lot 1-1-3 St. Mary's Place)
INTRODUCTION
The enclosed material provides for City Council acceptance of the public sanitary
sewer improvements that the developer, Kane Development Corp., has recently
completed in Lot 1-1-3 St. Mary's Place.
BACKGROUND
As a condition of approval of the Pine Knoll Subdivision - Phase I, the developer
was required to install certain improvements including sanitary sewer and
watermain. The developer of Pine Knoll - Phase I, Kane Development Corp., has
recently completed the improvements and has formally requested the City's
acceptan.ce of the sanitary sewer and watermain has been installed.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of
the improvements, requesting that the City either approve or reject the acceptance
of the improvements, together with a statement of reasons for any rejection.
On February 10, 2001, Kane Development Corp. requested the City's acceptance
of the sanitary sewer and watermain in Pine Knoll - Phase I. Upon inspection by
the City, it has been determined that the sanitary sewer improvements have been
completed in accordance with plans approved by the City Council and in
conformance with City specifications. An easement has been recorded for
maintenance and repair of the sanitary sewer.
The watermain has not been installed to City specifications and is not proposed to
be accepted until a flushing hydrant is installed, and noncompliant stop boxes are
replaced.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the
sanitary sewer improvements.

RESOLUTION NO. 384-01
ACCEPTING SANITARY SEWER IMPROVEMENTS IN PINE KNOLL -
PHASE I
Whereas, certain improvements including sanitary sewer were installed by the
developer of Pine Knoll - Phase I (Lot 1-1-3 St. Mary's Place); and
Whereas, the improvements have been completed and the City Manager has
examined the work and has filed a certificate stating that the same has been completed
in accordance with the plans approved by the City Council and in conformance with City
specifications, and has recommended that the improvements be accepted by the City
Council.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and
that said improvements in Pine Knoll - Phase 1 (Lot 1-1-3 St. Mary's Place) be and
the same is hereby accepted.
Section 2. That maintenance of said improvements shall be the
responsibility of the contractor and the owner for a period of two years from this
date.

of Dubuque County, State of Iowa, for themselves, their heirs and assigns, do hereby grant, sell and
convey to the CITY OF DUBUQUE, IOWA, a municipal corporation, its agents and conh~saters, in
perpetuity, from the date hereof, a right-of-way and easement through, under and across the following
described real estate situation in Dubuque, Iowa, to wit:
Lot 1-1-3 St Marls Place in the CiI7 of I)ubuque~ Dubuque County, Iowa.
Said easement shall be as shown on the attached Exhibit A, for the purpose of consh'ucting and
maintaining a sanitary sewer and water main in accordance with the Plans and Specifications on file in the
office of the City Engineer.
Together with the rigbt to enter said property during the period of construction until the projeot is
accepted by the City Council.
It is undemteod and agreed that the grantee herein shall restore the disturbed area due to the installation or
repair of said sanitary sewer and water main. Cont~ctor will stockpile any topsoil present in separate
area and place on top of the excavation so as to restore said ground to its present condition.
Grantor shall not perfom~ any construction or excavation lhat will diminish the lateral support of said
improvement without obtaining the prior written consent of thc City Engineer.
To bare and to hold unto the said City of Dubuque, Iowa, forever, and thc undersigned to hereby
expressly covenant that they are the owners in fee of said real estate and have good ,~ght to execute this
agreement, and that the grantee, its agents or canl~acter% shall at all times have f~ee aeoess to and egress
from and over said real estate to maintain, remodel or repair said sanil~r7 sewer and water main thereon
or therein.
