Council met in Reguiar Session at 6:30 P.M. in
the Library Auditorium
Present: Mayor Duggan, Council Members
Buol, Cline, Markham, Michalski, Nicholson,
Robbins, City Manager Michael Van Milligen,
Corporation Counsel Barry Lindahl.
Mayor Duggan read the cail and stated this is
the regular session of the City Councii called for
the purpose of acting upon such business which
may properly come before the City Council.
Invocation was given by Reverend Terry
Simm, Pastor, First Presbyterian Church.

Finance Director submitting the Financial

Notice of Claims/Suits: Mark Heacock in
estimated amount of $129.96 for property
damage; Bev Hodgson in undetermined amount
for vehicle damage; Morse Electric, Inc" in
amount of $18,900 for labor and materials used
for renovation of the Bunker Hill Clubhouse,
presented and read. Michalski moved that the
claims and suits be referred to the Legal Staff for
investigation and report. Seconded by

Corporation Counsel advising that the
foilowing claim has been referred to Public Entity
Risk Services of Iowa, the agent for the Iowa
Communities Assurance Pool: Karen A. Heaiy
for personal injury, presented and read.

Citizen Communications: Communication of
James R. Myers regarding the electrical system
at Miiler-Riverview Park, presented and read.
Michalski moved that the communication be'
received and filed and referred to the City
Manager. Seconded by Nicholson. Motion

Request of Frank J. Fincel that a portion of his
property which was involuntarily annexed to the
City of Dubuque in 1979 be detached from the
City, presented and read. Michalski moved that
the communication be received and filed and
referred to the City Manager. Seconded by
Nicholson. Motion carried 7-0.
Wilbricht Lane Storm Sewer - Acceptance:
City Manager recommending acceptance of the
Wilbricht Lane Storm Sewer Reconstruction
Project in the final contract amount of
$21,489.80, presented and read. Michalski
moved that the communication be received and
filed. Seconded by Nicholson. Motion carried 7-
O.
RESOLUTION NO. 424-01
ACCEPTING IMPROVEMENT
Whereas, the contract for the Wiibricht Lane
Storm Sewer Improvements Project has been
compieted and the City Manager has examined
the work and filed his certificate stating that the
same has been completed according to the
terms of the contract, plans and specifications
and recommends its acceptance.
NOW THEREFORE, BE IT RESOLVED BY
THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the recommendation of the
City Manager be approved and that said
improvement be and the same is hereby
accepted.
BE iT FURTHER RESOLVED that the City
Treasurer be and he is hereby directed to pay to
the contractor from the Fiscal Year 2001
General Fund in amount equal to the amount of

this contract, less any retained percentage
provided for therein.

FINAL ESTIMATE
Whereas, the contract for the Wilbricht Lane
Storm Sewer Improvements Project has been
completed and the City Engineer has submitted
his final estimate showing the cost thereof
including the cost of estimates, notices and
inspection and ail misceilaneous costs;
NOW THEREFORE, BE IT RESOLVED BY
THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the cost of said improvement is
hereby determined to be $21,489.80 and the
said amount shail be paid from the Fiscai Year
2001 General Fund of the City of Dubuque,
Iowa.

A RESOLUTION ACCEPTING A CONVEY.

CITY OF DUBUQUE-ON MANSON ROAD TO
THE CITY OF DUBUQUE
Whereas, the City of Dubuque entered into an
Acquisition Agreement with Rodney J. Krapft
and Mary Jane Krapfl, pursuant to which
Rodney J. Krapft and Mary Jane Krapfl, agreed
to convey a part of Lot 2-1-1-1-1-1-2-1-4 of
Mineral Lot 501 in the City of Dubuque, Iowa, as
shown on the Acquisition Plat thereof; and
Whereas, Rodney J. Krapft and Mary Jane
Krapfl. have executed a conveyance of said
property.
NOW, THEREFORE, BE IT RESOLVED B
THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City Council of the City of
Dubuque, Iowa, hereby approves of, accepts
and consents to the Warranty Deed from
Rodney J. Krapft and Mary Jane Krapfi, copies
of which are attached hereto, as required by
Iowa Code Section 569.7.
Section 2. The Mayor is hereby authorized and

Dubuque County. Iowa, as shown on the
Acquisition Plat thereof; and
Whereas, Harry J. and Mary E. Althaus have

Whereas, the City of Dubuque entered into an
Acquisition Agreement with H&M Realty, L.C"
pursuant to which H&M Realty, L.C., agreed to
convey Lot A of Lot 2 of Lot 2 of Lot 27, Section
2, T89N, R2E, 5'h P.M., Dubuque County, Iowa,
as shown on the Acquisition Plat thereof; and
Whereas, H&M Realty. L.C. has executed a
conveyance of said property.
NOW THEREFORE, BE IT RESOLVED BY
THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City Council of the City of
Dubuque, Iowa, hereby approves of, accepts
and consents to the Warranty Deed from H&M

Woodward Place - Plat of Survey: City
Manager recommending approval of the plat of
survey of Woodward Place to expand an off-
street parking lot for use by Woodward
Communication, Inc. employees and the
Dubuque Museum of Art at the northeast corner
of Bluff Street and 7'h Street, presented and
read. Michalski moved that the communication
be received and filed. Seconded by Nicholson.

RESOLUTION NO. 429-01
A RESOLUTION APPROVING THE PLAT OF
SURVEY OF WOODWARD PLACE IN THE
CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City
Clerk a plat of survey of Woodward Place in the
City of Dubuque; and
Whereas, upon said plat of survey appears a
lot to be known as Lot 2 Woodward Place, which
the owners by said plat of survey have
dedicated to the public forever; and
Whereas, said plat of survey has been
reviewed by the City Planner and had her
approval endorsed hereon; and
Whereas, said piat of survey has been
examined by the City Council and they find that
it conforms to the statutes and ordinances
relating hereto.
NOW THEREFORE, BE IT RESOLVED BY
THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the dedication of Lot 2
Woodward Place as it appears on said final plat,
be and the same are hereby accepted; and,
Section 2. That the plat of survey of Woodward
Place is hereby approved and the Mayor and
City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque,
Iowa, upon said survey plat.

Infrastructure Grant: City Manager
recommending approval of a grant application to
the Iowa Department of Natural Resources
(IDNR) for Federal Boating Infrastructure Funds.
for dredging and construction of transient boat
docks in the Ice Harbor and construction of a
riverfront boat pier as part of the America's River
project, presented and read. Michalski moved
that the communication be received and filed.

RESOLUTION NO. 430-01
RESOLUTION AUTHORIZING A GRANT
APPLICATION TO THE IOWA DEPARTMENT
OF NATURAL RESOURCES FOR FEDERAL
BOATING INFRASTRUCTURE FUNDS FOR
THE AMERICA'S RIVER PROJECT
Whereas, the Iowa Department of Natural
Resources (IDNR) has Federal Boating
Infrastructure funds available to develop
transient boat docks for nontrailerable vessels;
and
Whereas, the City of Dubuque has adopted a
Comprehensive Plan and a Riverfront Plan that
include goals for development of transient boat
docks; and
Whereas, the City of Dubuque has approved
the America's River project that includes the
development of transient boat docks in the Ice
Harbor and on the Mississippi River.
NOW, THEREFORE, BE IT RESOLVED BY
THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the Assistant City Manager is
hereby authorized to submit an application for
Federal Boating Infrastructure funds to the IDNR
for development of transient boat docks in the
Ice Harbor and on the Mississippi River.
Section 2. That the City of Dubuque agrees to
maintain the transient boat docks used in
accordance with the Federai Boating
Infrastructure Grant Program.

extension of Heritage Trail from Heron Pond to
the Dubuque Jaycees Trail, presented and read.
Michalski moved that the communication be
received and filed. Seconded by Nicholson.

RESOLUTION NO. 431-01
RESOLUTION AUTHORIZING A GRANT
APPLICATION FOR IOWA DEPARTMENT OF
TRANSPORTATION STATEWIDE TRANS-
PORTATION ENHANCEMENT FUNDS FOR
THE HERITAGE TRAIL EXTENSION FROM
THE HERON POND WETLANDS NATURE
TRAIL TO THE DUBUQUE JAYCEES TRAIL
Whereas, the Iowa Department of
Transportation (I DOT) has Statewide
Transportation Enhancement Funds available to
develop recreational trails in cities; and
Whereas, the City of Dubuque has adopted a
Comprehensive Plan and a Riverfront Plan that
include goals for development of bike/hike trails;
and
Whereas, the City of DUbuque has adopted
the Heritage Trail Master Plan that includes the
Heritage Trail Extension.
NOW, THEREFORE, BE iT RESOLVED BY
THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the Planning Services
Manager is hereby authorized to sign and
submit this application for Statewide
Transportation Enhancement Funds to the IDOT
for the extension of Heritage Trail from the
Heron Pond Wetlands Nature Trail to the
Dubuque Jaycees Trail, on behalf of the City of
Dubuque.
Section 2. That the City of Dubuque agrees to
adequately maintain the trail for its intended use
and maintain the total trail used to justify the
project in public use for a minimum of 20 years
following project completion.
Section 3. That the City Manager is hereby
authorized to reallocate $100,000 from the FY02
Capital Improvement Program from the Highway
20 Landscaping project to serve as the local
match for this grant.

Trail Extension in the Riprow Valley Recreation
Area, presented and read. Michalski moved that
the communication be received and filed.

Section 1. That the cost of said improvement is
hereby determined to be $445,959.67, and the
said amount shall be paid from the General
Fund of the City of Dubuque, Iowa.

Human Rights Commission - Application for
HUD Contract Funds: City Manager
recommending approval of the Human Rights
Commission application to the U.S. Department

United Rentals Site - Restrictive Covenant:
Corporation Counsel recommending execution
of a Declaration of Restrictive Covenants on
behaif of the City for the United Rentals property
located at 301 Iowa Street, presented and read.

approved. Seconded by Nicholson. Motion

Manson Road Bridge Reconstruction Project:
Corporation Counsel recommending that the
City issue a check to the Dubuque County
Sheriff in the amount of $4,650 to complete the
acquisition of property for the Manson Road
Bridge Reconstruction Project, presented and
read. Michalski moved that the communication
be received and filed and recommendation
approved. Seconded by Nicholson. Motion

Supplement No. 51 to the Code of Ordinances:
City Manager recommending adoption of
Suppiement No. 51 to the City of Dubuque Code

ADOPTING SUPPLEMENT NO. 51 TO THE

Whereas, under date of July 17, 1989, the City

Whereas, since December 19, 1988 the City
Council of the City of Dubuque, Iowa has
adopted certain ordinances amending the Code
of Ordinances and said amendments have been
printed as supplements to the Code of
Ordinances; and
Whereas, Section 380.8 of the Code of
Ordinances provides that supplements by
resolution, become part of the Code of
Ordinances.

Whereas, the City of Dubuque entered into a
Grant Agreement for the Fiscal Year
commencing July 1, 2001, with the U.S.
Department of Housing and Urban
Deveiopment, providing for financial assistance
to the City under Title I of the Housing and
Community Development Act of 1974, as
amended; and
Whereas, pursuant to the rules and regulations
as promulgated by the U.S. Department of
Housing and Urban Development, an
environmental review has been processed for
the Grand Opera House Accessible Restroom
project; and
Whereas, based on said environmental review,
the Department of Housing and Community
Development has determined that said project
will have no significant impact on the
environment; and
Whereas, a combined notice of "Finding of No
Significant Impact on the Environment" and of
Regular Session, October 1, 2001

"Intent to Request Release of Funds" for said
project will be sent by regular mail to various
federal, state and local public agencies; to the
appropriate Regional Office of the
Environmental Protection Agency, to the HUD
Area Office and to the iocal news media,
individuais and groups known to be interested

notice; and
Whereas, any and all comments received as a
result of such notice will be duly considered
before proceeding with a Request for Release of
Funds and Certification.
NOW, THEREFORE, BE IT RESOLVED BY
THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the City Clerk be and is hereby
authorized and directed to publish a combined
Notice of Finding of No Significant Impact on the
Environment and Notice of Intent to Request
Release of Funds for the Grand Opera House
Accessible Restroom project and to make the
Environmental Review Record for said project
available for public inspection and comment until
5:00 p.m. on October 19, 2001. Such notice
shail be in the form of Exhibit "A" attached
hereto and made a part hereof.
Section 2. That the environmental review
record for the project shall be placed on file in
the Office of the City Clerk and the Housing and
Community Development office where said
record may be examined and copied by any
interested party.
Section 3. That the Mayor of the City of
Dubuque is hereby authorized and directed to
submit to the U.S. Department of Housing and
Urban Development fifteen (15) days after
publication of appropriate notice a Request for
Release of Funds to undertake the said project.
Section 4. That the Mayor of the City of
Dubuque is hereby authorized to consent to
assume the status of a responsible federal
official under the National Environmental
Protection Act, insofar as the provisions of the
said Act apply to the U.S. Department of
Housing and Urban Development
responsibilities for review, decision making, and
action assumed and carried out by the City of
Dubuque as to environmental issues.
Section 5. That the Mayor of the City of
Dubuque is hereby authorized to consent
personally, in his official capacity and on behalf
of the City of Dubuque, to accept the jurisdiction
of the federal courts if an action is brought to
enforce responsibilities in relation to
environmental review, decision making and
action.
Section 6. That the Mayor of the City of
Duboque be and he is hereby authorized and
directed to execute a certification pertaining to
the environmental review procedures.

Whereas, the Physical Infrastructure
Assistance Program (PIAP) program has been
created by the Iowa Department of Economic
Development to assist in the economic
development efforts of local jurisdictions; and
Whereas, on April 22, 1998, the City of
Dubuque, Iowa was awarded a one million one
hundred eighty-four thousand dollar
($1,184,000) forgivable loan from the PIAP
program by the Iowa Department of Economic
Development; and
Whereas, the City of Dubuque, Iowa desires to
assist Eagle Window & Door Company in its
efforts to expand its operations in Dubuque and
create new, permanent employment
opportunities for local citizens; and
Whereas, a PIAP Loan Agreement, hereto
attached and by this reference made a part
hereof, is to be executed between the Iowa
Department of Economic Development and the
City of Dubuque, iowa.

Sec. 7-16 Definitions:
The following definitions shall apply in the
interpretation of this Article:
(1) Dog: Both male and female animals of the
canine species whether neutered or not, but not
including a law enforcement dog.
(2) Cat: Both maie and female animals in the
family Felis catus whether neutered or not.
. (3) Owner: Any person owning a cat or dog.
(4) Keeper: Any person other than the owner
keeping, sheltering, having control or custody of
or harboring a cat or dog.
(5) Neutered: Shall refer to a surgical
procedure that has been performed on a dog or
a cat that renders it incapable of siring or
bearing offspring.
(6) At large: Includes any dog, cat or livestock,
fowl or ferret found off the premises of the
owner. A dog or cat shall not be deemed at large
if the dog or cat is:
a. Attached to a ieash of sufficient strength
and appropriate length to control the animal
where such leash is held by its owner or keeper;
or
b. Restrained within an enclosed motor vehicle
or by a crate or leash of sufficient strength and
appropriate length to keep the dog or cat within
the motor vehicle; or
.
c. Housed in a licensed veterinarian's animal
hospital; or
d. Accompanied by the owner or keeper on the
premises of another with such person's consent
and restrained by an adequate protective fence
or by leash, cord, chain or other similar restraint
that does not allow the dog or cat to go beyond
such person's property line or to come into
contact with anyone outside such person's
property line.
(7) Kennel: Shall refer to a place or
establishment where dogs or cats are kept or
raised for the purpose of breeding, boarding,
racing at a licensed pari-mutuel track,
exchanged or offered for sale to the general
public and which are kept under constant
restraint.
(8) Nuisance: A dog or cat shall be considered
a nuisance if it:
a. Damages, soils, defiles or defecates on
private property other than the owne~s or on
public walks and recreation areas unless such
waste is immediately removed and properly
disposed of by the owner.
b. Causes unsanitary, dangerous or offensive
conditions.
c. Causes a disturbance by excessive barking
or other noise-making or chases vehicles, or
molests, attacks or interferes with persons or
other domestic animals on public property.
(9) Vicious animal: A vicious cat or d09 is
deemed so when it shall have attacked or bitten
any person on more than one occasion without
provocation or when an attack or bite results in
serious bodily injury.
(c) Sec. 7-18 is amended to read as follows:
Sec. 7-18. Nuisance:
It shall be unlawful for any owner or keeper to
permit a dog or cat to commit a nuisance.
(d) Sec. 7-19 is amended to read as follows:
Sec. 7-19. Female Dogs In Season:
It shall be unlawful for any owner or keeper to
allow a female dog in season to run at large or
to so confine such dog as to attract male dogs to
the area and by their presence cause a
nuisance.
(e) Sec. 7-23 Is amended to read as follows:
Sec. 7-23. Redemption:
(a) Except as otherwise provided, the owner
may redeem a licensed dog or cat seized or
impounded pursuant to this Article by paying the
sum of twenty-five dollars ($25.00) plus the
separate daily fee for keeping such dog or cat
each day or fraction thereof during the time that
such dog or cat is impounded. Upon the second
subsequent impoundment of the same animal
within three hundred sixty five (365) days, an
impoundment charge of thirty-five dollars
($35.00) shall be assessed, plus the separate
daily fee for keeping such dog or cat each day or
fraction thereof during the time which said dog
or cat is impounded.

cannot be served personally or by mail, by
publication in a newspaper of general circulation
in the county.
(c) The declaration shall state:
(1) The description of the animal;
(2) The name and address of the owner of the
animal, if known;
(3) The whereabouts of the animal, if not in the
custody of the owner;
(4) The facts upon which the declaration of
potentially vicious dog is based;
(5) The owner's right to a hearing if the person
objects to the declaration;
(6) The restrictions placed upon the animal as
a result of the declaration of potentially vicious
dog; and .
(7) The penalties for a violation of such
restrictions.
(d) The owner may object to the declaration of
potentially vicious dog by requesting a hearing
before the Health Services Officer by submitting
a written request to the Heaith Services Officer
within ten (10) days of the date of mailing of the
declaration, or within ten (10) days of the
publication of the declaration.
(1) If the Health Services Officer finds that
there is insufficient evidence to support the
declaration, It shall be rescinded, and the
restrictions imposed thereby annulled.
(2) If the Health Services Officer finds
sufficient evidence to support the declaration,
the Health Services Officer shall provide the
owner with written notice of such determination
within five (5) working days after the hearing.
(3) Prior to the hearing, the owner shall confine
the dog in a fenced enclosure on the owner's
premises. It shall be unlaw1ul for the owner of
the potentially vicious dog to allow or permit
such dog to go beyond the premises of the
owner unless such dog is securely leashed and
humanely muzzled or otherwise securely
restrained.
(4) If it is determined by the animal control
officer or law enforcement officer that probably
cause exists to believe the dog in question
poses an immediate threat to public safety, then
the animal control officer or law enforcement
officer may seize and impound the dog pending
the hearing to be held pursuant to this article.
The owner or keeper of the dog shall be liable to
the city or county where the dog is impounded
for the costs and expenses of keeping the dog if
the dog is later determined to be potentially
vicious. When a dog has been impounded and it
is not contrary to public safety, the animal
control officer shall permit the animal to be
confined at the owner's expense in a Health
Services Department approved kennel or
veterinary facility.
Sec. 7-84. Notification Of Status Of Potentially
Vicious Dog.
.

The owner shall immediately notify the Health
Services Department when a dog which has
been classified as potentially vicious:
(1) Is loose or unconfined;
(2) Has bitten a human being or attacked
another animal;
(3) Is sold or given away, or dies; or
(4) Is moved to another address.
Prior to a potentially vicious dog being sold or
given away, the owner shall provide the name,
address and telephone number of the new
owner to the Health Services Department. The
new owner shall comply with all the
requirements of this Chapter.
Sec. 7-85. Exceptions To Classification.
(a) No dog may be declared potentially vicious
if:
(1) Any injury or damage was sustained by a
person who, at the time of the injury or damage
was sustained, was committing a willful trespass
or other tort upon, premises occupied by the
owner or keeper of the dog, or was teasing,
tormenting, abusing, or assaulting the dog, or
was committing or attempting to commit a crime;
(2) The dog was protecting or defending a
person within the immediate vicinity of the dog
from an unjustified attack or assault; or
(3) The injury or damage was sustained by a
person or a domestic animal, which at the time
of the injury or damage was sustained, was
teasing, tormenting, abusing or assaulting the
dog.
(b) No dog may be declared potentially vicious
if the injury or damage to a domestic animal was
sustained while the dog was working as a
hunting dog, herding dog or predator control dog
on the property of, or under the control of, its
owner or keeper, and the damage or injury was
to a species or type of domestic animal
appropriate to the work of the dog.
Sec. 7-86. Disposition Of Potentially Vicious
Dog.
(a) A potentially vicious dog shall be properly
licensed and vaccinated. The potentially vicious
designation shall be included in the registration
records of the dog. The City may charge a
potentially vicious dog fee in addition to the
regular licensing fee to provide for the increased
costs of maintaining the records of the dog.
(b) A potentially vicious dog, while on the
owner's property, shall at all times be kept
indoors or in a securely fenced yard from which
the dog cannot escape and into which children
cannot trespass. A potentially vicious animal
may be off the owner's premises only if
restrained by a substantial leash, of appropriate
length, and if the dog is under the control of a
responsible adult and is humanely muzzled.
(c) If a potentially vicious dog dies, or is sold,
transferred or permanently removed from the
city, the owner of dog shall notify the Health
Services Department of the changed condition

and new location of the dog in writing within two
(2) working days.
Section 2, This Ordinance shall take effect
upon publication.

Section 1. City of Dubuque Code of
Ordinances is hereby amended by adopting the
following new Sections:
Sec. 33.23. Permit Required for Events on
Private Property.
No person shall hold an event on private
property when the person knows or reasonably
should know that the event will substantially
affect public health or safety or the peace and
quiet of a neighborhood by reason of the
number of persons attending such event, the
use of outdoor music or amplified noise, and the
likely effect on traffic and parking, without first
obtaining a permit from the City Manager, which
permit, when issued, shall be without charge,
and shall state the time, manner and conditions
of such event. This Section shall not apply to an
event heid by a church or educational institution.

Sec. 33-24. Permit Application.
(a) An application for a permit containing the
information required herein shall be filed with the
City Manager by a person holding such an
event. Applications shall be made on forms
prepared by the City Manager, and shall contain
the information required herein. The City
Manager shall have a reasonable time to grant
or deny the permit. The length of time that is
reasonable shall be determined by the type of
use requested; the information supplied; the
time of filing of the application; and the extent of
advance preparation or planning demonstrated
and reasonably required.
(b) The City Manager shall grant or deny the
permit, in writing, according to the standards set
forth in Section 33-25 of this Chapter and shall
provide the written decision to the applicant by
regular mail or personal delivery.
Sec. 33-25. Application Form.
The application form for the event shall contain
the following information:
(1) Name and address of the applicant and the
sponsoring organization, if any.
(2) The type of event that is planned.
(3) Proposed location or locations.
(4) Expected size of group.
(5) Date, time and expected length of use.
(6) Names and addresses of the person or
persons to be in charge of the proposed use at
the specified location.
(7) Names and addresses of any persons to
be featured as entertainers or speakers.
(8) List of mechanical or electronic equipment
to be used.
(g) Number and type of any motor vehicles or
other forms of transportation to be used,
including bicycles.
(10) Number and type of any animals to be
used.
(11) A description of any sound amplification to
be used.
Sec. 33-26. Standards for Issuance.
The City Manager shall examine the
application and shall grant or deny said permit
based upon the following standards:
(1) In light of the date and time of said
proposed use, whether the use will
unreasonably interfere with the privacy, safety,
security, convenience and tranquility of the
residents or inhabitants of the area.
(2) Whether the proposed use or activity is
compatible with the normal activity of the
neighborhood at the requested time and date.
(3) Whether the application demonstrates the
applicant has the means, planning and
coordination to hold the proposed event,
considering the time of day, location, traffic
control, parking requirements and any
monitoring required to protect the public health
and safety.

(4) Whether the event will Interfere with
another event for which a permit has already
been granted.
(5) Whether the proposed use would
substantially interrupt the flow of street and/or
pedestrian traffic.
(6) Whether the use would require the
excessive diversion of police from other duties
or substantially interfere with the City's
firefighting operations.
Sec. 33-27. Revocation.
After a permit is granted, In the event it is
determined that the applicant has misstated any
material fact in the application, or that there is a
substantiai and material variance between the
information in the application and the actual
facts or those facts that appear reasonably to
have occurred, the City Manager may review
such application and revoke such permit if not in
compliance with this Article. Such permit may
also be revoked when it is determined by the
Chief of Police that by reason of disaster, public
calamity, riot or other emergency, the pubiic
safety requires such revocation.
Section 2. This Ordinance shall take effect
upon publication.

Whereas, the City of Dubuque prepared and
filed Annual Action Plans for Fiscal Years 2001

into one amended and restated plan as per the
attached Exhibit A; and
Whereas, said amendment is a substantial
amendment as provided in the City's Citizen
Participation Plan and must therefore be
approved by resolution of the City Council after
a public hearing by the Community Development
Advisory Commission; and
Whereas, the City advertised a public
comment period beginning August 17, 2001; and
Whereas, the Community Development Advisory
Commission reviewed the proposed amendment

Michalski praised the Fire Dept. for their great
work at the recent fire on lower Main St. Duggan
shared the news from Governor Vii sack that the
National Guard will help with security at the
Dubuque Regional Airport. Markham stated that
they are reviewing applications for the position
of Airport Manager and hopefully will finalize the
process by the end of November.

Whereas, The Finley Hospital has requested
the vacating of an alley west of College Street
and the southwest corner of West Fifth Street
and COllege Street.
Whereas, IIW Engineers & Surveyors, PC has
prepared and submitted to the City Council a
plat showing the vacated alley west of College
Street and the southwest corner of West Fifth
Street and College Street and assigned lot
numbers thereto, which hereinafter shall be
known and described as Lots 7 A and 8A of
Finley Home Addition in the City of Dubuque,
Iowa; and
Whereas, the City Council of the City of
Dubuque, Iowa has determined that this alley
west of College Street and the southwest corner
of West Fifth Street and College Street is no
longer required for pubiic use, except for utility
easements as noted, and vacating and sale of

entered into a Development Agreement, subject

A RESOLUTION APPROVING THE FINAL
PLAT OF PINTO RIDGE SUBDIVISION IN THE
CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City
Clerk a final plat of Pinto Ridge Subdivision in
the City of Dubuque, Iowa; and
Whereas, upon said final piat appears a street
to be known as Pinto Ridge Court (Lot A),
Seippel Road (Lot B) and Old Highway Road
(Lot C) together with certain public utility and
sewer easements, which the owners by said
final plat have dedicated to the public forever:
and
Whereas, the preliminary plat has been
examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said final plat has been reviewed by
the City Planner and had her approval endorsed
thereon, subject to the owners agreeing to the
conditions noted in Section 2 below; and
Whereas, said final plat has been examined by
the City Council and they find that it conforms to
the statutes and ordinances relating to it, except
that no streets or public utilities have yet been
constructed or installed.
NOW, THEREFORE, BE IT RESOLVED BY
THE CITY COUNCIL OF THE CITY OF
DUBUQUE, iOWA:
Section 1. That the dedication of Pinto Ridge
Court (Lot A), Seippel Road (Lot B) and Old
Highway Road (Lot C), together with the
easements for public utilities, sanitary sewer,
storm sewer and water mains as they appear
upon said final plat, be and the same are hereby
accepted; and
Section 2. That the finai plat of Pinto Ridge
Subdivision, is hereby approved and the Mayor
and City Cierk are hereby authorized and
directed to endorse the approval of the City of
Dubuque, Iowa, upon said final plat, provided
the owners of said property herein named,
execute their written acceptance hereto attached
agreeing:
(a) To reduce Pinto Ridge Court (Lot A) to
grade and to construct concrete curb and gutter
and to hard surface with asphaltic concrete, or
with concrete paving with integral curb, all in
accordance with the City of Dubuque standard
specifications, all in a manner acceptable to the
City Engineer, in conformance with construction
improvement plans approved by the City
Engineer, and inspected by the City Engineer.
(b) To install a capped sanitary sewer main
system, with service laterals into each lot, water
mains and water service laterals into each
individual lot, storm sewers and catch basins,
boulevard street lighting and erosion control
devices all in accordance with the City of
Dubuque standard specifications, all in a
manner acceptable to the City Engineer, and in
accordance with construction improvement
plans approved by the City Engineer, and
inspected by the City Engineer.
(c) To construct said improvements, prior to
two (2) years from the date of acceptance of this
resolution, at the sole expense of the owners, or
future owner;
(d) To maintain the public improvements, for a
period of two (2) years from the date of the
acceptance of those improvements by the City
of Dubuque, Iowa, at the sole expense of the
owners, or future owner;
And, further provided that said that Wayne and
Lynn Stewart, as owners of said property, shall
secure th'e performance of the foregoing
conditions provided in this Section by providing
guarantees in such form and with such sureties
as may be acceptable to the City Manager of the
City of Dubuque, Iowa.
Section 4. Sidewalk installation shall be the
responsibility of the owner abutting the public
rights-of-way, including lots with multiple
frontages, as required by City Code 41-161
through 41-164. The responsibility shall extend

to all successors, heirs and assignees. Sidewalk
installation will not be required until the
development of the lot has been completed,
except as required herein. In sparsely developed
subdivisions, sidewalks on developed lots will
not be required until 50% of the lots approved by
the plat have been developed. All vacant lots
shall have sidewalks installed upon development
of 80% of the lots approved by the plat.
Sidewalks along Old Highway Road will not be
required untii curb and cutter has been installed
along said roadway.
Section 5. That the final acceptance of all
public improvements shall occur upon
certification of City Engineering to the City
Council that all public Improvements have been
completed in accordance with the improvement
plans and City standard specifications and
accepted by City Council Resolution.
Section 8. That in the event Wayne and Lynn
Stewart fail to execute the acceptance and
furnish the guarantees provided in Section 3
hereof within 180 days alter the date of this
Resolution, the provisions hereof shall be null
and void and the acceptance of the dedication
and approval the plat shall not be effective.

Whereas, said plat of survey has been
examined by the City Council and they find that

IOWA, TO RUSCILLI DEVELOPMENT CO.,
LTD.
Whereas, this Council, by Resolution No. 449-
01 dated October 8, 2001, declared its intent to
enter into a Development Agreement with
Ruscilli Development Co., LTD. and the
McGraw-Hili Companies, Inc. for the sale and
option to purchase certain property in the
Dubuque Industrial Center West in the City of
Dubuque, Iowa, (the Property) described in the
attached Development Agreement; and
Whereas, pursuant to published notice, a
public hearing was held on the proposed
disposition on October 15, 2001, at 6:30 p.m. at
the Camewie-Stout Public Library Auditorium,
360 W. 11' Street, Dubuque, Iowa.: and
Whereas, it Is the deterrrination of this Council
that approval of the Development Agreement for
the sale to and option to purchase by and
development of the Property by Ruscilll
Development Co., LTD. according to the terrrs
and conditions set out in the Development
Agreement is in the public interest of the City of
Dubuque.
NOW, THEREFORE, BE IT RESOLVED BY
THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the attached Development
Agreement by and among the City of Dubuque,
Ruscilli Development Co., LTD. and The
McGraw-Hili Companies, Inc. and the sale of
and option to purchase by Ruscilli Development
Co., LTD. of the Property is hereby approved.
Section 2. That the Mayor is hereby authorized
and directed to execute the Development
Agreement on behaif of the City and City Clerk

LOCATED ALONG KEBBIE DRIVE FROM R-1
SINGLE-FAMILY RESIDENTIAL TO R-2 TWO-
FAMILY RESIDENTIAL DISTRICT.
NOW, THEREFORE, BE IT ORDAINED BY
THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. Appendix A of the Zoning
Ordinance of the City of Dubuque Code of
Ordinances is hereby amended by reclassifying
the hereinafter described properly as shown in
Exhibit A, and to the center line of the adjoining
public right-of-way, all in the City of Dubuque,
Iowa, from R-1 Single-Family Residential District
to R-2 Two-Family Residential District.
Section 2. The foregoing arnendment has
heretofore been reviewed by the Zoning
Advisory Commission of the City of Dubuque,
Iowa.
Section 3. This Ordinance shall take effect
immediately upon publication, as provided by
law.

recommending modification of the Memorandum
of Agreement regarding limited access to

RESOLUTION DISPOSING OF CITY

BIES SUBDIVISION, DUBUQUE, IOWA
Whereas, pursuant to resolution and published
notice of time and place of hearing, published in
the Telegraph Herald, a newspaper of general
circulation published in the City of Dubuque,
Iowa on the 21" day of September, 2001, the
City Council of the City of Dubuque, iowa met on
the 1" and 15'h day of October, 2001, at 6:30
p.m. in the Public Library Auditorium, 11th and
Locust, Dubuque, Dubuque, County, Iowa to
consider the proposai for the sale of real estate
described as:
Lot 4A of Biock 3 C.J. Bies Subdivision and
Lot 5A of Block 3 C.J. Bies Subdivision in the
City of Dubuque, Dubuque County, Iowa
Whereas, the City Council of the City of
Dubuque, Iowa overruled any and all objections,
oral or written to the proposal to sell such real
estate, except for easement as noted.
NOW THEREFORE, BE IT RESOLVED BY
THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the sale of City of Dubuque
real properly described as Lot 4A of Block 3 C.J.
Bies Subdivision in the City of Dubuque, Iowa to
Julie A. and Rick J. Hardorff be and the same is
hereby approved for the sum of $664.00.
Conveyance shall be by Quit Claim Deed.
Section 2. That the sale of City of Dubuque
real property described as Lot 5A of Block 3 C.J.
Bies Subdivision in the City of Dubuque, Iowa to
Pamela A. Triolo, Roger G. Klauer, and
Kathleen M. Sullivan be and the same is hereby
approved for the sum of $18,553.00, plus the
cost of pubiication, platting, and filing fees.
Conveyance shall be by Quit Claim Deed.
Section 3. The City of Dubuque reserves unto
itself a perpetual easement including the right of
ingress and egress thereto, for the purpose of
erecting, installing, construction, reconstructing,
repairing, owning, operating, and maintaining
water, sewer, drainage, gas, telephone, t.v.
cable, and electric lines as may be authorized by
the City of Dubuque, Iowa, as shown in the Plat
of Survey of Lot 4A and Lot 5A of Block 3 C.J.
Bias Subdivision.
Section 4. That the Mayor be authorized and
directed to execute a Quit Claim Deed, and the

directed to deliver said deeds of conveyance to
Pamela A. Triolo. Roger G. Klauer, and

authorized and directed to record a certified
copy of this resolution in the office of the City
Assessor, Dubuque County Recorder and
Dubuque County Auditor.

Communication of N. J. Yiannias requesting to

Mr. Yiannis spoke requesting a fair deal as to
the sale price of the property. Direction was
given to work with Staff and complete an
appraisal of the property.
COUNCIL MEMBER REPORTS
Duggan invited concerned community citizens
to a meeting hosted by Dubuque365 on
Saturday, 10/20/01, from 9:00 to 11:00 A.M. at
Irving School where Dubuque community efforts
for assistance in the 9/11/01 tragedies will be
discussed and considered. Markham stated he
Is going to Washington DC soon and will talk to
the Legisiators, and also that Airport officials are
arranging a meeting in February with Legislators
in the near future.

At 7:55 P.M. Buol moved to go into Closed
Session: Collective Bargaining Strategy - Iowa
Code Chapter 20.17(3). Seconded by Michalski.
Motion carried 7-0.
At 8:01 Council reconvened Regular Session
stating that staff had been given proper
direction.
There being no further business, Buol moved
to adjourn. Seconded by Michalski. Motion
carried 7-0. The meeting adjourned at 8:02 P.M.
